MINUTES SEPTEMBER 14, 2006

A Regular Meeting of the City Council was held in the Council Chamber on Thursday,
September 14, 2006 at 7:00 P.M., for the purpose of transacting any and all business.  Notice of
this meeting was posted on September 8, 2006 at 8:44 A.M.


       All Councillors were present.

       Council President Jean M. Pelletier presided.


  Councillor Lovely moved to dispense with the reading of the record of the previous meeting. It was so voted.

       President Pelletier requested that everyone please rise to recite the Pledge of Allegiance.


(#534) –  HELD FROM LAST MEETING APPOINTMENT OF KATHLEEN WILKINSON TO COUNCIL ON AGING

        Held over from the last meeting of July 20, 2006, the Mayor’s appointment of Kathleen Wilkinson to serve as a member of the Council on Aging Board, for a term to expire July 1, 2009, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillor Veno requested and received unanimous consent to suspend the rules to allow Ms. Wilkinson to speak.


(#541) – HELD FROM LAST MEETING APPOINTMENT OF RACHEL HUNT TO BIKE PATH COMMITTEE

        Held over from the last meeting of July 20, 2006, the Mayor’s appointment of Rachel Hunt to serve as a member of the Bike Path Committee, for a term to expire July 1, 2008, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent. Councillor Corchado requested and received unanimous consent to suspend the rules to allow Ms. Hunt to speak.


#609 – APPT. OF DAVID SHEA AND RICK LEE TO LICENSING BOARD

        The Mayor’s appointment of David Shea to serve as chairman for the Licensing Board, for a term to expire June 1, 2011 and Rick Lee to serve as a member of the Licensing Board, for a term to expire July 1, 2009, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

Councillor O’Leary moved immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.


Councillor Furey moved that a letter of thanks and a City Seal be sent to Harold Blake. It was so voted.

Councillor O’Leary requested and received unanimous consent to suspend the rules to allow Mr. Shea and Mr. Lee to speak.


#610 – APPT. OF JOHN WALSH TO PARKING BOARD

The Mayor’s appointment of John Walsh to serve as a member of the Parking Board, for a term to expire July 1, 2008, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

Councillor Veno requested and received unanimous consent to suspend the rules to allow Mr. Walsh to speak.


#611 – APPT. OF ROBERTA CLEMENT TO BEAUTIFICATION COMMITTEE

The Mayor’s appointment of Roberta Clement to serve as a member of the Beautification Committee, for a term to expire September 1, 2008, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

Councillor Sosnowski requested and received unanimous consent to suspend the rules to allow Ms. Clement to speak.


#612 – APPT. OF SANDRA POWER TO BEAUTIFICATION COMMITTEE

The Mayor’s appointment of Sandra Power to serve as a member of the Beautification Committee, was held until the next meeting of September 28, 2006.



#613 – APPT. OF THOMAS MORAN TO BEAUTIFICATION COMMITTEE

The Mayor’s appointment of Thomas Moran to serve as a member of the Beautification Committee, for a term to expire September 1, 2008, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

Councillor O’Keefe requested and received unanimous consent to suspend the rules to allow Mr. Moran to speak.




#614 – APPT. OF DAN SHUMAN TO BIKE PATH COMMITTEE

The Mayor’s appointment of Dan Shuman to serve as a member of the Bike Path Committee, for a term to expire September 1, 2008, was confirmed by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

Councillor Corchado requested and received unanimous consent to suspend the rules to allow Mr. Shuman to speak.

        The Mayor’s reappointment of the following Constables was received and filed.

#617 – CONSTABLE

The following reappointment of the following Constable was received from the Mayor after the deadline of Tuesday noon. Councillor Lovely requested and received unanimous consent to suspend the rules to allow the matter to come before the Council. The reappointment was received and filed.

#618 – APPR. EXTERIOR PAINTING CENTRAL STATION AND VEHICLE FOR VETERANS SERVICES

        The following Order, recommended by the Mayor, was adopted under suspension of the rules by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

        ORDERED: That the previously unexpended appropriation of $30,000.00 from the Capital Outlay Account for fire engine repairs be re-programmed as follows:
$10,000.00 for exterior painting of Central Station and $20,000.00 for purchase of new vehicle for Veterans Services.






#619 – APPR. CEMETERY BURIAL

        The following Order, recommended by the Mayor, was adopted under suspension of the rules by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

        ORDERED: That the sum of Five Thousand Dollars ($5,000.00) is hereby appropriated from the “Receipts Reserved – Sale of Lots” account to the “Cemetery – Burial” account in accordance with the recommendation of Her Honor the Mayor.


#620 – TRANSFER TO CEMETERY – BURIAL

The following Order, recommended by the Mayor, was adopted under suspension of the rules by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

        ORDERED: That the sum of Four Thousand, One Hundred and Fifty-Eight Dollars and Seventy-eight cents ($4,158.78) is hereby appropriated from the “Receipts Reserved – Sale of Vaults” account to the “Cemetery – Burial” account in accordance with the recommendation of Her Honor the Mayor.


#621 – ORDINANCE AMENDING ORDINANCE RELATIVE TO PLUMMER FARM SCHOOL

        The following Ordinance, recommended by the Mayor, was adopted for first passage.

        In the year two thousand and six

        An Ordinance to amend an Ordinance relative to Plummer Farm School

        Section 1. Chapter 2, Article XIII, Plummer Farm School, Section 2-1973(a) Trustees Appointment is hereby amended by deleting the word “two” and replacing it with the word “fifteen”

        Section 2. This Ordinance shall take effect as provided by City Charter.


#622 – ORDINANCE AMENDING WATER AND SEWER

The following Ordinance, recommended by the Mayor, was referred to the Committee of the Whole for a Public Hearing.

        In the year two thousand and six

        

An Ordinance to amend an Ordinance relative to Water and Sewer

        Section 1. Chapter 46, Section 46-35 (c) Meter Testing; Tampering and Section 46-36 Due Date and Payment of Bills are hereby amended by deleting the word  “quarterly” as it appears in these sections.

        Section 2. Chapter 46, Section 46-66 (c) Schedule is hereby amended by deleting sub-section (c) in its entirety and re-lettering sub-sections (d) and (e) as sub-section (c) and (d), respectively

        Section 3. Chapter 46, Section 46-232(a) Payment of Sewer Use Charges is hereby amended by deleting sub-section (a) in its entirety and replacing it with the following new sub-section (a):

        “(a) Sewer use charges will be determined by water use and shall be charged separately, but coincidental with water bills.”

        Section 4. This Ordinance shall take effect as provided by City Charter.


#623 – ACCEPT PROVISION OF MGL CHAPTER 39, SECTION 23D

The following Order, recommended by the Mayor, was referred to the Committee of the Whole.

ORDERED: That the City of Salem hereby accepts the provision of Massachusetts General Laws, Chapter 39, Section 23D. Upon acceptance, members of the City Council, Appeals Board, Conservation Commission, Board of Health, Historical Commission, Licensing Board and Planning Board, when holding an adjudicatory hearing, shall not be disqualified from voting in the matter solely due to that member’s absence from no more than a single session of the hearing at which testimony or other evidence is received. Before any such vote, the member shall certify in writing that he or she has examined all evidence received at the missed session and this certification shall become part of the record of the hearing.











#624 – DOR FINANCIAL MANAGEMENT REVIEW

        The Financial Management Review prepared by the Department of Revenue submitted by the Mayor was referred to the Committee of the Whole.


#625 – COMMUNICATION FROM MAYOR REQUESTING SPECIAL MEETING

        The communication from the Mayor requesting a Special Meeting for extended hours of operation for Sammy’s Roast Beef, was referred to the Committee of the Whole to hold a public hearing on September 25, 2006 at 6:30 P.M.


#626 – PROJECT SAILMAKERS INC. TO MASS DEVELOPMENT FINANCE AGENCY FOR REVENUE BONDS

        The following Order was received from the Mayor after the deadline of Tuesday noon. Councillor O’Leary requested and received unanimous consent to suspend the rules to allow the matter to come before the Council.

The following Order, recommended by the Mayor, was adopted by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

ORDERED: AN ORDER REFERRING A PROJECT IN THE CITY OF SALEM TO THE MASSACHUSETTS DEVELOPMENT FINANCE AGENCY

WHEREAS, the Massachusetts Development Finance Agency (the”Agency”) has received an inquiry from Doyle Sailmakers, Inc., (the “Sponsor”, which term includes any parent, subsidiary or related affiliate entity) as a potential Sponsor of a project to be located in the City of Salem Massachusetts, and being generally described as the financing of : (I) the acquisition and renovation of approximately 31,000 sq. ft. in a 170,000 sq. ft. commercial condominium building located at an existing commercial facility at 96 Swampscott Road, Salem, Massachusetts, to be owned by Doyle Sailmakers, Inc.: and (II) the acquisition for the manufacturing facility.

WHEREAS, the Sponsor has made application to the Agency for the financing of the Project through the issuance of its Revenue Bonds (the “Bonds”)

WHEREAS, the Agency has notified the City in writing of such inquiry by the Sponsor, in compliance with Section 8(a) of Chapter 23G of the Massachusetts General Laws, as amended, and;




NOW, THEREFORE, BE IT ORDAINED that the City Council acting in the name and behalf of the City of Salem, Massachusetts, hereby requires the Agency assume the role of an industrial development financing authority in financing the Project by issuance of the Bonds pursuant to Massachusetts General Laws Chapter 23G and Chapter 40D to finance the project.


#627 – RESOLUTION TRAFFIC ENFORCEMENT RE- PROGRAM FUNDING

The following Order was received from the Mayor after the deadline of Tuesday noon. Councillor O’Leary requested and received unanimous consent to suspend the rules to allow the matter to come before the Council.

The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance.

RESOLUTION:

WHEREAS, motor vehicle speeding in neighborhoods throughout the City of Salem is a public safety concern that also impacts quality of life in residential areas; and

WHEREAS, due to budgetary constraints and reduced patrol staffing in the Police Department the Traffic Unit is not fully staffed, and

WHEREAS, there is a need for traffic enforcement in the interim period of time between full staffing of the Traffic Unit can be achieved;

NOW THEREFORE BE IT RESOLVED that the Salem City Council is in favor of the proposed neighborhood traffic/speeding enforcement initiative and would recommend that the Administration and the Police Department proceed with implementation.


#628 – MAYOR INFORMING COUNCIL OF APPOINTING FINANCE DIRECTOR AS ACTING PURCHASING AGENT


A communication from the Mayor, appointing the Finance Director as acting Purchasing Agent, was received and filed.






#629 – MAYOR INFORMING COUNCIL OF CONTRACT WITH MIIA AS CITY’S INSURANCE PROVIDER

A Communication was received from the Mayor after the deadline of Tuesday noon. Councillor O’Leary requested and received unanimous consent to suspend the rules to allow the matter to come before the Council.

        A communication from the Mayor informing the City Council of a contract with MIIA as the City’s Insurance provider was referred to the Committee of the Whole.


#630 – MAYOR INFORMING COUNCIL REGARDING  CONCERNS FOR ST. JOSEPH’S CHURCH PROPERTY AS SENIOR CENTER

A Communication was received from the Mayor after the deadline of Tuesday noon. Councillor O’Leary requested and received unanimous consent to suspend the rules to allow the matter to come before the Council.

A communication from the Mayor informing the City Council of concerns regarding the St. Joseph’s property as the new Senior Community life center, was referred to the Committee of the Whole.


#631 – PRESERVATION PLANS FOR POINT NEIGHBORHOOD

        Councillor Furey and Corchado introduced the following Order, which was adopted.

        ORDERED:  That the Committee on Community and Economic Development meet to discuss the following proposed preservation plans as recommended by the “Point Neighborhood Historic Resources Survey and Preservation Plan (by Vanasse Hangen Brustien, Inc.)
        
1.      Adopt Community Preservation Act
2.      Strengthen the Demolition Delay Ordinance
3.      Create a Neighborhood Conservation District Ordinance

And other recommendations as may pertain to this committee. Invite City Solicitor, Building Inspector, representative of Conservation Commission.







#632 – CITY’S YEAR TO DATE BUDGET REPORT FOR JULY AND AUGUST 2006

        Councillor O’Leary introduced the following Order, which was adopted.

        ORDERED: That the City’s Year to Date Budget Report for the months of July and August 2006 be received and filed.


#633 – ORDINANCE AMENDING TRAFFIC HANDICAP PARKING, MALL STREET

        Councillor Sosnowski introduced the following Ordinance, which was adopted for first passage.

        In the year two thousand and six

        An Ordinance to amend an ordinance relative to Traffic, Chapter 42, Section 50A, “Handicap Parking, Tow Zone”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. In front of #1 Mall Street, for a distance of twenty feet, “Handicap Parking, Tow Zone”

        Section 2. This Ordinance shall take effect as provided by City Charter.


#634 – PILOT OR SILOT FOR KERNWOOD COUNTRY CLUB

        Councillor Prevey introduced the following Order, which was adopted.

        ORDERED: That the City of Salem enter into dialogue with the owners of the Kernwood Country Club in an effort for the City to receive additional revenues via the PILOT Program or some service or benefit via the SILOT program.

        And that the matter be referred to the Committee on Administration and Finance.


#635 – AGREEMENT FOR PAYMENT TO BAKER’S ISLAND IN LIEU OF SERVICES

        Councillor Corchado introduced the following Order, which was adopted.

        ORDERED: That the Mayor, City Solicitor and Trustees of Baker’s Island meet to discuss the amount to be paid by the City of Salem in lieu of Police and Fire services to Baker’s Island and

that said agreement be documented and filed as a legal document or Memorandum of Understanding between the parties. This matter to be referred to the Committee on Ordinances, Licenses and Legal Affairs and Committee on Administration and Finance.


#636 – HOURS OF OPERATION BETWEEN THE HOURS OF 11:00 PM AND 6:00 AM

        Councillor Sargent and Councillor Pelletier introduced the following Order, which was adopted.

        ORDERED: That the Salem City Council Committee of the Whole meet to discuss the matter of Hours of Operation between the hours of 11:00 P.M. and 6:00 A.M.

        The general public will be invited to this meeting, and discuss the issue and how they feel it affects the City of Salem, or how it affects them personally. I ask that this meeting be scheduled at the same time as the Sammy’s Roast Beef Public Hearing on Monday, September 25, 2006 at 6:30 P.M.

#637 – ORDINANCE AMENDING TRAFFIC, PARKING PROHIBITED

        Councillor O’Keefe introduced the following Ordinance, which was adopted for first passage.

        In the year two thousand and six

        An Ordinance to amend an Ordinance relative to Traffic, Chapter 42, Section 51B, “Parking Prohibited Certain Streets”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. Lafayette Street easterly side, beginning at the Marblehead line and running in a northerly direction to the corner of Rosedale Avenue, “Two Hour Parking, Tow Zone”

        Section 2. This Ordinance shall take effect as provided by City Charter.


#638 – PROGRESS AND COMPLIANCE OF SUNSHINE ORDINANCE

        Councillor Prevey introduced the following Order, which was adopted.

        ORDERED: That the City provide the Council with a specific update regarding efforts and progress relative to compliance with the City’s Sunshine Ordinance.

        And the matter be referred to the Committee on Government Services.


#639 – SALEM STATE COLLEGE PROFESSOR AVI CHOMPSKY  DELEGATION TRIP TO TOBACO COLUMBIA

        Councillor Veno introduced the following Order, which was adopted.

        ORDERED:        That Salem State College Professor Avi Chomsky be invited to appear before the Committee of the Whole to discuss her participation in a delegation trip to Tobaco Columbia.


#640 – BOARDS AND COMMISSIONS BE REQUIRED TO AUDIO TAPE MEETINGS

        Councillor Sosnowski introduced the following Order, which was adopted.

        ORDERED: That the Committee on Ordinances, Licenses and Legal Affairs meet to discuss drafting an Ordinance to require all Boards and Commissions to audio tape their meetings and also amplify the discussions so that the entire audience can hear what is being said.


#641 – ORDINANCE AMENDING TRAFFIC, REPEAL OF HANDICAP PARKING

        Councillor Corchado introduced the following Ordinance, which was adopted for first passage.

        In the year two thousand and six

        An Ordinance to amend an ordinance relative to Traffic, Chapter 42, Section 50B, “Handicap Parking, Limited Time”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. Repeal “Handicap Parking, Limited Time” in front of #9 Salem Street

        Section 2. This Ordinance shall take effect as provided by City Charter.


#642 – ORDINANCE AMENDING TRAFFIC, HANDICAP PARKING

        Councillor Veno introduced the following Ordinance, which was adopted for first passage.

In the year two thousand and six

        

An Ordinance to amend an ordinance relative to Traffic, Chapter 42, Section 50B, “Handicap Parking, Limited Time”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. Repeal “Handicap Parking, Limited Time”, in front of #101 Broadway

        Section 2. This Ordinance shall take effect as provided by City Charter.


#643 – RE-ESTABLISH A TASK FORCE RELATIVE TO HOMELESSNESS

        Councillor Prevey introduced the following Order, which was adopted.

        ORDERED: That the City re-establish a task force with the purpose of addressing the issue of homelessness within the City. In addition, the Task Force will be charged with the objective of focusing on problems related to homelessness, homeless persons and other related matters. As part of the Task Force, two (2) members of the Council, member of the Police Department, member of the Mayor’s office and members of the community and members of the Salem Mission.

        And that the matter be referred to the Committee on Community and Economic Development.


#644 – SCHEDULE PUBLIC HEARING REGARDING FUTURE PLANS FOR COUNCIL ON AGING SITE

        Councillor Blair introduced the following Order, which was adopted.

        ORDERED: That the City Council schedule a public hearing to discuss the proposed Council on Aging site. Such meeting will include the estimated costs involved and any plans for the current location at 5 Broad Street.

        And be it further ordered that the Mayor or members of her staff be invited along with members of the Council on Aging including the Director and Board.


#645 – ORDINANCE AMENDING TRAFFIC, HANDICAP PARKING

Councillor Pelletier introduced the following Ordinance, which was adopted for first passage.

        In the year two thousand and six

        
An Ordinance to amend an ordinance relative to Traffic, Chapter 42, Section 50B, “Handicap Parking, Limited Time”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. In front of #5 Laurent Road, for a distance of twenty (20) feetl “Handicap Parking, Tow Zone”

        Section 2. This Ordinance shall take effect as provided by City Charter.


#646 – TRIAL PERIOD, OBEDIENCE TO ISOLATED STOP SIGNS

        Councillor Pelletier introduced the following Order, which was adopted.

        ORDERED: That the Police Traffic Division institutes the following traffic regulations for a trial period of up to ninety (90) days.

        Chapter 42, Section 49, “Obedience to Isolated Stop Signs”

        Hathorne Street, north and south bound traffic at Endicott Street. “Trial Period up to ninety (90) days.


#647 – ORDINANCE AMENDING TRAFFIC, PARKING TIME LIMITED

Councillor Pelletier introduced the following Ordinance, which was adopted for first passage.

        In the year two thousand and six

        An Ordinance to amend an ordinance relative to Traffic, Chapter 42, Section 57A, “Parking Time Limited, Unmetered Zone”

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1. Easterly side, 20 feet from the intersection of Essex and Washington Street and running forty-four (44) feet in a northerly direction.

        Repeal fifteen (15) minute parking, and replace with thirty (30) minute parking.

        Section 2. This Ordinance shall take effect as provided by City Charter.



#648 – TRIAL PERIOD, OBEDIENCE TO ISOLATED STOP SIGNS

        Councillor Pelletier introduced the following Order, which was adopted.

        ORDERED: That the Police Traffic Division institutes the following traffic regulations for a trial period of up to ninety (90) days.

        Chapter 42, Section 49, “Obedience to Isolated Stop Signs”

        Margin Street, south bound traffic at Mill Street, “Trial Period up to ninety (90) days.


#649 – MEET WITH BUSINESS MANAGER  OF THE SCHOOL DEPARTMENT

        Councillor O’Leary introduced the following Order, which was adopted.

        ORDERED: That a letter be sent, to the Business Manager of the School Department to appear before the City Council Committee on Administration and Finance.

        And that a member of the School Committee be invited.



#650 – SECOND ANNUAL SALEM SENIOR RECOGNITION DAY

        Councillor Pelletier introduced the following Resolution, which was adopted.

        RESOLUTION:

WHEREAS: August 10, 2006, will mark the Second Annual Salem Senior Recognition Day,    and;

WHEREAS: This day Honors all of Salem’s Senior Citizens for their countless contributions and invaluable service to this Community, and;

WHEREAS: They are the driving force behind this community in which they share their wisdom, talents and leadership, and;

WHEREAS: For the many sacrifices they have made to ensure that we may enjoy our quality of life;

NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Salem publicly go on record as applauding our Senior Citizens and commending them for their


outstanding contributions, and voice our appreciation for their leadership and dedication.

AND BE IT FURTHER RESOLVED: That this Resolution be made a matter of record of these proceedings, on behalf of the Salem City Council as a token of our appreciation and admiration.


#651 – (#596, #406, #324) - BLANKET FORTUNETELLING LICENSE, ORDINANCE AMENDING CABLE COMMISSION, CHARTER AGREEMENT WITH WATER TRANSPORTATION ALTERNATIVE

        Councillor Lovely introduced the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was voted to accept the report and the recommendation.

        The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matters of a request for a Blanket Fortunetelling License, Ordinance amending Cable Commission, and Charter Agreement with Water Transportation Alternative, has considered said matter and would recommend that the blanket license be approved, Adoption for first passage of the an Ordinance amending Cable Commission and that the matter of the Charter Agreement be discharged from Committee with no recommendation.


#652 – PLANNING BOARD DECISION FOR PROPOSED ZONING FOR DRIVE-THROUGH FACILITIES

        A communication from Planning Board Chairman Walter B. Power III, submitting the Board’s recommendation regarding proposed zoning amendment for Drive-through facilities, was referred to the Committee on Ordinances, Licenses and Legal Affairs.


#653 – CONDUIT LOCATION ON BOTTS COURT

        A hearing was ordered for September 28, 2006 on the petition of National Grid for conduit locations on Botts Court.


#654 – PETITION RELATING TO TRAFFIC ISSUES ON MARLBOROUGH ROAD

        The petition of Attorney Brian McGrail representing Osborne Hills Realty Trust requesting City Council approval relating to traffic issues on Marlborough Road, was referred to the Committee of the Whole for a Public Hearing.


#655 – PETITION FROM RESIDENTS FOR TEMPORARY MORATORIUM ON BUILDING

        The petition from the residents of Salem for a temporary moratorium on building in Salem was referred to the Committee of the Whole to hold a public hearing.


#656 – REQUEST FOR BLANKET FORTUNETELLING LICENSE

        The request from Sylvia Martinez for a blanket fortunetelling license to hold a psychic fair in October 2006, was granted on the condition that background checks are completed and the $250.00 fee is paid.
