MINUTES JANUARY 13, 2005

A Regular Meeting of the City Council was held in the Council Chamber on Thursday, January 13, 2005 at 7:00 P.M., for the purpose of transacting any and all business.  Notice of this meeting was posted on January 7, 2005 at 10:54 A.M.

       Councillor O’Keefe Absent

        Council President Michael Bencal presided.

Councillor Harvey moved to dispense with the reading of the record of the previous meeting. It was so voted.

       President Bencal requested that everyone please rise to recite the Pledge of Allegiance.





#4 POLE LOCATION ON PEARL STREET


        A hearing was held on the Order of Verizon and Massachusetts Electric Company for a pole location on Pearl Street. Councillor Sosnowski moved that the matter be held till the next regularly scheduled City Council meeting of January 27, 2005. It was so voted.

        


#5 – #6 REAPPOINTMENT OF THE FOLLOWING CONSTABLES

        Mayor’s reappointment of the following Constables with terms to expire as designated. Councillor Sargent moved that the question be divided and hold over the reappointment of Ruthanne Davis till the next meeting. It was so voted and the reappointments of the following was received and filed.

#7 -  APPR. SEWER INFRASTRUCTURE REPAIR

        The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

        ORDERED: That the sum of Two Hundred Thirty-Three Thousand four-hundred sixty Dollars and Fifty-six cents ($233,460.56) is hereby appropriated from the “Retained Earnings – Sewer Fund“ Account to the “Public Services – Sewer Infrastructure Repair” Account in accordance with the recommendation of His Honor the Mayor.


#8 – APPR.  HUMAN RESOURCES – EARLY RETIREMENT INCENTIVE (ERI)

        The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

ORDERED: That the sum of Two Hundred Thirteen Thousand Six Hundred and Seventy –One Dollars ($213,671.00) is hereby appropriated from “Fund Balance Reserved for Appropriation – Free Cash” Account to the “Human Resources – Early Retirement Incentive” (ERI) Account in accordance with the recommendation of His Honor the Mayor.

#23 – RE-USE OF ST. JOSEPH’S SITE

        Councillor Furey introduced the following Order, which was adopted.

        ORDERED:  That the Committee on Community and Economic Development meet at a convenient time with the Committee to re-use St. Joseph’s.


#24 – VARIOUS COMPLAINTS REGARDING TAXI CAB COMPANIES

        Councillor Sosnowski introduced the following Order, which was adopted.

        ORDERED: That the Taxi Cab companies licenses to operate in Salem be ordered to appear before the Committee on Ordinances, Licenses and Legal Affairs to answer to various complaints.


#25 – COMMITTEE FOR SUBSTANCE ABUSE

        Councillor Harvey introduced the following Order, which was adopted by roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Veno, Sosnowski, Sargent, Pelletier, O’Leary, Lovely, Harvey, Furey, Corchado and Bencal were recorded as voting in the affirmative. Councillor O’Keefe was recorded as absent.

        Councillor O’Leary assumes chair. Councillor Bencal asked for support of the order.

        
        ORDERED: That the Committee on Ordinances, Licenses and Legal Affairs meet with Paul O’Shea of Health and Education Incorporated to discuss forming a Community wide Committee for substance abuse prevention, to address the alarming growth in the abuse of opiates. The Committee will be responsible for developing its own mission goals and objectives and that the participants will consist of Service Providers, Law Enforcement Officials, Educators, Community Leaders, Municipal Officials, Parents, Business Leaders, and any other interested community members.

#26 – RESOLUTION SALEM HELP RELIEF EFFORT IN SUMATRA

        Councillor O’Leary introduced the following Resolution, which was adopted.

RESOLUTION:

WHEREAS:        That the people of Salem and the people of Sumatra having a long standing relationship dating back to 1793 when Captain Jonathan Carnes first pulled into Sumatra, as President Washington was giving his inaugural  address.

As the pepper trade peaked in 1805 with the tariffs on the pepper trade collected in Salem accounting for five percent of the United States budget and;

As the peoples of Salem and Sumatra were drawn closed by this trade, despite the miles that separate both;

BE IT FURTHER RESOLVED:  That the City of Salem wishes to step forward and help in the relief efforts to aid our centuries old friends. Further, that the City of Salem wishes to work together and reaches out to the Peabody Essex Museium the Chamber of commerce, the business community, our residents, and other interested parties in seeking an appropriate response to this tragedy.   


#27 – RISING COST OF HEALTH CARE BENEFITS

        Councillor Veno introduced the following Order, which was adopted.

        ORDERED: That the Committee on Administration and Finance meet to discuss possible actions that can be taken to contain the City’s rapidly rising cost for health care benefits for current and retired employees.  And that the Finance Director, Assistant City Solicitor and the Mayor be invited to attend.


#28 – BIKE PATH

        Councillor Lovely introduced the following Order, which was adopted.

        ORDERED: That the Committee on Community & Economic Development meet with the City Planner relative to the creation and design of a bike path. Further that the following be invited to the meeting, a representative of Salem Cycle (70 Washington St.), Mr. David Alden (3 Bradford St., Salem), Mr. Jeffrey Bellin (396 Essex St., Salem), a representative of MassBike (20 Park Plaza, suite 1028, Boston 02116), and a representative of North Shore Cyclist (c/o Emmet Halpen, 541 Lowell St., Wakefield 01880).

#29 – SENIOR PROPERTY TAX RELIEF

        Councillor Lovely introduced the following order, which was adopted.

        ORDERED: That the matter of Senior Property Tax Relief, to decrease the burden on elderly homeowners by increasing exemptions, that is being proposed and supported by his excellency, Governor Romney, Senate President Robert . Travaglini and House Speaker Salvatore F. DiMasi, in their respective roles as Executive and Legislative leaders of the Commonwealth of Massachusetts, be referred to the Committee on Ordinances, Licenses and Legal Affairs for review and recommendation.


#30 – SALEM STATE COLLEGE ROAD RACE & WELLNESS FAIR

        Councillor Harvey offered the following report for the Committee on Ordinances, Licenses and Legal Affairs. It was so voted to accept the report and adopt the recommendation.

        The Committee on Ordinances, Licenses and Legal Affairs to whom was referred the matter of a request from Salem State College to hold a road race and wellness fair on April 10, 2005  has considered said matter and would recommend that request be granted.

#32 – ACCOUNTING REPORT FOR CHAPTER 90 FUNDS

        Councillor Veno offered the following report for the Committee on Administration and Finance. It was voted to accept the report and adopt the recommendation. Councillor Harvey amended the report to request a five year review. It was so voted.

        The Committee on Administration and Finance to whom was referred the matter of requesting a report on the accounting of  Chapter 90 Funds for FY04 and FY05 has considered said matter and would recommend that the matter remain in committee.


#33 –  (#704) – PLANNING BOARD RECOMMENDATION ON PROPOSED ZONING AMENDMENT FOR CHESTNUT STREET

        A communication from Planning Board Chairman Walter Power, submitting the Board’s recommendation regarding the proposed zoning amendment relative to Chestnut Street  rezoning parcels from Residential Two Family (R2) to Residential One Family (R1), Councillor Pelletier moved the recommendation be adopted for first passage by roll call vote. The matter was adopted for first passage by unanimous roll call vote of 10 yeas, 0 nays, 1 absent. Councillor O’Keefe was recorded as absent.

Councillor Pelletier requested moved for immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.

        The matter of second and final passage of an Ordinance amending the Salary Classification of certain employees,Recreation Supervisor was taken up. The Ordinance was adopted for second and final passage by unanimous roll call vote of 10 yeas, 0 nays. 1 absent. Councillor O’Keefe was recorded as absent.

        Councillor O’Leary moved immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.
