MINUTES - APRIL 25, 2002
        A Regular Meeting of the City Council was held in the Council Chamber on Thursday, April 25, 2002 at 7:00 P.M. for the purpose of transacting any and all business.  Notice of this meeting was posted on April 19, 2002 at 7:59 A.M.

        Councillors O'Leary was absent.  Councillor Driscoll arrived late.

        Council President Regina R. Flynn presided.

        Councillor Sargent moved to dispense with the reading of the record of the previous meeting.  It was so voted.

        President Flynn requested that everyone please rise to recite the Pledge of Allegiance.  

#300 - CONDUIT LOCATION ON LORING AVENUE

        A hearing was held on the Order of Verizon for a conduit location on Loring Avenue.  Appearing in favor was Terrance Dolan of Verizon.  There was no one opposed.  The hearing was closed.  Councillor O'Keefe moved that the permit be granted, and that all permits be obtained from the Department of Public Works prior to opening the street.  It was so voted.

#301 - APPT. KATHY FABISZEWSKI, COUNCIL ON AGING

        The Mayor's appointment of Kathy J. Fabiszewski to serve as a member of the Council on Aging for a term to expire October 1, 2004, was confirmed under suspension of the rules, by a roll call vote of 9 yeas, 0 nays, 2 absent.  Councillors Bencal, Chuber, DeToma, Furey, Harvey, Lovely, O'Keefe, Sargent, and Flynn were recorded as voting in the affirmative.  Councillors Driscoll and O'Leary were absent.

#302 - APPT. JOSEPH E. BARBEAU, JR., ASSOCIATE MEMBER BOARD OF APPEAL

        The Mayor's appointment of Joseph E. Barbeau, Jr. to serve as an Associate Member of the Board of Appeal for a term to expire May 1, 2005, was confirmed under suspension of the rules, by a roll call vote of 9 yeas, 0 nays, 2 absent.  Councillors Bencal, Chuber, DeToma, Furey, Harvey, Lovely, O'Keefe, Sargent, and Flynn were recorded as voting in the affirmative.  Councillors Driscoll and O'Leary were absent.

#303 - APPT. MICHAEL KAPNIS, PARK AND RECREATION COMMISSION

        The Mayor's appointment of Michael S. Kapnis to serve as a member of the Park and Recreation commission for a term to expire May 1, 2005, was confirmed under suspension of the rules, by a roll call vote of 9 yeas, 0 nays, 2 absent.  Councillors Bencal, Chuber, DeToma, Furey, Harvey, Lovely, O'Keefe, Sargent, and Flynn were recorded as voting in the affirmative.  Councillors Driscoll and O'Leary were absent.

        Councillor Harvey moved that a letter and City Seal be send to James Shea.  It was so voted.

#304 - REAPPT. CONSERVATION COMMISSION

        The Mayor's reappointment of the following to serve as members of the Conservation Commission for terms as designated, was confirmed by a roll call vote of 10 yeas, 0 nays, 1 absent.  Councillors Bencal, Chuber, DeToma, Driscoll, Furey, Harvey, Lovely, O'Keefe, Sargent, and Flynn were recorded as voting in the affirmative.  Councillor O'Leary was absent.

#306 - REAPPT. CONSTABLE

        The Mayor's appointment of Virginia Moustakis, 16 Cushing Street, as a Constable for a term to expire March 1, 2005, was received and filed.

#307 - APPR. PARKING CLERK PARKING TICKETS

        The following Order, recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED:  That the sum of One Thousand Dollars ($1,000.00) is hereby appropriated from the Fund Balance Reserved for Appropriation - Free Cash" Account to the "Parking Clerk - Parking Tickets" Account in accordance with the recommendation of His Honor the Mayor.

#308 - AUTHORIZE MAYOR TO SUBMIT FISCAL YEAR 2003 COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION.

        The following Order, recommended by the Mayor, was referred to the Committee on Community and Economic Development.

ORDERED:  That the Mayor is hereby authorized to submit the fiscal year 2003 Community Development Block Grant Application for Federal Assistance to the United States Department of Housing and Urban Development for One Million Three Hundred Ninety Seven Thousand Dollars ($1,397,000).

#309 - AUTHORIZE MAYOR TO GRANT EASEMENT FOR PARK LAND AT 22 VISTA AVENUE

        The following Order, recommended by the Mayor, was adopted by a roll call vote of 10 yeas, 0 nays, 1 absent.  Councillors Bencal, Chuber, DeToma, Driscoll, Furey, Harvey, Lovely, O'Keefe, Sargent, and Flynn were recorded as voting in the affirmative.  Councillor O'Leary was absent.

        ORDERED:  In accordance with Chapter 95 of the Acts of 2002, AN ACT AUTHORIZING THE CITY OF SALEM TO GRANT EASEMENTS IN CERTAIN PARK LAND, that the Mayor is hereby authorized to execute a Grant of Easement, for nominal consideration going from the City of Salem (the "Grantor") to Christopher K. Alexandrou and Theano Alexandrou, their successors and assigns (the "Grantee") for the perpetual right and easement as appurtenant to the land of the grantee at 22 Vista Avenue, Salem, Massachusetts to maintain, repair, reconstruct and replace the comer of the structure/wall supporting the inground pool which encroaches upon the land of the Grantor.

#310 - AUTHORIZE MAYOR TO GRANT EASEMENT FOR PARK LAND AT 8 WOODBURY COURT

        The following Order, recommended by the Mayor, was adopted by a roll call vote of 10 yeas, 0 nays, 1 absent.  Councillors Bencal, Chuber, DeToma, Driscoll, Furey, Harvey, Lovely, O'Keefe, Sargent, and Flynn were recorded as voting in the affirmative.  Councillor O'Leary was absent.

        ORDERED:  In accordance with Chapter 95 of the Acts of 2002, AN ACT AUTHORIZING THE CITY OF SALEM TO GRANT EASEMENTS IN CERTAIN PARK LAND, that the Mayor is hereby authorized to execute a Grant of Easement, for nominal consideration going from the City of Salem (the "Grantor") to John J. Cempellin, his successors and assigns (the "Grantee") for the perpetual right and easement for the continued encroachment of the Cempellin dwelling at 8 Woodbury Court into the City Parcel at 41 Northey Street (Gonyea Park).

#311 - ORDINANCE AMENDING TRAFFIC, SEC. 45, FRANKLIN STREET, AND SEC. 50B, DUNLAP STREET

        Councillor Bencal introduced the following Ordinance, which was adopted for first passage.

        In the year two thousand and two

        An Ordinance to amend an Ordinance relative to Traffic, Heavy Vehicles Prohibited, and Handicap Parking

        Be it ordained by the City Council of the City of Salem, as follows:

Section 1.  Chapter 42, Sec. 45, is hereby amended adding the following:

                        Franklin Street from Franklin Court to Moulton Avenue, Heavy
Commercial Vehicles Prohibited

        Moulton Avenue in it's entirety

Section 2.  Chapter 42, Sec. 50A, is hereby amended by adding the following:

        Dunlap Street in front of #4 Bates Terrace for a distance of twenty (20) feet.  "Handicap Parking - Tow Zone"

Dunlap Street in front of #5 Bates Terrace for a distance of twenty (20) feet.  "Handicap Parking - Tow Zone"

Section 3.  This Ordinance shall take effect as provided by City Charter.

#312 - PLANNER REVIEW PROPERTY AT #3 HAWTHORNE BLVD. REGARDING ZONING OF PROPERTY

        Councillor Chuber introduced the following Order, which was adopted.

        ORDERED:  That the City Planner have a staff review regarding the possibility of changing the zoning for the property located at 3 Hawthorne Boulevard from R-2 to B-5 to allow for the establishment of an upscale English tea house.

        AND BE IT FURTHER ORDERED:  that the City Planner provide an opportunity for the owners, Mr. & Mrs. Heath, to meet with him and present their case before he submits his recommendation to the Planning Board.

#313 - RESOLUTION "SALEM NOW" ON S.A.T.V.

        Councillor Harvey introduced the following Order, which was adopted by a roll call vote of 10 yeas, 0 nays, 1 absent.  Councillors Bencal, Chuber, DeToma, Driscoll, Furey, Harvey, Lovely, O'Keefe, Sargent, and Flynn were recorded as voting in the affirmative.  Councillor O'Leary was absent.

Councillor Harvey requested and received unanimous consent to allow Mr. Leo Jodoin to speak.

RESOLUTION:

WHEREAS:        Salem Access Television broadcasts the production of "Salem Now" to the residents of the City of Salem on S.A.T.V.; and

WHEREAS:        "Salem Now" is enjoyed by a large population of the City, and has proven
itself to be a very successful local production, with a unique format and informative guests; and

WHEREAS:        The producer/host of "Salem Now" has expressed his dedication and
commitment to this city, by producing a show that has encompassed both guided tours
of the City and its infrastructure, and studio discussion groups with candidates, local officials, and citizens.

NOW, THEREFORE, BE IT RESOLVED:  That the City Council of the City of Salem, supports the continued production of "Salem Now"; we commend Mr. Leo Jodoin for his tireless and tremendous efforts in the production of "Salem Now", and we thank Mr. Jodoin for his devotion and dedication

#314 - RESOLUTION SUPPORT OF EXEPEDITED PERMIT PROCESS FORFLYASH CLEAN-UP AT WENHAM LAKE

        Councillor Harvey introduced the following Resolution, which was adopted by a roll call vote of 10 yeas, 0 nays, 1 absent.  Councillors Bencal, Chuber, DeToma, Driscoll, Furey, Harvey, Lovely, O'Keefe, Sargent, and Flynn were recorded as voting in the affirmative.  Councillor O'Leary was absent.

        Councillor Harvey moved for immediate reconsideration in the hopes it would not prevail.  Reconsideration was denied.  

RESOLUTION:

WHEREAS:        Wenham Lake is a valuable natural resource, and the primary source of
Drinking water for the communities of Salem, Beverly, and Wenham; and

WHEREAS:        New England Power Company is undertaking efforts to clean-up the
flyash from the lake and the surrounding areas; and

WHEREAS:        This clean-up effort will help to ensure the quality of our drinking water for generations to come.

NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Salem, supports the efforts of the Wenham Lake Watershed Association in their involvement to clean our lake, and we applaud their efforts on behalf of our community.  Further, that the City Council of the City of Salem joins the Wenham Lake Watershed Association in support of an expedited permitting process in order to commence the flyash removal as soon as possible.

AND BE IT FURTHER RESOLVED: That a copy of this Resolution be forwarded to the
Wenham Lake Watershed Association, and to the Executive Office of Environmental Affairs.

#315 - AN ACT AUTHORIZING THE CITY OF SALEM TO GRANT EASEMENTS IN CERTAIN PARK LAND (22 VISTA AVENUE & 8 WOODBURY COURT)

        Councillor Harvey introduced the following Order, which was adopted.

        ORDERED:  That the enclosed ACT AUTHORIZING THE CITY OF SALEM TO GRANT EASEMENTS IN CERTAIN PARK LAND for parcels at 8 Woodbury Court and 22 Vista Avenue be received and placed on file.

#316 - TRAFFIC PATTERN AND SIGNAL CHANGES FOR TRADERS WAY

        Councillor Lovely introduced the following Order, which was adopted.

        ORDERED:  That the Planning Department be requested to re-examine the traffic pattern markings on Traders Way, and also re-examine the timing of the traffic signals at Traders Way/Highland Avenue/Marlborough Road.

        And be it further ordered:  That the matter be referred to the committee on Government Services.

#317 - SIGN AT ENTRANCE TO CHAMBER REGARDING SILENCING CELLPHONES, PAGERS, ETC.

        Councillor Bencal, in conjunction with Councillor O'Keefe, introduced the following Order, which was adopted.

        ORDERED:  That a sign be positioned at the entrance to the Council Chamber, at times when the Council or its sub-committees are in session, requesting that all attendees silence their cell phones, pagers, or other electronic devices.

#318 - MASS. HIGHWAY DEPARTMENT CONSIDER ADDING DECELERATION LANE ON HIGHLAND AVENUE AND SWAMPSCOTT ROAD

        Councillor Lovely introduced the following Order, which was adopted.

        ORDERED:  That the Planning Department communicate with Massachusetts Highway to investigate the feasibility of adding a deceleration lane on Highland Avenue, northbound lane, at Swampscott Road, and that the matter be referred to the Committee on Government Services.

#319 - ORDINANCE AMENDING TRAFFIC, PARKING PROHIBITED, WASHINGTON STREET, THIRTY-MINUTE PARKING

        Councillor Lovely introduced the following Ordinance, which was adopted for first passage.

        In the year two thousand and two

        An Ordinance to amend an Ordinance relative to Traffic, Parking Prohibited

        Be it ordained by the City Council of the City of Salem, as follows:

Section 1.  Chapter 42, Section 51B, Parking Prohibited, is hereby amended by deleting Washington Street, 15 minute parking, from Barton Square to Essex Street, and inserting in place thereof, the following:

        "Washington Street, southbound on the westerly side, beginning forty (40) feet from the intersection of Essex Street and extending to a point twenty (20) feet from the intersection with Barton Square.  Thirty Minute Parking."

Section 2.  This Ordinance shall take effect as provided by City Charter.

#320 - LETTER TO NORTHSIDE CARTING FROM MAYOR REGARDING MEETNIG WITH CITY COUNCIL

        Councillor Lovely introduced the following Order, which was adopted.

        ORDERED:   That the letter from Mayor Usovicz to Mr. Robert George of Northside Carting, dated April 25, 2002, be received and placed on file.

#321 - FINANCE REPORT

        Councillor Lovely introduced the following Order, which was adopted.

        ORDERED:  That the Financial Report dated March 31, 2002 be received and placed on file.

        Councillor Lovely assumed the Chair for President Flynn.

#322 - RESOLUTION - RESPECT FOR ALL, NO PLACE FOR HATE

        Councillor Flynn, in conjunction with Councillor Lovely, introduced the following Resolution, which was adopted by a roll call vote of 10 yeas, 0 nays, 1 absent.  Councillors Bencal, Chuber, DeToma, Driscoll, Furey, Harvey, Lovely, O'Keefe, Sargent, and Flynn were recorded as voting in the affirmative.  Councillor O'Leary was absent.

        Councillor Chuber requested unanimous consent to suspend the rules to allow the public to speak.  Councillor Flynn objected.

RESOLUTION:

WHEREAS:  All acts of subtle and overt racism, prejudice, homophobia, and anti-Semitism undermine our community, schools, and the promise of equal justice; and

WHEREAS:  Our nation was founded on the fundamental conviction that all persons are entitled to equal protection, opportunity and the enjoyment of their civil rights;

NOW, THEREFORE, BE IT RESOLVED:  That we in Salem have committed ourselves to fulfill the criteria of the "No Place for Hate" Proclamation of the DL (Anti-Defamation League) and request that the Mayor form a committee that will combat bias and promote respect for all people.

        President Flynn resumed the Chair.

#323 - ADMINISTRATION AND FINANCE MEET REGARDING COLLECTION OF PARKING TICKETS

        Councillor Lovely introduced the following order, which was adopted.

        ORDERED:  That the collection company presently administering our parking ticket fine collections be invited to appear before the Committee on Administration and Finance and that the Treasurer, Parking Clerk, and Finance Director be invited to attend.

#324 - (#861) - NORTH SHORE MEDICAL CENTER ROAD RACE

        Councillor O'Keefe offered the following report for the Committee on Ordinances, Licenses, and Legal Affairs.  It was voted to accept the report and adopt the recommendation.

        The Committee on Ordinances, Licenses, and Legal Affairs to whom was referred the matter of the use of city streets for a road race has considered said matter and would recommend that the following be granted.

Councillor Bencal moved to divide the question.  It was so voted.

        The matter of the taxi operators:  It was voted to accept the report and adopt the recommendation.

        The matter of the taxi cab/limousines:  It was voted to accept the report and adopt the recommendation.

        The matter of the public guides:  There was no motion to accept the report, nor adopt the recommendation.  Therefore the matter remained in committee.

#326 - (#88) - ORDINANCE REQUIRING ADVERTISING PRIOR TO APPOINTMENT OF CERTAIN OFFICERS/EMPLOYEES

        Councillor O'Keefe offered the following report for the Committee on Ordinances, Licenses, and Legal Affairs.  It was voted to accept the report and adopt the recommendation.

        The Committee on Ordinances, Licenses, and Legal Affairs to whom was referred a proposed Ordinance relative to advertising and appointments of certain offices has considered said matter and would recommend that the Ordinance, as amended by the Committee, be adopted for first passage.

        The Ordinance reads as follows:

        An Ordinance to amend an Ordinance relative to Advertising and Appointment of certain offices

        Be it ordained by the City Council of the City of Salem, as follows:  

Section 1.  Chapter 2, Article II, of the Salem Code of Ordinances, is hereby amended by adding the following new section:

Sec. 2-68.  Advertising and Appointment of Certain Offices

(a)     Upon a vacancy occurring, appointments to city departments or positions, over which the City Council or a separate municipal board or commission has the power of appointment or confirmation, shall not be eligible for appointment or confirmation unless and until the opening for the position has been posted at City Hall and advertised in a local or regional newspaper and/or professional journal, or web site posting, if one exists for the position, soliciting qualified candidates to apply, at least twenty-one days prior to any action by the City Council.  Any posting or notice shall include, at a minimum, the title of the position, description of duties, educational and/or professional qualifications, compensation, and the name, address and phone number for prospective applicants to obtain or send information.

(b)     It is hereby encouraged, but not required, that a committee consisting of municipal personnel and Salem residents with knowledge in the particular profession being solicited, be formed to review applications, interview candidates and short list finalists.

Section 2. This Ordinance shall take effect as provided by City Charter.
        
#327 - TAXI CAB FARES, AND REGULATIONS GOVERNING TAXI CABS & LIMOS

        Councillor O'Keefe offered the following report for the Committee on Ordinances, Licenses, and Legal Affairs.  It was voted to accept the report and adopt the recommendation.

        The Committee on Ordinances, Licenses, and Legal Affairs to whom was referred the matter of taxicab fares, and taxi/limo/livery regulations pertaining to vehicles operating in the City of Salem has considered said matter and would recommend that the matter be referred to the City Solicitor for an Ordinance amendment, working in coordination with the Salem Police Department Traffic Division, and return the Ordinance amendment within 45 days.

#328 - (#481A of 2001) - ORDINANCE AMENDING PARKING TICKET VIOLATIONS, TRAFFIC CHAPTER 42, SECTION 17A

        Councillor O'Keefe offered the following report for the Committee on Ordinances, Licenses, and Legal Affairs.  It was voted to accept the report.  

        The Committee on Ordinances, Licenses, and Legal Affairs to whom was referred a proposed Ordinance relative to a schedule of fines for various parking violations has considered said matter and would recommend that the Ordinance, as amended by the Committee, be adopted for second and final passage.

        Councillor Lovely amended to establish a new category with a $5.00 fine for overtime parking for meter or non-meter if the meter was a 15 or 30 minute meter.  The amendment was defeated by a roll call vote of 5 yeas, 5 nays, 1 absent.  Councillors Bencal, Harvey, Lovely, Sargent, and Flynn were recorded as voting in the affirmative.  Councillors Chuber, DeToma, Driscoll, Furey, and O'Keefe were recorded as voting in the negative.  Councillor O'Leary was absent.

        Councillor O'Keefe amended that the Ordinance be effective July 1, 2002.  It was so voted.

        The Ordinance was adopted as amended for second and final passage by a roll call vote of 7 yeas, 3 nays, 1 absent.  Councillors Bencal, Chuber, DeToma, Driscoll, O'Keefe, Sargent, and Flynn were recorded as voting in the affirmative.  Councillors Furey, Harvey, and Lovely were recorded as voting in the negative.

Penalties for Late Payment

If the original fine has not been paid within 21 days of the date the ticket was issued, a $5.00 late fee is added.  If any part of the original fine or penalty remains unpaid after 21 more days, a second penalty of $15.00 is added.  Failure to pay fine within proscribed time may result in Registry of Motor Vehicles Non-Renewal of License/Registration and assessment of an additional $20.00 surcharge.

Section 2. This Ordinance shall take effect on July 1, 2002.

#329 - (#289-#290-#291) USE OF SALEM COMMON

        Councillor O'Keefe offered the following report for the Committee on Ordinances, Licenses, and Legal Affairs.  It was voted to accept the report and adopt the recommendation.

        The Committee on Ordinances, Licenses, and Legal Affairs to whom was referred the matter of granting requests for use of the Salem Common has considered said matter and would recommend approval of the following:

(#279) - SECOND PASSAGE - ORDINANCE AMENDING TRAFFIC, STOP SIGN ON CABOT STREET, AND TOW ZONE ON LAFAYETTE STREET

        The matter of second and final passage of an Ordinance amending Traffic, Section 49, Stop Sign on Cabot Street, and Section 74, Tow Zone on Lafayette Street, was then taken up.  The Ordinance was adopted for second and final passage.

(#282) - SECOND PASSAGE - ORDINANCE AMENDING TRAFFIC, HANDICAP PARKING,  #13 CARLTON STREET

        The matter of second and final passage of an Ordinance amending Traffic, Section 50B, Handicap Parking on Carlton Street, was then taken up.  The Ordinance was adopted for second and final passage.
