PUBLIC HEARING MINUTES

FEBRUARY 22, 2005
7:45 P.M.

SOUTH WINDSOR COUNCIL CHAMBERS


PURPOSE:  TO RECEIVE CITIZEN INPUT ON A PROPOSED CLOSING OF THAT PORTION OF BIDWELL ROAD WHERE IT ENTERS THE PROPERTY OF J. E. SHEPARD COMPANY.

The Public Hearing was called to order at 7:45 p.m. by Mayor Edward Havens.  The Clerk of the Council read the Call of the Meeting (a copy of which is attached).  The following Town Council members were present:  Mayor Edward Havens, Deputy Mayor John P. Pelkey, and Councillors Williams, Pendleton, Fine, Prague, Paquin, and Streeter.  Councillor Delnicki was absent.  Town Manager Matthew B. Galligan and Town Attorney Barry D. Guliano were also present.

Attorney Guliano explained that this Public Hearing has to do with a request from the J. E. Shepard Company pertaining to a small portion of Bidwell Road that enters onto their property that they have requested the Town discontinue as a public road, in return for their agreeing to maintain that portion of the roadway.  This issue was brought to Planning and Zoning for their report.  

Planning and Zoning unanimously agreed that they did not oppose the discontinuance of the road stub.  There is a report regarding traffic safety, it concluded that it will have no impact on traffic safety.  The purpose tonight is to have a Public Hearing on whether the Council will discontinue that road stub and have it be taken over by J. E. Shepard Company with their agreement to maintain the property.

Attorney Guliano previously asked Clerk of the Council Patricia Brown to put the Resolution on the Agenda for tonight even though in the past Council has not wanted to vote the same night as the Public Hearing.  He did not think that this issue was going to be controversial so he thought that a maintenance agreement could be worked out, but he did not have a chance to prepare one.  So, when it comes time to the Resolution, he asked that the Council table the resolution until he has an opportunity to negotiate and enter into the maintenance agreement before the road is discontinued.  

Mayor Havens asked if anyone in the audience cared to speak.

There being no further discussion, Mayor Havens called for a Straw Vote of the audience, the results of which were as follows:





Those in favor of the Proposed Closing of that portion of Bidwell Road where it enters the property of J. E. Shepard Company – 1
Those opposed to the Proposed Closing of that portion of Bidwell Road where it enters the property of J. E. Shepard Company – 0
