TOWN COUNCIL – Regular Meeting

The Meeting was called to order by Mayor Streeter at 8:00 p.m., was immediately recessed in order to continue the Work Session’s Executive Session.  

Before reconvening the Regular Meeting, Mayor Streeter called upon Town Clerk Gretchen Bickford to swear in South Windsor’s recently hired new Fire Marshal, Walter Summers.   Mrs. Bickford and Mr. Summers came forward for the brief ceremony.

Two other proceedings to be recognized prior to reconvening the meeting, according to Mayor Streeter, were the recognizing of South Windsor’s Jaycees, and the Messiah Lutheran Church (Buckland Road)—both of which would be coming forward to present a check to The Boundless Playground.  The Mayor said that Councillor Pelkey would be accepting these checks on behalf of the Playground.

Paul Petrillo, South Windsor Jaycees, introduced that organization’s President, Erin Aldi, who presented a check for $800 to Councillor Pelkey in support of the Boundless Playground effort.  Next to speak was the Reverend Tom Milkie, Pastor of Messiah Lutheran Church on Buckland Road.  With the help of his congregation and a fund drive held through a “Miniature Golf Tournament,” Rev. Milkie said he was happy to present Councillor Pelkey with a “collection of checks” totaling $1,329 for the Boundless Playground.

Councillor Pelkey extended his thanks and those of the Playground Committee’s thanks to both the South Windsor Jaycees and the congregation of Messia Lutheran Church on Buckland Road for their generous contributions.  He went on to explain that, to date, the

Committee has approximately $230,000 plus tonight’s donations—in “real cash money;” and about $30,000 to $40,000 in “in-kind services.”  He reminded everyone that the goal was about $413,000.  

Mr. Petrillo then made other presentations on behalf of the Jaycees—they were:  From the Jaycees - $1,000 for the “Ropes Course” at Nevers Road Park; on behalf of Wapping Fair, the Jaycees presented the Fire Department with $1,000 to help in their continuing effort in training firefighters; $2,500 check presented to Commander Matt Reid for the purchase of a “police dog” for the unit.

5.     Public Input

Next to make a presentation was Marge Anthony, Chairman of the St. Patrick’s Day Parade Committee.  She then introduced other members who were present.  Each year, someone is named “Honoree” of the St. Patrick’s Day Parade.  The person named is usually a person who is, or has been, “a voice to their personal profession or political achievements; but, more importantly, for his or her service to the community.”

Continuing, Mrs. Anthony named this year’s St. Patrick’s Day Parade Honoree.  Describing him as a spokesman, a leader with a strong voice in the field of education; respected by his peers and by many educators around New England; a credit to the Town of South Windsor, who has the understanding and innovation that has made South Windsor’s reputation for the excellent education system we provide to our children and grandchildren.”  Adding that South Windsor will miss him when he retires this June, Mrs. Anthony proudly introduced Dr. Joseph Wood, Superintendent of South Windsor’s Schools, and presented him with a gift “Shillelagh,” and the designation of “St. Patrick’s Day Parade Honoree.”

5.     Public Input  (Continued)


Further, Mrs. Anthony announced that there will be a Reception in Dr. Wood’s honor on Sunday, March 5, 2006, at Maneeley’s Banquet Facility on Rye Street.  

Another presentation being presented this evening by the Committee, according to Mrs. Anthony, is the “Irish Heritage Youth Award.”  This award, she added, is given to a South Windsor student who is of Irish descent, in Middle School 8th Grade, and High School Grades 9th through 12th.  This year’s Winner, she announced, is Caitlin Melinosky who is a Senior at South Windsor High School, and a Member of the National Honor Society, a Member of the Student Council, the marching Band, and a Mentor/Tutor program participant.  Mrs. Anthony then introduced Caitlin.

Mrs. Anthony also announced that the “St. Patrick’s Day Parade Committee is a member of the 5C’s (Central Connecticut Celtic Cultural Committee).  This year’s St. Patrick’s Day Parade will be held on Saturday, March 11, 2006.

Ms. Caitlin Neiswanger came forward to speak as a representative of the “Relay for Life Committee” for the South Windsor/Rockville “Relay” that’s held at South Windsor high School.  Last year, she said, over 600 people participated; and over $166,000 was raised for the “fight against cancer.”  Caitlin then went on to explain the events surrounding the “Relay for Life” program, and the promise it offers in the fight against cancer.  

This year’s goal, she said, is $185,000; and the event will be held from 3:00 p.m. on Friday, June 9 through noon on Saturday, June 10.   Councillor Prague explained his involvement and participation in the “Relay for Life” each year—and his reasons for doing so.  He urged everyone who could to participate in this event and the fight against cancer.

7.     Adoption of Minutes of Previous Meetings

Motion to accept the Minutes of the following Town Council meetings:  Budget Orientation Work Session of January 9, 2006; Work Session of January 17, 2006; and Regular Meeting of January 17, 2006.

8.     Public Petitions  -  None

9.     Communications from Officers and Boards Directly Responsible to Council

Ms. Terry Dickey-Gaignet, representing the Town’s Patriotic Commission, came forward to discuss, once again, the Commission’s upcoming Memorial Day “Students Essay Contest;” and explain the process for entering the Contest and the various topics for the four (4) different Grade levels.

10.     Communications and Reports from Town Manager

Town Manager Matthew Galligan touched upon the following subjects:

a.      The “Property Tax Relief Program” -  Applications will be received beginning on February 1st this year.  These are for “Seniors,” he added, within a certain fixed income who are looking for tax relief.  The “income level” for one person, according to Mr. Galligan, is no higher income than $27,700; and for two people, is $33,900.  He asked that anyone interested should call the Town’s Human Services Department.

b.      STEAP Grant – (Small Town Economic Assistance Program) Grant is broken up into 2 or 3 areas—Rye Street Park (for additional ballfield); Wapping Fair (to move it out of Rye Street Park to a location in the Barber Hill Road area).  The third Grand applied for was for $100,000 for Union School.  These Grants, he added, have already been submitted.

c.      Shared Services Committee -  Mr. Galligan reported that he had met, together with Dr. Wood, with this Committee today.  Some things are moving forward that will result in “some cost savings.”  He said such items as “completion dates,” “potential savings,” and expected  “productivity increases” were discussed.  A report on this, he added, would be coming to the Town Council very shortly.

d.      Reimbursement to Town for Fire Department “Call-Out on State Highway – Pointing out that South Windsor provided this service on Route 291 heading “west;” Windsor provided this same service on this Route for traffic, etc. heading “east.”  The reimbursement, according to the Town’s Fire Chief is $100 per occurrence—and, he was told, is a “very long process.”  Mr. Galligan suggested that, perhaps, the “State needs to look at that process and make it $1.000 or $2,000, or recoup our costs.”

e.      Remaining Snow-Removal Monies:  When asked the status of this account, Mr. Galligan responded that “we’re in good shape right now with that budget.”  

(Councillor Moriarty, at this time, chose to alert the listening public to a web site called “myspace.com” which has received extensive negative publicity in local newspapers lately because of the danger it poses to young people using it.  He referred, specifically, to seven (7) “attacks” in Meriden, Ct. alone that have been directly attributed to the use of this website.  He explained, basically, what this website is—a website for adolescents to post things about themselves to join and have a network of friends.  He added that, currently, his daughter has “205 friends” that are all students of South Windsor High School.

The Councillor went on to explain how easy it is for an adult of questionable character and background to impersonate a young person joining this group via this website—and the adherent dangers this poses for our young people.  He made note of the very recent Articles contained in both local newspapers (The Journal Inquirer, and The Hartford Courant) alerting the public to the dangers linked to this website.

Councillor Pelkey, too, expressed his outrage what was happening with that website and other similar websites.  He urged parents to talk with their children about “where they’re going on line;” and placing restrictions, where possible.

N.      Resolution Limiting the Use of “Eminent Domain” by the Current Town Council to Public Purposes and Public Uses Rather than Private Economic Development

WHEREAS, the United States Supreme Court, in the recent decision of Kelo v. City of New London, Docket Number 04-108, upheld a ruling that a municipality may take private property, including private residences, by Eminent Domain or the purpose of the taking is to construct a private development for economic development within the municipality; and

WHEREAS, the present South Windsor Town Council is sensitive to the private property rights of the citizens of South Windsor in their homes and believes that such residential property should not be taken by Eminent Domain where the purpose is to facilitate private development for purposes of economic development to the Town; and

WHEREAS, the present South Windsor Town Council wishes to limit its use of the power of Eminent Domain for the property in question is a private residence but to only those situations where the property will be used for public development to be used as public property for a public purpose and not to facilitate private development, even where such development may provide and economic benefit to the Town.

NOW, THEREFORE, BE IT RESOLVED that during the term of the present South Windsor Town Council, the power of Eminent Domain will not be used with respect to property that constitutes a private residence unless the property is taken to be used by the public as public property for a public purpose and not to facilitate purely private development even where this may provide an economic benefit to the Town.

Following a brief history and explanation of the reasons and need for this Resolution by Deputy Mayor Delnicki, Councillor Yagaloff expressed his concern that the Resolution did not include all that it should.  

Following his remarks, Councillor Yagaloff moved to Amend the Resolution to strike the term “private residence;” and to include, instead, everywhere that term currently appeared, the following:  “private business, private residence, farmland, places of worship, private land, condominiums, and rental properties.”  The Amendment was seconded by Councillor Pelkey.

Mayor Streeter then called for remarks on the Amendment.  Deputy Mayor Delnicki pointed out that this was the same discussion that had transpired in July of 2005 about this same Resolution.  At that time, however, the Deputy Mayor said that then Town Attorney Guliano had opinioned that this was a marked reasonable step, not a political step, to address a compelling issue.  

There followed comments from other Councillors.  Councillor McCann said that he agreed with Councillor Yagaloff that this Resolution should not be limited to “private residences;” but disagreed with listing the various types of specific properties that Councillor Yagaloff has recommended.  

Councillor McCann then offered what he felt would be a simpler change to the Resolution by removing the references to “residences;” and, simply, prohibit this Council from taking private property of any sort for private purposes.  The Councillor then stated that he would not be supporting Councillor Yagaloff’s Amendment; and, following action on that Amendment, would be proposing one of his own.

Concern was expressed by several of the Councillors regarding the fact that this Resolution could “take away Council’s power to act upon each individual case when it came to “Eminent Domain.”

Mayor Streeter then called for a vote on Councillor Yagaloff’s proposed Amendment.  The Amendment was defeated 5 Nays to 4 Ayes, on a Roll Call vote, as follows:

Councillor McCann then proposed a second Amendment to remove the references to “residences” in the Resolution, as follows:  (2nd paragraph)  by striking the words “in their homes”, and “residential;”  (3rd paragraph) strike “where the property in question is a private residence;” and  (in the 4th paragraph) strike the words “that constitutes a private residence.”  The Amendment was seconded by Councillor Yagaloff.  

Mayor Streeter then called for a vote on the second Amendment.  It was approved, on a Roll Call vote, 8 Ayes to 1 Nay, with the single “No” vote being cast by Deputy Mayor Delnicki.

O.      Resolution Promoting Community Health Awareness

WHEREAS, the Town of South Windsor was recognized by the  America’s Promise Alliance as one of the 100 best towns for young people because of our innovative efforts to improve the well-being of our young people by keeping the five promises to our children:

Caring Adults
Safe Places
A Healthy Start
Effective Education
Opportunities To Help Others; and

WHEREAS, a recent report of the Strategic School Profile stated that only 29% of our students were able to pass the bare minimum physical fitness requirements, a statistic that directly reflects on promise number three “A Healthy Start;” and

WHEREAS, the National Center for Disease Control has indicated that childhood obesity has reach epidemic proportions, and that childhood obesity leads to even greater lifetime healthcare issues such as diabetes and heart disease

NOW, THEREFORE, BE IT RESOLVED that the South Windsor Town Council wishes to promote a keen awareness of a healthy lifestyle for its youth and citizens by setting into action a plan with specific goals of weight reduction and physical fitness activity, as well as parental and public awareness; and

BE IT FURTHER RESOLVED that the South Windsor Town Council urges the South Windsor Board of Education to join the Town Council in this effort by providing one or more representatives to serve on a temporary subcommittee to address this issue.

I.      Resolution Accepting the Resignation of Philip Forzley (D) from the Inland/Wetlands Agency

BE IT RESOLVED that the South Windsor Town Council accepts, with regret, the resignation of Philip Forzley from the Inland/Wetlands Agency, said resignation to be effective immediately; and,

BE IT FURTHER RESOLVED that the South Windsor Town Council extends its sincere thanks to Mr. Forzley for his many years of dedicated and invaluable contributions to this Agency and to his community.

J.      Resolution Authorizing the Town Manager to Enter into a Contract with the National Association of Municipal Employees (NAGE RI-208) for the Period July 1, 2005 through June 30, 2008

BE IT RESOLVED that the South Windsor Town Council authorizes Town Manager Matthew B. Galligan to enter into a Contract between the National Association of Municipal Employees (NAGE RI-208) and the Town of South Windsor’s Pollution Control Employees, said Contract to be effective from July 1, 2005 through June 30, 2008.

K.      Resolution Approving a Refund of Property Taxes to Forty-Nine (49) South Windsor Taxpayers

BE IT RESOLVED that the South Windsor Town Council approves a refund of property taxes to forty-nine (49) South Windsor taxpayers, the total of said refunds being $12,533.30 and as more fully described on attached Exhibit A.

20.     Communications and Reports from Town Manager  (Continued) – Referring to the Executive Session held earlier this evening, Mr. Galligan reminded the Town Council of the information he will need as to the Council’s intention.  He added that there is a time limit to some of the information he needs.


21.     Executive Session  -  (If needed to continue Executive Session discussion conducted earlier this evening at the Work Session.

        A motion to adjourn was made at 10:15 p.m.; was duly seconded, and approved, unanimously.
