MINUTES- 10-27-2011

“Know Your Rights Under the Open Meeting Law, M.G.L. Chapter 39 §23B, and
City Ordinance Sections 2-2028 through 2-2033.”

A Regular Meeting of the City Council held in the Council Chamber on Thursday,

October 27, 2011 at 7:00 P.M., for the purpose of transacting any and all business.  Notice of
this meeting was posted on October 21, 2011 at 9:45 A.M.  This meeting is being taped and is

live on S.A.T.V.   

        
       All Councillors were present.

       Council President Ryan presided.


Councillor  Lovely moved to dispense with the reading of the record of the previous meeting.
It was so voted.


 President Ryan requested that everyone please rise to recite the Pledge of Allegiance.



PUBLIC TESTIMONY

  • Shirley Walker – Derby Lofts resident – Councillor Sosnowski’s order regarding fights in the downtown  and would request that the Police Chief and Mayor or representative be invited to Committee meeting.

#662 – (#641) CONDUITS ON DERBY SQUARE, ESSEX STREET AND WASHINGTON STREET

        A hearing was held on the Order of Comcast to install conduits on Derby Square, Essex Street and Washington Street. Appearing in favor was Tim Broderick representative of Comcast. The was no one opposed. Councillor Pelletier moved that the petition be granted. It was so voted.


#663 – (#642) CONDUIT ON ESSEX STREET

A hearing was held on the Order of Verizon to install a conduit on Essex Street. Appearing in favor was Joseph Gleason representative of Verizon. There was no one opposed. Councillor Pelletier moved that the petition be granted. It was so voted.




(#643) – EXTENDED HOURS OF OPERATION FOR McDONALD’S ON CANAL STREET

        The petition for extended hours of operation for McDonald’s on Canal Street was withdrawn.


#664 – CONSTABLE

        The Mayor’s  reappointment of Cynthia Bourgeault to serve as a Constable with a term to expire October 14, 2012, was received and placed on file.


#665 – TRANSFER TO RECREATION GOLF COURSE – CONTRACTED SERVICES

        The following Order recommended by the Mayor was adopted.

        ORDERED: That the sum of Twenty Nine Thousand and Four Hundred Dollars ($29,400.00) is hereby transferred from the “Recreation Golf Course – Seasonal Labor” account to the “Recreation Golf Course – Contracted Services” account in accordance with the recommendation of Her Honor the Mayor.


#666 – YEAR TO DATE BUDGET REPORT

        Councillor McCarthy introduced the following Order, which was adopted.

        ORDERED: That the Year to Date Budget Report dated September 30, 2011, be referred to the Committee on Administration and Finance.


#667 – ORDINANCE TRAFFIC RESIDENT STICKER PARKING HAZEL STREET

        Councillor Ronan introduced the following Ordinance, which was adopted for first passage.

In the year Two Thousand and Eleven

An Ordinance to amend an Ordinance relative to Traffic, Chapter 42, Section 75 “Parking Prohibited, Towing Zone Resident Sticker Parking”

Be it Ordained by the City Council of the City of Salem, as follows:

Section 1. Hazel Street, even side between Laurel Street and Holly Street, Resident Sticker Parking, Zone E, color orange “Resident Sticker Parking, Tow Zone.

Section 2. This Ordinance shall take effect as provided by City Charter.



#668 – ORDINANCE TRAFFIC PARKING TIME LIMITED, UNMETERED ZONE, BRIDGE STREET

        Councillor Sosnowski introduced the following Ordinance, which was adopted for first passage.

In the year Two Thousand and Eleven

An Ordinance to amend an Ordinance relative to Traffic, Chapter 42, Section 57A “Parking Time Limited; Unmetered Zone”

Be it Ordained by the City Council of the City of Salem, as follows:

Section 1. Bridge Street, in front of #45, starting at a point of twenty (20) feet south of Planters Street and continuing south for twenty (20) feet, one space, thirty (30) minute parking limit 9:00 AM to 5:00 PM, Monday through Sunday. “Parking Time Limited; Unmetered Zone”

Section 2. This Ordinance shall take effect as provided by City Charter.


669 – ISSUES WITH FIGHTS IN THE DOWNTOWN

        Councillor Sosnowski introduced the following Order, which was adopted.

        ORDERED: That the Committee of the Whole meet in a joint meeting with the Licensing Board to discuss a recurring problem of fights breaking out downtown near bars, restaurants, taverns and any other establishments that serves alcohol. And that the following be invited Police Chief or his representative, Mayor or her representative.


#670 – ELECTION ORDER

        Councillor O’Keefe introduced the following Order, which was adopted.

        ORDERED:   That the meetings of the qualified voters of the City of Salem be held in the several voting precincts in the city at the polling places designated hereinafter, on Tuesday, November 8, 2011, for the purpose of casting votes in the City Election for the election of candidates for the following offices:
        
        Four Councillors at Large:  for the term of two years
            Councillor of Wards One, Two, Three, Four, Five, Six, and Seven:  for the term of two      years
        Three members of the School Committee:  for the term of four years

#671 – L.E.D. LIGHTS

        Councillor Sargent introduced the following Order, which was adopted.

        ORDERED: That the Committee on Community and Economic Development meet to discuss the use of L.E.D. (Light Emitting Diode) lights in the street lights and other City owned lighting in Salem. Invited John Giardi City Electrician or his representative.





#672 – RESIDENTS EFFECTED BY FLOODING

        Councillor Sargent introduced the following Order, which was adopted.

        ORDERED: That the Committee on Community and Economic Development meet to discuss the charging of our residents who were affected by recent heavy flooding, for dumping at the Transfer Station after a City robo-call directed them to bring flood damaged items to the Transfer Station.

#674 – (#572 of 2009) CITY WIDE FLOOD CONTROL

Councillor Pelletier offered the following report for the Committee on Government Services co-posted with the Committee of the Whole to whom was referred the status of the City Wide Flood Control, has considered said matter and would recommend that the matter remain in committee. It was voted to accept the report and adopt the recommendation.






#675 – (#317) PROPOSED GAS STATION LOCATED AT 111 NORTH STREET

Councillor Pinto offered the following report for the Committee on Public Health, Safety & Environment co-posted with the Committee of the Whole to whom was referred the matter of the status of the proposed gas station located at 111 North Street (Trickett Realty) and would recommend that the City Council respectfully request that the Building Inspector hold the issuance of any Occupancy Permit until all Zoning Ordinances are adhered to.  It was voted to accept the report and adopt the recommendation.

#676 – (#620) MASSACHUSETTS HEALTH INSURANCE REFORM

Councillor Ryan offered the following report for the Committee of the Whole to whom was referred the matter of the Massachusetts Health Insurance Reform Law and would recommend   the Committee of the Whole meet again on November 9, 2011 followed by a Special Meeting.  It was voted to accept the report and adopt the recommendation.



        Councillor Ryan resumed the Chair.


#677 – FREE MASONS USE OF PARKING SPACES FOR BLOOD DRIVE

        A request from the Free Mason to reserve four parking spaces near 70 Washington Street to hold blood drives on February 15th, April 11th, June 13th, Aug. 16th and Dec. 12th, 2012 was granted.
