TOWN COUNCIL – Regular Meeting

1.      Call Meeting to Order

Mayor Prague called the Regular Meeting to order at 8:05 p.m.

7.      Adoption of Minutes of Previous Meetings

BE IT RESOLVED that the South Windsor Town Council approves the Minutes of the following Town Council Meetings:  Work Session of March 16, 2009; Special Budget Work Session of March 18, 2009; and Regular Meeting of March 16, 2009.

The motion was approved, unanimously

17.     New Business

  • Resolution Waiving the Bid Process for the Immediate Redesign and Reconstruction of the Multi-Purpose Fields at South Windsor High School and Directing Town Manager, Matthew B. Galligan to Negotiate and Execute any and all Contracts Necessary to Begin the Redesign and Reconstruction Project
WHEREAS, the playing fields at South Windsor High School are constantly used by a number of sports teams, bands, and physical fitness classes from early spring to late fall; and

WHEREAS, such constant use provides little time for maintenance and rejuvenation of said fields; and

WHEREAS, condition of said fields have become a serious safety issue; and

WHEREAS, the Town of South Windsor has been asked to consider a project for the reconstruction and re-sodding of both multi-purpose fields at South Windsor High School in order to provide safe playing surfaces for all seasons; and

WHEREAS, it has been determined that in order to have the project completed by the fall of 2009, and prevent the possibility of any further injuries to student athletes, the project must start immediately; and

WHEREAS, in order to start the project immediately, the bid process set forth in Section 714 of the Town Charter must be waived; and

WHEREAS, the Town Council pursuant to Section 714 of the Town Charter, has determined that requiring the use of such bid process in this instance is against the best interest of the Town of South Windsor

NOW, THEREFORE, BE IT RESOLVED that the Town Council has determined that the bid process required pursuant to Section 714 of the Town Charter for the immediate redesign and reconstruction of the multi-purpose fields at South Windsor High School is not in the best interest of the Town of South Windsor and is hereby waived; and

BE IT FURTHER RESOLVED that Town Manager, Matthew B. Galligan is directed to negotiate and execute any and all contracts necessary to begin the redesign and reconstruction project immediately such that the multi-purpose fields at South Windsor High School will be ready for use in the fall of 2009.

B.      Resolution Referring the Proposed Construction and Re-Sodding of the two Multi-Purpose Fields at South Windsor High School to the Planning & Zoning Commission Pursuant to the Requirements of Section 8-24 of the Connecticut General Statutes

WHEREAS, the playing fields at South Windsor High School are constantly used by a number of sports teams, bands, and physical fitness classes from early spring to late fall; and

WHEREAS, such constant use provides little time for maintenance and rejuvenation of said fields; and

WHEREAS, condition of said fields become a serious safety issue; and

C.      Resolution Authorizing the Waiving of competitive bidding for the Installation of Safety Netting at Nevers Road Park and Directing Town Manager, Matthew B. Galligan to Execute any and all contracts/Documents Necessary to Begin the Installation

WHEREAS, the playing fields at South Windsor High School are constantly used by a number of sports teams, bands, and physical fitness classes from early spring to late fall; and

WHEREAS, such constant use provides little time for maintenance and rejuvenation of said fields; and

WHEREAS, the Town of South Windsor has approved a project for the reconstruction and re-sodding of both multi-purpose fields at South Windsor High School in order to provide safe playing surfaces for all seasons; and

WHEREAS, the Town Council acknowledges while this project is in progress, there will be a need to use the three (3) existing fields at Nevers Road Park and install safety netting to avoid injuries from cross field play; and

WHEREAS, the Town of South Windsor has received a quote of $10,000 for the installation of safety netting at Nevers Road Park from Sports Field Specialties, Inc., and the Town Council views such quote to be reasonable

NOW, THEREFORE, BE IT RESOLVED that the South Windsor Town Council  authorizes the waiving of competitive bidding to complete the installation of safety netting at Nevers Road Park; and

BE IT FURTHER RESOLVED that Town Manager, Matthew B. Galligan is directed to execute any and all contracts/documents necessary to begin the installation of safety netting at Nevers Road Park.

Councillor Pelkey made an Amendment to the resolution.  This paragraph would be after the NOW, THEREFORE, BE IT RESOLVED as follows:

BE IT FURTHER RESOLVED that the funding for this project be utilized from the original $35,000 that was allocated for the architectural study; and

Councillor McCann seconded the amendment.

Mayor Prague called for a vote on the Amendment; it was approved, unanimously.

Mayor Prague then called for a vote on the Amended Resolution; it was approved, unanimously.

D.      Resolution Approving the Transfer of $606,705 from the Miscellaneous Drainage/Road Overlay Capital Project Account to the Renovate 1530 Sullivan Avenue Capital Project Account

WHEREAS, the Town Council approved $800,000 for Miscellaneous Drainage/Road Overlay Projects under the FY 2008/2009 Capital Improvement Projects Budget; and

WHEREAS, the Town Council wishes to use $606,705 in LoCIP funds to pay for Miscellaneous Drainage/Road Overlay Projects for FY 2008/2009

NOW, THEREFORE, BE IT RESOLVED that the South Windsor Town Council hereby authorizes the Town Manager to apply to the State of Connecticut, Office of Policy and Management to use $606,705 in LoCIP funds for reimbursement of expenses for FY 2008/2009 Miscellaneous Drainage/Road Overlay Projects; and

BE IT FURTHER RESOLVED that the South Windsor Town Council hereby authorizes the transfer of $606,705 from the Miscellaneous Drainage/Road Overlay Capital Project Account to the Renovate 1530 Sullivan Avenue Capital Project Account.

Mayor Prague made a motion to Amend this resolution to have “renovate” changed to “purchase”.  Deputy Mayor Bazzano seconded the amendment.  No vote was taken on this.

After further discussion regarding this issue, Councillor Pelkey made a motion to table action on this Resolution until after the Executive Session.  Deputy Mayor Bazzano seconded the motion; and it was approved, unanimously.

E.      Resolution Approving the Transfer of $10,000 from the Contingency Account to the Town Manager’s Budget

BE IT RESOLVED that the South Windsor Town Council hereby approves a transfer of $10,000 from the Contingency Account to the Town Manager’s Professional Account to cover the purchase of defibrillators for the schools.

Mayor Prague called for a vote on the Motion; it was approved, unanimously.

  • Resolution Authorizing the Town Manager to Contribute $3,500 to South Windsor High School’s 2009 “Operation Graduation Fund”
BE IT RESOLVED that the South Windsor Town Council hereby authorizes Town Manager, Matthew B. Galligan to transfer $3,500 from the Contingency Fund to the Town Manager’s Professional Account – said $3,500 to then be used as the Town’s contribution towards South Windsor High School’s 2009 “Operation Graduation Fund.”

Seconded by Deputy Mayor Bazzano

Councillor McCann stated that he wanted to make sure that the public is aware that this is a contribution towards Operation Graduation.  Most money is funded through the community and businesses in town.

Mayor Prague called for a vote on the Motion; it was approved, unanimously.

G.      Resolution Approving a Refund of Taxes to Thirty-Seven (37) South Windsor Taxpayers

Mayor Prague made a motion to table action on this resolution until the exhibit is received.  Deputy Mayor Bazzano seconded the motion; and it was approved, unanimously.

21.     Executive Session

Deputy Mayor Bazzano made a motion to go into Executive Session at 8:58 p.m. to discuss possible purchase of real estate for the Town.  Councillor Maneeley seconded the motion; and it was approved, unanimously.

The following individuals went into Executive Session:  Town Manager Matthew B. Galligan, Mayor Cary Prague, Deputy Mayor Gary Bazzano, Councillors Ed Havens, Lisa Maneeley, Kevin McCann, John Pelkey, and Keith Yagaloff.

Deputy Mayor Bazzano made a motion to adjourn Executive Session at 9:30 p.m.  Councillor Maneeley seconded the motion; and it was approved, unanimously.

The Regular Meeting reconvened at 9: 30 p.m.

Councillor Pelkey made a motion to take Item 17. D. off of the table.  Councillor McCann seconded the motion; and it was approved, unanimously.

Councillor Pelkey made a motion to amend the resolution as follows:

BE IT RESOLVED that the South Windsor Town Council approves a refund of property taxes to thirty-seven (37) South Windsor Residents, the total of said refunds being $19,121.32.

Was made by Councillor Yagaloff
Seconded by Deputy Mayor Bazzano

Councillor Yagaloff made a motion to amend the resolution to change residents to taxpayers as follows:

BE IT RESOLVED that the South Windsor Town Council approves a refund of property taxes to thirty-seven (37) South Windsor Taxpayers, the total of said refunds being $19,121.32.

Councillor Pelkey seconded the Amendment.  Mayor Prague called for a vote on the Amendment; it was approved, unanimously.

Mayor Prague then called for a vote on the Amended Resolution; it was approved, unanimously.
