MINUTES SEPTEMBER 9, 2004


A Regular Meeting of the City Council was held in the Council Chamber
on Thursday, September 9, 2004  at 7:00 P.M. for the purpose of transacting any
and all business.  Notice of this meeting was posted on September 3, 2004 at 8:30 A.M.

        Councillor Bencal was recorded as absent.

        Council President Leonard F. O’Leary presided.

        Councillor Lovely moved to dispense with the reading of the record of the previous meeting.  It was so voted.

        President O’Leary requested that everyone please rise to recite the Pledge of Allegiance.


#558 – APPT. DR. JANICE L. LEBEL TO PLUMMER HOME FOR BOYS BOARD OF TRUSTEES

        The Mayor’s appointment of Janice L. LeBel as a member of the Plummer Home for Boys Board of Trustees for a term to expire February 1, 2010, was confirmed by roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Corchado, Furey, Harvey, Lovely, O’Keefe, Pelletier, Sargent, Sosnowski, Veno and O’Leary were recorded as voting in the affirmative. Councillor Bencal was recorded as absent.

        Councillor Pelletier moved that a Letter and City Seal be sent to Amelia Cody. It was so voted.

#559 – APPT.  KEITH E. GLIDDEN TO CONSERVATION COMMISSION

        The Mayor’s appointment of Keith E. Glidden to serve as a member of the Conservation Commission for a term to expire March 1, 2007, was confirmed by roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Corchado, Furey, Harvey, Lovely, O’Keefe, Pelletier, Sargent, Sosnowski, Veno and O’Leary were recorded as voting in the affirmative. Councillor Bencal was recorded as absent.

        Councillor O’Keefe moved that a Letter and City Seal be sent to Mr. Allen. It was so voted.




#560 – APPT OF MICHAEL PANNETON AS CONSTABLE

        Mayors appointment of Michael Panneton to serve as a constable for a term to expire August 20, 2007 was received and filed.


#561 – TRANSFER TO CEMETERY - BURIAL

        The following Order recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED: That the sum of Ten Thousand Dollars ($10,000.00) is hereby appropriated to the “Receipts Reserved – Cemetery – Sale of Lots” Account to “Cemetery – Burial” in accordance with the recommendation of His Honor the Mayor.


#562 – APPR. TO PARK & RECREATION – WINTER ISLAND – STORE INVENTORY

        The following Order recommended by the Mayor was referred to the Committee on Administration and Finance under the rules.

        ORDERED: That the sum of Five Thousand Dollars ($5,000.00) is hereby appropriated from the “Receipts Reserved – Golf Course” Account to the “Park and Recreation – Winter Island – Store Inventory” Account in accordance with the recommendation of His Honor the Mayor.


#563 – TRANSFER TO CEMETERY - BURIAL

        The following Order recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED: That the sum of Three Thousand Six Hundred Dollars ($3,600.00) is hereby appropriated from the “Receipts Reserved – Cemetery – Sale of Vaults” Account to the “Cemetery - Burial” Account in accordance with the recommendation of His Honor the Mayor.






#564 – ORDINANCE AMENDING SPRAY PAINT VANDALISM

        The following Ordinance, recommended by the Mayor was referred to the Committee on Ordinances, Licenses and Legal Affairs.

        In the year two thousand and four

        An Ordinance to amend an Ordinance relative to Offenses and Miscellaneous

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1.  Chapter 24, is hereby amended by adding the following new sections:

        Section 24-25 Spray Paint Vandalism

        Any individual who shall use a spray paint container to vandalize shall be subject to a fine of no less than $100.00 and not more than $500.00 to be issued by the police department. Any aforementioned section which contains an enforcement provision shall not be repealed by adoption of this section.

Section 24-26 Sale of Spray Paint

(a)     No person shall knowingly sell or otherwise transfer any spray paint container to a minor, unless the minor is accompanied by his or her parent or legal guardian at the time of the purchase or transfer.
(b)     No minor shall, at the time of purchase of items specified in subsection (a) above, knowingly furnished fraudulent evidence of maturity, including, but not limited to, a motor vehicle operator’s license, a registration certificate issued under the Federal Selective Service Act, an identification card issued to a member of the armed forces, or any document issued by a Federal, State, County or Municipal Government.
(c)     Any individual who violates the provisions of this subsection shall be subject to a fine of no less than $25.00 and not more than $300.00, to be issued by the police department. Any aforementioned section, which contains an enforcement provision shall not be repealed by adoption of this section.

Section 2. This Ordinance shall take effect as provided by City Charter.


#565 – ORDINANCE AMENDING BOATS & WATERWAYS, MOORING PERMITS

The following Ordinance, recommended by the Mayor was referred to the Committee on Ordinances, Licenses and Legal Affairs.

In the year two thousand and four

        An Ordinance to amend an Ordinance relative to Boats and Waterways

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1.  Chapter 10, Article I, Section 10-24, Mooring permit is hereby amended by deleting Section 10-24(d) in its entirety, and replacing it with the following:

Section 10-24(d) Fee.
No mooring permit shall be issued until the fee established in this subsection shall be paid to the city. Mooring permits must be renewed by April 15 of each year. Renewal applications received or postmarked after April 15 shall result in a late fee of $15.00 being assessed. Mooring locations not renewed by May 1 will be considered illegal and removed at the owner’s expense and shall be delivered to the possession of the Harbormaster until claimed by the proper owner or disposed of according to (M.G.L. Chapter 91). A mooring fee shall be paid by every person liable under the law to pay excise taxes to any jurisdiction. The fee shall be based on the length of the vessel measured from the stem in a straight line aft to the stern. The fee shall be as follows:

(1)     Fee for non-resident mooring, $6.00 per foot.

(2)     Fee for resident mooring, $1.50 per foot.

(3)     Fee for non-resident slip fee, $2.00 per foot.

(4)     Fee for resident slip fee, $1.50 per foot.

For the purposes of this section, the boat registration shall be the sole determinant of residency.

Section 2. This Ordinance shall take effect as provided by City Charter.





#566 – MAYOR’S VETO OF #248, AMENDING ZONING “CONSERVATION OVERLAY DISTRICT” FOR  SALEM WOODS (HIGHLAND PARK)

        Mayor’s Veto of Council Order #248, Amending Zoning creating Conservation Overlay District for Salem Woods (Highland Park). No action for seven days under the Charter.



#567 – ORDINANCE AMENDING TRAFFIC, HANDICAP PARKING, LORING AVENUE

        Councillor O’Keefe introduced the following Ordinance, which was adopted for first passage.     

        In the year two thousand and four

        An Ordinance to amend an Ordinance relative to Traffic, Handicap Parking

        Be it ordained by the City Council of the City of Salem, as follows:

        Section 1.  Chapter 42, Section 50B, is hereby amended by adding the following:

        In front of #107 Loring Avenue, for a distance of twenty (20) feet, Handicap Parking, Tow Zone.

        Section 2.  This Ordinance shall take effect as provided by City Charter.



Councillor Harvey assumed the Chair.



#568 – RESOLUTION TIMOTHY JOHN LUNT ACHIEVING EAGLE SCOUT

        Councillor O’Leary introduced the following Resolution, which was Adopted.





RESOLUTION:

WHEREAS:        Timothy John Lunt has achieved the highest rank in scouting, the “Eagle Scout” Award; and

WHEREAS:        The Salem City Council takes pride in the accomplishments of the youth in our community; and

WHEREAS:        The “Eagle Scout’ Award is an honor of which Timothy and his family should be extremely proud; and

WHEREAS:        The Salem City Council recognizes the high level of commitment and dedication required of Timothy in order to achieve this honor.

NOW THEREFORE BE IT RESOLVED:  That the Salem City Council, on behalf of the citizens of the City of Salem, congratulate Timothy John Lunt on his “Eagle Scout” Award, and commend him for the dedication and perseverance.

AND BE IT FURTHER RESOLVED:  That the City Council make this Resolution a matter of record of these proceedings, and that a suitable copy of this Resolution be presented to Timothy John Lunt, along with a copy of the City Seal, at his Court of Honor.


#569 – RESOLUTION 375th ANNIVERSARY OF THE FIRST CHURCH IN SALEM

        Councillor O’Leary introduced the following Resolution, which was Adopted.

RESOLUTION:

WHEREAS: This year marks the 375th Anniversary of the founding of The First Church in Salem, Unitarian; and

WHEREAS:  The First Church in Salem was founded on August 6th, 1629 on a day of fasting and prayer appointed by Governor John Endicott. The church in Salem was the first Congregational church to be organized in the new world. It has had continuous existence as a religious community down to the present day; and



WHEREAS:  The First Church has dedicated itself to God and Country, giving guidance in the role of responsibility in the moral and social growth of the community and this long record of accomplishment deserves public expression of appreciation

NOW, THEREFORE, BE IT RESOLVED: That the Salem City Council, on behalf of all our citizens, extend our congratulations to the First Church in Salem and it’s membership on their 375th Anniversary.

AND BE IT FURTHER RESOLVED:  That a copy of this Resolution be entered into the record of these proceedings, and that a City Seal be presented to the First Church in Salem.

#570 – LETTER FROM PARK & RECREATION COMMISSION RE: CONSERVATION OVERLAY DISTRICT (SALEM WOODS)

        Councillor O’Leary introduced the following Order, which was adopted

        ORDERED: That the Committee on Ordinances, Licenses and Legal Affairs meet to discuss the enclosed letter from the Park and Recreation Commission regarding the recent votes by the City Council relative to the Conservation Overlay District for Salem Woods.


#571 – ORDINANCE AMENDING TRAFFIC, NO PARKING, BRIDGE STREET

        Councillor Sosnowski introduced the following Ordinance, which was adopted for first passage.

Section 1. Chapter 42, Section 74, is hereby amended by adding the following:



Bridge Street, southerly side in an easterly direction, from Mall Street to Oliver Street. “No Parking, Tow Zone”

Section 2. This Ordinance shall take effect as provided by City Charter.


#572 – ORDINANCE AMENDING TRAFFIC, NO PARKING, BARTON STREET

Councillor Sosnowski introduced the following Ordinance, which was adopted for first passage.

        Be it ordained by the City Council of the City of Salem as follows:

        Section 1. Chapter 42, Section 74, is hereby amended by adding the following:

        Warner Street beginning sixty (60) feet from the intersection of Barton Street and extending 140 feet. “No parking either side, Tow Zone”

Section 2. This Ordinance shall take effect as provided by City Charter.


#573 – ORDINANCE AMENDING TRAFFIC, LYNDE STREET

        Councillor Sosnowski and Councillor Pelletier introduced the following Ordinance, which was adopted for first passage.

        Be it ordained by the City Council of the City of Salem as follows:

        Section 1. Chapter 42, Section 75, Resident Parking, Tow Zone:

        Lynde Street, Zone C, Color Green, southerly side in a westerly direction, beginning in front of #7 Lynde Street and extending 256 feet. Northerly side in a westerly direction, beginning 279 feet from Washington Street and extending 47

Section 10. This Ordinance shall take effect as provided by City Charter.











#574 – RESOLUTION COMMANDER WILLIAM J. HARRISON

        Councillor Sosnowski introduced the following Resolution, which was adopted.


RESOLUTION:

WHEREAS:  William J. Harrison, Jr., who has served his country in peace and in war with honor and pride; and

WHEREAS: William J. Harrison, Jr., in joining the Veterans of Foreign Wars, volunteered many hours assisting his fellow V.F.W. members. He has then repeatedly elected and served as Commander of the Witch City Post 1524; and

WHEREAS: He was elected and served as V.F.W. District 10 Commander, bringing honor to his fellow members of Witch City Post and received many citations and certificates of recongnition; and

WHEREAS: His level of leadership was so recongnized that he was called upon to the All American Conferences in Washington D.C.  He is presently serving all Veterans of Salem as the Commander of the Salem Veterans Council.

NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Salem, on behalf of all our citizens, publicly go on record as commending William J. Harrison, Jr. for his outstanding efforts, and voice our appreciation for his leadership and dedication.

AND BE IT FURTHER RESOLVED: That this Resolution be made a matter of record of these proceedings, and that a suitable copy, along with a copy of the City Seal, be presented to William J. Harrison, Jr., on behalf of the Salem City Council as a token of our appreciation and admiration.


#575 – NO PARKING EITHER SIDE ON CHARTER STREET


        Councillor Corchado and Councillor Harvey introduced the following Order, which was adopted.



        ORDERED: That the Committee on Government Services invite interested parties to meet and discuss the feasibility of making Charter Street No Parking on either side.


#576 – ORDINANCE AMENDING ZONING, ASSESSORY BUILDINGS AND STRUCTURES

        Councillor Sosnowski introduced the following Ordinance, which was referred to the Planning Board to schedule a Joint Public Hearing with the City Council by roll call vote of 10 yeas, 0 nays, 1 absent. Councillors Corchado, Furey, Harvey, Lovely, O’Keefe, Pelletier, Sargent, Sosnowski, Veno and O’Leary
were recorded as voting in the affirmative. Councillor Bencal was recorded as absent.

An Ordinance to amend and an Ordinance relative to Zoning, Article VII, Supplementary Regulations

        Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Section 7-8 Accessory Buildings and Structures by adding the following:

(4) Accessory Structures and garages will not exceed one and a half (1 ½) stories or eighteen (18) feet.

        Section 2. This Ordinance shall take effect as provided by City Charter.

#578 – CITY SEAL BE SENT TO PETER DOLAN

        Councillor Furey introduced the following Order, which was adopted.

ORDERED: That a City Seal be sent to Peter Dolan for his years of service as the liaison and coordinator with our sister city Ota, Japan.



#579 – ORDINANCE AMENDING TRAFFIC, HANDICAP PARKING, CABOT STREET

        Councillor Veno introduced the following Ordinance, which was adopted for first passage.

#581 – ORDINANCE  AMENDING TRAFFIC, HANDICAP PARKING, WEBB STREET

        Councillor Corchado introduced the following Ordinance, which was adopted for first passage.

An Ordinance to amend and an Ordinance relative to Traffic, Handicap Parking

Be it ordained by the City Council of the City of Salem, as follows:

#582 -  TAX RELIEF FOR SENIOR CITIZENS

        Councillor Harvey introduced the following Order, which was adopted.

ORDERED:   That the Committee on Administration and Finance meet to discuss all the Massachusetts State law options to give property tax relief to our senior citizens property owners.




#583 – MEET WITH COMCAST REGARDING AIRING OF PORNOGRAPHY

Councillor Harvey introduced the following Order, which was adopted.

ORDERED:   That the Committee on Administration and Finance meet with ComCast regarding what remedies have been put in place so that the airing of pornography will never happen again and also to discuss the new contract approved by the Mayor.


#584 – CREATION OF AN ORDINANCE FOR BENEFITS BEYOND THE NORMAL

Councillor Harvey introduced the following Order, which was adopted.

ORDERED:   That the Committee on Administration and Finance meet to discuss an Ordinance to have any extended benefits beyond the normal benefits allowed for employees come before the City Council for approval.


#585 – ORDINANCE AMENDING TRAFFIC, HANDICAP PARKING, DERBY STREET

        Councillor Corchado introduced the following Ordinance, which was adopted for first passage.

In the year two thousand and four

An Ordinance to amend an Ordinance relative to Traffic, Handicap Parking Zone

Be it ordained by the City Council of the City of Salem, as follows:

Section 1. Chapter 42, Section 50A, is hereby amended by adding the following:

In front of #193 Derby Street, for a distance of forty (40) feet, (two spaces), Handicap Parking, Tow Zone.

Section 2. This Ordinance shall take effect as provided by City Charter.






#586 – RESOLUTION RETIREMENT OF REPRESENTATIVE J. MICHAEL RUANE

        Councillor Harvey introduced the following Resolution, which was adopted.

        RESOLUTION:
        
WHEREAS:  Representative J. Michael Ruane is a native son of the City of Salem; and

WHEREAS:  Representative J. Michael Ruane has been a Representative for thirty years, fifteen terms representing the City of Salem, and the longest continuously serving member of the House of Representatives, a member of the House Ways and Means, a Councillor at Large for the City of Salem and served in the U.S. Navy; and

WHEREAS:  Representative J. Michael Ruane has distinguished himself for his generosity and devotion of his beloved City of Salem that has
touched so many lives by his tireless and lengthy list of accomplishments for which we are thankful; and

WHEREAS:  Representative J. Michael Ruane is entering into retirement, and will be deeply missed; and

NOW THEREFORE BE IT RESOLVED: That the Salem City Council on behalf of it’s citizens, for the many years of service to this City, extend our sincere wish for much happiness and good health in the future.

AND BE IT FURTHER RESOLVED: That the City Clerk make this resolution a matter of record of these proceedings and that a suitable copy be presented to Representative J. Michael Ruane and that a copy of the City Seal of the City of Salem be given as a token of the respect and appreciation that he so well deserves.
        









#587 – RESOLUTION RETIREMENT OF HONORABLE JUDGE ZOLL
        
Councillor Harvey introduced the following Resolution, which was adopted.

        RESOLUTION:
        
WHEREAS:  The Honorable Samuel E. Zoll has served this Community and State as Chief Justice District Courts, Mayor of the City of Salem, State Representative Massachusetts General Court, President of the Salem City Council, City Councillor of the City of Salem, Attorney, Public Accountant, Teacher and Korean War Veteran; and

WHEREAS:  The Honorable Samuel E. Zoll has served the citizens of our City, State and Country with the highest degree of knowledge, professionalism, dedication, and loyalty; and

WHEREAS: The Honorable Samuel E. Zoll is now entering into retirement from his position as Chief Justice; and

WHEREAS: The Honorable Samuel E. Zoll will be missed professionally and as a friend and we are deeply appreciative of his many contributions throughout the years; and

NOW THEREFORE BE IT RESOLVED: That the Salem City Council on behalf of it’s citizens both past and present recognize the special person that the Honorable Samuel E. Zoll has been and the high standard of Public Service he has set as an example for all to emulate, and that we applaud him on his retirement from his services as Chief Justice and extend our highest regard and admiration and best wishes for sincere happiness and good health in the future.

AND BE IT FURTHER RESOLVED: That the City Clerk make this resolution a matter of record of these proceedings and that a suitable copy be presented to the Honorable Samuel E. Zoll and that a copy of the City Seal of the City of Salem be given to as a token of the respect and appreciation that he deserves so well.








#588 – TRIAL PERIOD OF A STOP SIGN ON NEW DERBY STREET

        Councillor Corchado introduced the following Order, which was adopted.

        ORDERED: That a Stop Sign be placed on New Derby Street, eastbound at the intersection with Congress Street for a trial period of sixty (60) days.


#589 – MEET TO DISCUSS ZONING PROCEDURES WITH CITY DEPARTMENTS AND BOARDS

        Councillor Harvey introduced the following Order, which was adopted by roll call vote of 9 yeas, 1 nays, 1 absent. Councillors Corchado, Harvey, Lovely, O’Keefe, Pelletier, Sargent, Sosnowski, Veno and O’Leary were recorded as voting in the affirmative. Councillor Furey was recorded as voting in the negative. Councillor Bencal was recorded as absent.

        ORDERED: That the Mayor, the City Planner, the Planning Board, the Zoning Board of Appeals, the Building Inspector, the Solicitor, the Conservation Commission meet with the Committee of the Whole to discuss the process and procedure for zoning in the City of Salem.

        BE IT FURTHER ORDERED: That the results of the communication among the boards be forward to the community and publicly discuss in a hearing of the people of Salem.

#598 – PETITION TO AMEND ZONING FOR 319 HIGHLAND AVENUE

        The following petition was referred to the Planning Board to schedule a joint public hearing with the Salem City Council by roll call vote of 10 yeas, 0 nays, 1 absent.  Councillors Corchado, Furey, Harvey, Lovely, O’Keefe, Pelletier,

Sargent, Sosnowski, Veno and O’Leary were recorded as voting in the affirmative. Councillor Bencal was recorded as absent.

        Petition of Attorney Joseph Correnti to amend the Zoning Ordinance and Map for a parcel of land consisting of 1.76 +/- acres at 319 Highland Avenue by extending the B-2 district to include this parcel.
