MINUTES - FEBRUARY 8, 2001
A Regular Meeting of the City Council was held in the Council Chamber on Thursday, February 8, 2001 at 7:00 P.M. for the purpose of transacting any and all business.  Notice of this meeting was posted on February 2, 2001 at 1:12 P.M.

        All Councillors were present.

        Council President Joan B. Lovely presided.

        Councillor Hayes moved to dispense with the reading of the records of the previous meeting.  It was so voted.

        President Lovely requested that everyone please rise to recite the Pledge of Allegiance.

(#51) - JOINT POLE LOCATION ON WILLSON STREET

        A hearing was held on the Order of Verizon and Massachusetts Electric Company for a joint pole location on Willson Street.  Appearing in favor was Councillor O'Leary, who was in receipt of a letter from Verizon, stating that they were unable to attend the hearing, but stating that this is for the new Bowditch School.  There was no one appearing in opposition.  The hearing was closed.  Councillor O'Leary moved that the request be granted.

(#52) - CONDUIT LOCATION ON WILLSON STREET

        A hearing was held on the Order of Massachusetts Electric Company for a conduit location on Willson Street.  Appearing in favor was Councillor O'Leary, who stated that this was for the new Bowditch School.  There was no one opposed.  The hearing was closed.  Councillor O'Leary moved that the request be granted.

#88 - REAPPT. CONSTABLE

        The Mayor's reappointment of Franklin J. Hall to serve as a Constable for a term to expire January 11, 2002, was received and filed.

#89 - APPR. CAPITAL OUTLAY FOR ROOF REPAIRS AT JAIL KEEPERS HOUSE AT OLD SALEM JAIL

Councillor Harvey left the Council Chamber due to a conflict of interest.

The following Order, recommended by the Mayor, was adopted under suspension of the rules.

        Ordered:  That the sum of Seventy-nine Thousand Dollars ($79,000.00) hereby appropriated to the "Capital Outlay - Repairs & Renovations" Account) to be expended for the repair of the roof of the Jail Keepers House located at the Old Essex County Jail Complex at 50 St. Peter Street in accordance with the recommendation of His Honor the Mayor.

#90 - CAPITAL OUTLAY FOR RESTORATION AND REPAIR OF WINDOWS AT CITY HALL

The following Order, recommended by the Mayor, was adopted under suspension of the rules.

        Ordered:  That the sum of Forty-two Thousand Dollars ($42,000.00) is hereby appropriated to the "Capital Outlay - Repairs & Renovations" Account to be expended for the restoration and repair of the sixty-six windows located at Salem City Hall in accordance with the recommendation of His Honor the Mayor.

        Councillor Harvey returned to the City Council Chamber.

#91 - APPR. PARK IMPROVEMENTS

The following Order, recommended by the Mayor, was referred to the Committee on Administration and Finance under the rules.

        Ordered:  That the sum of Thirty Thousand Dollars ($30,000.00) is hereby appropriated from the "Receipts Reserved - Golf Course" Account  to the "Park Improvements" Account in accordance with the recommendation of His Honor the Mayor.

#92 - APPR. CEMETERY BURIAL

The following Order, recommended by the Mayor, was adopted under suspension of the rules.

        Ordered:  That the sum of Twenty-Four Thousand Dollars ($24,000.00) is hereby appropriated from the "Receipts Reserved - Cemetery - Sale of Lots" Account to the "Cemetery - Burial" Account in accordance with the recommendation of His Honor the Mayor.

#93 - AUTHORIZE MAYOR TO SELL SURPLUS PROPERTY AT 10-12 PHILLIPS STREET

        The following Order, recommended by the Mayor, was referred to the Committee on Community and Economic Development.

        Ordered:  That the Mayor is hereby authorized to dispose of an undevelopable city-owned parcel of surplus property located at 10-12 Phillips Street through sealed bids pursuant to Chapter 2, Section 2-1635(b).

#94 - INVITATION TO COUNCIL TO ATTEND LITTLE LEAGUE PARADE

        A letter was received from the Mayor, extending an invitation from Mr. Gerald Wilkins, President of the Salem Little League, to participate in the Little League Parade on Sunday, April 29, 2001.  The invitation was accepted and placed on file.

#95 - STUDY OF PARKING METERS BE REPORTED TO THE COUNCIL

        Councillor Furey introduced the following Order, which was adopted.

        Ordered:        That the Police Dept., Fire Dept., Parking Director, Parking Department Board, and Planning Dept. develop a study for possible changes in the use of parking meters, lots, and streets in the downtown area by June 30 and report their findings and recommendations to the Committee on Ordinances, Licenses & Legal Affairs and the Committee on Public Health, Safety & Environment.

#96 - USE OF OLD TOWN HALL AREA BY "SALEM NOW" FOR LIVE SHOW

        Councillor O'Leary introduced the following Order, which was adopted.

        Ordered:  That the attached request of Salem Now to use the grounds behind Old Town Hall, on Wednesday, August 15, 2001 for a live production of "Salem Now", and requesting that Front Street be closed to traffic during the airing, be approved by the City Council.

#97 - ADMINISTRATION AND FINANCE MEET REGARDING C.D.B.G. FUNDS

        Councillor LaCava introduced the following Order, which was adopted.

              Ordered: That the Planning Department meet with the Committee on Administration and Finance to discuss the current draft Action Plan, CDBG.

#98 - GOVERNMENT SERVICES MEET REGARDING LONG-TERM PARKING AT CHUCH STREET PARKING LOT

        Councillor DeToma introduced the following Order, which was adopted.

          Ordered:  That the Committee on Government Services meet to investigate the increase use of long term parking at the Almy's Parking Lot.  Inviting representatives of the Mayor's office, Parking Board, Chamber of Commerce and Church Street Businesses.

                Councillor Hayes offered the following report for the Committee on Ordinances, Licenses, and Legal Affairs.  It was voted to accept the report and adopt the recommendation.

# 100 - (#56) APPR. PUBLIC SERVICES WATER AND SEWER

          Councillor Driscoll offered the following report for the Committee on Administration and Finance.  It was voted to accept the report and adopt the recommendation.

                The Committee on Administration and Finance to whom was referred the matter of an appropriation of $300,000.00 to Public Services Water and Public Services Sewer
has considered said matter and would recommend approval.

#101 - (#57) APPR. PUBLIC SERVICES  PUBLIC WORKS IMPROVEMENTS

Councillor Driscoll offered the following report for the Committee on Administration and Finance.  It was voted to accept the report and adopt the recommendation.

                The Committee on Administration and Finance to whom was referred the matter of an appropriation of $35,000.00 to Public Services Public Works Improvements has considered said matter and would  recommend approval.

#102 - (#58) - APPR. POLICE CONTRACTUAL SERVICES

Councillor Driscoll offered the following report for the Committee on Administration and Finance.  It was voted to accept the report and adopt the recommendation.

                The Committee on Administration and Finance to whom was referred the matter of an appropriation of $27,042-50 to Police Contractual Services has considered said matter and would recommend approval.

#103 - (#891 of 2000) USE OF SALEM COMMON FOR HISPANIC FESTIVAL

        Councillor O'Leary offered the following report for the Committee on Community and Economic Development.  It was voted to accept the report and adopt the recommendation.

                The Committee on Community & Economic Development to whom was referred the matter of the Hispanic Festival on July 14, 2001.has considered said matter and would recommend that it be granted with the following conditions stipulated by the Committee.    
   
        1.      Event to be held on July 14, 2001 from 12:00 Noon to 7:00 P.M., not counting    set-up time.
2. Music must stop by 7:00 P.M.

#104 - (#802 OF 2000) JUNIPER POINT OUTFLOW PIPE

                Councillor Flynn offered the following report for the Committee on Government Services.  It was voted to accept the report and adopt the recommendation.

        The Committee on Government Services to whom was referred the matter of the drainage outflow pipe at Juniper Point has considered said matter and would recommend that the Director of Public Works will appraise the Council as to the moving of the pipe at Stepps Beach in Juniper Cove to higher ground in early spring of 2001, and Director Bornstein will submit a plan and profile that will remediate the problems with the discharge pipe.

#105 - ESSEX STREET PEDESTRIAN MALL AND TRAFFIC ISSUES

        Councillor Flynn offered the following report for the Committee on Government Services.  It was voted to accept the report and adopt the recommendation.
                
                The Committee on Government Services to whom was referred the matter of traffic and parking issues on the Essex Street Mall has considered said matter and would recommend that the signage at Liberty and Essex Street be changed to clearly state that the mall be closed between 11:30 a.m. and 1:00 p.m. for all deliveries.

        The Police are to be more aggressive with the tagging of cars; and also to be explored are the possibilities of designated delivery areas and reassessing the situation at the end of thirty days.

#106 - LEGISLATIVE AGENDA FOR THE YEAR 2001

        Councillor Driscoll offered the following report for the Committee of the Whole.  It was voted to accept the report and adopt the recommendation.

        The Committee on of the Whole  to whom was referred the matter of establishing a Legislative Agenda for the year 2001 has considered said matter and would recommend that the attached Resolution be adopted.

#106A - LEGISLATIVE AGENDA FOR THE YEAR 2001

RESOLVED:

WHEREAS: The City Council realizes the value of partnering with the Administration on municipal projects, programs, and policies of mutual concern; and

WHEREAS: The City Council has worked to identify priorities for joint Council/Administration action.

NOW, THEREFORE, BE IT RESOLVED: That the Salem City Council hereby adopts the attached set of priorities, to be known as the 2001 Legislative Agenda.

CITY COUNCIL PRIORITIES LEGISLATIVE AGENDA

Adopt written fiscal policies for municipal finance and budget operations.
Examples include: adopting policies for one time revenue receipts, operational budgets, short and long term financial planning initiatives, pilots/silots, etc.

Adopt and provide support for municipal programs aimed at enhancing and improving residential neighborhoods/neighborhood infrastructures.
Examples include: sidewalk repair and replacement programs, roadway repaving programs, tree planting programs, housing rehabilitation funding programs, anti-litter campaign, street light maintenance, street sweeping programs, etc.

Adopt and provide support for park and recreation programs, especially programs geared toward at risk youth.
Examples include: enhanced summer park programs, community schools programs, formation of a youth commission, improved maintenance of community parks (Salem Common, Forest River Park, Salem Willows and Winter Island), skate park, bike path development, etc.

Adopt and provide support for enforcement of current Zoning Ordinances.  Examples include:  form a partnership with municipal inspectors to enforce current zoning ordinances, including the issuance of 21D fines.

Adopt and provide support for enhancing Entrance Corridors.
Examples include:  extra street sweeping, code enforcement and litter pick up in Entrance Corridors.

Review and Finalize Recommendations for major transportation issues impacting the community.
Examples include: Bridge Street Bypass Roadway Design, Route IA Design and Reconstruction, Liberty Street Traffic Re-routing, Canal/Loring Intersection Improvements, MBTA Garage and Additional Rail Services, bike path development, formation of Traffic Commission, etc.

Maximize the use of public assets for economic and community revitalization.  Old Town Hall, Old Police Station, South Harbor Garage, Salem Jailer's House, etc.

Adopt and provide support for programs aimed at protecting and preserving the environment and natural resources.
Examples include: Salem Harbor Power Plant issues, Wenham Lake, Forest River Conservation Area, Salem Woods, wetland resource area preservation, water main and drainage improvements, etc.

Adopt and provide support for programs aimed at enhancing elder services.
Adopt and provide support for e-government programs, access and services.

#107 - CONDUIT LOCATION ON WASHINGTON STREET

        A hearing was ordered for February 22, 2001 on the petition of Massachusetts Electric Company for a conduit location on Washington Street.

(#60) - SECOND PASSAGE ORDINANCE AMENDING TRAFFIC, HANDICAP PARKING, 3 ABBOTT STREET

        The matter of second and final passage of an Ordinance amending Traffic, Handicap Parking, Section 50B, 3 Abbott Street, was then taken up.  The Ordinance was adopted for second and final passage.


        President Lovely announced that she has appointed Councillor O'Keefe to serve as liaison to the Fire Department, and Councillor Harvey to serve as liaison to the Salem/Beverly Water Board.  

        Councillor Harvey requested that the Council President contact Beverly Mayor Scanlon to request that a representative of the Salem City Council and the Beverly City Council serve on his newly found commission regarding Wenham Lake.


        On the motion of Councillor Hayes, the meeting adjourned at 7:35 P.M.
