A Regular Meeting of the City Council held in the Council Chamber on Thursday,
July 16, 2015 at 7:00 P.M. for the purpose of transacting any and all business. Notice of this meeting was posted on July 9, 2015 at 5:13 P.M.  This meeting is being taped and is live on S.A.T.V.   

        
       Councillor Turiel was recorded as absent. Councillor Furey arrived at 7:25 P.M.

       Council President Sargent presided.

       Councillor O’Keefe moved to dispense with the reading of the record of the previous meeting.
          It was so voted.

Councillor Milo requested and received unanimous consent to allow Councillor Gould of Peabody to speak.

Councillor Legault moved for a moment of silence for the death of the Marines  in Chattanooga, Tennesssee.

Councillor Siegel  moved to take out of order, under Communications from the Mayor
a request to hold an Executive Session to discuss the operation and sale of the Salem Transfer
Station to Northside Carting.               

Councillor Siegel  moved that the City Council adjourn to the City Council Anteroom to hold the Executive Session for the purpose of discussing with the Mayor, Solicitor, City Engineer and
Director of Public Services the strategy with respect to litigation, which is imminently likely, as a
Result to fail to convey the property to Northside Carting. Conducting this discussion in an open
Meeting may have a detrimental effect on the litigation position of the City.

Following the Executive Session, the City Council shall reconvene in open session and continue the regular meeting by Roll Call Vote of 10 Yeas, 0 Nays, 1 Absent.
Councillors Siegel, O’Keefe, Milo, McCarthy, Legault, Gerard, Furey, Famico, Eppley and Sargent were recorded as voting in the affirmative. Councillor Turiel was recorded as absent.

Following Executive Session:

Councillor Siegel       Moved that the Regular Meeting be continued.    It was so Voted.


#456 – HEARING NATIONAL GRID FOR RELOCATION OF POLE AND INSTALL CONDUITS

A hearing was held on the Order of National Grid to install one single-owned pole and to relocate a single owned pole and also install conduits at on Lafayette Street.

Appearing in favor was Michael Burn representative of National Grid. He stated the relocation of the pole and conduits were necessary to provided services.

        There was no one appearing opposed.

Councillor O’Keefe moved that the hearing be closed. It was so voted.

Councillor O’Keefe moved that the Order be granted. It was so voted.



(#419) – APPOINTMENT OF WILLIAM MCHUGH AS HARBORMASTER
Held from the last meeting, the Mayor’s appointment of William McHugh to serve as the Harbormaster for the Port of Salem, pursuant to Chapter 10 of Section 4 of the City Ordinances. Mr. McHugh was confirmed by a roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Siegel, O’Keefe, Milo, McCarthy, Legault, Gerard, Furey, Famico, Eppley and Sargent were recorded as voting in the affirmative. Councillor Turiel was recorded as absent.






#457 – CONSTABLE

The Mayor’s appointment of Matthew Christensen to serve as a Constable with the term to expire on June 26, 2016, was received and placed on file.

The Mayor’s appointment of Shawn Newton to serve as a Constable with the term to expire on February 11, 2016, was received and placed on file.



#459 – APPROPRIATION TO THE STABILIZATION FUND & RETIREMENT STABILIZATION FUND

        The following Order recommended by the Mayor was adopted under suspension of the rules.

ORDERD: That the sum of Six Hundred Thousand ($600,000.00) is hereby appropriated from the “Fund Balance – Free Cash” account to the following Special Revenue funds. This transfer is requested in accordance with the recommendation of Her Honor the Mayor.

#462 – APPROPRIATION FOR REPAIR OF HYDRANTS

The following Order recommended by the Mayor was adopted under suspension of the rules.

ORDERD: That the sum of One Hundred Thousand Dollars ($100,000.00) is hereby appropriated within the “Capital Outlay Repairs” account to be expended for the repair of hydrants and other items damaged during the winter by the Department of Public Services in accordance with the recommendation of Her Honor the Mayor.
#463 – APPROPRIATION FROM RETIREMENT STABILIZATION – VACATION/SICK LEAVE BUYBACK ACCOUNT

The following Order recommended by the Mayor was adopted under suspension of the rules.

ORDERD: That the sum of Eighteen Thousand Two Hundred Fifty Dollars and Eighty-seven Cents ($18,250.87) is hereby appropriated in the “Retirement Stabilization Fund – Vacation/Sick Leave Buyback” account to be expended for Fiscal Year 2016 contractual buyback for retirement of Michael Bick.


#464 – GRANT OF EASEMENT WITH MASSACHUSETTS ELECTRIC COMPANY

The following Order recommended by the Mayor was adopted.

ORDERED: The Mayor is hereby authorized to execute on behalf of the City of Salem, a Grant of Easement with Massachusetts Electric Company for an aerial line crossing 22 Thorndike Street, property taken by the Commonwealth of Massachusetts Department of Public Works on behalf of the City of Salem. The Easement is granted to enable the property at 18 Thorndike Street to receive electric service.



#465 – HOME RULE PETITION FOR BAMBOLINA LOCATED AT 288 DERBY STREET

The following Order recommended by the Mayor was adopted by a roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Siegel, O’Keefe, Milo, McCarthy, Legault, Gerard, Furey, Famico, Eppley and Sargent were recorded as voting in the affirmative. Councillor Turiel was recorded as absent.

That a petition to the General Court, accompanied by a bill for the conversion of a certain seasonal liquor license to an annual liquor license notwithstanding the provisions of Sections 17 and 17A of chapter 138 of the General Laws as set forth below, be filed with an attested copy of this Order be, and hereby is, approved under Clause (1) of Section 8 of Article 2, as amended, of the Amendments to the Constitution of the Commonwealth of Massachusetts, to the end that the following legislation be adopted, except for amendments by the Senate or House of Representatives which conform to the intent of this home rule petition:
AN ACT authorizing the City of Salem to convert 1 seasonal license to an annual license for the sale of wines and malt beverages to be drunk on the premises.
        Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.      Notwithstanding sections 17 and 17A of chapter 138 of the General Laws, the licensing authority of the City of Salem may convert 1 currently issued seasonal license for the sale of wines and malt beverages to be drunk on the premises under section 12 of said chapter 138, currently issued to Ragazza Restaurant Group, Inc. d/b/a Bambolina, located at 288 Derby Street, to an annual license for the sale of wines and malt beverages to be drunk on the premises under said section 12 of said chapter 138 to Ragazza Restaurant Group, Inc. d/b/a Bambolina, located at 288 Derby Street. An annual license converted under this section shall be subject to all of said chapter 138, except sections 17 and 17A. An application for conversion of a seasonal wine and malt license to an annual wine and malt license shall not be required to notify abutters as required by section 15A of said chapter 138. The licensing authority shall not approve the transfer of the license converted under this section to any other location, but it may grant the license to a new applicant at the same location if the applicant for the license files with the authority a letter from the department of revenue and a letter from the division of unemployment assistance indicating that the license is in good standing with the department and that all applicable taxes have been paid.

If the license converted or granted under this section is cancelled, revoked or no longer in use, it shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which may then grant the license to a new applicant at the same location under the same conditions as specified in this section.

SECTION 2. (a) The city of Salem shall charge a fee for the conversion to an annual license for the sale of wines and malt beverages pursuant to this act which shall be paid by the licensee at the time of issuance unless the licensing authority agrees to enter into an arrangement with the licensee which would enable the fee to be divided into multiple payments or prorated over multiple periods of time. If the city elects to accept prorated payments over time from a licensee, the option shall be made available, upon request, to all qualified applicants for lincensure.

(b) Any fee collected by the city of Salem for a license converted or granted under this act which is greater than the amount of the fee charged for an annual renewal of a similar license issued by the city, shall be deposited into an economic development account which shall be established by the city of Salem to be expended by it in a manner consistent with the purposes of the account.

SECTION 3. This act shall take effect upon its passage.


#466 – ORDINANCE TRAFFIC, PARKING PROHIBITED CERTAIN STREETS OCTOBER 1 TO NOVEMBER 1
        The following Ordinance recommended by the Mayor, was referred to the Committee on Ordinances, Licenses and Legal Affairs.

In the year two thousand and fifteen

An Ordinance to amend an Ordinance relative to Traffic resident sticker parking

Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Chapter 42 Section 75 - Parking Prohibitions towing zone (resident sticker) is herby amended by adding the following streets to the list of streets restricting parking to residents only from October 1 to November 1:

Margin Street, Endicott Street, High Street, Summer Street, Broad Street, Winthrop Street, Hathorne Street, Oliver Street, Williams Street, Union Street, Northey Street, Downing Street, Mt. Vernon Street, Pratt Street, Prescott Street, “Resident Parking, October 1 to November 1”.



Section 2. This Ordinance shall take effect as provided by City Charter.

Councillor Famico amended Smith Street be added.

#467 – ORDINANCE TRAFFIC, SCHEDULE OF FINES (DURING MONTH OF OCTOBER)

The following Ordinance recommended by the Mayor, was referred to the Committee on Ordinances, Licenses and Legal Affairs.

An Ordinance to amend an Ordinance relative to Traffic parking fines

Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Chapter 42 , the Salem Traffic Ordinance, is herby amended by deleting the following section within Section 17A Schedule of Fines re: Penalties of Article I

Section 75

$15 Fine/$40 Fine during Month of October       Parking Prohibitions Towing Zone (Resident Sticker)…

And replace it with:

#468 – FIVE YEAR LEASE-TO-OWN AGREEMENT WITH ALL AMERICAN INVESTMENT GROUP LLC

        The following Order recommended by the Mayor, was adopted by a roll call vote of 9 yeas,
1 nay, 1 absent. Councillors Siegel, Milo, McCarthy, Legault, Gerard, Furey, Famico, Eppley and Sargent were recorded as voting in the affirmative. Councillor O’Keefe was recorded as voting in the negative. Councillor Turiel was recorded as absent.

ORDERED: The Mayor is hereby authorized to enter into a five-year Lease-to-Purchase Agreement with All American Investment Group, LLC for the purchase of one New Elgin Pelican Sweeper, acquisition cost $195,000.00.


#469 – REQUEST FOR EXECUTIVE SESSION

A request from the Mayor to meet in Executive Session, in order to discuss the operation and sale of the Salem Transfer Station to Northside Carting, was held earlier in the meeting.


#470 – UPDATE ON MAYOR JEAN LEVESQUE COMMUNITY LIFE CENTER

A request from the Mayor to address the City Council regarding the Mayor Jean Levesque Community Life Center, was received and placed on file.

Councillor Siegel moved for suspension of the rules to allow the Mayor to speak. There was no objection.

Mayor gave a power point presentation with an overview of new center.


Councillor Sargent moved for suspension of the rules to allow Mr. Sweetzer developer High Rock LLC.

Mr. Sweetzer stated they will be breaking ground in spring 2016 and in the spring of 2017 will be in the building. He stated the interior designer is Elaine Bellow who is working with the city of Salem.

Councillor Siegel introduced the following Ordinance, which was adopted for first passage.

#485 – (#346) RESERVED PARKING SPACES IN BOTH GARAGES

        Councillor Gerard offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation as amended by roll call vote of 6 yeas, 4 nays, 1 absent. Councillors Milo,
McCarthy, Legault, Gerard, Furey and Eppley were recorded as voting in the affirmative. Councillors Siegel, O’Keefe, Famico and Sargent were recorded as voting in the negative. Councillor Turiel was recorded as absent.

        The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of designating up to fifty (50) total reserve parking spaces in the Museum Place Mall and South Harbor Garages with a permit cost of $1,500.00 per year and to expire on June 30, 2016 has considered said matter and would recommend that the language be amended to state “with all permits expiring on August 31, 2016.

        Councillor Eppley offered the following report for the Committee on Public Health, Safety and Environment. It was voted to accept the report and adopt the recommendation.

The Committee on Public Health, Safety and Environment to whom was referred the matter creating an ordinance for standards of outdoor illumination of streets and public ways has considered said matter and would recommend that the matter remain in committee.







#487 – (#382) ORDINANCE TRAFFIC, RESTRICTED WAY CERTAIN TIMES CHASE STREET

Councillor Eppley offered the following report for the Committee on Public Health, Safety and Environment co-posted with the Committee. It was voted to accept the report and adopt the recommendation.
