The Park and Recreation Commission held it’s meeting on Tuesday September 11, 2007 at 6:45 P.M. at the Park, Recreation and Community Center located on Broad Street.

MINUTES
Laura Swanson made a motion to approve the minutes from the June 2007 meeting with the addressed changes being made.  MaryAnn Curtin seconded.

Ellen Talkowsky Haunted Happenings
She presented the proposal for the use of Franklin Park on October 31, 2007 for a fireworks display on Halloween night.  She explained that many efforts to enhance public safety are being made.  The fireworks display will mark the ending of Halloween night.  Fire Chief David Cody has walked the site and he sees no problems.  Once pyrotechnics arrive at the site a Fire Department detail will be stationed at Franklin Park until the end of the display.  The entire park site will need to be closed off to the public, and police officer will also be on-site.  All necessary insurance certificates will be supplied by the pyrotechnics company and the City of Salem will be listed as an additional insured.  The fireworks will start at 10:00 for a 10 - 15 minutes show.  
Discussion:   Laura Swanson asked, what time would they be setting up?  Ellen was not sure but the area will be blocked off for setting up equipment.  Councilor Leary has been contacted.  Dumpsters will be on site and they will through all boxes and racks away.  A crew will be back in the morning to check on trash detail.  Worker will be on all night.  

Laura Swanson made a motion to approve the application for the fireworks at Franklin Street for October 31, 2007.  James Shea seconded.

MaryAnn Curtin made a motion to recuse herself from the following regarding the Common.

James Shea made a motion to approve the proposal regarding the Haunted Happenings events on the Common as listed on her proposal, see attachment.  Laura Swanson seconded under discussion.

Chris Burke questioned the ordinance regarding vehicles on the Common.  Ellen responded that they do not need to bring vehicles onto the Common, they could use dollies.   She stated that that ordinance needs to be looked at because of the fact that trash trucks, lawn mowers ect. are needed to be on the Common.  

Dr. Curtin stated that ordinance 26-69 section C states that we are not allowed to review a permit with out a fee, we cannot consider an application without a payment.  

Dr. Curtin would like the letter from Elizabeth Rennard, City Solicitor with her legal opinion read into the minutes. See Attachment
Dr. Curtin stated that he has just received this letter from the City Solicitor and would like to be courteous and send it to the Council to discuss the ordinance.  

Joan Lovely was present and spoke of the definition of the words Carnival, Amusement and Vehicles.  She stated that you can't violate the ordinance regarding vehicles, Ellen Talkowsky asked does that ban walkers, bikes ect. from the Common?  

Michael Coleman 12 Brown Street - Asked if there is an existing written agreement between the Fiesta Company and the City of Salem?  Ellen Talkowsky stated that they are operating through good faith and drafted documents for the City Council to be on their Agenda.

Laura Swanson made a motion to amend the motion to change the type of use for the Common to Amusement, not Fiesta rides and games.  James Shea seconded.

Russell Slam 4 Forrester Street - He would like some more information on what is going on the Common, he would like specifics on the amusements and concession stands.

Jim Kilroy 2 Forrester Street - He asked if the vendors will be using microphones.  Response was no only for the entertainment/D.J.

Mary Costello  33 Forrester Street - stated that they should cancel the whole idea right now.

Rhode Island resident Eddie Claire of James Town RI asked why have the times be from 10a.m. to 10 p.m. for a children’s day.  
Jim Kilroy asked about the generator and why buses can't run when parked around the Common but a generator can run for 12 hours.

Rose Kilroy would like to know how the monies are being monitored because they will be mostly handling cash.  

Gordon Venhessian 41 Washington Square- asked if there was any certainty that any funds will be brought back to the Common.

Councilor Lovely stated that the Mayor did state in a letter that the Common will get a portion of the revenue.  

Chris Burke made a motion to amend the motion with the following restrictions

9:00 p.m. closing for weeknight, not 10:00 p.m.
latest closing will be 10:00 p.m. on weekends unless earlier dependant on police
No vendors shall use microphones
Protective barrier around fence
Petition off the gazebo for safety
Funds allocated will be available for repair and reseeding of land
Any revenues will be deposited into the Common fund
Also the Commission would like to ask the City Council to look closely at the ordinance 26-72 number 7 regarding the vehicular restrictions on the Common.

Bonnie Hurd Smith - Pioneer Village
Has 3 banks lined up to pay the 7200.00 for the lumber to replace a fence, with the help of the Eagle Scout, Eastern Bank, Danvers Savings and Salem Five.   They need help with some metal poles that need to be removed, along with a chain link fence.  Also need help getting some plant growth pulled out because it has poison ivy in it.  She is concerned because the banks do not want to invest their money if after the lease is up something happens to the fence; she needs to tell the vendors that it will be preserved.

The Commission stated that Pioneer Village should always stay a historic preservation.  

Laura Swanson made a motion to approve the fence at Pioneer Village because it is the intent of the Commission that Pioneer Village always be maintained as a historic preservation and respect the historical being of the Village.  Chris Burke seconded.

Ruth Wall - Horse and Carriage discussion, she is still searching for a site for her horses and carriage to be stored.  She has not found any spot yet but is still open for ideas and is continuing to look at sites in Salem.

Leslie Tuttle - Community Garden Farm Market at Mack Park
Laura Swanson made a motion to approve the Community Garden Farmers Market at Mack Park on September 22, 2007 from 9:00 a.m. - 12:00 p.m.  James Shea seconded.

African Development through Drum and Dance application submitted
The Commission has questions and would like to hold this application until the October meeting.

Holly Grose, Friends of Forest River would like to hold a Yard Sale for a fundraiser
James Shea made a motion to approve the Friends of Forest River's request to have a Yard Sale September 29, 2007 from 9:00 a.m. - 2:00 p.m.  Laura Swanson seconded.

A thank you letter was received from the Stephen O'Grady Foundation for the support of the 8th Annual Steven O'Grady Open, which was held at Olde Salem Greens on August 20, 2007.

Finance Report

Recreation Report  - brochure
Dr. Curtin commended Doug Bollen for the great job he has done with all of the programs he is running.  James Shea also praised Doug Bollen for doing a great job on the programs and brochure.

Parks and Facility Report
Willows meters have made $20,000.00 the goal is $25,000.00  -
Mack Park RFP - Al Hill has it

Old Business
End of year review, next year planning for Golf Course, Forest River Pool, WI and Witch House.
Chris Burke suggests that the Doug Bollen look into what kind of consultants to contact to help increase the revenue at the Golf Course.  He would like a good study be done with a consultant to look at enterprise funds and operation of the Golf Course.  Dr. Curtin suggested contacting the USGA or USMGA to see what is out there in terms of consultants.  The Commission would like Doug Bollen to report back to the Commission regarding this subject.

Community Appreciation Award
Men, women, children, groups or partnerships,  may be recognized.   Commissioners are to send their idea to Doug Bollen.

The next Park and Recreation Commission meeting will be held on Tuesday October 16, 2007 at the Park and Recreation Community Center located on Broad Street.
