MINUTES SEPTEMBER 13, 2007

A Regular Meeting of the City Council was held in the Council Chamber on Thursday, September 13, 2007 at 7:00 P.M., for the purpose of transacting any and all business.  Notice of this meeting was posted on September 7, 2007 at 9:05 A.M.
        

       All Councillors were present.

       Council President Matthew Veno presided.


Councillor Corchado moved to dispense with the reading of the record of the previous meeting. It was so voted.


       President Veno requested that everyone please rise to recite the Pledge of Allegiance.

#567 – APPR. TO CEMETERY BURIAL

The following Order, recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED: That the sum of Three Thousand, Nine-Hundred and Twenty Dollars ($3,920.00) is hereby appropriated from the “Receipts Reserved – Sale of Vaults” account to “Cemetery – Burial” account in accordance with the recommendation of Her Honor the Mayor.


#568 – COMMUNICATION FROM MAYOR REGARDING S.I.L.O.T. WITH SALEM STATE COLLEGE

        A communication from the Mayor informing the City Council of a (S.I.L.O.T.) Services In Lieu of Taxes agreement with Salem State College in the amount of $353,922.00, was received and placed on file.



#569 – MEET WITH DIRECTOR OF SALEM MAIN STREET PROGRAM

        Councillor Lovely introduced the following Order, which was adopted.

ORDERED: That Jennifer Bell, the new Director of Salem Main Street Program be invited to a Committee of the Whole to allow the Council to officially welcome her and get an update on the program going forward.


#570 – SIXTY DAY TRIAL PERIOD, STOP SIGN PATTON AT SURREY ROAD

        Councillor O’Keefe introduced the following Order, which was adopted.

        ORDERED: That a stop sign be placed on Patton Road in a westerly direction at the intersection with Surrey Road for a sixty (60) day trial period.


#571 – ORDINANCE, TRAFFIC SEC. 49, STOP SIGN DIBIASI ST. AT SABLE ROAD

        Councillor O’Keefe introduced the following Ordinance, which was adopted for first passage.

        In the year two thousand and seven

        An Ordinance to amend an Ordinance relative to Traffic, Chapter 42, Section 49, “Obedience to isolated Stop Signs”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. DiBiasi Street at the intersection with Sable Road, both directions, “Stop Sign”

        Section 2. Sable Road at the intersection with DiBiasi Street, “Stop Sign”

        Section 3. This Ordinance shall take effect as provided by City Charter.










#572 – CITY PRELIMINARY ELECTION

        Councillor O’Leary introduced the following Order, which was adopted.

        ORDERED: That the meetings of the qualified voters of the City of Salem be held in the several voting precincts in the city at the polling places designated hereinafter on Tuesday, September 18, 2007 for the purpose of casting votes in the City Preliminary Election for the nomination of candidates for the following offices:

#573 -  TRAFFIC HOT SPOTS

        Councillor Corchado introduced the following Order, which was adopted.

        ORDERED: That the Committee on Public Health, Safety and Environment co-posted with the Committee of the Whole meet to discuss issues pertaining to Traffic “Hot Spots” in various areas of the City and the plan of action to address these issues, including but not limited to speeding, littering, racing, noise violations and that Lt. Precezewski and a representative from the Mayor’s office be invited. Also requested is documentation of tickets for said violations.


#574 – ORDINANCE TRAFFIC, GENERAL TOWING ZONES, BRIDGE STREET

        Councillor Sosnowski introduced the following Ordinance, which was adopted for first passage.

In the year two thousand and seven

        An Ordinance to amend an Ordinance relative to Traffic, Chapter 42, Section 74, “Obedience to isolated Stop Signs” and Sec. 51B “Parking Prohibited Certain Times on Certain Streets”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1.      Bridge Street, beginning at a point where the North Street westerly down-                               ramps intersect with Bridge Street, extending in an easterly direction to the                   overpass, both sides of Bridge Street, “No Parking, Tow Zone”

        Section 2.      Chapter 42, Section 51B, “Parking Prohibited at Certain Times on Certain                                Streets” is hereby amended by repealing the following:

        Councillor O’Leary introduced the following Order, which was adopted.

        ORDERED: That the Committee on Administration and Finance meet with the City Planner and the Salem Redevelopment Authority for an update on the property known as the Old Salem Jail located at 50 St. Peter Street.

        Councillor Pelletier introduced the following Order, which was adopted.

#577 – ENTRANCE / EXIT AT SALEM HIGH SCHOOL

        Councillor Pelletier introduced the following Order, which was adopted.

        ORDERED: That the City Council investigate the feasibility of making the Salem High School and the Bowditch School’s entrance/exit to a one way direction to alleviate traffic congestion on Willson Road and Highland Avenue and surrounding neighborhoods. Also explore the feasibility of a second entrance and exit on the Highland Avenue side of the High School. The matter be referred to the Committee on Government Services co-posted with the Committee of the Whole and that a meeting be scheduled within thirty days. The following to be invited Mayor or her designee, Superintendent of Schools, School Committee members, Lt. Preczewski, Officer Mike Page and Sgt. Gifford of the Salem Police Department.


#578 – ORDINANCE TRAFFIC, HANDICAP ZONE LIMITED TIME, NORTH STREET

        Councillor Prevey introduced the following Ordinance, which was adopted for first passage.

        In the year two thousand and seven

        An Ordinance to amend an Ordinance relative to Traffic, Chapter 42, Section 50B,        “Handicap Zone, Limited Time”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1.  North Street in front of #180 for a distance of twenty (20) feet, “Handicap         Parking, Tow Zone”

        Section 2. This Ordinance shall take effect as provided by City Charter.

Councillor O’Keefe offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation.

        The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter of a request for a Fortunetelling Store License has considered said matter and would recommend that this request be referred to the Salem Licensing Board for their review.







#582 – (#544) – ORDINANCE AMENDING CH. 46, SEC. 74, CROSS CONNECT CHARGES

        Councillor O’Keefe offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and adopt the recommendation.

        The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter of an Ordinance amending Ch. 46, Sec. 76 Cross Connect Charges has considered said matter and would recommend that the revised ordinance submitted by the City Solicitor be adopted for first passage.

        Councillor Lovely recused herself from discussion.

        Councillor Prevey moved that the matter be referred back to the Committee on Ordinances, Licenses and Legal Affairs. It was so voted. Councillor Furey and Blair were recorded as opposed.      

#583 – #583A - ORDINANCE CHAPTER 14, BUSINESS LICENSES
A communication from City Solicitor Elizabeth Rennard submitting the following ordinance amending Chapter 14, Business Licenses by adding Article VI, Theatrical Exhibitions, Public Amusements, etc., which was adopted for first passage by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.


In the year two thousand seven
         
         An Ordinance to amend an Ordinance pertaining to business licenses

        Be it ordained by the City Council of the City of Salem, as follows:

         Section 1.  Chapter 14, Business Licenses is hereby amended by adding a new Article as follows:

        “Article VI.  THEATRICAL EXHIBITIONS, PUBLIC AMUSEMENTS, ETC.

                Sec. 14-400~ ~ ~Application for License.
~ ~ ~The Licensing Board, hereinafter “the Board”, may, unless otherwise prohibited by law, grant a license for theatrical exhibitions, public shows, public amusements, concert, dances, cabarets, and exhibitions of every description pursuant to Massachusetts General Law Chapter 140, Section 183A.
     

        The application for such license must be in writing and fully and specifically describe the conditions of the proposed exhibition, dance, concert, cabaret, show, or amusement and the premises upon which the proposed exhibition, show, or amusement is to take place, to the extent that such conditions or premises would affect the public safety, health, or order.
     The application for such license shall be in writing in a form adopted by the Board and shall state, at a minimum, the type of concert, dance, exhibition, cabaret or public show or amusement sought to be licensed and shall state whether such public show will include: (a) dancing by patrons, (b) dancing by entertainers or performers, (c) recorded or live music, (d) the use of an amplification system, (e) a theatrical exhibition, play, or moving picture show, (f) a floor show of any description, (g) a light show of any description, or (h) any other dynamic audio or visual show, whether live or recorded.
     The application shall also state whether as part of the concert, dance or theatrical exhibition, cabaret or public show or amusement any person will be permitted to appear on the premises in any manner or attire as to expose to public view any portion of the pubic area, anus, or genitals, or any simulation thereof, or whether any female person will be permitted to appear on the premises in any manner or attire as to expose to public view any portion of the breast below the top of the areola, or any simulation thereof.
     Upon written request of the Board, the applicant shall, in addition to such description, furnish reasonable information concerning the condition of the premises and actions to be taken in order to prevent danger to the public safety, health, or order.

Sec. 14-401~ ~ ~Time Limit for Acting on Application.
~ ~ ~The Board shall act upon every application for a license or renewal of a license within thirty (30) days next following the date of the filing of said application; and if the Board shall fail to act upon any application within the thirty (30) days next following the date thereof or such other time as may be prescribed by law, the Board shall forthwith upon demand of the applicant issue or renew such license, unless the Board shall have determined that a hearing should be held to consider whether the application should be denied under Subsection 14-402 and within such thirty (30) day period shall have given the notice specified in said subsection.

Sec. 14-402~ ~ ~Issuance of Licenses.
~ ~ ~The Board shall grant a license applied for under this division unless the Board specifically finds, after a hearing preceded by at least ten (10) days written notice to the applicant and states in writing within thirty (30) days next following the close of such hearing that the granting of the license at the premises would lead to or cause an offense under any applicable law, code, or ordinance; or would lead to the creation of a nuisance or otherwise endanger the public health, safety, or order by:
~ ~ ~

    a.~ ~Unreasonably increasing pedestrians or vehicular traffic in the area in which the premises are located; or
~ ~ ~b.~ ~Increasing the incidence of illegal or disruptive conduct in the area in which the premises are located; or
~ ~ ~c.~ ~Unreasonably increasing the level of noise in the area in which the premises are located; or
~ ~ ~d.~ ~Otherwise significantly harming the legitimate protected interests of the affected citizens of the City.
        The Board shall consider City Ordinance Chapter 22 (Noise Control), Chapter 14, Article IV (Hours of Operation) and any other relevant local or state laws or regulations when making its decision.  The board shall adopt rules and standard conditions for the issuance of license for theatrical exhibitions, public shows, public amusements, concerts, dances, cabarets, and exhibitions of every description pursuant to Massachusetts General Law Chapter 140, Section 183A.  In addition, the Board may impose additional conditions upon a license, but said conditions may only relate to compliance with applicable laws or ordinances, or to public safety, health, or order, or to steps required to be taken to guard against creation of a nuisance or to insure adequate safety and security for patrons of the affected public.

Sec. 14-403~ ~ ~Suspension of License.
~ ~ ~No license shall be revoked or suspended without a hearing before the Board, prior to which hearing the Board shall give reasonable notice of the time and place of the hearing and the specific grounds of the proposed revocation or suspension; provided that the Board may suspend a license for no more than three (3) days without such notice or hearing if the Board specifically notifies the license holder in writing there is a probability of violation of public safety, health, or order without such suspension. In such a case a hearing shall be held within forty-eight (48) hours of said suspension in order to determine whether the public safety, health, or order justified such suspension.
Sec. 14-404~ ~ Fee
A fee of one hundred ($100.00) dollars shall be charged per year for the issuance of a License under this Article.

Sec 14-405.  Fine for Violation.
~ ~ ~Whoever offers to view, sets up, sets on foot, maintains, carries on, or otherwise assists in or promotes any such exhibition, dance, show or amusement without a license shall be subject to a fine of fifty ($50.00) dollars for each day on which such violation occurs or during which said violation continues.

Section II.  This Ordinance shall take effect as provided by City Charter.     

#584 – #584A - #584B - HOME RULE PETITIONS

        A communication from City Solicitor Elizabeth Rennard submitting the following two Home Rule Petitions which were adopted by unanimous roll call votes of 11 yeas, 0 nays, 0 absent.

        ORDERED: That a petition to the General Court, accompanied by a bill for certain additional liquor licenses notwithstanding the provisions of Section 17 of chapter 138 of the General Laws as set forth below, be filed with an attested copy of this Order be, and hereby is, approved under Clause (1) of Section 8 of Article 2, as amended, of the Amendments to the Constitution of the Commonwealth of Massachusetts, to the end that the following legislation be adopted, except for amendments by the Senate or House of Representatives which conform to intent of this home rule petition:

AN ACT authorizing the City of Salem to issue additional licenses for the sale of alcoholic beverages.

        Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

Section 1. Notwithstanding the provisions of Section 17 of Chapter 138 of the General Laws, the licensing authority of the City of Salem may grant 1 additional license for the sale of all alcoholic beverages to be drunk on the premises under Section 12 of said chapter 138 to New Boston Ventures, LLC, for a restaurant located at 50 St. Peter Street in Salem, Massachusetts. The license shall be subject to all of said Chapter 138 except Section 17.

Notwithstanding any General or special law, or any rule or regulation to the contrary, the local alcoholic licensing authority shall not approve the transfer of said license to any other location. Said license may be granted by the local alcohol licensing authority at the same location if an applicant for said license files with said authority a letter in writing from the Department of Revenue indicating that said license is in good standing with said Department and that any and all applicable taxes have been paid. If the license granted under this section is cancelled, revoked or no longer in use, such license shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the local alcohol licensing authority.

Notwithstanding Section 17 of Chapter 138 of the General Laws, or any other general or special law to the contrary, the local alcohol licensing authority may then grant the license to a new applicant at the same location and under the same conditions as specified in the preceding paragraph.

Section 2. This act shall take effect upon it’s passage.


        Councillor O’Keefe moved immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.

#585 – POLE LOCATION ON LINCOLN ROAD

        A hearing was ordered for September 27, 2007 on the petition of National Grid for a solely owned pole location on Lincoln Road.


#586 – CONDUIT ON HIGHLAND AVENUE AND TRADER’S WAY

        A hearing was ordered for September 27, 2007 on the petition of Comcast to install a conduit on Highland Avenue and Trader’s Way.

#587 – FIESTA SHOWS TO HOLD A CARNIVAL

        The request of Fiesta Shows to hold a carnival at 289 Derby Street from October 12-31, 2007 from noon to 10:00 P.M. daily.

        Councillor Corchado amended hours be changed from 10:00 P.M. to 9:00 P.M., it was so voted.

        Councillor Lovely amended the start date to October 19 – 31, 2007, it was so voted.

        Councillor O’Keefe was recorded as opposed.

        Councillor Lovely moved to approve the request as amended contingent on the certificate of insurance be changed from 279 Derby Street to 289 Derby Street.

        The petition was granted as amended by a roll call vote of 7 yeas, 4 nays, 0 absent. Councillors Prevey, Pelletier, O’Keefe, Lovely, Furey, Corchado and Veno were recorded as voting in the affirmative. Councillors Sosnowski, Sargent, O’Leary and Blair were recorded as voting in the negative.

        Councillor Pelletier moved for immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.



#588 – REQUEST OF NORTH SHORE MEDICAL CENTER TO HOLD A CANCER WALK

        The request of North Shore Medical Center to hold their annual Cancer Walk and the closing of Derby and Lafayette Streets on June 22, 2008, was granted.


#589 – REQUEST OF SAMMY’S ROAST BEEF & SEAFOOD FOR EXTENDED HOURS OF OPERATION

        The request of Sammy’s Roast Beef and Seafood located at 17 Canal Street for extended hours of operation on Thursday, Friday and Saturday from 11:00 P.M. to 2:00 A.M., was granted.

The matter of second and final passage of an Ordinance amending Traffic, Section 49, Stop Sign, Bradley Road, was then taken up. The Ordinance was adopted for second and final passage.



(#551) – SECOND PASSAGE -ORDINANCE AMENDING ZONING, CLARK AVENUE

The matter of second and final passage of an Ordinance amending Zoning, Clark Avenue rezone parcels from Industrial to R-1, was then taken up. The Ordinance was adopted for second and final passage by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

Councillor Pelletier moved for immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.
