A Regular Meeting of the City Council held in the Council Chamber on Thursday,
January 23, 2014 at 7:00 P.M., for the purpose of transacting any and all business. Notice of this meeting was posted on January 17, 2014 at 10:12 A.M.  This meeting is being taped and is live on S.A.T.V.   

        
       All Councillors were present.

       Council President  McCarthy presided.


Councillor Milo moved to dispense with the reading of the record of the previous meeting. It was so voted.

    President McCarthy requested that everyone please rise to recite the Pledge of Allegiance.

A motion to suspend the rules to allow Mr. Sawicki to speak was denied by a roll call vote of 5 yeas, 6, nays, 0 absent. Councillors Eppley, Legault, Sargent, Siegel and McCarthy were recorded as voting in the affirmative. Councillors Famico, Furey, Gerard, Milo, O’Keefe and Turiel were recorded as voting in the negative.

The hearing was tabled as no representative from National Grid was present.




(#5)- APPOINTMENT OF WILLIAM GRISET TO THE PLANNING BOARD

Held from last meeting, Mayor’s appointment of William Griset, Jr., 153 Fort Avenue, Salem, to serve as a member of the Planning Board with a term to expire on December 14, 2014, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel, Turiel and McCarthy were recorded as voting in the affirmative.

Counicillor O’Keefe requested and received unanimous consent for suspension of the rules to allow Mr. Griset to speak.

(#6) – APPOINTMENT OF PETER COPELAS TO ZONING BOARD OF APPEALS

Held from last meeting, Mayor’s appointment of Peter Copelas, 40 Warren Street, Salem, to serve as an alternate member of the Zoning Board of Appeals with a term to expire on June 1, 2015 was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel, Turiel and McCarthy were recorded as voting in the affirmative.

Councillor Famico requested and received unanimous consent for suspension of the rules to allow Mr. Copelas to speak.
        

#48 – APPOINTMENT OF ABIGAIL BUTT TO THE COUNCIL ON AGING BOARD

The Mayor’s appointment of Abigail Butt to serve as a member of the Salem Council on Aging with a term to expire on March 1, 2017, held under the rules until the next meeting of February 13, 2014.

#49 – REAPPOINTMENT OF JOHN JODOIN TO THE DISABILITIES COMMISSION

The Mayor’s re-appointment of John Jodoin to serve on the Salem Disabilities Commission with the term to expire on March 1, 2017 was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel, Turiel and McCarthy were recorded as voting in the affirmative.


#50 – LETTER FOR ADDRESS CHANGE ON APPOINTMENT OF MICHAEL CAGGIANO

A letter to amend an address of Salem Parking Board re-appointee, Michael Caggiano, from his work address of 16 Front Street to his current home address of 14 Patton Road was received and placed on file.

The Mayor’s re-appointment of Mark McGrath to serve as a Constable with a term to expire on January 22, 2017, was received and placed on file.


#54 – TRANSFER FOR REPAIRS TO PARKING GARAGES

        The following Order recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED:        That the sum of Twenty-five Thousand, Three Hundred and Eighty Dollars ($25,380.00) is hereby appropriated within the “Capital Outlay Renovation and Repair” account to be expended for repair of the water damage at the South Harbor and Museum Place parking garages in accordance with the recommendation of Her Honor the Mayor.


#55 – APPROPRIATION TO RETIREMENT STABILIZATION VACATION / SICK LEAVE BUYBACK ACCOUNT

        The following Order recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED: That the sum of Ten Thousand, One Hundred and Sixty-one Dollars and Seventy-Eight Cents ($10,161.78) is hereby appropriated in the “Retirement Stabilization Vacation/Sick Leave Buyback” account to be expended for the retirement of Bela Grenader employee of the Parking Garage in accordance with the recommendation of Her Honor the Mayor.





#56 – APPROPRIATION TO RETIREMENT STABILIZATION VACATION /SICK LEAVE BUYBACK ACCOUNT

The following Order recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED: That the sum of Eight Thousand, Three Hundred and Twenty Dollars and Seventy-one Cents ($8,320.71) is hereby appropriated in the “Retirement Stabilization Vacation/Sick Leave Buyback” account to be expended for the retirement buyback of Gloria Merrill employee of the Parking Garage in accordance with the recommendation of Her Honor the Mayor.



#57 – DONATION FOR SALEM POLICE DEPARTMENT K-9 DONATION FUND

        The following Order recommended by the Mayor, was adopted.

        ORDERED: To accept the donation listed below in the amount of Two Thousand One Hundred and Forty-Three Dollars ($2,143.00). These funds will be deposited into the Salem Police Department K-9 Donation Fund as listed in accordance with the recommendation of Her Honor the Mayor.



#58 – DONATION FOR FIRE DEPARTMENT DONATION FUND

The following Order recommended by the Mayor, was adopted.

        ORDERED: To accept the donation in the amount of One Thousand Five Hundred Dollars ($1,500.00). These funds will be deposited into the Salem Fire Department Donation Fund to be used to purchase additional licenses for the Firehouse inspection software in accordance with the recommendation of Her Honor the Mayor.



#59 – ACCEPT MASS. GENERAL LAW CH. 32 SEC. 20 (4) (h) COMPENSATION FOR THE CITY TREASURER

The following Order recommended by the Mayor, was adopted by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel, Turiel and McCarthy were recorded as voting in the affirmative.


        ORDERED: The city hereby accepts Massachusetts General Laws Ch. 32 Section 20(4) (h) to allow the City Treasurer to be compensated for services rendered as custodian of the funds of the Salem Contributory Retirement System. Section 20 (4) (h) provides that the compensation for such services shall not be more than three thousand dollars per annum and shall be payable from the expense of the system.

#60 – AUTHORIZED MAYOR FOR SALE OF SURPLUS LAND OFF TECHNOLOGY WAY

The following Order recommended by the Mayor, was adopted by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel, Turiel and McCarthy were recorded as voting in the affirmative.

ORDERED: The Mayor is hereby authorized to convey a 20,226 square foot parcel of surplus land on Technology Way as shown on the attached plan entitled “Roadway Abandonment and Layout Plan of Land in Salem, Mass.” Dated June 10, 2013, (hereinafter the “Plan”) and declared surplus property by the City Council on September 26, 2013 to KAK Realty Trust, Anthony Klein, Trustee, for the sum of $1.00, the conveyance to the City of 4,033 square foot portion of land as shown on the Plan and the construction of a cul-de-sac as shown on the Plan to be constructed in accordance with the bid from KAK Realty Trust dated November 27, 2013, a copy of which is attached to this Order.

Be it further that in accordance with City Ordinance Chapter 2, Section 2-1635, the City Council hereby finds that the sale of such land to an abutter will provide the use most compatible with the surrounding neighborhood.


#61 – HOME RULE PETITION TO REMOVE CIVIL SERVICE RESTRICTION FOR CHIEF OF POLICE & FIRE CHIEF

        The following Order recommended by the Mayor, was referred to the Committee of the Whole.

ORDERED: That a petition to the General Court, accompanied by a bill as set forth below removing the police chief/city marshal and fire chief positions from civil service notwithstanding the provisions of chapter 31 of the General Laws, chapter 245 of the Acts of 1924 or any other special or general law to the contrary, be filed with an attested copy of this Order be, and hereby is, approved under Clause (1) of Section 8 of Article 2, as amended, of the Amendments to the Constitution of the Commonwealth of Massachusetts, to the end that the following legislation be adopted, except for amendments by the Senate or House of Representatives which conform to intent of this home rule petition:

AN ACT exempting the police chief/city marshal and fire chief from the civil service law.

        Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding chapter 245 of the Acts of 1924 or any other special or general law to the contrary, the police chief/city marshal and fire chief positions in the City of Salem shall be exempt from chapter 31 of the General Laws
SECTION 2. Section 1 shall not impair the civil service status of the person holding the position of fire chief or police chief/city marshal in the City of Salem on the effective date of this Act.
SECTION 3. This act shall take effect upon its passage.



#62 – ORDINANCE RELATIVE TO NON-DISCRIMINATION

        The following Ordinance recommended by the Mayor was referred to the Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole.

        In the year two thousand and fourteen

        An Ordinance to amend an Ordinance relative to non-discrimination

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. Chapter 2  Administration is hereby amended by adding a new Article as follows:

        “ARTICLE XVI. Non-Discrimination Policy

        Sec. 2-2055. Purpose and Intent

It is the finding of the City of Salem that no individual should be denied equal treatment or opportunity as a result of his or her age, ancestry, color, disability, family status, gender identity or expression, military status, marital status, national origin, race, religion, sex or sexual orientation.  

Sec. 2056. Policy       

It is the policy of the City of Salem to uphold the human rights of all persons in Salem and the free exercise and enjoyment of any and all rights and privileges secured by the Constitutions, Laws, Ordinances and Regulations of the United States, the Commonwealth of Massachusetts and the City of Salem. As such, actions that my deny or tend to deny to an individual equal access or opportunity in matters of housing, employment, education, municipal services, contracts, purchasing or public accommodations on the basis of: age, ancestry, color, disability, family status, gender identity or expression, military status, marital status, national origin, race, religion, sex or sexual orientation, are hereby prohibited.

Sec. 2057. Enforcement

The Licensing Board shall hear and determine a complaint of a violation by a private individual of this section as it relates to public accommodations and may issue fines for a violation of this section as it relates to public accommodations pursuant to Chapter 1 § 1-10 of the City of Salem Code of Ordinances; provided, however, that nothing set forth herein is intended to alter or limit the authority of the Licensing Board or any other municipal employee, officer, board, commission, authority or agent pursuant to any federal, state or local statute, regulation or ordinance.”

Section 2. This ordinance shall take effect as provided by city charter.



#63 – ORDINANCE TRAFFIC TOW ZONE FLINT STREET

        The following Ordinance recommended by the Mayor was referred to the Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole.

        In the year two thousand and fourteen

        An Ordinance to amend an Ordinance relative to Traffic

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. Chapter 42, Section 74 General Prohibitions Towing Zones, is hereby amended inserting the following new no parking tow zone:

        Flint Street, both sides between Mason and Oak Streets, General Prohibition, Towing Zone.

Section 2. This ordinance shall take effect as provided by City Charter.

#67 – ORDINANCE AMENDING TRAFFIC HANDICAP PARKING CABOT STREET

Councillor Turiel introduced the following Ordinance, which was adopted for first passage.

An Ordinance to amend and Ordinance relative to Traffic Ch. 42, Sec. 50B Handicap Parking Limited Time

Be it ordained by the City Council of the City of Salem as follows:

Section 1. Cabot Street in front of #33 for a distance of twenty feet. Handicapped Parking

Section 2. This Ordinance shall take effect as provided by city charter.


#68 – ORDINANCE AMENDING TRAFFIC TOW ZONE NORTH STREET

Councillor Gerard introduced the following Ordinance, which was adopted for first passage.

In the year two thousand and fourteen

An Ordinance to amend and Ordinance relative to Traffic Ch. 42, Sec. 74 General Prohibition Tow Zone

Be it ordained by the City Council of the City of Salem as follows:

Section 1. North Street, easterly side of Commercial Street for a distance of one hundred eleven (111) feet as marked by signs, No Parking Tow Zone.

Section 2. This Ordinance shall take effect as provided by city charter.



#69 – CO-POST  ORDER #19 RELATIVE TO AN ORDINANCE FOR FINGERPRINTING FEES

        Councillor O’Keefe introduced the following Order which was adopted.

        ORDERED: That Council Order #19 of 2014 currently in the Committee on Ordinances, Licenses and Legal Affairs be co-posted with the Committee of the Whole. And that the matters of #670 of 2013 and #18 & #19 of 2014 be taken up in a meeting to be scheduled for Wednesday, January 29, 2014 at 6:00 P.M.

#72 – (#101A of 2013) SHOPPING CART ORDINANCE

Councillor O’Keefe offered the following report for the Committee on Ordinances, Licenses and Legal Affairs co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Ordinances, Licenses and Legal Affairs co-posted with the Committee of the Whole to whom was referred the matter of the Shopping Cart Ordinance has considered said matter and would recommend adoption for first passage.

In the year Two Thousand and Thirteen

An Ordinance to amend an Ordinance relative to Offenses and Miscellaneous Provisions.

Be it ordained by the City Council of the City of Salem, as follows:

Section I.      Chapter 24, Offenses and Miscellaneous Provisions is herby amended by adding a new section as follows:

“Chapter 24-28. Unattended and Abandoned Shopping Carts.
 
a) Litter.  A shopping cart left unattended and abandoned on public property for more than twenty-four hours shall, for the purpose of this section, be deemed litter.

b) Removal and Redemption.  The director of public services may cause any shopping cart left unattended and abandoned on public property and deemed litter to be removed to a designated location.  Owners may redeem said shopping carts upon proof of ownership and payment of all city costs which shall not exceed twenty –five dollars for each shopping cart removed and stored by the city.

c) Notice.  The director of public services shall give notice to the owner of a shopping cart, if known, that the city intends to remove the unattended and abandoned shopping cart if it is not removed from public property within twenty four hours after notice is provided.  Once the director of public services removes a shopping cart, the director must give notice, either in an electronic message or telephone call, to the named owner, if known, that the city has removed an unattended and abandoned shopping cart to a designated location along with the procedure and time schedule for reclamation of a shopping cart prior to disposal.

d) Identification.  All businesses located within the city that offer shopping carts to its customers shall place a distinguishing mark on each shopping cart to identify the shopping cart as belonging to that particular business.

e) Contact information.  All businesses located within the city that offer shopping carts to its customers shall provide the director of public services the name of a contact person or department, including a phone number and electronic mail address, responsible for receiving notices of unattended and abandon shopping carts.

f) Disposal.  Any shopping cart not redeemed within ten days after notice is given to the owner, if known, shall be disposed of by the director of public services as scrap metal.

g) Liability.   The City of Salem shall not be liable for any damage to unattended and abandoned shopping carts deemed litter pursuant to this section.

Section II.  This Ordinance shall take effect as provided by City Charter.

Councillor O’Keefe offered the following report for the Committee on Ordinances, Licenses and Legal Affairs co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Ordinances, Licenses and Legal Affairs co-posted with the Committee of the Whole to whom was referred the matter of Amending Section 58 of the City Charter relative to Mayor, election, term of office has considered said matter and would recommend adoption of a Home Rule Petition.

#74 – (#73, #74A, #26) AMENDING CHARTER VACANCIES IN THE OFFICE OF THE MAYOR

Councillor O’Keefe offered the following report for the Committee on Ordinances, Licenses and Legal Affairs co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Ordinances, Licenses and Legal Affairs co-posted with the Committee of the Whole to whom was referred the matter of Amending Section 59A of the City Charter relative to vacancies in the office of Mayor and council has considered said matter and would recommend adoption of a Home Rule Petition.


#74A – HOME RULE PETITION

ORDERED: That a petition to the General Court, accompanied by a bill as set forth below, be filed with an attested copy of this Order be and hereby is, approved under Clause (1) of Section 8 of Article 2, as amended, of the Amendments to the Constitution of the Commonwealth of Massachusetts, to the end that the following legislation be adopted, except for amendments by the Senate or House of Representatives which conform to intent of this home rule petition:

AN ACT relative to the Charter of the City of Salem

        Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The charter of the City of Salem, which is on file in the office of the archivist of the Commonwealth, as provided in section 12 of chapter 43B of the General Laws, is hereby amended, in accordance with the majority vote on November 2, 1999 in the affirmative to change the term of office of the Mayor to a four-year term, by striking out Section 58 and inserting in place thereof the following section:



        Section 58. Mayor as chief executive officer; election; term of office.

        There shall be a mayor, elected by and from the qualified voters of the city, who shall be the chief executive officer of the city. The Mayor shall hold office for the term of four years from the first Monday in January following his or her election and until his or her succe3ssor is qualified.

SECTION 2. The charter of the City of Salem is hereby further amended by striking out the first two paragraphs of Section 59A and inserting in place thereof of the following two new paragraphs:

        Section 59A. Vacancies in office of mayor and council; procedure for filling.

        If a vacancy occurs in the office of mayor by death, removal or resignation during the first through thirty-sixth months of the term ending on December thirty-first for which the mayor was elected, the city clerk shall forthwith order an election to fill such vacancy for the remainder of the unexpired term. Such election may be held at the time of the regular municipal election so long as the vacancy does not occur more than six months prior to the regular municipal election. Until such time of said election, the city council shall hold a meeting to elect by majority vote one of its members as acting mayor until a candidate for mayor is elected and the election results are certified. If the city council fails so to elect at said meeting or within thirty days thereafter, the president of the city council shall become acting mayor, shall exercise all the rights and powers of mayor and shall be sworn to the faithful discharge of his or her duties. The candidate for mayor elected at such election shall take office immediately upon the certification of the results of the election.

        If a vacancy occurs during the thirty-seventh month beginning January first through the end of the term for which the mayor was elected, a meeting shall be held by the city council to elect by majority vote one of its members as acting mayor for the remainder of the unexpired term. If the city council fails so to elect at said meeting or within thirty days thereafter, the president of the city council shall become acting mayor, shall exercise all the rights and powers of mayor and shall be sworn to the faithful discharge of his or her duties.

SECTION 3.  This act shall take effect upon its passage.


#75 – (#16) ORDINANCE PROHIBITED SMOKING ON THE OFF-ROAD BIKE PATH

Councillor O’Keefe offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation.

The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter of an Ordinance Ch. 24 Sec. 16, relative to Prohibited Smoking on the off-road bike path has considered said matter and would recommend the matter remain in committee.
#77 – (#12) APPROPRIATION TO VARIOUS ENGINEERING ACCOUNTS

        Councillor Turiel offered the following report for the Committee on Administration and Finance co-posted with Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of a $150,000 appropriation from retained earnings water/sewer to various Engineering accounts has considered said matter and would recommend approval.


#78 – (#28) SUPPLEMENTAL BUDGET FOR SPLAINE PARK

Councillor Turiel offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

#79 – FINANCIAL REPOT FOR FISCAL YEAR 2014 BY POWERS & SULLIVAN LLC

The Finance Director submitting the Annual Financial Report for Fiscal Year 2013 and Financial Statements audited by Powers & Sullivan LLC was received and placed on file.



#80 – BOND ORDER $2,000,000  REPURPOSED FOR VARIOUS ROADWAY IMPROVEMENTS

        The Finance Director submitting the following Bond Order due to procedural error that was done May 23, 2013. It was adopted under suspension of the rules for first passage by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Eppley, Famico, Furey, Gerard, Legault, Milo, O’Keefe, Sargent, Siegel, Turiel and McCarthy were recorded as voting in the affirmative.

BOND ORDER: rescind a Two Million Dollar ($2,000,000) portion of the appropriation that was authorized to be borrowed on March 28, 2013 in the amount of $5,900,000 for the Canal Street Utility Program. The $2,000,000 to be repurposed for various roadway improvements.




#81 – CONDUIT ON ESSEX STREET

A hearing was ordered for February 13, 2014 on the petition from Comcast to install a conduit on Essex Street.
