PUBLIC HEARING MINUTES
JUNE 17, 2002

COUNCIL CHAMBERS
7:OO P.M.


PURPOSE:        TO RECEIVE CITIZEN INPUT ON A PROPOSED AMENDMENT TO SECTION 14-31(b) OF THE TOWN CODE OF ORDINANCES REGARDING CERTIFICATE OF OCCUPANY FEES, A COPY OF WHICH AMENDMENT WILL BE ON FILE IN THE OFFICE OF THE TOWN CLERK PRIOR TO THE PUBLIC HEARING.

The Public Hearing was called to order at 7:00 p.m.  The Clerk of the Council read the Call of the Meeting (copy attached).  The following Town Council members were present:  Mayor Aman, Deputy Mayor Streeter; and Councillors Barbour, Burnham, Delnicki, Fine, Havens, Lassman Fisher and Pelkey.  Also present were Town Manager Matthew B. Galligan, Town Attorney Barry D. Guliano, and Town Engineer Jeff Doolittle.

There were 6 people in the audience.

Town Attorney Barry Guliano explained that most Certificate of Occupancy fees would not be affected by this change.  However, there are some Certificates of Occupancy that require an inspection by the Engineering Department before they are granted.  This change indicates that in those instances there would be a fee charged for that inspection by the Engineering Department, and that fee would be $35.  

Mayor Aman noted that any new house or commercial building would require an inspection, but it would not be required for something like the addition of a deck.  

When asked if there was currently a fee, Atty. Guliano replied that there is a fee for obtaining a Certificate of Occupancy (CO), but there is no separate fee to get the inspection that is required with some CO
Town Engineer Jeff Doolittle said that the Certificate of Occupancy inspection has been occurring for some time; it is required as part of the Zoning and Subdivision Regulations.  A fee has not been charged previously for the inspections for CO
a fee of $35 to recover part of those costs.  Some CO requests require several inspections to be certain that things are completed.  

Mr. Doolittle was asked if he expected a number of inspections with regard to Evergreen Walk, and he said it would depend upon how the project is configured.  Their inspections do not include any mechanical or other building inspections.  Based upon previous years
Mayor Aman called for a Straw Vote, the results of which were as follows:

        Those in favor of the inspection fee - 2
        Those opposed to the inspection fee - 2

The Public Hearing was closed at 7:15 p.m.
