PUBLIC HEARING MINUTES
JULY 15, 2002

COUNCIL CHAMBERS
7:45 P.M.


PURPOSE:        TO RECEIVE CITIZEN INPUT ON THE APPROPRIATION OF $50,000 FROM CAPITAL AND NON-RECURRING EXPENDITURES ACCOUNT NUMBER 004-4200-4201-320 FOR DRAINAGE IMPROVEMENTS ALONG BUCKLAND ROAD.


The Public Hearing was called to order at 7:45 p.m.  There was one individual present in the audience.  The Clerk of the Council read the Call of the Meeting (copy attached).

Town Engineer Jeffrey Doolittle was asked for a brief explanation, and he provided the following information.  There is a drainage problem along Buckland Road in the vicinity of the Messiah Lutheran Church.  During heavy rainfall, water flows from the back of the property out onto the street and floods the street.  This is caused by a number of factors – the back of the property slopes down toward the road, and there is an area where water collects and builds up until it gets out through parking lots and driveways.  The drainage in Buckland Road is not adequate to handle the water.  They are proposing a solution involving constructing a berm behind the Messiah Lutheran Church to retain the bulk of the water and installing piping and drainage structures to drain the water out into the road at a rate the road can assimilate.

The Church is in favor of this solution, and the Town is in the process of obtaining written approvals from the Church.  When asked why the Church would not be responsible for the drainage, Mr. Doolittle said that the drainage has occurred because of a variety of circumstances over the years.  There have been changes to neighboring properties, as well as natural changes to the Church property.  When the road was reconstructed and redesigned in 1990,  the drainage was redesigned, but it wasn’t designed to account for this amount of water.

Continuing, Mr. Doolittle said that the Town will obtain approval from the Church to work on their property.  A temporary construction easement will be obtained for the construction.  The Town would like to make this a permanent aspect of the Church’s property, and the Church would be responsible for long-term maintenance.  No other properties would be adversely affected.

Mayor Aman called for a Straw Vote, the results of which were as follows:

        Those in favor of the appropriation – 0
        Those opposed to the appropriation - 0

The Public Hearing closed at 7:53 p.m.
