A Regular Meeting of the City Council held in the Council Chamber on Thursday,
March 12, 2015 at 7:00 P.M. for the purpose of transacting any and all business. Notice of this meeting was posted on March 5, 2015 at 5:42 P.M.  This meeting is being taped and is live on S.A.T.V.   

        
      All Councillors were present.

      Council President Sargent presided.


Councillor Milo moved to dispense with the reading of the record of the previous meeting. It was so voted.


President Sargent requested that everyone please rise to recite the Pledge of Allegiance.

(#128) – APPOINTMENT OF TYLER GLODE TO THE CONSERVATION COMMISSION

Held from the last meeting the Mayor’s appointment of Tyler Glode to serve as a member of the Conservation Commission with a term to expire on March 1, 2018, was confirmed by roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Turiel, Siegel, O’Keefe, Milo, McCarthy, Legault, Gerard, Furey, Famico, Eppley and Sargent were recorded as voting in the affirmative.

Councillor Eppley moved for suspension of the rules to allow Mr. Glode to speak. There was no objection.

#162 – APPOINTMENT OF JAMES HACKER TO ZONING BOARD OF APPEAL

The Mayor’s appointment of James Hacker to serve as an alternate member of the Zoning Board of Appeals with a term to expire on March 1, 2017, was held under the rules until the next meeting.


#163 – APPOINTMENT OF J.P. STORY TO THE PARKING BOARD

The Mayor’s appointment of J.P. Story to serve as a member of the Parking Board with a term to expire on March 1, 2016, was held under the rules until the next meeting.

        

#164 – APPOINTMENT OF ELYSIA ALLEMAN TO THE PARKING BOARD

The Mayor’s appointment of Elysia Alleman to serve as a member of the Parking Board with a term to expire on March 1, 2016, was held under the rules until the next meeting.



#165 – REAPPOINTMENT OF TIMOTHY DOGGETT TO PARKING BOARD
        
The Mayor’s reappointment of Timothy Doggett to serve as a member of the Parking Board with a term to expire on March 1 2016, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Turiel Siegel, O’Keefe, Milo, McCarthy, Legault, Gerard, Furey, Famico, Eppley and Sargent were recorded as voting in the affirmative.


#166 – APPROPRIATION TO “POLICE DEPARTMENT – MEDICAL LINE”

        The following Order recommended by the Mayor was adopted under suspension of the rules.

ORDERED: That the sum of Thirty Thousand Dollars ($30,000.00) is hereby appropriated from the “Fund Balance – Free Cash” account to the “Police Dept. – Medical Line” account in accordance with the recommendation of Her Honor the Mayor.






#167 – GRANTS OF EASEMENTS

        The following Order recommended by the Mayor was adopted by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Turiel Siegel, O’Keefe, Milo, McCarthy, Legault, Gerard, Furey, Famico, Eppley and Sargent were recorded as voting in the affirmative.


ORDERED: To authorize the Mayor to execute on behalf of the City of Salem the following Grants of Easements:

  • Grant of Easement SESD
  • Parking, Drainage & Utility Easements Woodbury Court
  • Drainage Easement Bridge Street
  • Water Line & Drainage relocation Howard Street
  • Easements for Encroachments Bridge St. & St. Peter Street
  • Commonwealth of Mass. Dept. Highway Easements to City of Salem & accept
Bridge Street and Howard Street
  • Declaration of Discontinuance & abandonment of city easements & rights no longer necessary for public access.
Councillor Gerard moved for suspension of the rules to allow Attorney Quinn to speak. There was no objection.

Councillor Gerard moved for immediate reconsideration in the hopes it would not prevail. reconsideration was denied.



#168 – AMEND CITY ORDINANCE RELATIVE TO ELECTED OFFICIALS RECEIVING COMPENSATION  AFTER TERMINIATION OR RESIGNATION

Councillor Siegel introduced the following Order which was adopted.

ORDERED: That the Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole meet to discuss amending City Ordinance Chapter 2 Section 2-278 relative to “Elected Officials receiving compensation from city after termination or resignation from office”






#169 – LIMIT ON NUMBER OF TAXI CAB LICENSES ALLOWED

Councillor Siegel introduced the following Order which was adopted.

ORDERED: the Committee on Ordinances, Licenses and Legal Affairs meet to discuss a limit on the number of taxi cab licenses allowed.
             

#170 – ORDINANCE AMENDING CH. 44 SEC. 44-34 OPERATOR (HACKNEY) LICENSE

Councillor Siegel introduced the following Ordinance, which was adopted for first passage.

In the year two thousand and fifteen

An Ordinance to amend an Ordinance relative to Vehicle for Hire Operators License

Be it ordained by the City Council of the City of Salem as follows:

Section 1. Article II. Motorized Vehicles for Hire, Taxicabs, Liveries and Limousines
Chapter 44 Section 44-34 “Operator (hackney) License” is hereby amended by adding the following to the 5th sentence in section (b):


(b) Application Qualifications of Applicant

The police traffic division will perform a criminal record check, ensure the driver is over 18 years of age and holds a valid driver’s license, “has held a valid drivers license for a minimum of one year” and then attach a recommendation for approval or denial and submit the application to the city council.

Section 1. This Ordinance shall take effect as provided by City Charter.



#171 – MONTHLY FINANCIAL REPORT

Councillor Turiel introduced the following Order which was adopted.

ORDERED: That the monthly Financial Report dated February 28, 2015 be referred to the Committee on Administration and Finance   



#172 – TRIAL PERIOD TRAFFIC “ONE WAY STREET” SALEM STREET

Councillor Turiel introduced the following Order which was referred to the Committee on Public Health Safety and Environment by roll call vote of 8 yeas, 3 nays, 0 absent.
Councillor Turiel, O’Keefe, Milo, McCarthy, Legault, Gerard Furey and Sargent were recorded as voting in the affirmative. Councillors Siegel, Famico and Eppley were recorded as voting in the negative.

ORDERED: That a trial period of up to 60 days be done on the following Traffic recommendation Chapter 42 Section 10 “One Way Streets”  Salem Street starting at Chase Street in a southerly direction, one way, do not enter at Lafayette Place.



#173 – PROHIBITING AMPLIFICATION DEVICES ON ESSEX STREET AND IN THE DOWNTOWN DURING THE MONTH OF OCTOBER

Councillor Eppley introduced the following Order which was adopted.

ORDERED: That the Committee on Public Health, Safety and Environment meet to discuss “Prohibited Amplification by any Devices on Essex Street and in the downtown for the month of October” and that the following be invited: Mayor or her designee and Chief Butler or her designee.



#174 – SUBSTANCE ABUSE IN SALEM

Councillor Furey introduced the following Order which was adopted.

ORDERED: That the Committee on Public Health, Safety and Environment co-posted with the Committee of the Whole meet to discuss setting up a task force of local leaders and specialists on the growing epidemic of substance abuse in the City of Salem. And that the following be invited Senator Joan Lovely, State Representative Paul Tucker, Mayor or her representative, District Attorney Blodgett, City Solicitor, Chief of Police or her designee, School Committee, School Administration and the Board of Health.


#175 – (#149) GRANTING LICENSES

Councillor Siegel offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation.

The Committee on Ordinances, Licenses and Legal Affairs to whom was referred granting certain licenses has considered said matter and would recommend that the following licenses be granted.

#176 – (#59, 60, 104, 105, 140)       TAXI OPERATOR HEARINGS

Councillor Siegel offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation.

The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter of two taxi operator hearings has considered said matter and would recommend that Camilo Divanne’s license be granted and that Sandy Jaquez-Gil license be denied

        
#177 – (#400 of 2014) VIDEO SURVEILLANCE IN PARKS AND PLAYGROUNDS

Councillor Siegel offered the following report for the Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Ordinances, Licenses and Legal Affairs co-posted with the Committee of the Whole to whom was referred the matter of video surveillance in parks and playgrounds has considered said matter and would recommend that the matter remain in Committee.


#178 – AMEND INFLAMMABLE LICENSE TO REFECT NEW OWNERSHIP

The matter of a petition from Spaulding Hospital North Shore/ Partners Health Care, 1 Dove Avenue, to amend a flammable license to reflect new ownership change was adopted.

(#90, #139) SECOND PASSAGE ORDINANCE AMENDING FINES FOR SNOW REMOVAL


The matter of second passage of an Ordinance amending Ch. 38 Sec. 38-13 “Fines for failing to remove snow and ice from sidewalks was then taken up. It was adopted for second and final passage.
