MINUTES

June 7, 2010




Town Moderator, Robert J. Long, called the fourth session of the 2010 Annual Town Meeting to order on June 7, 2010 at 8:19 p.m. at the Town Hall Auditorium, 298 Central Street, Saugus, MA with 48 members, plus the moderator present. A quorum is met.




Joyce Rodenhiser from precinct 1 and Edward S. W. Boesel from precinct 9 were appointed and sworn as tellers.




Pamela Goodwin from precinct 5 will, as a courtesy, be making motions this evening.




Mr. Dennis Moschella noted his presence at 8:15 p.m. Therefore attendance for the fourth session of the 2010 Annual Town Meeting is as follows:

Mr. Lawrence makes a motion to take Article 13 off the Table.

Article 13 is taken off the table.




Article 13 as written:




Article 13. To see if the Town will vote to increase water rates with all receipts to be held within the Water Enterprise Fund to be used exclusively for water expenses, water maintenance, water debt and interest and water improvement programs, or take any other action relating thereto. (Town Manager)







Mr. Manoogian makes a motion to amend Article 13 by inserting “That all users, commercial and residential pay the same rate.”

Seconded at 8:23 p.m.

Mr. Manoogian explained his proposed amendment.




Stephen Sweezey stated that town meeting was in the same predicament previously, when research was not done correctly, therefore creating larger bills for some elderly, trailer parks, some condominium complexes and apartment buildings. Mr. Sweezey noted that he did not want to see this inequity happen again.




Town Manager Bisignani stated that if it was the wish of Town Meeting to implement a flat rate structure, he would suggest it be done by a study over a period of time to ensure equity, as the last time they tried to change this, it was a fiasco.




Ms. Dever asked Town Counsel if he thought it was legal for one rate payer to be charged different than other rate payers. Mr. Vasapolli stated that it was probably not right or legal, but when agreements have been made with previous administrations, whether written or through court orders, they must be adhered to, regardless.




Ms. Dever asked if such a situation could be modified, whereas Mr. Vasapolli replied that he could not answer that question right now, as he is not privy to the situation, but if requested he would look into it.




Mr. Manoogian makes a motion to add the following wording to his proposed amendment:

“barring any previous agreements”.




Unanimous consent to accept the additional wording to Mr. Manoogian’s amendment which will now read: “Barring any previous agreements, all users, commercial and residential, pay the same rate.”

Unanimous Voice Vote to accept all of the above mentioned budgets as recommended by the Finance Committee.




Discussion came on Mr. Cox’s Amendment.




Mrs. Leuci asks for support of the amendment. Ellen Faiella has a question on sustainability, should this amendment pass. Mr. Cox believes this budget is sustainable, if the Town has high enough priorities. Mr. Cox asks for support on the amendment. Rick Smith stated that he supports this amendment and so did Mr. DiNardo.




Theresa Lehane, of 24 Burrill Street spoke in support of the amendment, as well as residents Karla DeStuben of 172 Forest Street and 13 year old Matthew Genovese, who asked the members to please support this amendment, as he, his friends and family all enjoy the library.




Rick Smith, Pam Gill, Florence Chandler, Martha Clause, and Ellen Faiella all spoke on the amendment.




Scott Crabtree, Vice Chairman of the Board of Selectmen, spoke in support of the Amendment.

Mr. Long proceeded to read the several budget numbers left to vote on. Should any discussion on them be required, he asked for members to let him know.




Budget 122 – Board of Selectmen




Mr. Manoogian asked the Chairman of the Finance Committee if it is his understanding that members will now be eligible for insurance.




Mr. Palleschi stated that they will not be eligible to be covered by health or life insurance.




Mr. Bisignani confirmed that members are not eligible for health or life insurance.




Budget 210 – Police Department




Mr. DiNardo asked for an update on the status of funding for the Police Department, as well as the Essex Street fire station. Town Manager stated that both are expected to end the fiscal year with out a deficit.

Budget 301 – Vocational School Assessment




Mr. DiNardo asked for a status update. Peter Rossetti responded by saying that this years budget was actually down from last years, but the number of students from Saugus went up, therefore, so did the cost. Mr. Rossetti noted that there is an amendment (#801) which was supported by the Mass Teachers Association, which would clearly benefit the Town, should it pass. However, it has yet to be voted in the Legislature.




Budget 491 – Cemetery Department




Ellen Faiella wanted to take a moment to say that she was disappointed in the maintenance at the cemetery.




Budget 525 – Recycling Department




Mr. Manoogian moves to amend Budget 525 by decreasing $31,000 for capital equipment and apply it to Article 20, for athletic and extra curricular user fees.

Seconded at 10:30 p.m.




Mr. Manoogian stated that he felt this was the time to fund the user fees. Town Manager Bisignani reminded members that the trash truck which will be purchased, should this budget be passed, was recommended by the exterminating company.




George Moriello spoke in favor of the truck, as a closed container would be put to good use.




Vote came on Manoogian amendment:
