Minutes of Meeting
March 10, 2009

Members Present: Chairperson Paulette Puleo, Vice Chair Marc Salinas, Martin Fair, Noreen Casey, Carol Rainville, Larissa Lucas, Barbara Poremba.
Others Present: Councillor Steve Pinto, Janet Mancini-Acting Health Agent, Tracy Giarla-Public Health Nurse

Paulette Puleo called the meeting to order at 7:00pm

  • Approval of Minutes- February 10, 2009 meeting
Page 2, 3rd paragraph, rephrase sentence “they are supposed to safeguard public health” and in the second sentence of same paragraph, correct/change BOD to BOH.

Carol Rainville motioned to approve the minutes as corrected, seconded by Marc Salinas-passed 7-0.

  • Public Health Nurse’s Report - Tracy Giarla reviewed the February nurse’s report.
3.  New/Old Business

Riverview Place Project- Second application for Site Plan Review- Presented by James McDowell, Engineer
James McDowell was unable to attend, Steve Livermore did the presentation. Owner Dan Walsh was present. Mr. Livermore explained the updated filing since February 21, 2008. The density still contains 130 units with most of the parking in the garage and 38 surface parking spaces.  The bulk of units are in buildings 1 and 2. There are internal trash rooms for buildings 1 and 2 (small rolling dumpsters or trash chutes) and building 3 will use dumpsters.  The dimensions of trash rooms will be appropriate size for the number of units. Recycling will be done as well.  For traffic flow there is an access road through the property and can exit and enter on Mason St. and on Flint St.  There are no playgrounds, but there is open space.  Most units are 1 and 2 bedroom units, which means there will probably be few kids.  For the barrier along the river there is no fence, but there is a riprap wall.  There will be no food establishments, a possible rental office.  

Paulette reviewed each condition from the February 21, 2008 list of conditions approved by the BOH.
 Additions/Comments:
 #2- Mr. Livermore said they will post a DEP tracking number if they need to.
 
#3- a 21E hasn’t been done yet, when completed a copy will be sent to the Health Agent.  

#5- delete the word “construction”, also, a report in addition to the invoice will be sent to the Health   
      Agent.  

#6- due to the close proximity to the neighborhood, Paulette Puleo requested:
         a-the initial rodent assessment and a weekly report be sent to the Health Agent for the first
            30 days during demolition then
        b- monthly inspections & reports sent to Health Agent until such time the report indicates no       rodent activity.
        c-rodent control to be in place 1 week prior to demolition.
        d-abutters are to be notified 72 hours prior to demolition.

#11- they will also supply spec sheets to the Health Agent. Mr. Livermore added that most
        condensers would be on the roof, contained.
As far as flood zone area, Steve Livermore said there are no living areas below grade; the lowest level is basement level, which is above grade & the flood plain.

#16- Paulette added that each basement housing unit will need to be mitigated for radon and the testing would be done after completion of project and prior to occupancy. Mr. Livermore said they could do that.  Once the building is all closed up, they can measure for radon.

Motion made by Carol Rainville to accept the conditions, seconded by Noreen Casey-passed 7-0.


Review and approval of 2010 Board of Health Budget
Janet Mancini reviewed the budget & handouts presented to Board members.   


Discussion and Vote on Hiring Of a Health Agent
After discussion regarding hiring a health agent, Martin Fair motioned to defer hiring a health agent until fiscal year 2010, seconded by Barbara Poremba-motion lost 3-4.

After continued discussion regarding hiring a Health Agent, Carol Rainville motioned to hire a health agent for the City of Salem as soon as possible, seconded by Noreen Casey-passed 4-3.

After discussion of the candidates’ qualifications, Noreen Casey motioned to choose Paul Etkind, DrPH, MPH, to fill the position as Health Agent for the City of Salem, pending the results of the CORI and after receiving written documentation verifying credentials on his resume, seconded by Carol Rainville-passed 7-0.


Discussion And Vote Regarding Regionalization Pilot Program
After discussion of the proposed regionalization of the Peabody & Salem’s Health Departments,  Barbara Poremba motioned to pursue the goal of regionalization/collaboration, seconded by Larissa Lucas and approved (6-1).


Review And Consideration Of Swampscott BOH Additions To Massachusetts Regulations For Tanning Facilities, 105 CMR 123.003D, Parental Consent And Record Keeping For Minors
Currently, the regulation states that no persons 14-17 shall use tanning device without the consent of parent.  A consent form needs to be filled out and they need to do this every time they go to tan.
Swampscott added a provision that requires tanning facilities to make a copy of the parents ID to be kept on file for 24 months.  Marc Salinas and a few other members didn’t agree, saying that they had concerns with maintenance of records, as well as private information like SS# on ID’s, etc.   Tracy Giarla added said Salem regulations require they maintain records of minors for 3 years.
