MINUTES - 09-23-2010

A Regular Meeting of the City Council was held in the Council Chamber on Thursday,

September 23, 2010 at 7:00 P.M., for the purpose of transacting any and all business.  

Notice of this meeting was posted on September 16, 2010 at 5:14 P.M.  This meeting is

being taped and is live on S.A.T.V.
        
       Councillor McCarthy was recorded as absent.

       Council President O’Keefe presided.

Councillor Furey moved to dispense with the reading of the record of the previous meeting. It was so voted.

 President O’Keefe requested that everyone please rise to recite the Pledge of Allegiance.



#536 – CONDUIT LOCATION ON BRIDGE STREET

        A hearing was held on the Order of Comcast to install conduits on Bridge Street. Appearing in favor was Tim Broderick of Comcast.  Also in support was Councillor Sosnowski. The hearing was closed. Councillor Sosnowski moved that the permit be granted. It was so voted.


(#491) – APPT. OF SUE KEENAN TO HISTORICAL COMMISSION

        Held from last meeting Mayor’s appointment of Sue Keenan to the Historical Commission with a term to expire on September 1, 2013, was confirmed by a roll call vote of 10 yeas, 0 nays, 0 absent. Councillors Furey, Lovely, O’Keefe, Pelletier, Pinto, Prevey, Ronan, Ryan, Sargent and Sosnowski were recorded as voting in the affirmative. Councillor McCarthy was recorded as absent.


#537 – REAPPT. OF CONSTABLE

        The Mayor’s reappointment of Donald Hurwitz, 5 Marion Rd., Marblehead to serve as a Constables with the term to expire on October 15, 2012, was received and placed on file.


#538 – APPLICATION FOR A CARNIVAL FOR FIESTA SHOWS

        Received after the deadline of Tuesday noon under suspension of the rules.

        The Mayor submitting an application from Gene Dean of Fiesta Shows to hold a carnival on a vacant parcel at 289 Derby Street between October 15th and October 31st, 2010.
Councillor Lovely moved that the application be approved contingent of the signed approvals of the Chief of Police and Chief of the Fire Department. It was so voted.

#540 – RESOLUTION FOR JAMES T. “DOC” RYAN’S 80TH BIRTHDAY

        Councillor Ryan introduced the following Resolution, which was adopted.

RESOLUTION

WHEREAS:  James T. “Doc” Ryan being a lifelong citizen of Salem, born September 27,                     1930 to former Salem School Committee Member and Salem High                                             School Football Physician Dr. James Patrick Ryan and his wife Anna.  Having                             one brother, George Ryan born on the same day five years later.

WHEREAS:  James T. “Doc” Ryan graduated from Salem High School in 1948 having played                     both Football and Baseball.  He went on to graduate from the School of the                              Holy Cross in Worcester, MA in 1952 and then graduated from Tufts University                            Dental School in 1960.

WHEREAS:  James T. “Doc” Ryan was a City of Salem Playground Instructor where he met                      his wife, Ann Butler while they were Playground Instructors at Gallows Hill                             Park.  James T. “Doc” Ryan and Ann Butler were married on December 27,                                 1954 at St. James Church with the reception at the Hawthorne Hotel in Salem,                             MA.

WHEREAS:  James T. “Doc” Ryan served as a Lieutenant in the U.S. Navy from 1952-1956                    during the Korean War aboard the U.S.S. Salem CA-139.  He has served as                                 Commander of the Salem Legion Post 23 and has been involved in the Legion                               Baseball Program for over 50 years.  He has coached many kids over the years                             and helped them to succeed in life.  A couple of his former players went on to                          play Major League Baseball and one player, John Tudor went on to win a World                            Series with the St. Louis Cardinals.

WHEREAS:  James T. “Doc” Ryan served on the Salem School Committee from 1978-1982.                       He served as a Park & Recreation Commissioner from 1984-1999.  He was a                                 member of the Salem Charter Commission and was a candidate for Mayor in                                 2000.

WHEREAS:  James T. “Doc” Ryan started his own dental practice in downtown Salem in                      1960.  He also served as the City of Salem Dentist from 1960-2000 in which                              capacity he would go to the schools in Salem to check on the dental health of                           the children of Salem.

WHEREAS:  James T. “Doc” Ryan and his wife, Ann, a former Salem Public School Teacher                    have   fourteen children:  Marybeth, Martha, Julie, James, Thomas, Anna,                                        Edward, Joseph, Stephen, Frederick, Alice, Jerry, Jennifer and Patrick.  Along                                  with 28 grandchildren to date:  Emily, George, Kathryn, Martha, Geena, Brady,                                  Marcus, Julie, Hannah, Thomas, Rachel, Timothy,        Matthew, Katelyn,                                Hayley, Connor, Maddox, Morgan, Paige, Brooke, Quinn, MacKenzie, Devyn,                                 Mitchell, Colby, Austin, Gavin and Jackson.


NOW THEREFORE BE IT RESOLVED:  That the Salem City Council of the City of Salem extends to James T. “Doc” Ryan, their sincere heartfelt appreciation, on behalf of a grateful community, for service and a job well done.  The City Council wishes to extend to you and your family best wishes upon your 80th birthday.

AND BE IT FURTHER RESOLVED:  That this resolution is made a matter of the record of these proceedings, and that a suitable copy is sent along with a City Seal, on behalf of the Salem City Council, as a token of our appreciation.

        Councillor Prevey introduced the following Order, which was adopted.

#542 – DOUBLE POLES

        Councillor Sosnowski introduced the following Order, which was adopted.

        ORDERED: That the Committee on Community and Economic Development co-posted with the Committee of the Whole meet to discuss the double pole issues, and that the following be invited, Mayor or her representative, John Giardi or representative of the Electrical Department, Solicitor, Public Works Director and City Engineer, John Upham from National Grid, Rich Swirk from Verizon and Gary McDonald from Comcast.

        Councillor Lovely offered the following report for the Committee on Ordinances, Licenses and Legal Affairs.

        The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter of Order #367 Petition for South Pine Street, has considered said matter and would recommend that the matter be referred to the Committee of the Whole and schedule a public hearing.


#547 – (#218) APPOINTMENT OF THOMAS WATKINS AS PURCHASING AGENT

        Councillor Prevey offered the following report for the Committee on Administration and Finance co-posted with the Committee of the Whole.

        The Committee on Administration and Finance co-posted with the Committee of the Whole to whom was referred the matter of appointment of Thomas Watkins as the purchasing agent, has considered said matter and would recommend that the matter be reported out to the full Council to confirm the appointment of Thomas Watkins as Purchasing Agent by roll call vote.

        The appointment of Thomas Watkins as the Purchasing Agent was confirmed by a roll call vote of 8 yeas, 1 nay, 1 absent, 1 present. Councillors Furey, Lovely, O’Keefe, Pelletier, Ronan, Ryan, Sargent and Sosnowski were recorded as voting in the affirmative. Councillor Prevey was recorded as voting in the negative. Councillor Pinto was recorded as voting present. Councillor McCarthy was recorded as absent.

A motion for immediate reconsideration in the hopes it does not prevail was denied.


#548 – (#457) COMPREHENSIVE PARKING STUDY

        Councillor Sargent offered the following report for the Committee on Community and Economic Development co-posted with the Committee of the Whole.

        The Committee on Community and Economic Development co-posted with the Committee of the Whole to whom was referred the matter of a comprehensive parking study, has considered said matter and would recommend that the full City Council adopt the concept of the Salem Comprehensive Parking Plan to provide 15% parking availability per city block in downtown Salem. And that the City Council will receive monthly updates and a final plan by the first Council meeting in March 2011.


#549 – BLOCK PARTY

        The petition from the residents of Federal St. (at intersection of Federal and Beckford St.) to hold a block party on October 1, 2010 from 6:00 P.M. to 9:00 P.M. with a rain date of October 8, 2010, was granted.
