A Regular Meeting of the City Council held in the Council Chamber on Thursday,
April 11, 2013 at 7:00 P.M., for the purpose of transacting any and all business. Notice of this meeting was posted on April 4, 2013 at 4:23 P.M.  This meeting is being taped and is live on S.A.T.V.   

        
       Councillor O’Keefe was recorded as arriving at 7:05 PM

       Council President Ryan presided.

Councillor  Carr moved to dispense with the reading of the record of the previous meeting.
 It was so voted.

#260 – APPROPRIATION TO VETERANS – BENEFITS ACCOUNT

        The following Order recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

ORDERED: That the sum of Sixty Thousand Dollars ($60,000.00) is hereby appropriated from the “Fund Balance – Free Cash” account to “Veterans – Benefits” account in accordance with the recommendation of Her Honor the Mayor.

                




        #261 – APPROPRIATION TO FUND RETIREMTN BUYBACK COSTS OF NEWLY NEGOTIATED SICK LEAVE BUYBACK PROVISION

The following Order recommended by the Mayor, was adopted under suspension of the rules.

ORDERED: That the sum of Fifty Thousand Dollars ($50,000.00) is hereby appropriated in the “Retirement Stabilization Fund – Vacation/Sick Leave Buyback” account to be expended for the newly negotiated sick leave buyback provision as needed in accordance with the recommendation of Her Honor the Mayor.


#262 – APPROPRIATION TO DPS- GASOLINE / DIESEL FUEL ACCOUNT

The following Order recommended by the Mayor, was adopted under suspension of the rules.

ORDERED: That the sum of Twenty-Five Thousand Dollars ($25,000.00) is hereby appropriated from the “Fund Balance – Free Cash” account to “DPS – Gasoline/Diesel Fuel” account in accordance with the recommendation of Her Honor the Mayor.

                                
#263 – APPROPRIATION TO DPS – GASOLINE / DIESEL FUEL ACCOUNT

The following Order recommended by the Mayor, was adopted under suspension of the rules.

ORDERED: That the sum of Twenty-Five Thousand Dollars ($25,000.00) is hereby appropriated from the “Retained Earnings – Sewer Fund” account to the “DPS – Gasoline/ Diesel Fuel” account in accordance with the recommendation of Her Honor the Mayor.


#264 – ACCEPT DONATION FROM FOOTPRINT POWER AND CITY OF LYNN

The following Order recommended by the Mayor, was adopted.

ORDERED: To accept donations listed below in the amount of Four Thousand Dollars ($4,000.00). These funds will be deposited into the Salem Police Department Summer Camp Fund as listed in accordance with the recommendation of Her Honor the Mayor.

#265 – ACCEPT DONATION FROM PEABODY POLICE DEPARTMENT

The following Order recommended by the Mayor, was adopted.

ORDERED: To accept donation from Peabody Police Department in the amount of Three Thousand Five-Hundred Dollars ($3,500.00)  to fund the summer camp program. These funds will be deposited into the Police Department Summer Camp Donation Fund in accordance with the recommendation of Her Honor the Mayor.


#266 – AUTHORIZE SUBMISSION OF CITY OF SALEM’S APPLICATION FOR FEDERAL ASSISTANCE TO HUD FOR COMMUNITY BLOCK GRANT FUNDS

The following Order recommended by the Mayor, was adopted by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Turiel, Sosnowski, Siegel, Sargent, Prevey, McCarthy, Legault, O’Keefe, Furey, Carr and Ryan were recorded as voting in the affirmative.

ORDERED: That the City Council hereby approves the submittal of the City of Salem’s application for Federal Assistance to the United States Department of Housing and Urban Development (HUD) for Community Block Grant (CDBG) funds for the period of July 1, 2013 through June 30, 2014 in the amount determined by HUD’s formula entitlement allocation ($858,641 estimated).

                                

#267 – APPROVE CHAPTER 121A DESIGNATION FOR SALEM HEIGHTS PRESERVATION ASSOCIATES, LIMITED PARNERSHIP

The following Order recommended by the Mayor, was to schedule a joint public hearing with the Planning Board.

ORDERED: That the City Council approve the Chapter 121A designation for Salem Heights Preservation Associates, Limited Partnership effective upon the expiration of the current 121A designation, which expires on March 26, 2013, and approve a 25-year extension to the initial 15-year period of exemption from property taxation and long term affordable housing restrictions that encumber the Project subject to approval of the Massachusetts Department of Housing and Community Development.

Be it further Ordered, that the Mayor be authorized to enter into the 121A Agreement on behalf of the City.




#268 – ORDINANCE TRAFFIC PARKING TIME LIMITED, UNMETERED ZONES, WASHINGTON SQUARE NORTH

Councillor Sosnowski introduced the following Ordinance, which was adopted for first passage.

In the year two thousand and Thirteen

An Ordinance to amend an Ordinance relative to Traffic, Chapter 42 Section 57A, Parking Time Limited, Unmetered Zones.

Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Washington Square North, west side, beginning at the corner of Kimball Court and continuing in a northeasterly direction, ending at the corner of Williams Street two (2) hour parking limit. “Parking Time Limited, Unmetered Zones”

Section 2. This Ordinance shall take effect as provided by City Charter.



#269 – HOME RULE PETITION TO REDUCE THE NUMBER OF MEMBERS OF THE BOARD OF HEALTH

        Councillor Furey introduced the following Order, which was adopted.

        ORDERED: That a request to the Committee on Public Health, Safety and Environment co-posted with Committee of the Whole meet to discuss a Home Rule Petition for submission to the Massachusetts Legislature to repeal the Special Act, Chapter 654 of the Acts of 1972. The repeal will effectively reduce the size of the Salem Board of Health to three (3) members keeping with M.G.L. Chapter 111-25. Invited City Solicitor, Health Agent, members of the Board of Health and Mayor or her representative.

#271 – (#200) APPROPRIATION TO COVER TEACHER CONTRACTUAL INCREASES

Councillor Prevey offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of an Appropriation of $380,000.00 from the “Stabilization Fund” to “School Collect Bargaining Reserve” to cover FY2013 Teachers contractual increases has considered said matter and would recommend approval.


#272 – (#201) APPROPRIATION TO POLICE PATROLMEN ACCOUNTS FOR CONTRACTUAL INCREASES

Councillor Prevey offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of an Appropriation of $143,003.00 from “Fund Balance – Free Cash” account to various Police Patrolmen accounts to cover FY2013 contractual increases has considered said matter and would recommend approval.


#273 – (#202) APPROPRIATION TO AFSCME 1818 FOR CONTRACTUAL INCREASES

Councillor Prevey offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

Councillor Prevey offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

       The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of a Transfer of $10,252.00 from “Water CIP 2009 Prinicipal” account to cover FY2013 Water AFSCME 1818 contractual increases has considered said matter and would recommend approval.

Councillor Prevey offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of a Transfer of $10,252.00 from “Sewer CIP 2009 Prinicipal” account to cover FY2013 Sewer AFSCME 1818 contractual increases has considered said matter and would recommend approval.

The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of an appropriation of $8,924.50 from “Fund Balance – Free Cash” account to “Inspectional Services – Emergency Demo/Rep” account has considered said matter and would recommend approval.


#281 – (#210) BOND ORDER FOR CANAL STREET UTILITY PROGRAM PROJECTS

Councillor Prevey offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation. It was adopted for first passage by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Turiel, Sosnowski, Siegel, Sargent, Prevey, McCarthy, Legault, O’Keefe, Furey, Carr and Ryan were recorded as voting in the affirmative.

The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of a Bond Order in the amount of $5,900,000.00 for Canal Street Utility Program projects has considered said matter and would recommend adoption.

Councillor Turiel offered the following report for the Committee on Community and Economic Development co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Community and Economic Development co-posted with the Committee of the Whole to whom was referred the matter of Footprint Power’s Presentation regarding the redevelopment of the Salem Harbor Station has considered said matter and would recommend the matter remain in Committee.

Councillor Turiel moved to take from the table the following Committee report. It was so voted.


Councillor Ryan offered the following report for the Committee of the Whole. It was voted to accept the report.  

The Committee of the Whole to whom was referred the matter of an Ordinance amendment relative to Solid Waste – Mandatory Recycling has considered said matter and would recommend that the ordinance be adopted for first passage.

Councillor McCarthy moved that the matter be referred back to the Committee of the Whole. It was so voted.
