TOWN COUNCIL – Regular Meeting
Council Chambers – South Windsor Town Hall

1.      Call Meeting to Order

Mayor Delnicki called the Regular Meeting to order at 8:00 p.m.

4.      Roll Call

Also Present:           Matthew B. Galligan, Town Manager

At 8:02 p.m. Mayor Delnicki recessed the Regular Meeting in order to go back and finish the Work Session agenda.  The Regular Meeting was reconvened at 8:52 p.m.

5.      Public Input

Mr. Robert Benson, 15 West Road came before the Town Council to discuss the four poles that are needed on West Road in order to keep electricity producing properly.  Mr. Benson urged the Town Council to take action on this issue and help out the residents on West Road.

Mr. Hugh Brower, 25 West Road concurred the need for a loop system on West Road because the power on West Road is so unreliable.  Mr. Brower also concurred with Mayor Delnicki that ham radio operators would be very useful during emergencies.

Mr. Robert Pellegatto, 128 Chapel Road thanked everyone involved in helping the community during the storm and then questioned if federal funds could be used from a project that has been in the works for years but has gone no where, to help clean up the Town’s from Storm Alfred.



ITEM:

6.      Environmental Health & Safety Message

Chief Reed from the South Windsor Police Department came before the Town Council with an environmental health & safety message.  Chief Reed explained that beginning November 15, 2011 the winter overnight parking ban will be in effect on Town roads from 2:00 a.m. too 6:00 a.m.  There is also a parking ban for the duration of a storm and up to 24 hours after the conclusion of a storm.

Chief Reed also explained that he is the point person to contact for street light issues.  If there is any street light out, please go onto the C L & P website, or contact the Police Department by calling the main number for routine calls or email the Chief at Matthew. Reed@southwindsor.org.

7.      Adoption of Minutes of Previous Meetings

BE IT RESOLVED that the South Windsor Town Council approves the Minutes of the following Town Council Meetings:  Work Session Meeting of October 17, 2011; Regular meeting of October 17, 2011; Emergency Meeting of November 4, 2011; and Organizational Meeting of November , 2011.

9.      Communications from Officers and Boards Directly Responsible to Council

10.     Communications and Reports from Town Manager

Mr. Galligan explained that he went to the Connecticut Recreation & Parks Association meeting today and informed the public that Ray Favreau, who is the Director of Parks & Recreation was honored as a “Distinguished Professional”.  The South Windsor Rotary Club received the award for an outstanding non-profit organization.

13.     Communications and Petitions from Council

Councillor Havens stated that he feels it is good idea for the Town Council to have an Orientation Meeting.  In that meeting the Town Council should discuss our goals and objectives for the next couple of years.  Councillor Havens requested that Mr. Galligan question why there is no reporter from the Hartford Courant reporting on South Windsor.  The Town Council is losing communication with residents.

Councillor McCann requested that the Mayor establish a temporary committee to review the expansion of sidewalks and bike trails throughout the Town.

Councillor Yagaloff thanked Shelley Saiden and Stop & Shop for running a food collection at Stop & Shop.  They had $8,132.00 donations, 7,542 foot items donated and 200 turkeys donated.  At this time the South Windsor Food and Fuel Bank is in need of donations if anyone can help.

Councillor Anwar informed the Town Manager that there is graffiti on the crossing between Sullivan Avenue and Rte. 74 that should be painted over.

Councillor Yagloff made a motion to Supend the Rules in order to bring Item 17. E. forward.  Deputy Mayor Bazzano seconded the motion; and it was approved, unanimously.

17.     New Business

E.      Resolution Authorizing the Town Manager to Negotiate with Connecticut Light & Power for the Installation of Four Poles on West Road

WHEREAS, it has come to the attention of the South Windsor Town Council, after the construction of the new Company 3 Firehouse, that there have been issues with electricity on West Road that need to be addressed; and

WHEREAS, a definite loop system needs to be installed on West Road so that power can be restored quickly to residents, as well as the Public Works Town Garage and Company 3 Firehouse during emergency situations; and

WHEREAS, these poles will also be used to install fiber optic lines that will connect the Firehouse, Public Works Town Garage, Town Hall and the Police Department in conjunction with the Town of South Windsor’s emergency management planning activities

NOW, THEREFORE, BE IT RESOLVED that the South Windsor Town Council hereby authorizes Town Manager, Matthew B. Galligan to start negotiations for the installation of four poles to service West Road residents as well as the Town of South Windsor public buildings; and

BE IT FURTHER RESOLVED that Town Manager, Matthew B. Galligan will bring back to the Town Council the costs associated with this project for final approval.

Councillor McCann thanked Mr. Benson for bringing this issue forward and thanked Mr. Brower for his support on this issue.  Councillor McCann then suggested that the loop system be put underground which would help prevent storm damage to the area in the future.  

Councillor McCann made a motion to amend the resolution.  In the NOW, THEREFORE, BE IT RESOLVED paragraph, after installation of, insert “an electric service loop system involving” and then after poles insert “or underground service”.  Councillor Yagaloff seconded the amendment; and it was approved, unanimously.

The Resolution to read as follows:

Mayor Delnicki called for a vote on the Amended Resolution; it was approved, unanimously.

A.      Resolution Appointing Joan Walsh (D) to the Board of Assessment Appeals

BE IT RESOLVED that the South Windsor Town Council hereby appoints Joan Walsh (D) to the Board of Assessment Appeals for a term ending November 30, 2011 to fill the unexpired term of Thomas Barrett.

17.     New Business

A.      Resolution Authorizing the Sale or Disposal of Surplus Vehicles

BE IT RESOLVED that the South Windsor Town Council hereby declares the following Police Department vehicles to be “surplus equipment” and authorizes Town Manager, Matthew B. Galligan to sell, or otherwise dispose of the following:

  • 1998 GMC Jimmy, VIN #1GKCS18W1WK501230, odometer reading of 80,681
  • 2006 Segway XT Police Model Serial #062211021378

Answering questions from the Council, Chief Reed explained that this segway is one of the first segways that came out and there has been an on-going power problem with this vehicle.  It has also been found that it is not being utilized the way is used to be.

Mayor Delnicki called for a vote on the Resolution; it was approved, unanimously

B.      Resolution Accepting a Street within the Rye Springs Subdivision

BE IT RESOLVED that the South Windsor Town Council hereby accepts the deed for a street within the following Subdivision:

Rye Springs Subdivision

Saxton Lane    -    100 linear feet

Answering questions from the Council, Mr. Galligan explained South Windsor is only taking 110 feet of the road and then the rest of the road, because it is in East Windsor, East Windsor is responsible for.  As far as the plowing of this road, there is an arrangement with bordering Town’s that the first Town to the road will be the Town that clears the road.  Town’s will coordinate the maintenance of roads with each other so that the maintenance is getting done at the same time for both Town’s.

Mayor Delnicki called for a vote on the Resolution; it was approved, unanimously.

C.      Resolution Setting a Time and Place for a Public Hearing to Receive Citizen Input on a Proposed Ordinance Establishing Regulations of Hair Salons, Nail Salons, Barber Shops and Tattoo Parlors

BE IT RESOLVED that the South Windsor Town Council hereby sets Monday, December 5, 2011, at 7:15 p.m., in the Council Chambers of the South Windsor Town Hall, 1540 Sullivan Avenue, South Windsor, Connecticut as the time and place for a Public Hearing to receive citizen input on a proposed Ordinance establishing “Regulations of Hair Salons, Nail Salons, Barber Shops and Tattoo Parlors”.

Councillor Prague stated he is generally opposed to regulating businesses but would like to go through the public hearing before he really gets into conversations.  Councilor Prague then stated the he does not feel this is the time to regulate businesses and feels the Town should be encouraging businesses to come to Town.

Mayor Delnicki stated for the record that this resolution was requested by Town staff.

Councillor McCann felt that resolutions should not be brought forward unless they are endorsed by a Council member.  Councillor McCann stated he is opposed to going forward with a public hearing, but if the Town Council does go forward, every nail salon, hair salon, barber shop and tattoo parlor should receive notification of the public hearing.

Councillor Anwar felt the Town should be business friendly and this Ordinance would have a negative effect on small businesses.  The Town needs to find a way to educate these types of businesses for health and safety purposes.

Councillor Yagaloff stated that these facilities are unregulated and should be regulated, but not charged a fee.

Councillor Havens disagreed with Councillor McCann stating that staff should bring resolutions forward.  The Town has an obligation to the community to protect the public safety and health.

Mr. Robert Pellegatto, 128 Chapel Road came before the Town Council.  Mr. Pellegatto stated he does not disagree with any of the health issues, but stated that he would assume that the State of Connecticut is not going to allow a business to open without knowing the health issues involved.  Mr. Pellegatto also stated that business owners are aware of most health concerns.

Mayor Delnicki called for a vote on the Resolution; it passed on a Roll Call vote of 8 to 1 with Mayor Delnicki, Deputy Mayor Bazzano, Councillors Anwar, Beaulieu, Havens, Prague, Snyder and Yagaloff voting in favor of holding a public hearing; and Councillor McCann voting in opposition of holding a public hearing.

D.      Resolution Setting a Time and Place for a Public Hearing to Receive Citizen Input on a Proposed Ordinance Establishing Regulations of Food Establishments, Water Supply Wells and Subsurface Sewage Disposal Systems

BE IT RESOLVED that the South Windsor Town Council hereby sets Monday, December 5, 2011, at 7:30 p.m., in the Council Chambers of the South Windsor Town Hall, 1540 Sullivan Avenue, South Windsor, Connecticut as the time and place for a Public Hearing to receive citizen input on a proposed Ordinance establishing “Regulations of Food Establishments, Water Supply Wells and Subsurface Sewage Disposal Systems”.

Mayor Delnicki stated for the record that this resolution was requested by Town staff.

Councillor Yagaloff requested that the Town Manager talk to staff and see if this is feasible to do without the fees.  The Town does not want to send a message of being anti-business.  If the Town does implement this process without fees, this issue could be re-visited in the future if there are concerns.  Councillor Yagaloff then explained that regulations protect businesses that are being run properly.

Councillor McCann stated that this resolution came before the Town Council previously and there were many questions and concerns regarding this issue.  There have been no changes made to the resolution and believe the Town Council’s rules call for resolutions to be brought forward by Town Councillors rather than a member of the public or Town staff.  This would avoid issues coming back before the Council with no changes.  Councillor McCann stated he would not be supporting this resolution and feels that if this public hearing does go forward, all food establishments should be notified of this public hearing.

Mayor Delnicki called for a vote on the Resolution; it passed on a Roll Call vote of 7 to 1 with Mayor Delnicki, Deputy Mayor Bazzano, Councillors Anwar, Beaulieu, Havens, Snyder and Yagaloff voting in favor of holding a public hearing; and Councillor McCann voting in opposition of holding a public hearing.

F.      Resolution Approving a Refund of Taxes to Twenty-Eight (28) South Windsor Taxpayers

BE IT RESOLVED that the South Windsor Town Council hereby approves a refund of property taxes to twenty-eight (28) South Windsor Taxpayers, the total of said refund being $3,528.66, and as more fully described on attached Exhibit A.
