A Regular Meeting of the City Council held in the Council Chamber on Thursday,
May 9, 2013 at 7:00 P.M., for the purpose of transacting any and all business. Notice of this meeting was posted on May 2, 2013 at 5:32 P.M.  This meeting is being taped and is live on S.A.T.V.   

        
       All Councillors were present.

       Council President Ryan presided.


Councillor  Legault moved to dispense with the reading of the record of the previous meeting.
It was so voted.


President Ryan requested that everyone please rise to recite the Pledge of Allegiance.

(#299) – APPOINTMENT OF LYNDA COFFILL TO COUNCIL ON AGING

Held from the last meeting the Mayor’s appointment of Lynda Coffill to the Council of Aging with a term to expire on April 25, 2016 was held until the next meeting.


(#300) – APPOINTMENT OF JANE TURIEL TO HISTORICAL COMMISSION

Held from the Mayor’s appointment of Jane Turiel to the Historical Commission as an alternate with a term to expire on April 25, 2016, was confirmed by roll call vote of 10 yeas, 0 nays, 0 absent, 1 present. Councillors Sosnowski, Siegel, Sargent, Prevey, O’Keefe, McCarthy, Legault, Furey, Carr and Ryan were recorded as voting in the affirmative. Councillor Turiel was recorded as voting present.


        Councillor O’Keefe assumed the Chair.


#329 – APPOINTMENT OF GINA FLYNN TO LICENSING BOARD

The Mayor’s appointment of Gina Flynn to the Licensing Board with a term to expire on June 1, 2016, was held until an opinion is obtained from the City Solicitor.


        Councillor Ryan resumed the Chair.


#330 – REAPPOINTMENT OF DALE YALE TO PLANNING BOARD

The Mayor’s reappointment of the Dale Yale to serve as a member of the Planning Board with a term to expire on May 1, 2018, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Turiel, Sosnowski, Siegel, Sargent, Prevey, O’Keefe, McCarthy, Legault, Furey, Carr and Ryan were recorded as voting in the affirmative.

#334 – BOND ORDER FOR BERTRAM FIELD RENOVATION PROJECT

        The following Bond Order recommended by the Mayor, was adopted for first passage by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Turiel, Sosnowski, Siegel, Sargent, Prevey, O’Keefe, McCarthy, Legault, Furey, Carr and Ryan were recorded as voting in the affirmative.

ORDERED: that the sum of $1,900,000 be and hereby appropriated to pay for Bertram Field Renovation Project, and for the payment of all other costs incidental and related thereto, and that to meet this appropriation, the Treasurer, with the approval of the Mayor, is authorized to borrow said amount under and pursuant to Chapter 44, Section 7 and 8 of the General Laws, or pursuant to any other enabling authority and to issue and sell bonds of notes of the City therefore.

FURTHER ORDERED: That the Mayor and the Treasurer are each authorized to file an application to qualify under Chapter 44A of the Massachusetts General Laws any and all bonds of the City issued under and pursuant hereto, and to provide such information and execute such documents as may be required in connection therewith.




#335 – APPROPRIATION FOR VACATION/SICK LEAVE BUYBACK OF WILLIAM J. CONSONE Jr.

        The following Order recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED: That the sum of Nineteen Thousand and Fifty-Five Dollars and Seventy –Six Cents ($19,055.76) is hereby appropriated in the “Retirement Stabilization Vacation/Sick Leave Buyback” account to be expended for the retirement buyback of William J. Consone, Jr. of the School Dept. in accordance with the recommendation of Her Honor the Mayor.








#336 – APPROPRIATION TO “GOLF COURSE – RENTAL AND LEASE”

The following Order recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED: That the sum of Ten Thousand Dollars ($10,000.00) is hereby appropriated from the “Receipts Reserved – Golf Course” account to “Golf Course Rental & Lease Line” account in accordance with the recommendation of Her Honor the Mayor.



#337 – APPROPRIATION FOR REPAIR OF PARKING METER POLES

The following Order recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED: That the sum of Two Thousand Five Hundred Dollars ($2,500.00) is hereby appropriated within the  “Capital Outlay – Renovation & Repair” account to be expended for the repair of parking meter poles by the Parking Department in accordance with the recommendation of Her Honor the Mayor.


#338 – TRANSFER TO “PURCHASING FIXED COST TELEPHONE”

The following Order recommended by the Mayor, was adopted.

        ORDERED: That the sum of One Thousand Seven Hundred and Six Dollars ($1,706.00) is hereby transferred to “Purchasing Fixed Cost Telephone line” account from accounts listed below in accordance with the recommendation of Her Honor the Mayor.

#339 – ACCEPT DONATION FOR SALEM POLICE DEPT. SUMMER CAMP FUND

The following Order recommended by the Mayor, was adopted.

        ORDERED: To accept the donation in the amount of Five Thousand Dollars ($5,000.00). These funs will be deposited into the Salem Police Department Summer Camp Fund from GE Employees Good Neighbor Fund, in accordance with the recommendation of Her Honor the Mayor.


#340 – FY2014 CAPITAL PLAN FOR 2013 - 2017

Mayor submitting FY2014 Capital Improvement Plan for 2013 – 2017, was referred to the Committee on Administration and Finance co-posted with the Committee of the Whole.

#341 – MONTHLY FINANCIAL REPORT

        Councillor Prevey introduced the following Order, which was adopted.

        ORDERED: That the Monthly Financial Report dated March 31, 2013, be referred to the Committee on Administration and Finance.

#342 – ORDINANCE TRAFFIC HANDICAP PARKING ZONE, GENEVA STREET

Councillor Turiel introduced the following Ordinance, which was adopted for first passage.


        In the year two thousand and thirteen

        An Ordinance to amend an Ordinance relative to Traffic, Chapter 42 Section 50B, “Handicapped Zones, Limited Time”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. Geneva Street, in front of #1 for a distance of twenty (20) feet, “Handicap Parking, Tow zone”

        Section 2. This Ordinance shall take effect as provided by City Charter.
#343- ORDINANCE TRAFFIC HANDICAP PARKING ZONE, SUMMIT AVENUE

Councillor Turiel introduced the following Ordinance, which was adopted for first passage.


        In the year two thousand and thirteen

        An Ordinance to amend an Ordinance relative to Traffic, Chapter 42 Section 50B, “Handicapped Zones, Limited Time”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. Summit Avenue, westerly side starting at a point of twenty (20) feet from Leach Street and continuing in a southerly direction for twenty (20) feet, “Handicap Parking, Tow zone”

        Section 2. This Ordinance shall take effect as provided by City Charter.


#344 – REVIEW ZONING REQUIREMENTS FOR PAVING AND REPAVING AS IT PERTAINS TO LOW IMPACT DEVELOPMENT


Councillor Sosnowski introduced the following Order, which was adopted.

ORDERED: That the Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole meet to review zoning requirements for paving or repaving on new developments or redevelopments as it pertains to low impact development (LID) to help control storm water issues that cause city wide flood concerns. And that the following be invited, Building Inspector or his representative, City Planner, City Engineer, Dept. of Public Services Director , Salem Sound Coastal Watch, Senator Joan Lovely and Representative John Keenan.


#345 – APPOINT COUNCILLOR TO COMMUNITY PRESERVATION COMMITTEE

        Councillor Furey introduced the following Order, which was adopted.

        ORDERED: That the Committee of the Whole meet to discuss appointing two City Council members to the Community Preservation Committee.





#346 – (#230 - #231) TAXI OPERATOR

        Councillor Sosnowski offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation

The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter of  a taxi operator hearing for Eddy Mendez, has considered said matter and would recommend that the license be granted. Councillor Legault was recorded as opposed.


#347 – (#95) MAYOR’S COMPENSATION

Councillor Prevey offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation

The Committee on Administration & Finance co-posted with the Committee of the Whole to whom was referred the matter of the Mayor’s Compensation, has considered said matter and would recommend that the Mayor’s salary be increased to $105,000.00 and the matter be referred to the Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole to amend the Ordinance.


#348 – (#144) SCHOOL COMMITTEE COMPENSATION

Councillor Prevey offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation

The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of the School Committee Compensation, has considered said matter and would recommend that the salary be increased to $4,000.00 and the matter be referred to the Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole to amend the Ordinance.


#349 – (#314) VERIZON RESOLUTION

Councillor Sargent offered the following report for the Committee on Government Services co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation by roll call vote of 11 yeas, 0 nays, 0 absent. Councillors Turiel, Sosnowski, Siegel, Sargent, Prevey, O’Keefe, McCarthy, Legault, Furey, Carr and Ryan were recorded as voting in the affirmative.
The Committee on Government Services co-posted with the Committee of the Whole to whom was referred the matter of the Verizon Resolution, has considered said matter and would recommend approval.


#350 – (#174) PEDESTRIAN LIGHT ON BRIDGE STREET

Councillor Sargent offered the following report for the Committee on Government Services. It was voted to accept the report and adopt the recommendation

The Committee on Government Services to whom was referred the matter of the installation of Pedestrian Lights on Bridge Street, has considered said matter and would recommend that the City Engineer work with the traffic consultant to come up with a plan to make this crossing as safe as possible and follow all state and Federal laws.


        Councillor O’Keefe assumed the Chair.



#351 – (#136) MANDATORY RECYCLING ORDINANCE

Councillor Ryan offered the following report for the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

Tthe Committee of the Whole to whom was referred the matter of the Mandatory Recycling – Solid Waste Ordinance Amendment,  has considered said matter and would recommend adoption as amended for first passage.

#352 – REQUEST FOR VETERANS SQUARE AT NORMAN AND CROMBIE STREETS

A request from Kim Emerling, Veteran’s Agent, to name a Veterans Square after Private First Class Vincent Louis Ansaloni to be located at the intersection of Norman and Crombie Streets was adopted.

        The matter of second and final passage of an Ordinance relative to Traffic Resident Sticker Parking, Repeal Belleau Rd. from Zone B and West Circle from Zone B and insert in place Zone E- color red on both Belleau Rd. and West Circle, was then taken up. The Ordinance was adopted for second and final passage.
