Minutes of Meeting


Date and Time:  Thursday, June 12, 2008, 6:00 p.m.

Chairperson Cornacchio calls the meeting to order.

1.  Approval of Minutes – May 22, 2008 Meeting

Pabich: Motion to approve the minutes as presented, seconded by Blier. Passes 4-0.

2.  Continuation of a Public Hearing – Notice of Intent – DEP #64-474 – Jean and Doug Karam, 25 Winter Island Road, Salem, MA 01970

Cornacchio reads the legal public hearing notice which states that the purpose of this hearing is to discuss the installation of riprap and re-grading to reduce erosion occurring along a Coastal Bank, Land Subject to Coastal Storm Flowage and buffer zone to salt marsh at 25 Winter Island Road.

Engineer Rich Williams, with Hayes Engineering, states that, since the last meeting, the Karams received an indemnification agreement from the city, which requires them to forever be responsible for anything that happens on that property.  He adds that the Karams do not with to have this degree of liability so they will instead work with the area on their own property.

Williams reviews the work plan for the property, which involves stones at the high water line up to the boundary to the city-owned land.

Blier asks for clarification about the indemnification agreement.

Doug Karam clarifies the indemnification agreement stating that it was an access agreement, and it stated that the Karams would be responsible for all future activities that occurred on the city’s property.

Summer suggests they make a donation to the city for the work.

Jean Karam states that they already tried to make a donation to the city, but they would still be responsible for that property.

Duques states that the Karams were made a co-applicant with the city and the donation issue was not explored.  She says there might be a chance to obtain grant money for the work, because there is already a plan, and the plan could be the Karams’ donation to the city.

Pabich asks for further explanation about the work at the boundary.

Williams explains.

Cornacchio opens to the public.  There are no questions or comments.

Pabich: Motion to close the public hearing, seconded by Summer.  Passes 4-0.

Cornacchio states that conditions should include that they use hydraulic mortar, and pin the toe in the wall.

Pabich: Motion to issue an Order of Conditions, seconded by Summer.  Passes 4-0.

Old/New Business

3.  Request for a Certificate of Compliance – DEP #64-442 – Uncle Bob’s Storage, 435 Highland Avenue – Improvements to an existing stormwater management system.

Duques states that she visited the site twice and they replaced an 18-inch line with a 24-inch line, installed 2 catch basins, removed the sediment from the stream, and installed 3 “No Dumping” signs.  She says that this area receives trash, which blows in from the surrounding area and also from stormwater that runs down Highland Avenue.  She suggested that they might be able to extend their fence to be lower to block blowing trash.  She says they are required to submit a maintenance report at the end of December,  describing when the stormwater system was cleaned.

Duques reads the three ongoing conditions:
·       Dumpsters on site shall be located outside of the buffer zone.
·       Snow piled on site shall be located outside of the buffer zone.
·       The proposed and approved operations and maintenance plan shall be implemented which shall also include quarterly inspection of the outfall pipe and surrounding area and removal and proper disposal of sediment and debris from the area, by hand, as necessary.  Annual reports are due to the Conservation Commission or the Conservation Agent by December 31 of each year.

Pabich: Motion to issue a Certificate of Compliance, seconded by Blier.  Passes 4-0.

4.  Request for a Certificate of Compliance – DEP #64-388 – Lionel Pelletier, 7 Brook Street – Construction of a single family home, driveway, and associated utilities

Duques states that he is not yet prepared to submit and as-built plan, and she will put this on the agenda the next meeting.



5.  Reminder:  Living Green and Renewable Energy Fair will be held Saturday, June 14, 2008

Duques states that the commission will have a table there and members of the Chamber of Commerce will be there.

Cornacchio and Blier agree to be there for a portion of the time.

They discuss the other participants of the Fair.

6.  Membership

Duques states that she spoke to the Mayor’s office about appointing two new members to the commission.


Pabich: Motion to adjourn, seconded by Summer. Passes 4-0.

The meeting is adjourned at 6:45 PM.
