A Regular Meeting of the City Council held in the Council Chamber on Thursday,

(#380) – APPOINTMENT OF NOAH KORETZ TO THE PLANNING BOARD

Held from the last meeting the Mayor’s appointment of Noah Koretz to serve as a member of Planning Board with a term to expire on March 1, 2019 (term begins July 31, 2014), was confirmed by a roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel and McCarthy were recorded as voting in the affirmative. Councillor Turiel was recorded as absent.

Councillor Gerard requested and received unanimous consent for suspension of the rules to allow Mr. Koretz to speak.

#434 – TRANSFER TO “DEPT. PUBLIC SERVICES – CONTRACTED SERVICES”

The following Order recommended by the Mayor was adopted.

        ORDERED: That the sum of Eighty Thousand Dollars ($80,000.00) is hereby transferred from the “Department of Public Services – Full Time Salary” account to “Department of Public Services – Contracted Services” for Fiscal Year 2015 Budget in accordance with the recommendation of Her Honor the Mayor.


#345 – APPROPRIATION TO BE EXPENDED FOR RETIREMENT OF JAMES LYNCH OF THE FIRE DEPARTMENT

The following Order recommended by the Mayor was adopted under suspension of the rules.

        ORDERED: That the sum of Sixty-Three Thousand Eight Hundred and Twenty-One Dollars and Eighty One cents ($63,821.81) is hereby appropriated in the “Retirement Stabilization Fund – Vacation/Sick Leave Buyback” account to be expended for retirement buyback of James Lynch of the Fire Department in accordance with the recommendation of Her Honor the Mayor.


#436 – APPROPRIATION TO BE EXPENDED FOR RETIREMENT OF THOMAS GRIFFIN OF THE POLICE DEPARTMENT

The following Order recommended by the Mayor was adopted under suspension of the rules.

#442 – DONATION TO SALEM POLICE DEPARTMENT SUMMER CAMP FUND

The following Order recommended by the Mayor was adopted.

ORDERED: To accept the donation totaling $1,000.00 from the Town of Danvers to Police Dept. Summer Camp Donation Fund.


        Councillor Gerard recused herself due to conflict and left the Chamber.

        
#443 – HOME RULE PETITION FOR THE CHEESE SHOP OF SALEM

The following Order recommended by the Mayor was referred to the Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole.

ORDERED:
        That a petition to the General Court, accompanied by a bill for an additional liquor license for the sale of wine and malt beverages not to be drunk on the premises notwithstanding the provisions of Sections 17 of chapter 138 of the General Laws as set forth below, be filed with an attested copy of this Order be, and hereby is, approved under Clause (1) of Section 8 of Article 2, as amended, of the Amendments to the Constitution of the Commonwealth of Massachusetts, to the end that the following legislation be adopted, except for amendments by the Senate or House of Representatives which conform to intent of this home rule petition:
AN ACT authorizing the City of Salem to grant 1 additional liquor license for the sale of wine and malt beverages not to be drunk on the premises.
Be it enacted by the Senate and House of Representatives in General Court Assembled, and by the authority of the same as follows:
SECTION 1. Notwithstanding section 17 of chapter 138 of the General Laws, the licensing authority of the city of Salem may grant 1 additional license for the sale of wine and malt beverages not to be drunk on the premises under section 15 of said chapter 138 to OTSG, LLC d/b/a The Cheese Shop of Salem, located at 45 Lafayette Street in the city of Salem.  The license shall be subject to all of said chapter 138 except section 17.
Notwithstanding any general or special law, or any rule or regulation to the contrary, the alcohol licensing authority of the city of Salem shall not approve the transfer of the license to any other location.  The license may be granted by the alcohol licensing authority of the city of Salem at the same location if an applicant for the license files with the authority a letter in writing from the department of revenue indicating the license is in good standing with the department and that any and all applicable taxes have been paid.
If the license granted under this section is cancelled, revoked or no longer in use, it shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the alcohol licensing authority of the city of Salem.  Notwithstanding section 17 or chapter 138 of the General Laws or any other general or special law to the contrary, the alcohol licensing authority of the city of Salem may then grant the license to a new applicant at the same location and under the same conditions as specified in the preceding paragraph.
SECTION 2. (a) The fee charged by the city of Salem for the issuance of a new license issued pursuant to this act shall be paid by the licensee to the city in full at the time of issuance, unless the licensing authority agrees to enter into an arrangement with the recipient of a license which would enable the fee to be divided into multiple payments or prorated over multiple periods of time.
(b) If the city of Salem charges a fee for the new license pursuant to this act which is greater than the amount of the fee charged for an annual renewal of a similar license issued by the city, then the city shall deposit the fee into its special economic development account established for the deposit of revenue from additional alcoholic beverage licenses issued pursuant to special acts and the fee charged shall be expended by the city in a manner consistent with the purposes of the account.
SECTION 3.  This act shall take effect upon its passage.

#444 – HOME RULE PETITION TO REMOVE POSITION OF CITY MARSHALL (CHIEF OF POLICE) FROM CIVIL SERVICE

        Received after the deadline of Tuesday Noon under suspension of the rules.

        The following Order recommended by the Mayor was referred to the Committee of the Whole. Councillor Furey was recorded as opposed.

        ORDERED:

That a petition to the General Court, accompanied by a bill as set forth below removing the police chief/city marshall position from civil service notwithstanding Chapter 178 of the Acts of 1936 or any other special or general law to the contrary, be filed with an attested copy of this Order be, and herby is, approved under Clause (1) of Section 8 of Article 2, as amended, of the Amendments to the Constitution of the Commonwealth of Massachusetts, to the end that the following legislation be adopted, except for amendments by the Senate or House of Representatives which conform to intent of this home rule petition:

AN ACT exempting the police chief/city marshall from the civil service law.

        Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 178 of the Acts of 1936 is hereby repealed.
SECTION 2. The position of chief of police/city marshall in the City of Salem shall be exempt from chapter 31 of the General Laws.
SECTION 3.  Nothing in Section 1 or 2 shall impair the civil service status of any person holding the position of police chief/city marshall in the City of Salem on the effective date of this Act.
SECTION 4. This act shall take effect upon its passage.



#445 – SPECIAL ELECTION FOR BALLOT QUESTION

Received after the deadline of Tuesday Noon under suspension of the rules.

        ORDERED:

                That a special election be scheduled by the City Clerk for November 4, 2014 so that a binding question, approved by the City Solicitor, may be placed on the ballot asking the voters of Salem whether the City Council should file a petition requesting that the state legislature enact a special act as set forth below:
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 178 of the Acts of 1936 is hereby repealed.
SECTION 2. The position of chief of police/city marshall in the City of Salem shall be exempt from chapter 31 of the General Laws.

#446 – APPROPRIATION TO “DPS – WATER OVERTIME” ACCOUNT

Received after the deadline of Tuesday Noon under suspension of the rules.

        The following Order recommended by the Mayor was referred to the Committee on Administration and Finance co-posted with Committee of the Whole.

        ORDERED: That the sum of Thirty Thousand Dollars ($30,000.00) is hereby appropriated from the “Retained Earnings – Water/Sewer Fund” account to the “DPS Water – Overtime” account in accordance with the recommendation of Her Honor the Mayor.

#448 – ORDINANCE AMENDING RULES & REGULATIONS FOR CARE AND USE OF CEMETERIES

Councillor Gerard introduced the following Ordinance which was referred to the Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole.

In the year Two Thousand and Fourteen

An Ordinance to amend an Ordinance relative to Cemeteries

Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Chapter 16 Article II. Section 36 Rules and regulations for care and use of cemeteries; penalty for violation be amended by deleting the following in the last sentence “fine not exceeding $50.00” and insert in place with the following, “fine not exceeding $100.00.”

Section 2. This ordinance shall take effect as provided by City Charter.



#449 – ORDINANCE TRAFFIC, HANDICAPPED PARKING ROSLYN STREET

Councillor  Famico introduced the following Ordinance which was adopted for first passage.

In the year Two Thousand and Fourteen

An Ordinance to amend an Ordinance relative to Traffic

Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Chapter 42, Section 50B, “Handicapped Parking, Limited Time” by adding the following:

        Roslyn Street, in front of #46 for a distance of twenty (20) feet, Handicap Parking, Tow Zone.

Section 2. This ordinance shall take effect as provided by City Charter.



#450 – RELOCATION OF POLLS FOR WARD FIVE

Councillor Famico introduced the following Order which was adopted by roll call vote of 10 yeas, 0 nays, 1 absent. . Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel and McCarthy were recorded as voting in the affirmative. Councillor Turiel was recorded as absent.


ORDERED: That the polling locations for Ward 5 Precinct 1 be relocated from the Temple Shalom to the Saltonstall School Auditorium located at 211 Lafayette Street

Also that the polling location for Ward 5 Precinct 2 be relocated from the Community Room, Pioneer Terrance to the Saltonstall School Auditorium located at 211 Lafayette Street

ORDERED: That the polling locations for Ward 1 Precinct 2 be relocated from the Bentley School Gymnasium to 135  Lafayette Street Apartments Community Room.

ORDERED: That the meetings of the qualified voters of the City of Salem be held in several voting precincts in the city at the polling places designated hereinafter on Tuesday, September 9, 2014 for the purpose of casting votes in the State Primary Election.


#453 – RETREAT FOR BOARDS & COMMISSIONS REGARDING OPEN MEETING LAW AND PROCEDURES FOR MEETINGS

        Councillor Famico introduced the following Order which was adopted.

        ORDERED: That the Committee of the Whole meet to discuss that the Mayor in collaboration with the City Council convene a retreat for Chairs of City Boards and Commissions with a representative of the District Attorney’s office or the Attorney General’s office, to review the Open Meeting Law and procedures for meetings.


#454 – CHANGE TITLE OF CITY MARSHALL AND POLICE POSITIONS

        Councillor Famico introduced the following Order which was adopted.

        ORDERED: That the Committee on Ordinances, Licenses and Legal Affairs co-posted with the Committee of the Whole shall convene a meeting with the presidents of the Police Departments Patrol and Superior Officers Unions, Police Chief, City Solicitor and the Mayor or her representative to discuss amendments to Chapter 32, Articles I and 2 of the Code of Ordinances relative to police positions (non civilian) Section 32(b)(1) to (5) within the Police Department. Subjects for discussion shall include, but not be limited to, replacing the title of City Marshall with Police Chief. Such a meeting is not intended to fulfill any collective bargaining obligations that may arise pursuant to MGL c 150E.


#455 – AMERICAB REGARDING PROTOCOL FOR DRIVERS

        Councillor Legault introduced the following Order which was adopted.

        ORDERED: That the Committee on Ordinances, Licenses and Legal Affairs meet with the owners of Americab to discuss proper procedures for dispatchers and drivers when drivers are stopped by Law Enforcement Officials. Invited Solicitor, Police Chief or his representative and owners of Americab.



#456 – HOURS AT COMMUNITY GARDENS AT SPLAINE PARK

        Councillor Siegel introduced the following Order which was adopted.

        ORDERED: That the Committee on Ordinances, Licenses and Legal Affairs co-posted with the Committee of the Whole meet to discuss restricting hours of use relative to the Community Gardens at Splaine Park.



#457 – POLICIES AND PROCEDURES FOR HANDLING UNACCOMPANIED ILLEGAL IMMIGRANT CHILDREN AND IMPACT ON SALEM SCHOOLS

Councillor Siegel introduced the following Order which was adopted. Councillor Eppley was recorded as opposed.

        ORDERED: That the Committee of the Whole meet to discuss policies and procedures for handling unaccompanied illegal immigrant children and the potential impact on the Salem Schools, economy and public health and safety. Invited guest, the Mayor, the Superintendent of Schools, The Chief of Police and the Salem Health Agent.


#458 (#146, 35, 113) -  TAXI OPERATOR HEARING ON LICENSE DENIAL

Councillor O’Keefe offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation.

The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter of a Taxi Operator Hearing for Sandy Jaquez-Gil, has considered said matter and would recommend the license be denied.

Councillor O’Keefe offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation.

The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter of a Taxi Operator Hearing for John Leone, has considered said matter and would recommend approval of the license.


#460 (#390) – APPROPRIATION TO MAYOR’S CONTRACTED SERVICES

Councillor Gerard offered the following report for the Committee on Administration and Finance co-posted with Committee of the Whole. It was voted to accept the report. Councillor Siegel and O’Keefe were recorded as opposed.

        The Committee on Administration and Finance co-posted with Committee of the Whole       
to whom was referred the matter of a $10,000.00 appropriation from Fund Balance Free Cash to Mayor – Contracted Services has considered said matter and would recommend that the matter be referred back to the Committee on Administration and Finance.

#461 (#406, 274) – ORDINANCE AMENDING ZONING FOR BREWERIES, TASTING ROOMS

Councillor McCarthy offered the following report for the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee of the Whole to whom was referred the matter of the Planning Board’s recommendation relative to the Zoning Ordinance Amendment regarding “Tasting Rooms” has considered said matter and would recommend that the Ordinance be amended by changing in the Table of Use change the Y to BA. The Ordinance was adopted for first passage as amended by roll call vote of 10 yeas, 0 nays, 1 absent.

Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel and McCarthy were recorded as voting in the affirmative. Councillor Turiel was recorded as absent.

        The matter of second and final passage of an Ordinance amending Traffic Ch. 42, Sec. 51 “Parking Prohibited Certain Streets, Franklin Street, was then taken up. It was adopted for second and final passage.
