MINUTES - 01-24-2008

A Regular Meeting of the City Council was held in the Council Chamber on Thursday, January 24, 2008 at 7:00 P.M., for the purpose of transacting any and all business.  Notice of this meeting was posted on January 17, 2008 at 4:32 P.M.
        

       All Councillors were present.

       Council President Michael Sosnowski presided.

Councillor Furey moved to dispense with the reading of the record of the previous meeting. It was so voted.

       President Sosnowski requested that everyone please rise to recite the Pledge of Allegiance.


#4 – (#726 of 2007) HEARING HELD FROM THE LAST MEETING POLE LOCATION COLLINS STREET

        Held from the last meeting of January 10, 2008 an Order for Verizon & Mass. Electric to place one jointly owned pole on Collins Street.

        Appearing in favor was William McEnany Right of Way Agent for Verizon. The petition was withdrawn.


#52 – HEARING COMCAST CONDUIT ON CROMBIE STREET

        A hearing was held on the order of Comcast to install one conduit on Crombie Street. Appearing in favor was Timothy Broderick of Comcast who stated the work was necessary to rehab the building at 281 Essex Street. There was no one opposed. Councillor Pelletier moved that the request be granted. It was so voted.


#53 – HEARING NATIONAL GRID CONDUITS ON LAFAYETTE STREET

        A hearing was held on the order of National Grid to install two conduits subject to granting of an easement on Lafayette Street. Appearing in favor was Sabhita Mahabier-Sheehy Senior Design Technician for National Grid. There was no one opposed. Councillor O’Keefe moved that the request be granted. It was so voted.







#54 – HEARING VERIZON AND MASS. ELECTRIC JOINTLY OWNED POLE ON JACKSON STREET

        A hearing was held on the order of Verizon and Massachusetts Electric to place a jointly owned pole on Jackson Street. Appearing in favor was William McEnany Right of Way Agent for Verizon. There was no one opposed. Councillor Pelletier moved that the request be granted. It was so voted.


#55 – HEARING VERIZON AND MASS. ELECTRIC JOINTLY OWNED POLE ON JEFFERSON AVENUE

        A hearing was held on the order of Verizon and Massachusetts Electric to relocate a jointly owned pole on Jefferson Avenue. Appearing in favor was William McEnany Right of Way Agent for Verizon. There was no one opposed. Councillor Pelletier moved that the request be granted. It was so voted.



#56 – HEARING VERIZON AND MASS. ELECTRIC JOINTLY OWNED POLE ON HIGHLAND AVENUE (NEAR POWDER HOUSE LANE)

        A hearing was held on the order of Verizon and Massachusetts Electric to place a jointly owned pole on Highland Avenue (near Powder House Lane). Appearing in favor was William McEnany Right of Way Agent for Verizon. There was no one opposed. Councillor Pelletier moved that the request be granted. It was so voted.



#57 – HEARING VERIZON AND MASS. ELECTRIC JOINTLY OWNED POLE ON HIGHLAND AVENUE (NEAR HOSPITAL)

        A hearing was held on the order of Verizon and Massachusetts Electric to place a jointly owned pole on Highland Avenue (near Hospital). Appearing in favor was William McEnany Right of Way Agent for Verizon. There was no one opposed. Councillor Pelletier moved that the request be granted. It was so voted.








#58 - CONSTABLES

        The Mayor’s appointments and reappointments of the following to serve as a Constables, were received and placed on file.

#59 – TRANSFER FROM RECEIPTS RESERVED – GOLF COURSE TO GROUP INSURANCE LINES

        The following Order recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED: That the sum of Seven Thousand One Hundred and Ninety Five Dollars and Seventy Six Cents ($7,195.76) is hereby transferred from the “Receipts Reserved – Golf Course”  account and appropriated to the following Group Insurance lines in accordance with the recommendation of Her Honor the Mayor.

#60 – TRANSFER FROM RECEIPTS RESERVED – WITCH HOUSE TO GROUP INSURANCE LINES

        The following Order recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED: That the sum of Two Hundred and Ninety One Dollars and Twenty Two Cents ($291.22) is hereby transferred from the “Receipts Reserved – Witch House”  account and appropriated to the following Group Insurance line in accordance with the recommendation of Her Honor the Mayor.

#61 – S.O.D.A.R. DEVICES TO MEASURE WIND SPEED

        Councillor McCarthy introduced the following Order, which was adopted.

        ORDERED: That the Committee of the Whole schedule a public hearing to discuss the installation of a SODAR device that gathers data for the measuring of wind speed, and that the following be invited:

        Abutters, S.E.S.D. representative, the Renewable Energy Task Force, UMass Amherst research team and the City Solicitor.


#62 – RATE RELIEF TO RATE PAYERS FOR ERECTION OF WIND TURBINE

        Councillor Lovely and McCarthy introduced the following Order, which was adopted.

        ORDERED: That the City Council forward a request to the Board of Directors requesting that the Board go on record by vote that any and all power generated by a wind turbine be applied as rate relief to Salem rate payers only.

        And that the erection of any wind turbine be contingent upon the affirmative vote of the Board.


#63 – AMEND SNOW AND ICE ORDINANCES

        Councillor Prevey introduced the following Order, which was adopted.

        ORDERED: That the Committee on Ordinances, Licenses and Legal Affairs meet to discuss amending City Ordinance Chapter 38, Section 12, “Throwing or plowing ice or snow into streets”, Section 13, “Removal of Snow from sidewalks” and Section 14, “Removal of Ice from sidewalks”, for the purpose of considering increasing the penalties associated with those sections.

        Also, the Committee should review all pertinent elements of each section as part of the discussion. It is requested that the City Solicitor, Police CIU officers and the Building Inspector be invited to participate.








#64 – RESOLUTION SGT. WILLIAM “BILLY” JOYCE

        Councillor Lovely introduced the following Resolution, which was adopted.

        RESOLUTION:

        WHEREAS:        Sergeant William “Billy” Joyce, having come to this United States at the age of                         17 from Ireland, chose to make this country his home. He married his lovely                     wife Diana and had four sons, Liam, Terence, Matthew and Brian and;

        WHEREAS:        Sergeant William “Billy’ Joyce having served the North Shore Medical Center                     Security Department for thirty three years, and;

        WHEREAS:        In recognition of his years of service and particularly his manner of                                   professionalism in the performance of his duties and responsibilities, and;

        WHEREAS:        Sergeant William “Billy” Joyce’s working relationships were always                                      characterized by obvious dedication.

        NOW THEREFORE BE IT RESOLVED: That the Salem City Council of the City of Salem  extends to Sergeant William “Billy” Joyce, a sincere heartfelt appreciation, on behalf of a     grateful community, for service and job well done. The City Council wishes to extend to you     and your family best wishes for happy, healthy and prosperous years of retirement.

        AND BE IT FURTHER RESOLVED: that this resolution be made a matter of the record of      these proceedings, and that a suitable copy be sent along with a City Seal , on behalf of the   Salem City Council, as a token of our appreciation.


#65 – STATUS OF SZETELA LANE

        Councillor Prevey introduced the following Order, which was adopted.

        ORDERED: That the Committee on Administration and Finance meet to discuss the status of the pending sale of the city owned land at Szetela Lane.

                        The following be invited: City Solicitor, Mayor or representative, members of the Planning Department, Finance Director, the developer of the property and abutters.


#66 – ORDINANCE AMENDING TRAFFIC, HANDICAP PARKING, MAY STREET

        Councillor Sargent and Sosnowski introduced the following Ordinance amendment, which was adopted for first passage.

        In the year two thousand and eight

        An Ordinance to amend an Ordinance relative to Traffic, Chapter 42, Section 50B, “Handicapped Zones, Limited Time”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. May Street in front of #7, for a distance of twenty (20) feet, Handicap Parking, Tow Zone.

        Section 2. This Ordinances, shall take effect as provided by City Charter.


#67 – ORDINANCE AMENDING TRAFFIC, PARKING TIME LIMITED, BRIDGE STREET

        Councillor Sargent and Sosnowski introduced the following Ordinance amendment, which was adopted for first passage.

        In the year two thousand and eight

        An Ordinance to amend an Ordinance relative to Traffic, Chapter 42, Section 57A, “Parking Time Limited”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. Bridge Street in front of #18, starting twenty (20) feet from the corner of Hubon Street, for a distance of twenty-eight (28) feet, thirty (30) minute parking, 10:00 A.M. to 5:00 P.M., Wednesday through Monday, “Parking Time Limited”.

        Section 2. This Ordinances, shall take effect as provided by City Charter.


#68 – (#30, 32, 33, 35- 44) GRANTING CERTAIN LICENSES

        Councillor O’Keefe offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation.

        The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter of granting certain licenses, has considered said matter and would recommend that the following be granted.

#69 – (#766) SALEM STATE COLLEGE ROAD RACE & FUN WALK

        Councillor O’Keefe offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation.

        The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter of a request from Salem State College to hold a Road Race and Fun Walk on Sunday, April 13, 2008, has considered said matter and would recommend it be granted.


#70 – EASEMENT WITH MASS. ELECTRIC FOR CONDUITS OF LAFAYETTE STREET

        A communication from City Solicitor Elizabeth Rennard enclosing a grant of Easement from the City of Salem to Massachusetts Electric for the purpose of placing underground  conduits beneath the City’s bike path which runs from Lafayette Street to Salem State College Ball field, was granted.


#71 – POLE LOCATION SKERRY STREET

        A hearing was ordered for February 14, 2008 on the petition of Verizon and Massachusetts Electric for a jointly owned pole on Skerry Street.





#72 – POLE LOCATION WILLIAMS STREET

        A petition of Verizon and Massachusetts Electric for a jointly owned pole on Williams Street within the same property boundary, was granted.


#73 – REQUEST FROM PARK & RECREATION COMMISSION RE: SALEM COMMON

        A request from the Park and Recreation Commission to meet with the City Council to address issues and concerns regarding the Salem Common, was referred to the Committee on Ordinances, Licenses and Legal Affairs.


#74 – OWNER CHANGE FOR ANTIQUES AT MUSEUM PLACE

        A communication from Elizabeth Grader and Judith Lazdowski owners of Antiques at Museum Place for owner change, name change and address change for Second Hand Valuable License was granted.


#75 – REQUEST FROM TRI CITY SERVICES  FOR INCREASE IN TAXI FARES

        A request from Tri City Services to meet with City Council to discuss increasing taxi fares was referred to the Committee on Ordinances, Licenses and Legal Affairs and all owner of Taxi Companies be invited.

        The matter of second and final passage of an Ordinance amending Traffic, Chapter 42, Section 50B, Handicapped Zones, Limited Time, Japonica Avenue, was then taken up. The Ordinance was adopted for second and final passage.


(#17) – ORDINANCE AMENDING TRAFFIC, HANDICAP PARKING, BRIGGS STREET

        The matter of second and final passage of an Ordinance amending Traffic, Chapter 42, Section 50A, Handicap Parking, Tow Zone, Briggs Street, was then taken up. The Ordinance was adopted for second and final passage.

        Councillor McCarthy took a moment of personal privilege to commend a young school boy for raising $1,100.00 for the school library.


        On the motion of Councillor Pelletier the meeting adjourned at 8:45     P.M.
