Town Moderator, Robert J. Long, called the Special Town Meeting of August 24, 2009 to order at 7:34

p.m. at the Town Hall Auditorium, 298 Central Street, Saugus, MA with 42 members, plus the moderator present.




The moderator led the meeting in the salute to the Flag.

With 43 members, including the Moderator present, a quorum is met.




Jeffrey Moses from precinct nine and Josesph Palczynski from precinct ten were appointed and sworn as tellers.




Moderator Long explained that Patricia Johnson, from precinct seven, would, as a courtesy, be making motions this evening.




Tellers distributed handouts, which included the Finance Committee recommendations and information regarding Article 6 and Article 9.




Moderator Long stated that he anticipated getting through the entire warrant this evening.




Article 1. Reports of Committees.




Robert Palleschi, Chairman of the Finance Committee spoke on the warrant articles before the members this evening. He was encouraged by the town meeting members who attended the Finance Committee meetings. He stated that they recommended to indefinitely postpone Article 2 & 3 and unless Articles 4 and Article 5 pass, there would be no money to support Articles 6, 7 & 8. They also recommended to refer Article 13 back to the Board of Selectmen.




Patricia Johnson moves, as a courtesy to indefinitely postpone Article 2.

Article 2. To see if the Town of Saugus will vote to designate 25 acres of Town of Saugus Property located on Assessors Plan 1038, formerly known as Curley Property, for the use by Cemetery Commission for a Cemetery for Saugus Residents. The 25 acres would be the parcel of property located at North and West portion of the ~ 59 acres of property. (Saugus Cemetery Commission)




Arthur Grabowski submitted a substitute motion. That Town Meeting shall form a committee to study best use of Town of Saugus Property located on Assessors plan 1038, formerly known as Curley Property. Said committee to be compromised of seven (7) members. To wit:




3 town meeting members

1 member or designate of planning board

1 member or designate of cemetery commission

1 member or designate of conservation commission

1 member or designate of school committee or school building committee.







Seconded at 7:45 pm.




Mr. Long stated that he spoke with Dennis Gould, who was unable to attend the meeting. Mr. Gould asked, as a courtesy, to have Articles 2 and Article 3 referred to the next special town meeting.

The 10 acres would be in the parcel of property located at North and West portion of the ~ 59 acres of property where there is a small stream/wetlands system. (Saugus Cemetery Commission)

Article 4. To see if the Town will vote to accept M.G.L. c.64L section 2(a) to impose a local meals excise. Said excise shall amount to .75% of restaurant meals originating within the Town. (Town Manager)




Selectmen Kelleher spoke in support of the increase in the meals tax. Saugus will greatly benefit from this article passing. The passage of Article 4 will help out Public Safety and the Schools.




Dean Murphy, Danvers, MA, Manager of Kelly’s Roast Beef spoke in opposition to the increase.




Al DiNardo stated that he is opposed to most tax increases but he is in support of this article.




Peter Manoogian asked for fourteen other Town Meeting members to stand for a roll call vote on this article.

Mr. Palleschi, Chairman of the Finance Committee stated that Article 6 & Article 7 is just restoring funding that was cut in the original budget. Ralph Matterese, from Building Maintenance, came to the Finance Committee meeting and gave a great presentation on the town buildings. The Belmonte Middle School is in terrible shape and in need of repairs.




Police Chief DiMella, Fire Chief Blanchard, and Town Meeting member Rick Smith all spoke, asking for support of this article.

Article 6 : Voted to raise and appropriate or transfer from available funds a sum of $100,000 to fund the FY2010 Police Department overtime account, $30,000 to fund the FY2010 Dispatchers overtime account, and $15,000 to fund the FY2010 Fire Department overtime account.

Peter Manoogian, Precinct ten, offered a resolution to this article. He requested that a vote on Article 7 be put off until September, as we would know better how we stand. The resolution was submitted as an opportunity to do something for the schools.




Mr. Manoogian moves to table Article 7.

Tellers handed out copies of the Resolution. Mr. Manoogian made a motion to accept the following resolution:




A resolution offered to the Saugus Town Meeting:




Whereas participation in organized athletic and school based extra curricular activities promotes sound character;




Whereas participation in organized athletic and school based extra curricular activities results in higher student achievement;

Whereas the participation in organized athletic and school based extra curricular activities result in a positive impact on the entire community;




Whereas the school administration has presented to the community the desire to reduce such fees;




Whereas the Saugus Public Schools currently charge up to $350.00 to participate in an athletic activity per student;




Whereas students in the Saugus Public Schools are discouraged from participating in student athletics and extra curricular activities because of the fee structure;




Whereas the Town of Saugus has adopted a meals tax and a motel tax that will yield up to $700,000.00 per year in new revenue;




Now Therefore, Be It RESOLVED THAT




The Saugus Town Meeting requests that the Board of Selectmen insert the following article into the next special town meeting:

An Article for the Next Saugus Special Town Meeting




To see if the Saugus Town Meeting will vote, in accordance with Ch 40 Section 5B, to establish a Targeted Stabilization Fund for the purpose of reducing or eliminating athletic and extra curricular user fees in the Saugus Public Schools.

Said funds to be released by a two-thirds vote of Town Meeting upon the School Committee presenting an article requesting funding as well as a specific plan, indicating how such funds would be used to reduce athletic and extra curricular user fees.  

Mr. Manoogian further stated that the Resolution is to submit an article to the next Special Town Meeting. The article would establish a Targeted Stabilization Fund for the purpose of reducing or eliminating athletic and extra curricular user fees in the Saugus Public School.  

Seconded at 8:30 p.m.

Steve Nelson, Precinct 8, and Maureen Dever, Precinct 3 spoke in favor and asked for the support of the Resolution.

Andrew Bisignani, Town Manager, asked for support of the article as submitted, to restore the cuts that were made due to state aid cuts. The Town Manager stated that there are serious problems at the Belmonte Middle School.

Joe Malone, Chairman of the School Committee, expressed his thanks for Mr. Manoogian and Mrs. Dever’s support of the resolution.

Mrs. Dever asked for fourteen other Town Meeting members to stand for a roll call vote on the Resolution. Seconded at 8:50 p.m.

Sean Maltais asked if the fixes on the school could wait or if it needed to be addressed now.




Peter Manoogian and the Town Manager spoke on the subject of building maintenance again, and how much money has been spent to date on the schools.

Article 12. To see if the Town will vote to accept the provisions of Chapter 182 of the Acts of 2008 which amended Section 1 of MGL chapter 60A. This act provides that an excise tax shall not apply to a motor vehicle owned and registered by a resident who is in active and full-time military service and is deployed or stationed outside the boundaries of the United States. (Board of Selectmen)

Article 13. To see if the Town of Saugus will authorize the Board of Selectmen to petition the Great and General Court of the Commonwealth to adopt the following legistation:




AN ACT PROVIDING FOR THE ESTABLISHMENT AND ADMINISTRATION OF RENT REGULATION AND CONTROL OF EVICTIONS IN MOBILE HOME PARK ACCOMMODATIONS IN THE TOWN OF SAUGUS.




SECTION 1. The general court finds and declares that a serious public emergency exists with respect

to the housing of a substantial number of citizens in the town of Saugus, which emergency has been created by excessive, abnormally high and unwarranted rental increases imposed by some owners of mobile home parks, located therein, that unless mobile home park accommodation rents and eviction of tenants are regulated and controlled, such emergency will produce serious threats to the public health, safety and general welfare of the citizens of said town, particularly the elderly; that such emergency should be met by the commonwealth immediately and with due regard for the rights and responsibilities of the town of Saugus.




SECTION 2. The town of Saugus may, by its by-laws, regulate rents for the use or occupancy of mobile home park accommodations in said town, establish a rent board for the purpose of regulating rents, minimum standards for use or occupancy of mobile home park accommodations and eviction of tenants therefrom and may, by it's by-laws, require registration by owners of mobile home parks under penalty of perjury, of information relating to the mobile home park accommodations. Said rent board shall have all the powers necessary or convenient to perform its functions, may make rules and regulations, require registration by owners of mobile home parks, under penalty of perjury, of information relating to the mobile home park accommodations, sue and be sued, compel the attendance of persons and the production of papers and information and issue appropriate orders which shall be binding on both the owner and tenants of such mobile home park accommodations. Violations of any by-law adopted pursuant to this act or any order of said rent board shall be punishable by a fine of no more than $1,000.00.




SECTION 3. (a) The rent board established under section two may make such individual or general adjustments, either upward or downward, as may be necessary to assure that rents for mobile home park accommodations in said town are established at levels which yield to owners a fair net operating income for such accommodations. (b) The following factors, among other relevant factors, which the board by regulation may define, shall be considered in determining whether controlled mobile home park accommodations yield a fair net operating income: (1) increases or decreases in property taxes; (2) unavoidable increases or any decreases in operating and maintenance expenses; (3) capital improvements of the mobile home park as distinguished from ordinary repair, replacement and maintenance; (4) increases or decreases in space, services, equipment, etc.; (5) substantial deterioration of the mobile home park other than as a result or ordinary wear and tear; and (6) failure to perform ordinary repair, replacement and maintenance.




SECTION 4. The provisions of chapter thirty A of the General Laws shall be applicable to the rent board, established under section two, as if said rent board were an agency of the commonwealth, including those provisions giving those agencies the power to issue, vacate, modify and enforce subpoenas, and those provisions relating to judicial review of an agency order.




SECTION 5. (a) The Lynn division of the district court department shall have original jurisdiction, concurrently with the superior court, of all petitions for review brought pursuant to section fourteen of chapter thirty A of the General Laws. (b) The superior court shall have jurisdiction to enforce the provisions of this act and any by-laws adopted thereunder and may restrain violations there.




SECTION 6. The town of Saugus may by its by-laws regulate the eviction of tenants and the rent board established under section two, may issue orders which shall be a defense to

actions of summary process for possession and such orders shall be reviewable pursuant to section four and five.




SECTION 7. The personnel, if any, of the rent board established under section two shall not be subject to section nine A of chapter thirty of the General Laws or chapter thirty-one of the General Laws.




SECTION 8. If any provision of this act or the application of such provision to any person or circumstance shall be held to be invalid, the validity of the remainder of this act and the application of such provision to other persons or circumstances shall not be affected thereby.




SECTION 9. This act shall take effect upon its passage.

Virginia Brown, 104 Broadway, Saugus, MA spoke in opposition of the referrel She stated that she thought a rent control board was necessary so that they can’t raise their rents whenever they feel like it.

Mr. Grabowski submitted a substitute motion:




That Town Meeting establish a special committee to study costs and benefits to the Town in regards to a proposed “rent control board for mobile home parks in the Town of Saugus”.




Said committee to be compromised of at least 7 members, 4 of which shall be town meeting members and of these one from precinct 1 and one from precinct 7.




Seconded at 9:13 p.m.




Mr. Grabowski mentioned that funds are at a premium and if a rent control board was established, it would cost the Town money. He further stated that it would be an added tax burden on the residents of the Town. He asked support to form a committee to look into the matter.




Robert DeCotis, 39 Forest St, Saugus, MA, co-owner of Saugus Mobile Home Park, Attorney Matthew Cavanaugh, 14 Main Street, Salem, MA, attorney for R. DeCotis, spoke about the article. He stated that the rents are not excessive, they are competitive and Saugus does not need a rent control board. Mr. Cavanaugh further stated that the parks are well maintained, which is also a benefit to the owners.




Virginia Brown spoke again and stated that her park is not well kept. She also stated that most people cannot survive another increase.




Selectmen Kelleher stated that he is in favor of creating a rent control committee that would consist of 4 town meeting members (1 from Precinct 1 and one from Precinct 7) 2 Board of Selectmen and 1 at-large.




Mr. Grabowski spoke on the change, and had no issue with increasing the number of members on the committee.




Mrs. Leuci suggested that their be three at-large members on the committee.




Mr. Grabowski amended the substitute motion from 7 members to 9 members




It was approved to change by unanimous consent by Town Meeting.




Ellen Faiella, Precinct 9, stated that she was very upset over the comments made by a former speaker.




Jeff Moses asked if by setting up a rent control board if that would include other complexes in Town, such as Avalon Bay, etc. John Vasapolli, Town Counsel, stated that this article is for “Mobile Home Parks only” Mr. Grabowski asked if one of the mobile home parks owners could be on the board.




Bill Tallis, 25 Taylor Street, Saugus, MA spoke against a rent control board.




Wayne Brooks, 846 Broadway, #39, Saugus and Rachel Kim, 104 Broadway, #8, Saugus, MA spoke in favor of forming a committee.




A vote came on Grabowski substitute motion.

Yeas: 36 Nays: 3 at 9:50 p.m.

Grabowski amendment passed, which now becomes the Main Motion.




A vote came on referral of new main Motion.

Yeas: 7 Nays: 31 at 9:50.5 p.m.

Substitute Main Motion is not referred.

Article 13. Voted to establish a special committee to study cost and benefits to the Town in regards to a proposed “rent control board for mobile home parks” in the Town of Saugus. Said committee to be comprised of at least 9 members, 4 of which shall be Town Meeting Members, and of these one from Precinct 1 and one from Precinct 7; 2 Board of Selectmen; 3 members of the General Public.
