TOWN COUNCIL – Regular Meeting
Council Chambers – South Windsor Town Hall

1.      Call Meeting to Order

Mayor Delnicki called the Regular Meeting to order at 8:03 p.m.  

4.      Roll Call

Members Present:        Mayor Tom Delnicki
        Deputy Mayor Gary Bazzano
        Councillor M. Saud Anwar
        Councillor Cindy Beaulieu
        Councillor Ed Havens
        Councillor Kevin McCann
        Councillor Cary Prague
        Councillor Janice Snyder
        Councillor Keith Yagaloff

Also Present:           Matthew B. Galligan, Town Manager

5.      Public Input    

Mr. Kevin Cooney came before the Town Council to announce that the St. Patrick’s Day Parade will be held on Saturday, March 10, 2012 beginning at 11:00 a.m.  The Town Marshal for South Windsor is Billy Mitchell and the Town Honoree is Margaret Shea.

Ms. Margaret Shea came forward and stated that she and Billy are both honored for being selected this year as the Marshal and the Honoree.  

Mr. Billy Mitchell came forward and thanked the Town Council.

Ms. Nancy Yario, 20 Andreis Trail came before the Town Council.  She explained that her and her husband are suing the Town based on the Bark Park.  It appears that the public is unaware of what the Town offered as a settlement.  Ms. Yario stated that she has correspondence that should go to the Council.  There continues to be noise from the Bark Park and interruptions due to the Bark Park.

7.      Adoption of Minutes of Previous Meetings

BE IT RESOLVED that the South Windsor Town Council approves the Minutes of the following Town Council Meetings:  Work Session Meeting of January 3, 2012 and February 21, 2012; Public Hearing of February 21, 2012; and Regular Meeting of February 21, 2012.

9.      Communications from Officers and Boards Directly Responsible to Council

11.     Reports of Temporary Committees

Councillor McCann reported that comments concerning a sidewalk ordinance will be reviewed by the Sidewalk & Bikeway Subcommittee.  Mr. Doolittle will be getting the actual costs that the Town has incurred for repairing sidewalks over the past few years and the number of times and the costs to Town residents for repairing the sidewalks.  That information will be considered by the Sidewalk & Bikeway Committee when making a recommendation to the Town Council with the respect to the existing sidewalk ordinances that are in place currently.

Mr. Galligan explained that the Water Pollution Control Subcommittee met for the fist time tonight.  Meetings are scheduled for March 12, 2012 and March 19, 2012.

12.     Consent Agenda

Councillor Snyder made a motion to approve Agenda Items 14. A. through 14. B., as the Consent Agenda.  Councillor Yagaloff seconded the motion; and it was approved, unanimously.

14.     New Business

* A.    Resolution Appointing Gene Botteron (R) a Full Member to the Patriotic Commission and Postponing Consideration of this Motion until the Town Council’s Next Regularly Scheduled Meeting

BE IT RESOLVED that the South Windsor Town Council hereby appoints Gene Botteron (R) a full member to the Patriotic Commission for a term ending December 31, 2014 and postpones consideration of this motion until the Town Council’s next regularly scheduled meeting.

* B.    Resolution Appointing Arthur Sladyk (R) an Alternate to the Patriotic Commission and Postponing Consideration of this Motion until the Town Council’s Next Regularly Scheduled Meeting

BE IT RESOLVED that the South Windsor Town Council hereby appoints Arthur Sladyk (R) an Alternate to the Patriotic Commission for a term ending December 31, 2014 to fill the unexpired term of Gene Botteron and postpones consideration of this motion until the Town Council’s next regularly scheduled meeting.

14.     New Business (Continued)

C.      Resolution Approving a Refund of Taxes to Twenty-Six (26) South Windsor Taxpayers

BE IT RESOLVED that the South Windsor Town Council hereby approves a refund of property taxes to twenty-six (26) South Windsor Taxpayers, the total of said refund being $30,028.06, and as more fully described on attached Exhibit A.

The motion was approved, unanimously

Deputy Mayor Bazzano made a motion to Suspend the Rules in order to go to Item 19.   Councillor Yagaloff seconded the motion; and it was approved, unanimously.

19.     Executive Session


At 8:20 p.m. Deputy Mayor Bazzano made a motion to go into Executive Session to discuss personnel issues (Town Manger’s and Clerk of the Council’s evaluation/salary increase).  Councillor Yagaloff seconded the motion; and it was approved, unanimously.

The following individuals went into Executive Session:  Matthew B. Galligan, Town Manager; Debbie Reid, Clerk of the Council; Mayor Delnicki; Deputy Mayor Bazzano; Councillor Anwar; Councillor Beaulieu; Councillor Havens; Councillor McCann; Councillor Prague; Councillor Snyder and Councillor Yagaloff.

At 9:20 p.m. Councillor Prague made a motion to adjourn the Executive Session.  Deputy Mayor Bazzano seconded the motion; and it was approved, unanimously.

  • Resolution Approving an Annual Salary for Town Manager Matthew B. Galligan for Fiscal Year 2011/2012
BE IT RESOLVED that the South Windsor Town Council hereby approves an annual salary increase of 3.5% for Town Manager Matthew B. Galligan for Fiscal Year 2011/2012, said annual salary rate of $154,176 will be retroactive to July 1, 2011.

Seconded by Councillor McCann

Councillor Prague stated that the Council is very pleased to award this increase to Matt Galligan.  The Council feels that Matt is an asset to South Windsor and one of the most respected Town Manager’s in the area.  The Town Manager has a long list of accomplishments.  

Councillor Anwar thanked Mr. Galligan for the dedication and commitment to the Town of South Windsor.  

Mayor Delnicki thanked the Town Manager for his help in transitioning him from a Council member to the Mayor.  Mr. Galligan’s leadership helps keeps the Town in order.

Mr. Galligan thanked the Town Council for their support.  

Mayor Delnicki called for a vote on the resolution; it was approved, unanimously.

  • Resolution Approving an Annual Salary for Deborah W. Reid, Clerk of the Council for Fiscal Year 2010/2011 and Fiscal Year 2011/2012
BE IT RESOLVED that the South Windsor Town Council hereby approves an annual salary increase of 3.5% for Deborah W. Reid, Clerk of the Council for Fiscal Year 2010/2011, said annual salary rate will be retroactive to July 1, 2010; and

BE IT FURTHER RESOLVED that the South Windsor Town Council hereby approves an annual salary increase of 3.5% for Deborah W. Reid, Clerk of the Council for Fiscal Year 2011/2012; said annual salary rate will be retroactive to July 1, 2011.

Councillor Yagaloff stated that Debbie is a very effective and a highly regarded Clerk of the Council.  She maintains confidentiality and sets very high standards for herself and is an asset to the Town.

Mayor Delnicki stated that Debbie has grown into this position and is doing a great job.  

Mayor Delnicki called for a vote on the resolution; it was approved, unanimously.

Deputy Mayor Bazzano made a motion to Suspend the Rules in order to add two items to the agenda, Item 14. F. and 14. G.  Councillor Snyder seconded the motion; and it was approved, unanimously.

  • Resolution Accepting the Resignation of Timothy Kenefick (R) from the South Windsor Board of Education
BE IT RESOLVED that the South Windsor Town Council hereby accepts with regret, the resignation of Timothy Kenefick (R) from the South Windsor Board of Education; and

BE IT FURTHER RESOLVED that the South Windsor Town Council extends its thanks to Timothy Kenefick for the time he has dedicated to serving his community by his membership on the South Windsor Board of Education.

  • Resolution Appointing Rick Stahr (R) to the South Windsor Board of Education and Postponing Consideration of this Motion until the Town Council’s Next Regularly Scheduled Meeting
BE IT RESOLVED that the South Windsor Town Council hereby appoints Rick Stahr (R) to the South Windsor Board of Education for a term ending November 4, 2013 to fill the unexpired term of Timothy Kenefick and postpones consideration of this motion until the Town Council’s next regularly scheduled meeting.

  • Passage of Ordinance
A.      Resolution Adopting an Amendment to Article II, Section 74-31 of the South Windsor Code of Ordinances – Established; terms of the Park & Recreation Commission

BE IT RESOLVED that the South Windsor Town Council hereby adopts an amendment to Article II, Section 74-31 of the South Windsor Code of Ordinances – Established; terms of the Park & Recreation Commission, said Ordinance more fully described in attached Exhibit B., a copy of which is on file in the Office of the Town Clerk.

ITEM:

17.     Communications and Petitions from Council

Mayor Delnicki reported that he had the pleasure of attending Rich Rylander’s retirement party.  Dancing with the Stars was held on Friday, March 2, 2012 which was a fund raiser to help attain a gazebo at the Community Center.  The night was fun and was for a good cause.

Councillor Havens stated that Mr. Galligan won first prize.

Mayor Delnicki extended an invitation to everyone who participated with Dancing with the Stars to come before the Town Council in the future in costume.

Councillor Havens stated that the South Windsor Rotary is matching the $6,000 that is necessary to complete the installation and construction of the gazebo.

Councillor McCann stated that as the Council knows, the Town of South Windsor, East Windsor and Windsor lost our Probate Court Judge, Brian Griffin.  The funeral services were held on Saturday, March 3, 2012 which was a wonderful tribute to a man who truly deserved it.  Judge Griffin will be sorely missed.

Mayor Delnicki stated that is was a tragic loss and it will be tough to find someone to step into that position.

Councillor Yagaloff said that Brian was loved by many in the community and he was a wonderful person.  Councillor Yagaloff wished his family and friends the very best.  Judge Griffin was a well respected person.  This is a great loss for everyone.

18.     Communications and Reports from Town Manager

None

  • Executive Session
At 9:35 p.m. Deputy Mayor Bazzano made a motion to go into Executive Session to discuss a personnel issue and pending claims and litigation regarding the Planning & Zoning Commission, enforcement of an ordinance.  Councillor McCann seconded the motion; and it was approved, unanimously.

At 9:55 p.m. Councillor Snyder made a motion to adjourn the Executive Session.                      Councillor Anwar seconded the motion; and it was approved, unanimously
