TOWN COUNCIL – Regular Meeting
Council Chambers – South Windsor Town Hall

1.      Call Meeting to Order

Mayor Pelkey called the Regular Meeting to order at 8:00 p.m.

Mayor Pelkey made a motion to Suspend the Rules in order to go to Item 6.  Councillor Hale seconded the motion; and it was approved, unanimously.

6.      Environmental Health & Safety Message

        Robin Bond, Animal Control Officer came before the Town Council and stated that residents have been experiencing coyote activity.  There was an incident in December where an elderly dog had been left outside unattended and was attacked and killed by coyotes, but that is very unusual.  Coyotes should not be feared, they are majestic animals.  Officer Bond explained that coyotes do not travel in packs, but sometimes in pairs during mating season, in family groups, and occasionally coyote siblings stay together for the first year.  Officer Bond suggested that residents not feed stray cats or leave any type of food outside where coyotes could get to it.  Installing motion lighting, or hanging wind chimes (which must be moved occasionally because coyotes become acclimated to them) are both helpful.  If a resident encounters coyotes, they should make themselves big and make loud noise such as banging pots together.

At 8:11 p.m. the Regular Meeting was recessed in order to finish the Work Session agenda.

        BE IT RESOLVED that the South Windsor Town Council hereby approves the Minutes of the following Town Council Meetings:  Work Session of December 21, 2009.

        Mr. Galligan stated that he submitted a copy of the “Critical Path Analysis” regarding the Connecticut Studios with a copy of the proposed new site plan to the Council.  This information is for the Town Council to review and can be discussed at a later date.

12.     Reports of Temporary Committees - None

13.     Communications and Petitions from Council

        Councillor Favreau thanked the Public Works employees for doing such a good job during the last snow storm.

BE IT RESOLVED that the South Windsor Town Council hereby reappoints William Flagg (D) to the Connecticut River Assembly for a term ending January 12, 2013.

* B.    Resolution Appointing Arthur Jennings (D) to the Building Code Board of Appeals

BE IT RESOLVED that the South Windsor Town Council hereby appoints Arthur Jennings (D) to the Building Code Board of Appeals for a term ending January 1, 2015 to fill an expired term of Mark Lillis.

17.     New Business

* A.    Resolution Accepting the Resignation of Anthony Duarte (D) from the Inland Wetlands/Conservation Commission

BE IT RESOLVED that the South Windsor Town Council hereby accepts with regret, the resignation of Anthony Duarte, said resignation to be effective immediately; and

BE IT FURTHER RESOLVED that the South Windsor Town Council extends its thanks to Anthony Duarte for the time he has dedicated to servicing his community by his membership on the Inland Wetlands Agency/Conservation Commission.

C.      Resolution Appointing Kevin Ricker (R) an Alternate to the Planning & Zoning Commission (postponed from the 1/4/2010 meeting)

Resolution appointing Kevin Ricker (R) an alternate to the Planning & Zoning Commission for a tem ending November 9, 2013 to fill an expired term of Daniel Van Horn.

Councillor Prague made a motion to rescind Item 16. C.  Councillor Delnicki seconded the motion; and it was approved, unanimously.

D.      Resolution Appointing Rachna Khanna (R) an Alternate to the Planning & Zoning Commission (postponed from the 1/4/2010 meeting)

BE IT RESOLVED that the South Windsor Town Council hereby appoints Rachna Khanna (R) an Alternate to the Planning & Zoning Commission for a term ending November 9, 2013 to fill an expired vacancy.

Resolution Appointing William Carroll, Jr. (R) an alternate to the Planning & Zoning Commission for a term ending November 9, 2013 to fill an expired vacancy and postpones consideration of this motion until the Town Council’s next regularly scheduled meeting.

Councillor Hale made a friendly amendment to change the term to November 30, 2013.  Councillor Prague and Councillor Yagaloff both agreed to this friendly amendment.

The resolution to read as follows:

Resolution Appointing William Carroll, Jr. (R) an alternate to the Planning & Zoning Commission for a term ending November 30, 2013 to fill an expired vacancy and postpones consideration of this motion until the Town Council’s next regularly scheduled meeting.

BE IT RESOLVED that the South Windsor Town Council hereby sets Tuesday, February 16, 2010, at 7:15 p.m., in the Council Chambers of the South Windsor Town Hall, 1540 Sullivan Avenue, South Windsor, Connecticut as the time and place for a Public Hearing to receive citizen input on the establishment of a proposed Ordinance, a “Film Production Ordinance”; said Ordinance more fully described in attached Exhibit A., a copy of which is on file in the Office of the Town Clerk.

BE IT RESOLVED that the South Windsor Town Council hereby sets Monday, March 1, 2010, at 7:25 p.m., in the Council Chambers of the South Windsor Town Hall, 1540 Sullivan Avenue, South Windsor, Connecticut as the time and place for a Public Hearing to receive citizen input on a proposed Amendment to Chapter 50 – Health and Sanitation, adding Article V – Food Establishments, Article VI – Water Supply Wells, and Article VII – Subsurface Sewage Disposal System (SSDS), Sections 50-90 through 50-150; said Ordinance more fully described in attached Exhibit F., a copy of which is on file in the Office of the Town Clerk.

Mayor Pelkey suggested a friendly amendment to have this resolution modified to set a time and place for a Work Session to receive Councillors input.  Councillor Yagaloff and Bazzano both accepted these changes as a friendly amendment.

BE IT RESOLVED that the South Windsor Town Council hereby sets Monday, March 1, 2010, in the Council Chambers of the South Windsor Town Hall, 1540 Sullivan Avenue, South Windsor, Connecticut as the place for a Work Session to receive Town Councillors input on a proposed Amendment to Chapter 50 – Health and Sanitation, adding Article V – Food Establishments, Article VI – Water Supply Wells, and Article VII – Subsurface Sewage Disposal System (SSDS), Sections 50-90 through 50-150; said Ordinance more fully described in attached Exhibit F..

  • Resolution Adopting a Public Park, Open Space, and Facility Naming Policy
WHEREAS, a sub-committee was established to review an existing drafted document regarding Public Park, Open Space, and Facility naming Policy; and

WHEREAS, the sub-committee presented a draft policy to the Town Council at the January 19, 2010 Regular Meeting

NOW, THEREFORE, BE IT RESOLVED that the South Windsor Town Council hereby adopts the newly revised Public Park, Open Space, and Facility Naming Policy, as described in attached Exhibit I.

L.      Resolution Approving a Refund of Taxes to Forty-Six (46) South Windsor Taxpayers
        
BE IT RESOLVED that the South Windsor Town Council approves a refund of property taxes to forty-six (46) South Windsor Taxpayers, the total of said refunds being $7,317.57.

19.     Communications and Petitions from Council (Continued)

        Councillor Prague requested that after the Board of Education have their three workshops, a dvd of all three workshops be sent to each Town Councillor.

        Councillor Hale stated that the articles and publicity that have gone out about the Senior Citizen and Disabled Tax Freeze have not highlighted the fact that the income limits are $36,300 for single individuals and $43,500 for an individual who is married.  Please contact the Human Services Department to find out about eligibility.

20.     Communications and Reports from Town Manager (Continued)

        Thanked the Council for hard work during the Work Session.

21.     Executive Session

At 9:49 p.m. Councillor Hale made a motion to go into Executive Session to discuss a personnel issue and discuss documents containing financial information provided in confidence and exempt from disclosure pursuant to C.G.S. § 1-200(6) and 1-210(b)(5)9B).  Councillor Delnicki seconded the motion; and it was approved, unanimously.

The following individuals went into Executive Session:  Mayor Pelkey, Deputy Mayor Havens, Councillor Bazzano, Councillor Delnicki, Councillor Favreau, Councillor Hale, Councillor Prague, Councillor Yagaloff, and Town Manager Galligan .

At 10:25 p.m. Mayor Pelkey made a motion to adjourn the Executive Session.  Councillor Yagaloff seconded the motion; and it was approved, unanimously.

22.     Adjournment

At 10:25 p.m. Mayor Pelkey made a motion to adjourn the Regular Meeting.  Councillor Yagaloff seconded the motion; and it was approved, unanimously.
