MINUTES- 12-06-2012
“Know Your Rights Under the Open Meeting Law, M.G.L. Chapter 39 §23B, and
City Ordinance Sections 2-2028 through 2-2033.”

A Regular Meeting of the City Council held in the Council Chamber on Thursday,
December 6, 2012 at 7:00 P.M., for the purpose of transacting any and all business. Notice of this meeting was posted on November 29, 2012 at 5:43 P.M.  This meeting is being taped and is live on S.A.T.V.   

        
       Councillor Siegel was recorded as absent.

       Council President Lovely presided.


Councillor O’Keefe moved to dispense with the reading of the record of the previous meeting. It was so voted.


President Lovely requested that everyone please rise to recite the Pledge of Allegiance.

Councillor O’Keefe presented President Lovely with parting gifts from the City Council a gavel plaque and clock and he and other Councillors extended warm wishes in her new role as Senator.

#675 – MAYOR SUBMITTING A TAX CLASSIFICATION TRANSMITTAL LETTER FOR THE PUBLIC HEARING

        Communication from the Mayor submitting a Tax Certification Transmittal letter recommending maintaining the current 1.65 CIP split tax erate or 0.859091, was received and placed on file.

A Public Hearing on the issue of allocating the local property tax levy among the four (4) property classes for fiscal year 2013, and the residential, open space and small commercial exemption options, was held.





President Lovely turned the Public Hearing over to the Assessor Deborah Jackson who introduced the Board of Assessors. Board of Assessors present were Donald Bates, Damian Johnson, member Richard Jagolta was recorded as absent. Also present were Steven Cortez and Jim Bond of the Assessors Office.


        Deborah Jackson Assessor – stated we are here for the Classification which requires four votes, one for the residential factor which the recommendation is to keep it at 1.65, open space, small commercial exemption and residential exemption. She explained the terms. The Levy limit is calculated growth which has increased 2.5%. The amount needed to be raised by taxes is $74,879,216. This is $3,076,077 less than the levy limit. There were 825 sales utilized, 333 were condos, 288 single family homes, 140 multi-family, 29 commercial and 35 mixed use properties.

The average single family is valued at $284,800, condo are valued at $217,300.
The average single family bill will increase $71.00.

A two family average Assessment is $273,300.
A three family assessement is $295,200.
The average two or three family bill will increase $116.00. Two or three families make up 19% of residential properties.

1.65% has been adopted for the last 10 years. This 1.65 equals 85.9091. Residential $16.38 and Commercial $31.46


        Councillor Prevey asked can you speak about our assessments are low but taxes are high, how do we compare to surrounding communities?

        Debora Jackson stated they may have lower tax rate but the assessments are higher.

Councillor Lovely opened the Hearing to the Public for comment.

        Rinus Ooestook – stated compare commercial rate with other communities our are considerably higher. Please consider this.

        There was no further comment from the public.


Councillor McCarthy moved that the hearing be closed. It was so voted.




#676 – APPROPRIATION TO REDUCE THE GROSS AMOUNT TO BE RAISED BY TAXATION

        The following Order recommended by the Mayor was adopted under suspension of the rules.

        ORDERED: That the sum of One Million, Eight Thousand, One Hundred and Six Dollars is hereby appropriated from the following “Receipts Reserved for Appropriation” accounts to reduce the gross amount to be raised by taxation when the Fiscal Year 2013 tax rate is set in accordance with the recommendation of Her Honor the Mayor.

#677 – APPROPRIATION TO VETERANS BENEFITS


The following Order recommended by the Mayor was adopted under suspension of the rules.
        ORDERED: That the sum of Two Thousand Dollars ($200,000.00) is hereby appropriated from the “Fund Balance Reserved for Appropriations – Free Cash” account to the “Veterans – Benefits” account in accordance with the recommendation of Her Honor the Mayor.
                                                                        

#678 – APPROPRIATION TO HUMAN RESOURCES – WORKERS COMP. SALARIES


The following Order recommended by the Mayor was adopted under suspension of the rules.
        ORDERED: That the sum of Eighty-Eight Thousand Dollars ($88,000.00) is hereby appropriated from the “Fund Balance – Free Cash” account to “Human Resources – workers compensation Salaries” account in accordance with the recommendation of Her Honor the Mayor.









#679 – APPROPRIATION FOR VACATION/SICK LEAVE BUYBACK FOR RETIREMENT OF RICHARD RENNARD

The following Order recommended by the Mayor was adopted under suspension of the rules.
        ORDERED: That the sum of Forty Thousand Three Hundred and Seventy-Two Dollars and Seven Cents ($40,372.07) is hereby appropriated in the “Retirement Stabilization Fund – Vacation/Sick Leave Buyback” account to be expended for the retirement buyback for Richard Rennard, Dept. of Public Services in accordance with the recommendation of Her Honor the Mayor.


#680 – APPROPRIATION FOR REPAIRS TO MUSEUM PLACE GARAGE

The following Order recommended by the Mayor was adopted under suspension of the rules.
        ORDERED: That the sum of Twenty Thousand Dollars ($20,000.00) is hereby appropriated within the “Capital Outlay – Renovations & repairs” account to be expended to inspect Museum Place Garage for deficiencies in drainage and electrical issues for Parking Department in accordance with the recommendation of Her Honor the Mayor.


#681 – APPROPRIATION  TO DEPT. OF PUBLIC SERVICES – EQUIPMENT

The following Order recommended by the Mayor was adopted under suspension of the rules.
        ORDERED: That the sum of Thirty-One Thousand Seven Hundred and Twenty-Five Dollars ($31,725.00) is hereby appropriated from the “Receipts Reserved – Sale of Lots” account to the “Dept. of Public Services – Equipment” account in accordance with the recommendation of Her Honor the Mayor.


#682 – APPROPRIATION TO DEPT. OF PUBLIC SERVICES – EQUIPMENT

The following Order recommended by the Mayor was adopted under suspension of the rules.
        ORDERED: That the sum of Nine Thousand and Sixty Dollars and Seven Cents ($9,060.07) is hereby appropriated from the “Receipts Reserved – Sale of Vaults” account to the “Dept. of Public Services – Equipment” account in accordance with the recommendation of Her Honor the Mayor.


#683 - APPROPRIATION TO DEPT. OF PUBLIC SERVICES – VEHICLE REPAIR

The following Order recommended by the Mayor was adopted under suspension of the rules.
        ORDERED: That the sum of One Thousand, Nine Hundred and Ninety-Five Dollars ($1,995.00) from the “Receipts Reserved – Sale of Lots” account to the “Dept. of Public Services – Vehicle Repair” account in accordance with the recommendation of Her Honor the Mayor.


#684 – ACCEPT SEC. 4, CHAPTER 73 OF ACTS OF 1986 FOR ADDITIONAL TAX EXEMPTIONS

The following Order recommended by the Mayor was adopted by a roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Carr, Furey, O’Keefe, McCarthy, Prevey, Ryan, Sargent, Sosnowski, Turiel and Lovely were recorded as voting in the affirmative. Councillor Siegel was recorded as absent. A motion for immediate reconsideration in the hopes it would not prevail was denied.

ORDERED: That the Mayor and City Council accept the provisions of Section 4, Chapter 73 of the Acts of 1986 for Fiscal Year 2013, and that such additional exemptions granted be 100% of the statutory exemption amounts, provided all other qualifications specified in said Section 4, Chapter 73 of the Massachusetts General Laws are met.

        Councillor O’Keefe assumed the Chair. Councillor Lovely recused herself and left the Chamber due to a conflict.

#685 – AUTHORIZE GRANT OF EASEMENT TO JOSEPH D. CONLEY FOR PORTION OF BEACON AVENUE

The following Order recommended by the Mayor was adopted.

ORDERED: The Mayor is hereby authorized, on behalf of the City of Salem, to execute a Grant of Easement over a portion of Beacon Avenue to Joseph D. Conley and his successors in title. The purpose of this Grant of Easement is to allow Conley to maintain a side yard deck, as shown on a Mortgage Inspection Plan prepared by Boston Survey, Inc. dated November 8, 2012, that encroaches onto Beacon Avenue. The City Solicitor shall approve the Grant of Easement and associated Easement Plan prior to its execution.








#686 – RESIDENTIAL FACTOR

        Councillor McCarthy introduced the following Order, which was adopted by roll call vote of 9 yeas, 1 nay, 1 absent. Councillors Carr, Furey, O’Keefe, McCarthy, Ryan, Sargent, Sosnowski, Turiel and Lovely were recorded as voting in the affirmative. Counciloor Prevey was recorded as voting in the negative. Councillor Siegel was recorded as absent. A motion for immediate reconsideration in the hopes it would not prevail was denied.

        ORDERED: That the City of Salem adopt a Residential Factor of 85.9091% for fiscal year 2013.



#687 - OPEN SPACE EXEMPTION

Councillor McCarthy introduced the following Order, which was adopted by roll call vote of 10 yeas, 1 absent. Councillors Carr, Furey, O’Keefe, McCarthy, Prevey, Ryan, Sargent, Sosnowski, Turiel and Lovely were recorded as voting in the affirmative. Councillor Siegel was recorded as absent. A motion for immediate reconsideration in the hopes it would not prevail was denied.

ORDERED: That the City of Salem NOT adopt an OPEN SPACE EXEMPTION for Fiscal Year 2013

#690 – ORDINANCE TRAFFIC RESIDENT STICKER PARKING ORD STREET

Councillor Ryan introduced the following Ordinance, which was adopted for first passage.

In the year two thousand and twelve

An Ordinance to amend an ordinance relative to Traffic, Chapter 42 Section 75, “Parking Prohibitions Towing zones, Resident Sticker Parking”

Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Ord Street, both sides between Aborn Street and Butler Street, “Resident Sticker Parking, Tow Zone”.

Section 2. This Ordinance shall take effect as provided by City Charter.


#691 - ORDINANCE TRAFFIC HANDICAP PARKING, MARGIN STREET

Councillor Sosnowski introduced the following Ordinance, which was adopted for first passage.

In the year two thousand and twelve

An Ordinance to amend an ordinance relative to Traffic, Chapter 42 Section 50B, “Handicap Parking, Limited Time.

Be it ordained by the City Council of the City of Salem, as follows:



Section 1. Margin Street, in front of #108, for a distance of twenty (20) feet, “Handicap Parking, Tow Zone”.

Section 2. This Ordinance shall take effect as provided by City Charter.


#692 – ORDINANCE RELATIVE TO VEHICLE FOR HIRE FEES

Councillor Sosnowski introduced the following Ordinance, which was adopted for first passage.

In the year two thousand and twelve

An Ordinance to amend an ordinance relative to Chapter 44, Section 32 (c) Fees.

Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Chapter 44, Article II, Section 32 (c) Fees: is hereby amended by deleting the fee for a decal shall be $50.00 and replace with the fee for a decal shall be $100.00.

Section 2. This Ordinance shall take effect as provided by City Charter.


#693 - ORDINANCE TRAFFIC HANDICAP PARKING LIMITED TIME, REPEAL READ STREET

Councillor Sosnowski introduced the following Ordinance, which was referred to the Committee on Ordinances, Licenses and Legal Affairs.

In the year two thousand and twelve

An Ordinance to amend an ordinance relative to Traffic Chapter 42, Section 50B, Handicap Parking Zones, Limited Time

Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Repeal Read Street, in front of #10 for a distance of twenty (20) feet. “Handicap Parking, Tow Zone” (6/1/98)

Section 2. This Ordinance shall take effect as provided by City Charter.

ORDERED: That the moratorium on addition of monthly and yearly passes at the South Harbor Garage be extended for six more months.

Councillor Sosnowski offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation.

The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter of holding three hearings on the denial of a pedicab, public guide and taxi operator license, has considered said matter and would recommend that no further action be taken.


#703 – (#529) ATTORNEY GENERAL SETTLEMENT TO THE SCHOOL DEPT. REGARDING PROCUREMENT & BIDDING LAWS

Councillor Sosnowski offered the following report for the Committee on Ordinances, Licenses and Legal Affairs co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

The Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole to whom was referred the matter of a settlement by the Attorney General’s office relative to the School Department violation of Procurement and Bidding Laws, has considered said matter and would recommend that the matter remain in committee.

The Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole to whom was referred the matter of repealing a Zoning Ordinance relative to Business Park Development, has considered said matter and would recommend establishing an OLLA subcommittee to review language on PUD/BPD Ordinance and that the subcommittee be established in the new year.


#705 - #705A COMPREHENSIVE PARKING PLAN TRAFFIC ISSUES

Councillor Sosnowski offered the following report for the Committee on Ordinances, Licenses and Legal Affairs co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.


The Committee on Ordinances, Licenses and Legal Affairs co-posted with Committee of the Whole to whom was referred the matter of the Comprehensive Parking Plan, the matter of repealing Ch. 42 Sec. 57C – Traffic Repeal Monthly Zones on Dodge St., Gedney St., Norman St. and Holyoke Sq. and the matter of traffic ordinances relative to the Comprehensive Parking Plan has considered said matter and would recommend that the proposed amended traffic changes that were submitted by the Mayor and approved by the OLLA Committee be sent to the Solicitor to write the proper supportive traffic ordinances and then return to the committee to be reported out to the full Council

In the year two thousand and twelve

An Ordinance to amend an Ordinance relative to parking

Be it ordained by the City Council of the City of Salem, as follows:

Section I.  Amend Chapter 42, Section 57 Parking Time Limited: Hours of Operation by replacing the hours of “8:00 A.M. to 8:00 P.M.” as it appears in this Section with “8:00 A.M. to 6:00 P.M.”.

Section II. Amend Chapter 42, Section 57A Parking Time Limited: Unmetered Zones by replacing the hours of “8:00 A.M. to 8:00 P.M.” as it appears in this Section with “8:00 A.M. to 6:00 P.M.”.

Section III. Amend Chapter 42, Section 57C Parking Time Limited: Monthly Zones by

  • deleting the description associated with Gedney Street in its entirety.
  • deleting “Summer Street” and its associated description in its entirety.
  • Adding “Holyoke Square” and an associated description as follows “easterly side from Norman Street to Gedney Street.”

Section IV. Amend Chapter 42, Section 13 Service Zones by deleting the Service Zone at Congress Street described as “easterly side, for a distance of fifteen (15) feet from the southeasterly side of the bridge” and replacing it with “easterly side, for a distance of forty (40) feet from the southeasterly side of the bridge.”


Section V. Amend the table inset within Section 56: Zones Established of Chapter 42, Article V. Parking, Division 2. Parking Meters by




  • inserting two new rows at the end of the section entitled “Congress Street” as follows “westerly side from a point 155 feet south of intersection of Derby Street continuing for 220 feet. Four hour limit parking” and “easterly side from a point 330 feet south of the intersection of Derby Street continuing for 620 feet. Four (4) hour limit parking.
  • inserting a new street within this section entitled “Holyoke Square” with the following description “easterly side from Norman Street to Gedney Street. Four (4) hour parking.”
  • Amending the Church Street description which reads “southerly side, from a point beginning approximately three hundred and eighty (380) feet easterly from Washington Street extending easterly for a distance of one hundred and seventy (170) feet. Four (4) hour parking” by replacing the sentence “Four (4) hour parking” as it appears in this description with the sentence “Fifteen minute parking.”
  • Amending the Harbor Street description which reads “north and south sides, beginning at the intersection of Washington Street and running to the intersection of Lafayette Stree. Four (4) hour parking” by replacing the sentence “Four (4) hour parking” as it appears in this description with the sentence “Two (2) hour parking.”
  • Amending the Washington Street description which reads “northeast side from Harbor Street to curb cut into 251 Washington Street. Four hour parking.” as it appears in this section with the sentence “Two (2) hour parking.”
  • Amending the Lafayette Street description which reads “easterly side from Derby to Harbor Street (not including handicap zones or restricted areas), “Metered Zones Established” , four (4) hour limit.” By replacing the phrase “four (4) hour limit” as it appears in this description with the phrase “two (2) hour limit.”
  • Amending the Riley Plaza description which reads “west parking lot, second row of parking approximately forty-five (45) feet from northern most end of lot, the entire row will be one hour parking” and replace it with “west parking lot, firs and second row of parking approximately forty-five (45) feet from northern most end of lot, the entire rows will be one (1) hour metered parking, excluding handicap spaces.”
Section VI.  Amend Chapter 42, Section 50A; Handicapped Zones by deleting the Washington Street description which reads “easterly side, beginning at a point sixty-four (64) feet from the corner of Essex Street Mall and Washington Street and extending in a northerly direction for a distance of twenty (20) feet” and replacing it with a description which reads “easterly side, beginning at a point one hundred for (104) feet from the corner of Essex Street Mall and Washington Street and extending in a northerly direction for a distance of twenty (20) feet”.

Section VII. This Ordinance shall take effect as provided by City Charter.






#706 – (#413) STATUS OF SALEM FERRY

Councillor McCarthy offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

#707 – (#483) PARKING REVENUE COLLECTED BE APPLIED TO TAX LEVY

Councillor McCarthy offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.

#709 – (#337) CREATE ORDINANCE FOR LIMITS OF DENSITY VARIANCE ISSUED BY BOARD OF APPEALS

Councillor Ryan offered the following report for the Committee on Community and Economic Development co-posted with the Committee of the Whole. It was voted to accept the report and adopt the recommendation.


Committee on Community and Economic Development co-posted with the Committee of the Whole to whom was referred the matter of creating a City Ordinance that limits the variances issued by the Zoning Board of Appeals on density variances to no more than 120% of the original zoning laws has considered said matter and would recommend that the matter die.



#710 – (#653) ESTABLISHING A CPA WORKING GROUP

        Councillor Ryan offered the following report for the Committee on Community and Economic Development. It was voted to accept the report and adopt the recommendation.


       Committee on Community and Economic Development to whom was referred the matter of establishing a working group for the Community Preservation Act, has considered said matter and would recommend the matter was amended to have the makeup of the working group to include one of each of the three Salem Community Preservation Alliance members represent Historic Salem Inc., Affordable Housing and Recreation/Open Space, and three City Councillors, Councillor Ryan, Furey and Turiel.


#711 – LETTER FROM COUNCILLOR JOAN B. LOVELY SUBMITTING RESIGNATION

        The following letter from Councillor Joan B. Lovely was received and placed on file.

A motion by Councillor Sosnowski that letter of interest be accepted until December 20th at 7:00 PM and a Special Meeting be held to fill the position on January 3, 2013 and that it be advertised in the Salem News was adopted.

A request from Free Masons to change date of approved reserved spaces for blood drive from Feb. 13, 2013 to Feb. 28, 2013 due to a scheduling conflict with the Red Cross was granted.
