A Regular Meeting of the City Council held in the Council Chamber on Thursday,
November 20, 2014 at 7:00 P.M., for the purpose of transacting any and all business. Notice of this meeting was posted on November 13, 2014 at 6:04 P.M.  This meeting is being taped and is live on S.A.T.V.

#625 – PUBLIC HEARING NATIONAL FOR A CONDUIT  ON THORNDIKE ST.

        A hearing was held on the Order of National Grid to install a conduit on Thorndike St./Massey Way.

Appearing in favor was Sabitah Mahabier-Sheehy a representative of National Grid. She stated this is needed for the new sub-division.

There was no one in opposition.

Councillor Famico moved that hearing be closed. It was so voted.

(#602) – CONTINUATION OF A PUBLIC HEARING  NATIONAL GRID FOR CONDUITS FOR THE SALEM CABLE REPLACEMENT PROJECT (part 1)

A continuation of a public hearing from October 23, 2014 on the Order from National Grid to install conduits for the Salem Cable Replacement Project for Franchise Rights (Part 1 of 2) on the following streets: Leavitt St., Congress St., Hawthorne Blvd., Washington Sq. West, Washington Sq. South and Forrester St. was held.   

Appearing in favor

George DeLoureiro, Project Manager from National Grid. He stated that the work on this project has been in progress since 2005. There are 2 cables which need to be replaced. There has been an extensive outreach in the communities. We have negotiated a MOU agreement with 30 conditions with the City of Salem. An engineer has been funded to protect the infrastructure. And the MOU has a claim process, and currently we are selecting a contractor and doing extensive background checks. The project has been approved by Energy and Environmental agencies.


Appearing in opposition

Christine Doll – 30 Forrester St. – she came to read into the record that she is against the land route. The cables classified by National Grid have carcinogenics. The World Health Organization classified this as carcinogenic. There has been no bond posted by National Grid for damage to property so claims may not be addressed. We need resident parking.

Councillor Siegel stated he wants reports on claims and that the Council receive them weekly.

Mary Madore – 31 Forrester Street – stated this doesn’t end tonight there is an appeal process. She said that a friend in Marblehead  had a school built in their neighborhood and their house was damaged during construction. So they went to the contractor and the contractor stated they were not responsible. They went to the Town and they said they were not responsible. It now 2 years later and things are still not resolved. We don’t want to end up this way. EMF standards and levels are to high. We have lost our moral compass. The citizens need to be protected. As a nurse she is disappointed when you expose kids to radiation, there is cancer. It can be shielded but National Grid doesn’t want to do that it’s all about the money.

#626 – PUBLIC HEARING NATIONAL GRID FOR CONDUITS FOR THE SALEM CABLE REPLACEMENT PROJECT (part 2)

Cypress Street, Cabot Street, Fairfield Street, Essex Street, Webb Street and Fort Avenue.

Councillor O’Keefe asked what time will the work start? Not before 7:00 AM

#627 – TAX CLASSIFICATION PUBLIC HEARING FOR FISCAL YEAR 2015

        A public hearing was held on the issue of allocating the local property tax levy among the four (4) property classes for the Fiscal Year 2015, and the residential, open space and small commercial exemptions.

Present was the Assessor Deborah Jackson, the Board of Assessors and Mayor Kimberly Driscoll.


President McCarthy turned the Public Hearing over to the Board of Assessors and the Assessor Deborah Jackson and Mayor Driscoll.


Mayor Driscoll thanked the Board of Assessors and the Finance Team for their work. She had a power point presentation showing how the rates are determined. She stated that she is using 1.2 million from Reserves and the Stabilization Account to lower the tax rate. She stated it is lower than last year. There was a 2 ½ increase of the Budget this year but we are way below the levy limit. She stated her recommendation is 1.65%.

Assessor Deborah Jackson explained what happens at the Tax Classification Hearing. Double sales in 2013 show growth she is recommending a factor of 1.65:% or .873540. She went over key tax terms. Salem is 4 million below the levy limit.

Councillor Siegel thanked the Assessor and asked what was last years.

Assessor stated tax rate is going down.

Councillor O’Keefe asked if the City will be ok this year not knowing about FootPrint power.

Mayor Driscoll stated this year we are ok but we are in negotiations with FootPrint. We will be ok until 2019 and we are hoping the amount will go up with new use on the property.

Councillor Eppley asked for clarification. What is going down if not the tax rate?

Mayor state the rate is going down.

Assessor stated values are going up.

Councillor Eppley asked are there additional dollars coming out of tax payers, is it more?

Mayor stated yes.

Councillor Gerard stated residential is partial. What is a typical mix for the North Shore.

Assessor stated maybe just for a city

Mayor stated we are impacted by the loss of power plant and its values.

Councillor Siegel stated the average went up 9.00 a month what is commercial?

Councillor Turiel moved that the public hearing be closed. It was so voted.

Councillor Turiel moved approval. It was so voted.

#628 – REAPPOINTMENT OF DR. DANIELLE LEDOUX TO BOARD OF HEALTH

        The Mayor’s reappointment of Dr. Danielle Ledoux to serve as a member of the Board of Health with a 3 year term to expire on March 1, 2018, confirmed by a roll call vote of 9 yeas, 0 nays, 2 absent. Councillors Eppley, Famico, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel, and McCarthy were recorded as voting in the affirmative. Councillors Furey and Turiel were recorded as absent.

#629 – REAPPOINTMENT OF WILLIAM GRISET TO THE PLANNING BOARD

The Mayor’s reappointment of William Griset to serve as a member of the Planning Board with a 5 year term to expire on March 1, 2020, was confirmed by a roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Eppley, Famico, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel, Turiel and McCarthy were recorded as voting in the affirmative. Councillor Furey was recorded as absent.


#630 – CONSTABLE

The Mayor’s reappointment of Richard Hardy to serve as a Constable with a term to expire on December 13, 2017, was received and placed on file.


#631 – MAYORS LETTER RELATIVE TO TAX CLASSIFICATION

The letter submitted by the Mayor relative to the Tax Classification recommending maintaining the current 1.65 CIP split tax rate or 0.87354, was received and placed on file.


#632 – APPROPRIATION TO REDUCE GROSS AMOUNT TO BE RAISED BY TAXATION

        The following Order recommended by the Mayor was adopted under suspension of the rules.

        ORDERED: That the sum of Six Hundred Thousand Dollars ($600,000.00) is hereby appropriated from the “Stabilization Fund” to reduce the gross amount to be raised by taxation when Fiscal Year 2015 tax rate is set. The Stabilization Fund will be replenished once Free Cash has been certified and in accordance with the recommendation of Her Honor the Mayor.




#633 – APPROPRIATION TO REDUCE GROSS AMOUNT TO BE RAISED BY TAXATION

The following Order recommended by the Mayor was adopted under suspension of the rules.

        ORDERED: That the sum of Seven Hundred Fifty Dollars ($750,000.00) is hereby appropriated from “Overlay Surplus” to reduce the gross amount to be raised by taxation when Fiscal Year 2015 tax rate is set in accordance with the recommendation of Her Honor the Mayor.



#634 - APPROPRIATION TO REDUCE GROSS AMOUNT TO BE RAISED BY TAXATION

The following Order recommended by the Mayor was adopted under suspension of the rules.

        ORDERED: That the sum of One Million, Fifty Thousand, Four Hundred and Fifty-two Dollars ($1,050,452.00) is hereby appropriated from the following accounts to reduce the gross amount to be raised by taxation when Fiscal Year 2015 tax rate is set in accordance with the recommendation of Her Honor the Mayor.

#635 – TRANSFER TO BE EXPENDED FOR HVAC VAV BOXES FOR POLICE DEPT.

The following Order recommended by the Mayor was adopted.

        ORDERED: That the sum of Nine Thousand, Seven Hundred and Twenty Dollars ($9,720.00) is hereby appropriated within the “Capital Outlay – Equipment” account to be expended for HVAC VAV boxes for the Police Department in accordance with the recommendation of Her Honor the Mayor.





#636 – TRANSFER TO BE EXPENDED FOR LIGHTING REPAIR TO THE COMMON GAZEBO

The following Order recommended by the Mayor was adopted.

        ORDERED: That the sum of Six Thousand Two Hundred Dollars ($6,200.00) is hereby appropriated from the “Receipts Reserved – Salem Common” to “Park & Recreation. – Park & Grounds Maintenance” account for repair of lighting in the Common Gazebo in accordance with the recommendation of Her Honor the Mayor.

Councillor Siegel left the Chamber.

#637 – TRANSFER TO PARK & RECREATION GOLF COURSE – CONTRACTED SERVICES

The following Order recommended by the Mayor was adopted.

        ORDERED: That the sum of Three Thousand Five Hundred Dollars ($3,500.00) is hereby appropriated from “Receipts Reserved – Golf Course” to “Park & Recreation – Golf Course – Contracted Services” account to cover cost of Golf Course Manager under a new contract in accordance with the recommendation of Her Honor the Mayor.

#638 – TRANSFER TO PURCHASING – CONTRACTED SERVICES

The following Order recommended by the Mayor was adopted.

        ORDERED: That the sum of One Thousand Two Hundred Dollars ($1,200.00) is hereby transferred from the “Purchasing – Part Time Salary” account to “Purchasing – Contracted Services” account for Fiscal Year 2015 Budget in accordance with the recommendation of Her Honor the Mayor.


#639 – ACCEPT PROVISIONS OF SECTION 4 CHAPTER 73 ACTS OF 1986

The following Order recommended by the Mayor was adopted.

        ORDERED: That the Mayor and City Council accept the provisions of Section 4, Chapter 73 of the Acts of 1986 for Fiscal Year 2015, and that such additional exemptions granted be 100% of the statutory tax exemption amounts, provided all other qualifications specified in said section 4, Chapter 73 of the Acts of 1986 are met.

#640 – DONATION FOR SALEM POLICE DEPARTMENT K-9 DONATION FUND

The following Order recommended by the Mayor was adopted.

        ORDERED: Accept the donation totaling Two Thousand and Six Hundred and Forty-Two Dollars ($2,642.00) from the Mack Park Association. These funds will be deposited into the Salem Police Department K-9 Donation Fund as listed in accordance with the recommendation of Her Honor the Mayor.


#641 – WAIVE FEES FOR UNPAID PARKING FINES WITH DONATION OF CANNED GOODS

The following Order recommended by the Mayor was adopted.

        ORDERED: Upon payment of an unpaid parking fine and the donation of two non-perishable items or canned goods to be donated to local food pantries, the City Collector shall waive, from December 1, 2014 to December 23, 2014, up to thirty dollars in late fees added to an unpaid parking fine, as provided in Section 17A of the City of Salem Traffic Code. The Collector shall not waive any surcharge imposed by the Massachusetts Registry of Motor Vehicles if the Collector has notified the Registry of Motor Vehicles of an unpaid fine and a non-renewal of license and/or registration has been recorded by the Registry of Motor Vehicles.


#642 – RESOLUTION FOR PARC PROGRAM FOR IMPROVEMENTS TO WINTER ISLAND

The following Resolution recommended by the Mayor was adopted.

RESOLUTION:

        A RESOLUTION TO FILE AND ACCEPT GRANTS WITH AND FROM THE COMMONWEALTH OF MASSACHUSETTS, EXECUTIVE OFFICE OF ENERGY AND ENVIRONMENTAL AFFAIRS FOR THE PARC PROGRAM FOR IMPROVEMENTS TO WINTER ISLAND PARK

WHEREAS:        The Winter Island Park is a community-wide asset and preservation and improvements to this facility are City priority as evidenced in the most resent Open Space and Recreation plan; and

WHEREAS:        Winter Island is dedicated to park and recreation purposes under M.G.L. Chapter 45, Section 14; and

WHEREAS:        Winter Island Park’s ultimate restoration, guided in principal by the Master Plan, will greatly enhance this facility with improved infrastructure, path system, site lighting universal access, signage and drainage; and

WHEREAS:        The main focus of the Plan is to renovate and preserve Winter Island’s unique historic recreation and natural resources. This overall cost and fiscal budget constraints prevented the City from proceeding forward with implementation as one project; and

WHEREAS:        The project was instead viewed as a series of phases, to be implemented over time by priority as fiscal resources were available, with the intention of securing grant funding, when and if available, to assist in this effort; and

WHEREAS:        The Executive Office of Energy and Environmental Affairs (EEA) is offering reimbursable grants to cities and towns to support the preservation and restoration of urban parks through the PARC Program, Chapter 933 Acts of 1977, as amended; and

WHEREAS:        Phase 1 of the Winter Island Park Renovation project will cost a total of $291,522 (two-hundred ninety-one thousand, five hundred twenty-two Dollars) and the City has allocated $291,522, in Community Preservation Act funds ($50,000) and City of Salem municipal funds,

NOW THEREFORE, BE IT RESOLVED

  • That the Mayor be and is hereby authorized to file and accept grants from the Executive Office of Energy and Environmental Affairs; and
  • That the Mayor be and is hereby authorized to take such other actions as are necessary to carry out the terms, purposes, and conditions of the grant to be administered by the Department of Planning and Community Development; and
  • That this resolution shall take effect upon passage.


#643 – RESOLUTION AFFIRMING THE RIGHTS OF CHILDREN

The following Resolution recommended by the Mayor was adopted.

RESOLUTION:

A RESOLUTION AFFIRMING THE RIGHTS OF CHILDREN AND DECLARING SALEM A CHILD AND YOUTH RIGHTS RESPECTING COMMUNITY

WHEREAS:        Children are recognized as the future of our city, state and nation; and

WHEREAS:        It is important that the physical, social, mental, and educational well-being needs of our youngest citizens are met; and

WHEREAS:        There has been a worldwide recognition on the rights of children for over a quarter century in the form of the United Nation’s Convention on the Rights of the Child, which is the most endorsed human rights treaty in the history of the world; and

WHEREAS:        Salem is a community that respects the rights and needs of all of its citizens, including people of different genders, races, cultures, religions, abilities, and orientations; and

WHEREAS:        Salem has taken steps to actively protect the rights of the eldest segment of the population and the youngest citizens deserve the same care and attention; and

WHEREAS:        A host of community services have been put in place to ensure that the children and youth in our community have adequate care, safety, and protection; and

WHEREAS:        The City of Salem, its organizations, and its business celebrate the wonderful contributions that young people make to the community and help them succeed in life;

NOW, THEREFORE, BE IT RESOLVED

  • That the City of Salem affirms the United Nation’s Convention on the Rights of the Child upon it’s 25th anniversary; and
  • That the City of Salem shall be a Child and Youth Rights Respecting Community; and
  • The Mayor and City Council of Salem encourage the people, businesses, and organizations in the City of Salem to help advocate for the rights and the physical, social, mental and educational well-being of all of Salem’s children and youth.

#644 – ORDINANCE AMENDING CH. 36 PICK UP OF LARGE ITEMS

The following Ordinance recommended by the Mayor was referred to the Committee on Ordinances, Licenses and Legal Affairs.

        In the year two thousand and fourteen

        An ordinance to amend an ordinance relative to Chapter 36, Pick up of Large Items

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. Chapter 36 is hereby amended by deleting Section 36-4. – Pick up of Large Items in its entirety and replacing it with the following:

        Section 36-4. Demolition and Renovation Debris

        Debris generated from demolishing or renovating properties such as ductwork, furnaces, radiators, bricks, concrete, asphalt, shingles, wood, windows, toilets or other such demolition and renovation debris, as may be determined by the director of public services, shall not be collected by the city or its solid waste contractor. Residents shall be responsible for the proper disposal of such debris.”

        Section 2. This Ordinance shall take effect as provided by City Charter.



#645 – EXECUTE AMENDMENT OF EASEMENT FOR TRUSTEES OF THE ESSEX CONDOMINIUM

        The following Order recommended by the Mayor was adopted by roll call vote of 10 yeas,
0 nays, 1 absent. Councillors Eppley, Famico, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel, Turiel and McCarthy were recorded as voting in the affirmative. Councillor Furey was recorded as absent.

ORDERED: The Mayor is hereby authorized to execute, on behalf of the City of Salem,  an amendment to an Easement and Agreement executed by and between the City of Salem and the Board of Trustees of the Essex Condominium Trust dated October 30, 2016 and recorded with the Southern Essex District Registry of Deeds in Book 26537, page 260. The amendment shall authorize the Trustees to extend an existing wheelchair ramp as shown on a plan in Exhibit C of the attached Amendment to Easement and Agreement. (On file in the City Clerks office)



#646 – COMMUNICATION FROM THE MAYOR

#647 – RESIDENTIAL FACTOR FOR FISCAL YEAR 2015

Councillor Turiel introduced the following Order which was adopted by a roll call vote of
10 yeas, 0 nays, 1 absent. Councillors Eppley, Famico, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel, Turiel and McCarthy were recorded as voting in the affirmative. Councillor Furey was recorded as absent.

Determination of the percentage of total taxes to be borne by the four (4) classes of  property


ORDERED: That the City of Salem adopt a Residential Factor of 0.873540 % (or 1.65%)
for Fiscal Year 2015

ORDERED: That the City of Salem NOT adopt an OPEN SPACE EXEMPTION for Fiscal Year 2015.

#651 – ORDINANCE TRAFFIC, SERVICE ZONE JACKSON STREET
Councillor Siegel introduced the following Ordinance which was adopted for first passage.

        In the year two thousand and fourteen

        An Ordinance to amend an Ordinance relative to Traffic

        Be it ordained by the City Council of the City of Salem as follows:

        Section 1.  Chapter 42 Sec. 13, “Service Zone”,  is hereby amended by adding the following street:

#100 Jackson Street, southeasterly side starting at National Grid Pole #2785 and continuting for one hundred twelve (112) feet in an easterly direction to Mass. Electric Co. pole #2741, as marked by signs, “Service Zone”

Section 2. This Ordinance shall take effect as provided by City Charter.









#652 – RESOLUTION SALEM ANCIENT ORDER OF HIBERNINAS


Councillor Eppley introduced the following Resolution which was adopted.



RESOLUTION:

WHEREAS: The Salem Ancient Order of Hibernians, Division 18, has been located at 104    Boston Street in Salem for approximately 112 years; and

WHEREAS: The primary; purposes of the Salem Ancient Order of Hibernians are to promote friendship, unity, and Christian charity among its members, as well as to foster the ideals and cultivate the history and traditions of the Irish people throughout the world; and

WHEREAS:        The Salem Ancient Order of Hibernians has made significant contributions to our city’s social and cultural growth and will continue as a center for humanitarian ideals; and

WHEREAS The Salem Ancient Order of Hibernians continues to open its doors to community groups like the Gallows Hill / Ward 4 Neighborhood Group for its monthly meetings and to the community at large for community meetings, political debates, and forums – all for no cost to those community groups.

NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Salem herby thanks the Salem Ancient Order of Hibernians for its significant contributions to Ward 4, to Salem, and to the public welfare.

AND BE IT FURTHER RESOLVED: That the City Council make this resolution a matter of record of these proceedings, and that a suitable copy be presented to the Salem Ancient Order of Hibernians, Division 18, along with a copy of the City Seal, as a token of our deep respect and gratitude.









#653 – ORDINANCE TRAFFIC HANDICAPPED PARKING OBER STREET

Councillor Eppley introduced the following Ordinance, which was adopted for first passage.


In the year two thousand and fourteen

An Ordinance to amend an ordinance relative to Traffic

Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Chapter 42, Section 50B “Handicapped Zones, Limited Time”
       is hereby amended by adding the following street:

Ober Street in front of #2 for a distance of twenty (20) feet, Handicap Parking Tow Zone.

        Section 2. This Ordinance shall take effect as provided by City Charter.



#654 – MONTHLY FINANCIAL REPORT


Councillor Turiel introduced the following Order, which was adopted.

ORDERED: That the Monthly Financial Report dated October 31, 2014, be referred to the Committee on Administration and Finance.



#655 – GUIDELINES FOR HOME RULE PETITION LIQUOR LICENSES

        Councillor Sargent introduced the following Order, which was referred to the Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole.

        ORDERED: That the rules and guidelines for Home Rule Petitions for liquor licenses formed by Council Order #471 of July 17, 2008 and adopted by the City Council with order #468 of July 15th 2010 submitted by the City Solicitor, be used for the purpose of finishing Council Orders #471 and #275 of April 11th, 2011, and that the rules submitted by the City Solicitor in council order #468 of 2010 shall be used to form an ordinance to regulate how we issue and use Seasonal and Home Rule Petition Liquor Licenses for the sale of Alcoholic Beverages in the City of Salem.


#656 – (#619) TAG DAY

        Councillor O’Keefe offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation.

Councillor O’Keefe offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation.

The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter a taxi operator hearing for Scott Middleton has considered said matter and would recommend that his taxi operator license be granted.

#662 – (#397)  ZONING ORDINANCE RELATIVE TO URBAN AGRICULTURE (CHICKENS)

Councillor McCarthy offered the following report for the Committee of the Whole.
It was voted to accept the report.

Councillor Siegel amended Section 2 Table of Principal & Accessory Use by changing Industrial and BPD to “N”. It was so voted.

The Committee of the Whole to whom was referred the matter of the Zoning Ordinance relative to Urban Agriculture (Chicken Ordinance), has considered said matter and would recommend adoption as amended. It was adopted as amended by roll call vote of 10 yeas, 0 nays,
1 absent. Councillors Eppley, Famico, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel, Turiel and McCarthy were recorded as voting in the affirmative. Councillor Furey was recorded as absent.


#663 – (#396) ELECTRICITY SUPPLIER

Councillor McCarthy offered the following report for the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee of the Whole to whom was referred the matter of entering into a contract with an electricity supplier through municipal aggregation process has considered said matter and would recommend that the Council authorize the City of Salem to initiate the process and explore options of aggregating the electrical load at no expense to the City and report back to the City Council.


#664 – (#322) CPA APPOINTMENTS & REAPPOINTMENTS

Councillor McCarthy offered the following report for the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee of the Whole to whom was referred the matter of the City Council appointments/reappointments to the Community Preservation Act Committee has considered said matter and would recommend the reappointments of Ed Moriarty, Jr. and Kevin Cornacchio for a two year term.

A communication from the Planning Board with a decision relative to a Zoning Map amendment for 38 Washington Square South going from R-2 (Residential Two-Family) District to B-5 (Central Development District) by extending the B-5 District to include this parcel was received and placed on file.

On the matter of adoption for first passage of the Ordinance relative to zoning map amendment for 38 Washington Square South it was adopted by a roll call vote of 10 yeas, 0 nays, 1 absent. . Councillors Eppley, Famico, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel, Turiel and McCarthy were recorded as voting in the affirmative. Councillor Furey was recorded as absent.
