A Regular Meeting of the City Council held in the Council Chamber on Thursday,
February 27, 2014 at 7:00 P.M., for the purpose of transacting any and all business. Notice of this meeting was posted on February 20, 2014 at 5:00 P.M.  This meeting is being taped and is live on S.A.T.V.   

        
       Councillor Sargent was recorded as absent.

       Council President  McCarthy presided.


Councillor Furey moved to dispense with the reading of the record of the previous meeting.
      It was so voted.


President McCarthy requested that everyone please rise to recite the Pledge of Allegiance.

(#47) HEARING TO INSTALL CONDUIT ON BRIDGE/BOSTON & GOODHUE STS.

A hearing was continued on the petition from National Grid to install conduits and remove poles on Bridge/Boston/Goodhue Streets.

Appearing in favor was Sabitah Mahabier-Sheehy representative for National Grid. She stated this work needed to be done to provide service.

No on was recorded as opposed.

Councillor Eppley moved that the hearing be closed. It was so voted.

Councillor Eppley moved for Approval. It was so voted.



(#94) – HEARING TO INSTALL CONDUIT ON ESSEX STREET

        A hearing was continued on the petition from Comcast to install a conduit on Essex Street.

Appearing in favor was Tim Broderick representative for Comcast. He stated this work needed to be done to provide services.

No one was recorded as opposed.

Councillor Famico moved that the hearing be closed. It was so voted.

Councillor Famico moved for Approval. It was so voted.



(#95) – APPOINTMENT OF ROBERT MILLERICK TO BOARD OF ASSESSORS

Held from the last meeting the Mayor’s appointment of Robert Millerick, 4 Gallows Circle, to serve as a member on the Board of Assessors with a term to expire on March 1, 2017, was confirmed by a roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Siegel, Turiel and McCarthy were recorded as voting in the affirmative. Councillor Sargent was recorded as absent.

Councillor Eppley requested and received unanimous consent to suspend the rules to allow Mr. Millerick to speak.

(#96) – APPOINTMENT OF JACQUELINE ENG TO CEMETERY COMMISSION

Held from the last meeting the Mayor’s appointment of Jacqueline Eng, 29 Fairmount Street, to serve as a member on the Cemetery Commission with a term to expire on February 1, 2016, was confirmed by a roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Siegel, Turiel and McCarthy were recorded as voting in the affirmative. Councillor Sargent was recorded as absent.

Councillor Gerard requested and received unanimous consent to suspend the rules to allow Ms. Eng to speak.


#132 – APPOINTMENT OF ROSALIE VELAZQUEZ AS COUNCIL ON AGING DIRECTOR

The Mayor’s appointment of Rosalia Velazquez to serve as the City of Salem’s Director of the Council on Aging with a term to expire on January 31, 2016, was held under the rules until the next meeting of March 13, 2014.

The Mayor’s reappointment of Christopher Burke to serve as a Constable with a term to expire on November 24, 2014, was received and placed on file.


#133A – CONSTABLE

The Mayor’s reappointment of Antonio Vieira to serve as a Constable with a term to expire on February 7, 2017, was received and placed on file.



#134 – MASSWORKS INFRASTRUCTURE PROGRAM FOR GROVE STREET

        The following Order recommended by the Mayor was adopted.
                                                                                         
ORDERED: That the City Council hereby approves acceptance of MassWorks Infrastructure Program funding in the amount of $1,275,000.00 for Grove Street Improvement Project.

                



#135 – HISTORIC PRESERVATION RESTRICTION FOR DICKSON MEMORIAL CHAPEL

The following Order recommended by the Mayor was adopted by a roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Siegel, Turiel and McCarthy were recorded as voting in the affirmative. Councillor Sargent was recorded as absent.

ORDERED: Authorize the Mayor to convey a perpetual historic preservation restriction for the Dickson Memorial Chapel located at 57 Orne Street, and having a property Assessor’s parcel identification number of 27_0571, to the Commonwealth of Massachusetts, by and through the Massachusetts Historical Commission, on such terms and conditions, and for such consideration, as deemed appropriate, as a stipulation of a Massachusetts Preservation Projects Fund (MPPF) grant application to make improvements to the structure.



#136 – DISCONTINUANCE OF A PORTION OF UNION STREET

        A hearing was ordered  for March 13, 2014 on the petition recommended by the Mayor to discontinue a portion of Union Street requested by M/R Rockett Management Corp.



#137 – PORTRAIT OF PRESIDENT GEORGE WASHINGTON BE MOVED

Councillor Milo introduced the following Order which was adopted.

ORDERED: That the City Council, together with the efforts of the Building and Planning Departments, explore the process of having the portrait of President George Washington moved back to the City Council Chambers and the matter be referred to the Committee on Government Services for their review and recommendation.



#138 – ORDINANCE AMENDING CH. 2, SEC. 2-142 COMPENSATION OF THE MAYOR


Councillor Turiel introduced the following Ordinance which was adopted for first passage by a roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Siegel, Turiel and McCarthy were recorded as voting in the affirmative. Councillor Sargent was recorded as absent.


In the year two thousand and fourteen

An ordinance to amend an ordinance relative to the Compensation of the Mayor

Be it ordained by the City Council of the City of Salem as follows:

Section 1. Chapter 2, Division 2, Mayor by deleting Section 2-142 (a) in it’s entirety and replace it with the following:

        Section 2-142 Compensation

  • Effective January 1, 2015, the Mayor shall receive a salary of $120,000.00 per annum.
Section 2. This ordinance shall take effect as provided by City Charter.

#140 – (#105) APPROPRIATION FOR IMPROVEMENT AT SPLAINE PARK

Councillor Turiel offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of an appropriation in the amount of $357,975.00 from Capital Outlay – Renovation and Repairs to be expended for soil remediation and improvement at Splaine Park has considered said matter and would recommend adoption.


#141 – (#98) APPROPRIATION FOR RESTORATION OF TOWN PUMP FOUNTAIN

Councillor Turiel offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

to whom was referred the matter of an appropriation in the amount of $84,000.00 from Capital Outlay – Renovation and Repairs for the restoration of the Town Pump Fountain has considered said matter and would recommend adoption.


#142 – (#95 of 2013 & #138 of 2014) ORDINANCE AMENDING MAYOR’S COMPENSATION

Councillor Turiel offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of the Mayor’s Compensation and increasing the amount to $120,000.00 has considered said matter and would recommend adoption.


#143 – (#112) COMPENSATION OF THE CITY COUNCIL

Councillor Turiel offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.


The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of discussing amending an ordinance relative to the Council Compensation Ch.2 Sec. 271 has considered said matter and would recommend the matter be discharged from committee.

                                                        
#144 – (#106) APPROPRIATION FOR ELECTRICAL STREET LIGHTS

Councillor Turiel offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Administration and Finance co-posted with the Committee to whom was referred the matter of an appropriation in the amount of $200,000.00 from Fund Balance – Free Cash to Electrical Street Light Account has considered said matter and would recommend Adoption.



#145 – PETITION FROM KENNETH SAWICKI ON RULES OF THE COUNCIL AND PUBLIC SAFETY CONCERNS

The petition from Kenneth Sawicki to meet with City Council regarding the rule preventing members of the public from speaking before the City Council and the matter of public safety and concerns given the state of economic conditions was referred to the Committee of the Whole.


#146 – HEARING REQUEST ON REVOCATION OF TAXI OPERATOR LICENSE

A request from Sandy Jacquez-Gil for a hearing on the revocation of his taxi operator license was referred to the Committee on Ordinances, Licenses and Legal Affairs to hold an executive session.

The matter of second and final passage of an Ordinance relative to Council on Aging Director Chapter 2 Sec. 2-593 (f) and 2-836 was then taken up. It was adopted for second and final passage.


(#62) SECOND PASSAGE ORDINANCE RELATIVE TO NON-DISCRIMINATION

The matter of second and final passage of an Ordinance creating a new Article, Ch. 2, Article XVI Non-Discrimination Policy Sec.2- 2055  through 2-2057 was then taken up. It was adopted for second and final passage.
