MINUTES JANUARY 11, 2007


A Regular Meeting of the City Council was held in the Council Chamber on Thursday,
January 11, 2007 at 7:00 P.M., for the purpose of transacting any and all business.  Notice of
this meeting was posted on January 5, 2007 at 8:59 A.M.


       All Councillors were present.

       Council President Matthew Veno presided.


 Councillor Pelletier moved to dispense with the reading of the record of the previous meeting. It was so voted.

Councillor Veno recognized past City Councillors in the audience Kevin Harvey, Sarah Hayes and Jean-Guy Martineau.

Councillor Lovely requested and received unanimous consent to suspend the rules to allow Kevin Harvey to present to the recipients of Kernwood Scholarships. The Scholarships were presented to Chris Noble, Patrick Sargeant, Eric Dodge, Louis De La Santos, John Taubeneck and Ryan Tobin.

Councillor Lovely requested and received unanimous consent to return to the regular portion of the meeting.


#4 – CONDUIT ON BELLEVIEW AVENUE

        A hearing was held on the Order of National Grid for a conduit on Belleview Avenue. Appearing in favor was Mr. John Jankowski of National Grid and Ellen Kelleher. Appearing in opposition was Jennifer Cookson abutting neighbor.

        Councillor O’Keefe moved that the matter be held until the next regularly scheduled Council meeting. Councillor Furey was recorded as opposed.  


#5 – POLE ON WILLSON ROAD

A hearing was held on the Order of National Grid for a solely owned pole on Willson Road. Appearing in favor was Mr. John Jankowski of National Grid.

        Councillor O’Keefe moved that the matter be held until the next regularly scheduled Council meeting.    

(#779 of 2006) – APPT. ANTHONY AMORE TO THE RENEWABLE ENERGY TASK FORCE

Held over from the last meeting of December 7, 2006, the Mayor’s appointment of Anthony Amore to serve as a member of the Renewable Energy Task Force with a term to expire December 1, 2009, was held until the next meeting of January 25, 2007.


(#783 of 2006) – APPT. NICK LEWIS TO RENEWABLE ENERGY TASK FORCE

Held over from the last meeting of December 7, 2006, the Mayor’s appointment of Anthony Amore to serve as a member of the Renewable Energy Task Force with a term to expire December 1, 2009, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.


#6 – APPT. CINDY KEEGAN TO RENEWABLE ENERGY TASK FORCE

        The Mayor’s appointment of Cindy Keegan to serve as a member of the Renewable Energy Task Force with a term to expire January 1, 2010, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.


#7 – APPT. ROBERT DEROISER TO RENEWABLE ENERGY TASK FORCE

The Mayor’s appointment of Robert DeRoiser to serve as a member of the Renewable Energy Task Force with a term to expire January 1, 2010, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.


#8 – REAPPT. CONSTABLE

        The Mayor’s reappointment of Deyanira Lugo to serve as a Constable for a term to expire October 1, 2007, was received and filed.


#9 – APPR. TO STABILIZATION FUND

        The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

        ORDERED: That the sum of One Hundred and Seven Thousand, Six Hundred and Seventy-Five Dollars ($107,675.00) is hereby appropriated from the “Fund Balance Reserved for Appropriations – Free Cash” account to the “Stabilization Fund” account in accordance with the recommendation of Her Honor the Mayor.

#10 – APPR. TO VETERANS - BENEFITS

        The following Order, recommended by the Mayor, was adopted by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

Councillor Prevey moved for immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.

        ORDERED: That the sum of Forty-Nine Thousand Dollars ($49,000.00) is hereby appropriated from the “Fund Balance Reserved for Appropriations – Free Cash” account to the “Veterans - Benefits” account in accordance with the recommendation of Her Honor the Mayor.


#11 – APPR. TO POLICE COMMUNITY EVENTS

        The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

        ORDERED: That the sum of Fifteen Thousand, Six Hundred and Fifty-One Dollars and Ninety-two Cents ($15,651.92) is hereby appropriated from the “Police Overtime” account to the “Police Community Events” account in accordance with the recommendation of Her Honor the Mayor.


#12 – APPR. TO PUBLIC PROPERTY – EMERGENCY REPAIRS

        The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

        ORDERED: That the sum of Thirteen Thousand, Four Hundred and Twenty-Five Dollars  ($13,425.00) is hereby appropriated from the “Fund Balance Reserved for Appropriations – Free Cash” account to the “Public Property – Emergency Repairs” account in accordance with the recommendation of Her Honor the Mayor.


#13 – APPR. TO FIRE – RETIREMENT ANTICIPATION

        The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

        ORDERED: That the sum of Twelve Thousand and Sixty-Five Dollars  ($12,065.00) is hereby appropriated from the “Fund Balance Reserved for Appropriations – Free Cash” account to


the “Fire – Retirement Anticipation” account in accordance with the recommendation of Her Honor the Mayor.


#14 – TRANSFER TO PUBLIC SERVICES – INTEREST ON NOTES

        The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

        ORDERED: That the sum of Ten Thousand, Six Hundred and Twenty-Eight Dollars and Seventy-two Cents ($10,628.72) is hereby appropriated from the “Retained Earnings – Water Fund” account to the “Public Services – Interest on Notes” account in accordance with the recommendation of Her Honor the Mayor.


#15 – TRANSFER TO CEMETERY - BURIAL

        The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

        ORDERED: That the sum of Ten Thousand ($10,000.00) is hereby appropriated from the “Receipts Reserved – Sale of Lots” account to the “Cemetery - Burial” account in accordance with the recommendation of Her Honor the Mayor.


#16 – TRANSFER TO FIRE – FULL TIME SALARIES

        The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

        ORDERED: That the sum of Seven Thousand ($7,000.00) is hereby appropriated from the “Fund Balance Reserved for Appropriation – Free Cash” account to the “Fire – Full Time Salaries” account in accordance with the recommendation of Her Honor the Mayor.


#17 – ACCEPTANCE OF M.G.L. CHAPTER 39, SECTION 23D

        The following Order, recommended by the Mayor, was referred to the Committee on Ordinances, Licenses and Legal Affairs.

        ORDERED: That the City of Salem hereby accepts the provisions of Massachusetts General Laws, Chapter 39, Section 23D. Upon acceptance, members of the City Council, Appeals Board, Conservation Commission, Board of Health, Historical Commission, Licensing Board and Planning

Board, when holding an adjudicatory hearing, shall not be disqualified from voting in the matter solely due to that member’s absence from no more than a single session of the hearing at which testimony or other evidence is received. Before any such vote, the member shall certify in writing that he or she has examined all evidence received at the missed session and this certification shall become part of the record of the hearing.


#18 – ORDINANCE AMENDING CH. 46, SEC. 35, 36, 66 & 232 RELATIVE TO WATER & SEWER

The following Ordinance, recommended by the Mayor, was referred to the Committee on Ordinances, Licenses and Legal Affairs and to be co-posted with the Committee of the Whole.

In the year two thousand and seven

An Ordinance to amend an Ordinance relative to Water and Sewer

Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Chapter 46, Section 46-35(c) Meter Testing; Tampering and Section 46-36 Due Date and Payment of Bills are hereby amended by deleting the word “quarterly” as it appears in these sections.

Section 2. Chapter 46, Section 46-66(c) Schedule is hereby amended by deleting sub-section  (c) in its entirety and re-lettering sub-sections (d) and (e) as sub-section (c) and (d), respectively.

Section 3. Chapter 46, Section 46-232 (a) Payment of Sewer Use Charges is hereby amended by deleting sub-section (a) in its entirety and replacing it with the following new sub-section (a):

“(a) Sewer use charges will be determined by water use and shall be charged separately, but coincidental with water bills.”

Section 4. This Ordinance shall take effect as provided by City Charter.


(#861 of 2006) – HELD OVER ACCEPTANCE OF M.G.L. CH. 44, SEC. 53F ½ ESTABLISH ENTERPRISE FUND FOR SOLID WASTE COLLECTION

        Held over from the last meeting of December 7, 2006 the following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance and to be co-posted with the Committee of the Whole.

        ORDERED:        Be It Hereby Ordered by the City Council of the City of Salem, as follows:

        The City of Salem hereby accepts the provisions of Chapter 44, Section 53F ½ of the Massachusetts General Laws, and establishes an enterprise fund for solid waste collection, effective fiscal year two thousand and eight.


#19 – DUAL POLE LOCATIONS IN THE CITY OF SALEM

        Councillor Pelletier introduced the following Order, which was adopted.

        ORDERED: That representatives from National Grid and Verizon come before the Committee on Ordinances, Licenses and Legal Affairs and co-post with the Committee of the Whole, to discuss the dual pole locations in the city. And to invite the City Solicitor, Mayor or designee, and interested parties, that this meeting be held before the next Council meeting.


#20 – COMMUNITY PRESERVATION ACT

        Councillor Furey introduced the following Order, which was adopted.

        ORDERED: That the Committee on Community and Economic Development meet to discuss the Community Preservation Act. Invited to the meeting Mr. Bollen, Director of Parks and Recreation, Members of the Park and Recreation Commission, representative of Friends of Salem Woods, representative of Point Neighborhood Association, representative of the Affordable Housing Trust and City Neighborhood Alliance.


#21 – RESOLUTION: VICTORIA STATION RESTAURANT FOR COMMUNITY SERVICE

        Councillor Sosnowski introduced the following Resolution, which was adopted.

        RESOLUTION:

WHEREAS:         That the City of Salem owes a debt of gratitude to Victoria Station, a restaurant at Pickering Wharf in Salem, for their many years of support to the school children of Salem, and;

WHEREAS:   Victoria Station has hosted the event known as “Salem’s Children’s Charity Auction” for the past thirteen years, and;

WHEREAS:   Victoria Station and its manager Paul Schafer not only hosted this auction but  also donated all the food to help with this fundraiser.

NOW THEREFORE BE IT RESOLVED That the City Council on behalf of the residents of the City of Salem go on record to publicly thank Victoria Station for their many years of dedicated community service to our school children, and that a suitable copy of this resolution be presented to Victoria Station.


#22 – HARBOR PLAN AND SALEM PORT DEVELOPMENT PROJECT

        Councillor Corchado introduced the following Order, which was adopted.

        ORDERED: That Her Honor the Mayor meet with the Committee of the Whole to discuss the Harbor Plan and the Salem Port Development Project and any other upcoming waterfront matters.


#23 – ORDINANCE, TRAFFIC, PARKING PROHIBITED, TOW ZONE, LORING AVENUE

        Councillor O’Keefe introduced the following Ordinance, which was adopted for first passage.

        In the year two thousand and seven

An Ordinance to amend an Ordinance relative to Traffic, Chapter 42, Section 74, Parking Prohibited, Tow Zone

Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Loring Avenue, westerly side beginning at the intersection of Jefferson Avenue and extending in a southerly direction for a distance of 186 feet. “No Parking, Tow Zone”

Section 2. This Ordinance shall take effect as provided by City Charter.


#24 – SUITABLE LOCATION FOR AN OFFICE FOR THE COMMISSION ON DISABILITIES

        Councillor Sosnowski introduced the following Order, which was adopted.

        ORDERED: That the Committee on Government Services meet to discuss finding a suitable location for the Commission on Disabilities (C.O.D.) and that the public building director, and the Commission on Disabilities be invited.







#25 – SCHOOL FINANCIAL REPORT

        Councillor Prevey introduced the following Order, which was adopted.

        ORDERED: That the enclosed Salem Public School Financial Report and Correspondence prepared by the Business Administrator be referred to the Committee on Administration and Finance.

        Councillor Pelletier amended to include a letter be sent to Mr. Guy to have him come to the Committee on Administration and Finance meeting when the report is submitted. It was so voted.



#26 – PARKING ISSUES IN THE DOWNTOWN

        Councillor Sosnowski introduced the following Order, which was adopted.

        ORDERED: That the Committee on Ordinances, Licenses and Legal Affairs, co-posted with the Committee of the Whole meet to discuss various parking issues throughout the downtown, cost per hour, time limit, various amounts of fines for violations and signage be addressed.

        The representatives from the Parking Department, Parking Commission, Police Department, and neighborhood Association, Salem Common Neighborhood Association and Federal Street Neighborhood Association be invited.



#27 – SIXTY DAY TRIAL PERIOD FOR STOP SIGN AT DIBIASI STREET

Councillor O’Leary introduced the following Order, which was adopted.

ORDERED: That the Police Traffic Division institute the following traffic regulations for a trial period of up to sixty (60) days.

Chapter 42, Section 49, “Obedience to Isolated Stop Signs”

Dibiase Street, northeasterly bound traffic at Sable Road. “Trial Period up to sixty (60) days.







#28 – RULE 31B OF THE CITY COUNCIL BE REVIEWED

        Councillor Lovely introduced the following Order, which was adopted.

        ORDERED: That Section 31B Disposition of Matters referred to Committees of the Rules and Orders of the City Council Meetings, Quorums, Proceedings, be referred to the Committee on Ordinances, Licenses and Legal Affairs for review and possible revision and that the City Solicitor be invited to attend and participate.



#29 – COMMITTEE MEET REGARDING “PROJECT LIFE SAVER”

Councillor Sosnowski introduced the following Order, which was adopted.

ORDERED: That the Committee on Government Services meet to discuss the implementation of “Project Life Saver”, and that a funding source be identified. Also that representatives from the Commission on Disabilities and the Police Department be invited.

#31 – FINANCIAL REPORT AND YEAR TO DATE BUDGET REPORT

Councillor Prevey introduced the following Order, which was adopted.

ORDERED: That the enclosed Monthly Financial Report dated November 30, 2006 and the Year to Date Budget Report dated December 31, 2006 be received and placed on file.






#32 – FEASIBILITY OF INSTALLING CAMERA(S) IN HANDICAP PARKING AREAS AT THE MBTA LOT

        Councillor Sosnowski introduced the following Order, which was adopted.

        ORDERED: That the Committee on Government Services meet to discuss the feasibility of installing camera(s) in the Handicapped Parking Area of the MBTA Lot for the purpose of catching those that abuse or violate City Ordinances. The representatives from the MBTA and the Salem Police Traffic Division and the Commission on Disabilities be invited.


#33 – CAMERA(S) AT VARIOUS TROUBLE SPOTS IN THE CITY

Councillor Sosnowski introduced the following Order, which was adopted.

        ORDERED: That the Committee on Government Services meet to discuss the use of “Red Light / Stop Sign” cameras at various trouble spots throughout the City. That Lt. Preczewski of the Police Traffic Division be invited.


#34 – DISCUSS A ZONING AMENDMENT REGARDING PARKING SPACES PER UNIT

        Councillor Sosnowski introduced the following Order, which was adopted.

        ORDERED: That the Committee on Ordinances, Licenses and Legal Affairs meet to discuss a zoning amendment that requires two parking spaces per unit regardless of zone. That members of the Planning Board, Zoning Board of Appeals, Planning Department and the Police Traffic Division be invited.

#36 – (#848) – APPR. PUBLIC PROPERTY – FULL TIME SALARIES

        Councillor Prevey offered the following report for the Committee on Administration and Finance. It was voted to accept the report. The matter was not adopted and was referred back to the Committee on Administration and Finance to be reported out at the next meeting.

        The Committee on Administration and Finance to whom was referred the matter of an appropriation of $35,000.00 to Public Property – Full Time Salaries, has considered said matter and would recommend Approval.


#37 – (#680, #277 of 2006) – ORDINANCE RELATIVE TO SALARY & CLASSIFICATION OF CERTAIN EMPLOYEE (DIRECTOR OF INSPECTIONAL SERVICES)

Councillor Prevey offered the following report for the Committee on Administration and Finance. It was voted to accept the report. The matter was not adopted and was referred back to the Committee on Administration and Finance to be reported out at the next meeting. Also that the Mayor be asked to endorse the Ordinance which she did not sign.

The Committee on Administration and Finance to whom was referred the matter of an ordinance relative to the Salary Classification of Certain Employees (Director of Inspectional Services)

        A hearing was ordered for January 25, 2007 on the petition from National Grid for a conduit on Highland Avenue.
