November 8, 2010 Minutes
Meeting:        Salem Licensing Board held Wednesday November 8, 2010 at 6:00 pm in the third floor conference room, 120 Washington Street. Present were members: Robert St. Pierre, Chairman, Rick Lee and John Casey. Investigator Lt. Ouellette and Melissa Pagliaro, Clerk.
        
Tabled: Application for Street Performers License. Applicant: Paul Lessard.
        Mr. Lessard said that he lives at 18 Leavitt Street and is an architect by trade but has been working on his comedy as a hobby for 30 plus years. He said he would like to have a chance to try out some of his material on the public.
        Mr. Casey said that the City Solicitor is currency examining issues with the Street Performers Licenses. He said that because of this the Board is reluctant to issue any more licenses right now. He said that Mr. Lessard can come back at one of the December meetings to request a license again.

Approved:       Application to change the name on a Common Victualler’s License. Applicant: Anna’s Pizzeria, 400 Highland Ave. Present: Paul Linder, owner.   
Mr. Linder said that he along with a former employee named the business and it just has not been successful so he would like to rename it to Joe’s Pizzeria of Salem.
Mr. Lee motioned to approve.
        Mr. Casey seconded.
Mr. St. Pierre said all were in favor. Motion carries.  


Approved:       Request to add stock members and transfer of stock. Applicant: Green Land Café. Present: Joe Giacalone.
Mr. Giacalone said that he is adding his name onto the license a s part owner.
Ms. Pagliaro said that proof of Citizenship from Mr. Giacalone is still needed.
Mr. Casey asked what percentage would be transferred.
Mr. Giacalone said he holds 73 % now and that Mr. Bolden would be kept on the license as Manager for right now.
Mr. Lee motioned to approve.
        Mr. Casey seconded.
Mr. St. Pierre said all were in favor. Motion carries.

Approved:       Application for a Common Victualler’s License. Applicant: Wang Chi                                    d/b/a Jade House, 331 Lafayette Street. Present Wang Chi and, Andrea, paralegal for Chris Coleman office.  
Andrea said that the application is really only for a change of ownership. She said that everything is going to stay the same, hours seating and menu. She said that the new owner currently has a business in New York and wants to move here. He lives in Somerville right now and has 20 years of experience.
Mr. Casey asked about the trash.
Andrea said that it would be like it is now in a dumpster emptied once a week.
Mr. Casey noted that Andrea represented the current owners of Jade House and put conditions that they swept gutters daily and kept front clean and neat. He asked that the new applicant do the same.
Andrea said that the current owner has never had an issue with those conditions and she will tell Mr. Chi the same.
Mr. Casey motioned to approve.
        Mr. Lee seconded.
Mr. St. Pierre said all were in favor. Motion carries.
Commun- 
ications:       Fire Prevention violation for overcrowding at O’Neil’s, Strega, Dodge Street, Passage to India and Gulu-Gulu and overcrowding and blocking a fire exit at Tavern in the Square. 
Mr. St. Pierre said to call of these establishments in for a Hearing at our December 13th meeting. He also asked that Ms. Pagliaro contact the Fire Chief to see if he will allow the Fire Inspector to be present for the meeting.
Mr. Lee stated that these violations are serious.

Lt. Ouellette spoke about the 4 violations of establishments and one store serving a minor during a sting conducted by the Salem Police on August 6 and August 19, 2010. He explained that these stings are usually educational and how they work. However, if there is a violation the establishments are called in.
Mr. St. Pierre said that if a violation is given then the Board can reserve the right to just issue a warning if a 0place has not had problems in the past.
Lt. Ouellette said that he thinks the three restaurants have not had offenses before but the store is questionable. He said he will check and will have formal reports at the meeting.
Mr. Casey noted that some of these establishments have been in business for 25 years without a problem.
Mr. Lee said the Board when determining punishment always looks at how egregious past violations were.
Mr. St. Pierre said to notify them for a Hearing on the 22nd.
Lt. Ouellette said the Board should hold the hearing, hear the testimony and go from there.
