MINUTES - NOVEMBER 29, 2001
A Regular Meeting of the City Council was held in the Council Chamber on Thursday, November 29, 2001 at 7:00 P.M. for the purpose of transacting any and all business.  Notice of this meeting was posted on November 21, 2001 at 10:29 A.M.

        All Councillors were present.

        Council President Joan B. Lovely presided.

        Councillor LaCava moved to dispense with the reading of the record of the previous meeting.  It was so voted.

        President Lovely requested that everyone please rise to recite the Pledge of Allegiance.

        Councillor Hayes requested a moment of silence for Vance Smith, President of Salem Oil and Grease who passed away recently.

PUBLIC HEARING - CLASSIFICATION

        A public hearing was held on the issue of allocating the local property tax levy among the five (5) property classes for the fiscal year of 2002, and the residential, open space, and small commercial exemption options.

        President Lovely then turned the Public Hearing over to the Board of Assessors to make a presentation.

        Mayor Usovicz addressed the Council and stated that he is open to compromise with the Council regarding the issue of appropriating free cash.

        Mr. Frank Kulik, Director of Assessing, addressed the Council and explained the procedure, and gave the members of the City Council an informational package, which was a copy of the Powerpoint presentation by Finance Director Bruce Guy.

        He explained that the city has fully implemented the Massachusetts Valuation system.  This year, we saw an increase in residential value of 8%.  We saw 10% in condominiums, and only 2% for commercial/industrial.  The loss of $1,000,000.00 from the Power Company translated into $29,000,000.00 on the commercial/industrial side.  New growth has been certified at $607,000.00.

        Councillor Driscoll expressed her concern about applying free cash to lower the tax rate this year, when next year, we could be facing larger cuts, higher costs, and less free cash.

        Councillor O'Keefe asked Mr. Guy about "payment in lieu of taxes" (P.I.L.O.T.) agreements.  Mr. Guy responded that the Mayor is aggressively pursuing this with the larger institutions.

        President Lovely opened the hearing up to the audience.

        Ms. Denise Flynn, Director of the Chamber of Commerce, asked the Council to consider lowering the Commercial/Industrial rate.  The following business owners also spoke and supported lowering the Commercial/Industrial rate:  Mike Allen, Tim Clarke, and Biff Michaud.

        Councillor Driscoll moved to continue the hearing until Thursday, December 6, 2001 at 6:30 P.M.  It was so voted.

#754 - REAPPT. CONSTABLE

        The Mayor's reappointment of Brian F. Davis to serve as a Constable for a term to expire November 11, 2004 was received and filed.

#755 - APPR. $1,000,000.00 FROM FREE CASH TO REDUCE TAX RATE

        The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

ORDERED:  That the sum of One Million Dollars ($1,000,000.00) is hereby appropriated from the "Fund Balance Reserved for Appropriation - Free Cash" Account to reduce the gross amount to be raised by taxation when the Fiscal Year 2002 tax rate is set, in accordance with the recommendation of His Honor the Mayor.

#756 - APPR. FIRE DEPARTMENT RETIREMENT ANTICIPATION

        The following Order, recommended by the Mayor, was adopted under suspension of the rules.  Councillor O'Keefe left the Chamber due to a potential conflict of interest.

        ORDERED:  That the sum of Forty One Thousand Four Hundred Ninety Eight Dollars and seventy-six cents ($41,498.76) is hereby appropriated from the "Fund Balance Reserved for Appropriation - Free Cash" Account to the "Fire Department - Retirement Anticipation" Account in accordance with the recommendation of His Honor the Mayor.

#757 - APPR. CAPITAL OUTLAY FOR SALTONSTALL SCHOOL ENGINEERNIG COSTS

        The following Order, recommended by the Mayor, was adopted under suspension of the rules.

ORDERED:  That the sum of Twenty Thousand Two Hundred Fifty Dollars ($20,250.00) is hereby appropriated to the "Capital Outlay - Repairs and Renovations" Account to be expended for payment of engineering costs related to the water infiltration at the Saltonstall School in accordance with the recommendation of His Honor the Mayor.

#758 - APPR. CEMETERY BURIAL SERVICES

        The following Order, recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED:  That the sum of Twelve Thousand Dollars ($12,000.00) is hereby appropriated from the "Cemetery - Receipts Reserved - Sale of Vaults" Account to the "Cemetery - Burial Services" Account in accordance with the recommendation of His Honor the Mayor.

#759 - APPR. CEMETERY SEASONAL SALARIES

        The following Order, recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED:  That the sum of Six Thousand Two Hundred Fifteen Dollars ($6,215.00) is hereby appropriated from the "Cemetery - Receipts Reserved - Sale of Lots" Account to the "Cemetery - Salaries - Seasonal" Account in accordance with the recommendation of His Honor the Mayor.

#760 - APPR. CEMETERY SALARIES OVERTIME

        The following Order, recommended by the Mayor, was adopted under suspension of the rules.  

        ORDERED:  That the sum of Five Thousand Seven Hundred Eighteen dollars and twenty-three cents ($5,718.23) is hereby appropriated from the "Cemetery - Receipts Reserved - Sale of Vaults" Account to the "Cemetery - Salaries - Overtime" Account in accordance with the recommendation of His Honor the Mayor.

#761 - APPR. $5,000.00 FOR CHARTER COMMISSION OPERATING BUDGET

        The following Order, recommended by the Mayor, was adopted under suspension of the rules.  Councillors O'Keefe and Furey left the Chamber due to a conflict of interest.

ORDERED:  That the sum of Five Thousand Dollars ($5,000.00) is hereby appropriated from the "Fund Balance Reserved for Appropriation - Free Cash" Account to establish a Charter Commission Operating Expense Budget under the provisions of Massachusetts General Laws, Chapter 43B, Section 8(b) and in accordance with the recommendation of His Honor the Mayor.

#762 - APPR. SHADE TREE SALARIES OVERTIME

The following Order, recommended by the Mayor, was adopted under suspension of the rules.

ORDERED:  That the sum of Four Thousand Dollars ($4,000.00) is hereby appropriated from the "Cemetery - Receipts Reserved - Sale of Vaults" Account to the "Shade Tree - Salaries - Overtime" Account in accordance with the recommendation of His Honor the Mayor.

#763 - APPR. CITY CLERK ELECTIONS VOTING MACHINE SERVICES

The following Order, recommended by the Mayor, was adopted under suspension of the rules.

        ORDERED:  That the sum of Two Thousand Nine Hundred Dollars ($2,900.00) is hereby appropriated from the "Fund Balance Reserved for Appropriation - Free Cash" Account to the "City Clerk - Elections - Voting Machine Services" Account in accordance with the recommendation of His Honor the Mayor.

#764 - ACCEPT CH. 73, SEC. 4, ACTS OF 1986 FOR FISCAL 2002, ADDITIONAL REAL ESTATE TAX EXEMPTIONS

        The following Order, recommended by the Mayor, was adopted by a unanimous roll call vote of 11 yeas, 0 nays, 0 absent.

ORDERED:  That the Mayor and City Council accept the provisions of Section 4, Chapter 73 of the Acts of 1986 for Fiscal Year 2002, and that such additional exemptions granted be 100% of the statutory exemption amounts, provided all other qualifications specified in said Section 4 and in Section 5, Chapter 59 of the Massachusetts General Laws are met.

#765 - ORDINANCE AMENDING SOLID WASTE MANAGEMENT, USE OF THE SALEM TRANSFER STATION, SOLID WASTE FEES AND USE BY RESIDENTS

        The following Ordinance was recommended by the Mayor.  Councillor O'Leary moved that the matter be tabled.  It was so voted.  Councillors Harvey, O'Keefe, and Furey were recorded as 'opposed'.

        In the year two thousand and one

        An Ordinance to amend an Ordinance relative to Solid Waste Management
        
        Be it ordained by the City Council of the City of Salem

Section 1.  Chapter 36, Section 36-2, Fee for delivery of solid waste to the transfer station, is hereby amended by deleting this section and inserting in place thereof, the following:

The operator of the solid waste transfer station shall establish fees per ton for delivery of solid waste to the transfer station by all parties other than the city.  Operator shall provide the city with a copy of fee schedule and notice of any changes thereto.  Residents (noncommercial) shall be allowed to deliver up to fifty (50) pounds of non-hazardous solid waste to the transfer station during normal working hours fee of charge.  Residents shall be charged a reduced rate for waste over fifty pounds.  Residents (noncommercial) shall also be allowed to deliver free of charge all white goods (without refrigerant).

Section 2.    Chapter 36, Section 36-3, Use of transfer station, is hereby amended by deleting this section and inserting in place, thereof, the following:

The solid waste transfer station shall be operated in accordance with its 100-ton per day Construction and Demolition (C&D) permit, the rules and regulations of the Department of Environmental Protection (DEP) and the provisions herein.

Section 3.   This Ordinance shall take effect as provided by City Charter.

#766 - FOUR HOURS OF FREE PARKING AT GARAGES

        The following Order, recommended by the Mayor, was adopted.

ORDERED:  That the City of Salem provide four (4) hours of free parking at the Museum Place Mall and South Harbor Garages from Sunday December 16 through Wednesday December 25,2001 upon the receipt of a one-hour parking stamp obtained from any of the participating merchants.

AND BE IT FURTHER ORDERED:  That parking fees in all other locations will remain in effect.

#767 - MAYOR SUBMITTING HIS RECOMMENDATION FOR FISCAL YEAR 2002 TAX CLASSIFICATION

        A communication from the Mayor, submitting his recommendation for the fiscal year 2002 tax classification vote, was received and filed.

Ladies and Gentlemen of the Council:

The following are my recommendations for the Fiscal Year 2002 Tax Classification for your review.

I am recommending that we keep the Commercial/Industrial Percentage (CIP) at 166, holding the percentage stable and constant from last year.  This results in a Minimum Residential Factor (MRF) of 74.5797%. Adopting this factor will result in a residential tax rate of $13.32 and a commercial rate of $28.49. If this factor is adopted, it will mark the fourth consecutive year that our combined efforts will have reduced the rates.  Only by continued fiscal discipline and working aggressively to expand the tax base will we be able to see this trend continue.

As we all know, although we continue to see new growth in our revenues in Salem from an expanded commercial and residential tax base, the reality is that our national economy is in recession, and state revenues have plummeted.  Working together over the past four years, we took advantage of the good economic times here in Salem to get our fiscal house in order and prepare for a "rainy day." Most dramatically, Free Cash reserves now stand at a record $5 million.  It is as a result of this sound fiscal management plan and our new growth in Salem that I can recommend to the City Council that you approve a Free Cash appropriation in the amount of $1,000,000.00 to reduce the burden on residents.

In addition to this one-time expenditure of Free Cash to stabilize our tax rate this year, we must also continue to focus on the anticipated decline in revenue from the long-term agreement with the PG&E power plant.  We must continue to take the appropriate action to minimize the effect of this loss of revenue.. Most significantly, we are renegotiating our tax agreement with PG&E.  By opening negotiation early we can work to avoid the expected dramatic loss of revenue from the power plant over the next few years, while continuing to promote economic growth in Salem.

I am pleased to be able to stabilize the city's residential tax rate at this level while
continuing to encourage commercial development by also reducing the commercial/industrial rate.

The economic realities of the market place will continue to challenge the City's financial constraints.  However, by working together, I remain confident that we can meet the challenges before us for the benefit of the taxpayer of Salem.

I respectfully recommend your favorable consideration on the tax classification recommendations.

#768 - APPR. PUBLIC PROPERTY ELECTRICAL

        The following Orders were received after the deadline of Tuesday Noon.  Councillor Driscoll requested and received unanimous consent to suspend the rules.

ORDERED:  That the sun of Twenty Thousand Dollars ($20,000.00) is hereby appropriated from the "Fund Balance Reserved for Appropriation - Free Cash" Account  to the "Public Property - Electrical" Account in accordance with the recommendation of His Honor the Mayor.

#769 - APPR. PUBLIC PROPERTY RENOVATIONAN AND REPAIRS

        The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

ORDERED:  That the sum of Fifteen Thousand Dollars ($15,000.00) is hereby appropriated from the "Fund Balance Reserved for Appropriation - Free Cash" Account to the "Public Property - Renovations and Repairs" Account in accordance with the recommendation of His Honor the Mayor.

#770 - APPR. PUBLIC PROPERTY BUILDING MAINTENANCE

        The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

        ORDERED:  That the sum of Ten Thousand Dollars ($10,000.00) is hereby appropriated from the " Fund Balance Reserved for Appropriation - Free Cash" Account to the "Public Property - Building Maintenance" Account in accordance with the recommendation of His Honor the Mayor.

#771 - COMMITTEE OF WHOLE MEET REGARDING SALEM/BEVERLY BY-PASS ROAD

        Councillor Flynn, in conjunction with Councillor Harvey, introduced the following Order, which was adopted.

        ORDERED: That the Director of Planning make a presentation to the Committee of the Whole before the next Council meeting on the Salem Beverly By-Pass Road, and that the public be invited.

#772 - VETERANS SQUARE AT ORANGE & CURTIS ST. BE NAMED BIROS SQUARE

        Councillor LaCava introduced the following Order, which was adopted.

ORDERED:  That the Salem City Council officially designates the corner of Orange Street and Curtis Street as "Biros Square" in honor of Lieutenant Commander Edmund William Biros, who was killed in action during World War II.

AND BE IT FURTHER ORDERED: That the Veterans Agent, working in conjunction with the Police Traffic Division, erect a suitable sign at this location to honor the late Edmund Biros.

        Councillor Furey left the meeting at 9:05 P.M.

#773 - COMMUNITY & ECONOMIC DEVELOPMENT MEET TO DISCUSS MARLBOROUGH ROAD PROJECT

        Councillor O'Leary introduced the following Order, which was adopted.

        ORDERED:  That the Committee on Community and Economic Development meet with the Director of Public Services, the City Planner, and the City's Consultant for the Marlborough Road project, to discuss the plans, construction timetable, and other related matters for this project.

#774 - ORDINANCE, TRAFFIC, HANDICAP PARKING, 27 ABBOTT STREET

        Councillor O'Leary introduced the following Ordinance, which was adopted for first passage.

        Be it ordained by the City Council of the City of Salem, as follows:

Section 1.  Chapter 42, Sec. 50B, is hereby amended by adding the following:

        In front of #27 Abbott Street for a distance of twenty (20) feet, "Handicap Parking Tow Zone"
Section 2. This Ordinance shall take effect as provided by City Charter.

#775 - ORDINANCE, TRAFFIC, PARKING TIME LIMITED, 118 BOSTON STREET

        Councillor O'Leary introduced the following Ordinance, which was adopted for first passage.

        Be it ordained by the City Council of the City of Salem, as follows:
Section 1.  Chapter 42, Sec. 57A, is hereby amended by adding the following:

"In front of #118 Boston Street for a distance of twenty (20) feet, fifteen (15) minute parking 9:00 A.M. to 5:00 P.M."

Section 2.  This Ordinance shall take effect as provided by City Charter.

#776 - AMENDMENT TO RULES & ORDERS, SECTION 31, TEMPORARY COMMITTEE MEMBERSHIP APPOINTED BY CHAIRMAN

        Councillor Hayes introduced the following Order.  No action until the next meeting under the rules.

ORDERED:  That the rules and orders of the City Council, Section 31, Appointment of Committees, is hereby amended by adding the following:

The chairperson of a committee may appoint a member of the City Council as a temporary member of said committee, when the absence of a quorum would cause a duly posted committee meeting to be canceled, postponed, or adjourned.  Said temporary appointment shall not remain in effect beyond adjournment of the Committee meeting.

#780 - FINANCING FOR THE PROPOSED NEW SENIOR CENTER

        Councillor Driscoll offered the following report for the Committee on Administration and Finance.  It was voted to accept the report and adopt the recommendation.

        The Committee on Administration and Finance to whom was referred the matter of financing for the proposed new senior center has considered said matter and would recommend that the matter remain in committee.

#781 - FOUR-WAY INTERSECTION IMPROVEMENTS, CONGRESS, NEW DERBY STREET AND HAWTHORNE BOULEVARD

        Councillor Flynn offered the following report for the Committee on Government Services.  It was voted to accept the report and adopt the recommendation.

        The Committee on Government Services to whom was referred the four way intersection at Congress, Derby Street and Hawthorne Boulevard has considered said matter and would recommend that because of the addition of the South Harbor Garage, and the proposed Hotel, this intersection needs to be reviewed, and that the Salem Planning Department review this intersection with the Massachusetts Highway Department and submit a recommendation to the City Council.

#782 - SNOW REMOVAL ON SIDEWALKS

        Councillor Flynn offered the following report for the Committee on Government Services.  It was voted to accept the report and adopt the recommendation.

        The Committee on Government Services to whom was referred the matter of snow removal from sidewalks has considered said matter and would recommend that the Commission on Disabilities give the City a comprehensive list of crucial city streets that need to be plowed, and that the City investigate the possibility of purchasing a bobcat, or contract out certain sidewalks.

#783 - (#670) - USE OF SCHOOL GYMNASIUMS

        Councillor Flynn offered the following report for the Committee on Government Services.  It was voted to accept the report and adopt the recommendation.

        The Committee on Government services to whom was referred the matter of use of the Salem School Gymnasiums by the Community has considered said matter and would recommend that the matter be referred to the School Committee.

#784 - (#585) - APPEAL TO CONSERVATION COMMISSION DECISION REGARDING WETLANDS ON ALMEDA STREET

        Councillor O'Leary offered the following report for the Committee on Community and Economic Development.  It was voted to accept the report and adopt the recommendation.

        The Committee on Community and Economic Development to whom was referred an appeal to the City Council regarding a Conservation Commission decision on Almeda Street has considered said matter and would recommend that the City Council hereby affirms the action of the Salem Conservation Commission, relative to this matter.

#785 - JOINT POLE LOCATION ON SPRINGSIDE AVENUE

        A hearing was ordered for December 13, 2001 on the petition of Verizon and Massachusetts Electric Company for a joint pole location on Springside Avenue.

#786 - COMM. REGARDING MIGRANT WORKERS BEING USED AT JPI CONSTRUCTION SITE

        A communication from the Local Teamsters Union #42, regarding the use of migrant workers at the JPI Construction site was referred to the Committee on Government Services.
