 Planning Board Zoning Bylaw Subcommittee Meeting

Marilyn Sidoti opened the Planning Board Zoning Bylaw Subcommittee meeting at 5:30 pm.
NEW BUSINESS
Review Development Rate Limitation Bylaw
David George presented an overview of the Bylaw and why it was developed. Mr. George indicated the Bylaw was developed as part of the Town’s Growth Management Study. The study consisted of a phase 1 and phase 2. The purpose of the study is to evaluate growth patterns and the impacts on municipal services. A particular goal of phase 2 was the review of growth management options and a policy recommendation. The options were reviewed by the Growth Management Steering Committee (GMSC) appointed by the Select Board, working with the Central Massachusetts Regional Planning Commission. After reviewing several growth management options, including upzoning, downzoning, development rights transfer, growth management bylaws, the GMSC recommended on March 27, 2019 a growth management bylaw. The Development Rate Limitation Bylaw was then developed.
The Subcommittee reviewed the Bylaw section by section and requested the changes listed below be made for clarity, organization, and functionality:
1. In § 1, add “Town” to management studies, remove “character” and replace with “needed Town Services,” and add purpose and intent language removed from § 3.

2. In § 3, change the limit to 36 from 30, create a separate sentence to describe partial year implantation, and move the last sentence to § 1.

3. In § 4, rewrite A, and change number in B to “3 per month” instead of 2.5 percent.

4. In § 5, create a second sentence describing the exempted units and make “unit” plural in A. for all uses of permit.

5. In § 6 E, add after “twenty-five percent or more” “, pursuant to the Town’s Zoning Bylaw.”

6. In § 8, change the term from 10 years to 5 years.
