MINUTES DECEMBER 7, 2004 CONT. SPECIAL MEETING


        A Continuation of a Special Meeting of the City Council was held in the Council Chamber on Tuesday, December 7, 2004 at 6:00 P.M. for the purpose of taking action on matters relating to setting the tax rate.  

All Councillors were recorded as present.

Council President Leonard F. O’Leary presided.

Councillor O’Keefe moved to dispense with the reading of the record of the previous meeting. It was so voted.

President O’Leary thanked Councillor Harvey for his efforts on trying to move on exemptions for Senior Citizens.

Councillor Harvey stated that he had not received a letter from D.O.R. They have no case history for a situation like this.

#741 – APPR. OF $839,236.00 TO REDUCE GROSS AMOUNT TO BE RAISED BY TAXATION

        The following Order, recommended by the Mayor, was adopted under suspension of the rules by a roll call vote of 10 yeas, 1 nay, 0 absent. Councillors Bencal, Corchado, Furey, Lovely, O’Keefe, O’Leary, Pelletier, Sargent, Veno and O’Leary were recorded as voting in the affirmative. Councillor Sosnowski was recorded as voting in the negative.

        Councillor Harvey moved for immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.

        ORDERED: That the sum of Eight Hundred Thirty-Nine Thousand Two Hundred Thirty-Six Dollars ($839,236.00) is hereby appropriated from the following “Receipts Reserved for Appropriation” Account to reduce the gross amount to be raised by taxation when the Fiscal Year 2005 tax rate is set in accordance with the recommendation of His Honor the Mayor.

#742 – APPR. OF $302,224.00 & $300,000.00 TO REDUCE GROSS AMOUNT TO BE RAISED BY TAXATION

        The following Order, recommended by the Mayor.

        ORDERED: That the sum of Three Hundred Two Thousand and Two Hundred Twenty-four Dollars ($302,224.00) from the “Fund Balance Reserved for Appropriations

–       Free Cash” Account and Three Hundred Thousand Dollars ($300,00.00)  from the “Stabilization Fund” Account is hereby appropriated to reduce the gross amount to be raised by taxation when the Fiscal Year 2005 tax rate is set in accordance with the recommendation of His Honor the Mayor.

Councillor Harvey moved to divide the question. It was so voted.

    That the sum of Three Hundred Two Thousand and Two Hundred Twenty-four Dollars ($302,224.00) from the “Fund Balance Reserved for Appropriations - Free Cash” Account to reduce the gross amount to be raised by taxation when the Fiscal Year 2005 tax rate is set was adopted by a roll call vote of 10 yeas, 1 nay, 0 absent. Councillors Bencal, Corchado, Furey, Lovely, O’Keefe, O’Leary, Pelletier, Sargent, Veno and O’Leary were recorded as voting in the affirmative. Councillor Sosnowski was recorded as voting in the negative.

    That the sum of Three Hundred Thousand Dollars ($300,00.00)  from the “Stabilization Fund” Account is hereby appropriated to reduce the gross amount to be raised by taxation when the Fiscal Year 2005 tax rate is set, was adopted by roll call vote of 7 yeas, 4 nays, 0 absent. Councillors Bencal, Corchado, Furey, O’Keefe, Pelletier, Sargent and Veno were recorded as voting in the affirmative. Councillors Harvey, Lovely Sosnowski and O’Leary were recorded as voting in the negative.

        Councillor Harvey moved for immediate reconsideration in the hopes it would not prevail by roll call vote of 6 yeas, 5 nays, 0 absent. The matter was reconsidered. Councillors Harvey, Lovely, Pelletier, Sargent, Veno and O’Leary were recorded as voting in the affirmative. Councillors Bencal, Corchado, Furey, O’Keefe and Sosnowski were recorded as voting in the negative.

        The matter of reconsideration of the Appropration of the sum of Three Hundred Thousand Dollars ($300,00.00)  from the “Stabilization Fund” Account is hereby appropriated to reduce the gross amount to be raised by taxation when the Fiscal Year 2005 tax rate is set, was adopted by roll call vote of 10 yeas, 1 nay, 0 absent. Councillors Bencal, Corchado, Furey, Harvey, Lovely, O’Keefe, Pelletier, Sargent, Sosnowski and Veno were recorded as voting in the affirmative. Councillor O’Leary was recorded as voting in the negative.


#743 – RESIDENTIAL FACTOR

        Councillor Harvey moved that the City of Salem adopt a Residential Factor of 0.860258 for fiscal year 2005. The motion was adopted by a roll call vote of 6 yeas, 5 nays, 0 absent. Councillors Bencal, Furey, Lovely, Sargent, Sosnowsk and Veno were

recorded as voting in the affirmative. Councillors Corchado, Harvey, O’Keefe, Pelletier and O’Leary were recorded as voting in the negative.

        Councillor Harvey moved for immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.



#744 – ACCEPT SEC. 4, CH. 73, ACTS OF 1986 FOR FISCAL YEAR 2005

        Councillor Harvey introduced the following order, which was adopted by unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

        ORDERED:  That the Mayor and City Council accept the provisions of Section 4, Chapter 73 of the Acts of 1986 for Fiscal Year 2005, and that such additional exemptions granted be 100% of the statutory exemption amounts, provided all other qualifications specified in said Section 4 and in Section 5, Chapter 49 of the Massachusetts General Laws are met.

        Councillor Harvey moved for immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.



#745 – OPEN SPACE EXEMPTION

        Councillor Harvey moved that the City of Salem Not adopt an Open Space Exemption for fiscal year 2005. The motion was adopted by a unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

        Councillor Harvey moved for immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.






#746 – RESIDENTIAL EXEMPTION

        Councillor Harvey moved that the City of Salem Not adopt a Residential Exemption for fiscal year 2005. The motion was adopted by a roll call vote of 8 yeas, 3 nays, 0 absent. Councillors Bencal, Corchado, Furey, Harvey, Lovely, Sargent, Veno and O’Leary were recorded as voting in the affirmative. Councillors O’Keefe, Pelletier and Sosnowski were recorded as voting in the negative.


        Councillor Harvey moved for immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.



#747 – SMALL COMMERCIAL EXEMPTION

        Councillor Harvey moved that the City of Salem Not adopt a Small Commercial  Exemption for fiscal year 2005. The motion was adopted by a roll call vote of 9 yeas, 2 nays, 0 absent. Councillors Bencal, Corchado, Furey, Harvey, Lovely, Pelletier, Sargent, Veno and O’Leary were recorded as voting in the affirmative. Councillors O’Keefe and Sosnowski were recorded as voting in the negative.

        Councillor Harvey moved for immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.


        Councillor Bencal requested a moment of silence in memory of Pearl Harbor.




        On the motion of Councillor Harvey the meeting adjourned at 7:00 P.M.
