     Minutes 1/23/18

Present: Norm Anderson (Chairman), Marilyn Sidoti, Dick Williams, Shawn Moore, Tim Nahrwold, Ron Barron (Town Planner)

Guests: Tom Fancy, Jim Gusha, Jean Trudeau


Minutes: The board reviewed the minutes from 1/09/18.  Dick made a motion to accept the minutes with corrections. Marilyn 2nd.  Marilyn, Dick, Shawn and Norm voted favorably. Tim abstained.  

ANRS: Tom Fancy submitted an ANR on Walnut Street to create lot 5.  The board reviewed the plans. Dick moved to endorse the ANR.  Tim 2nd, all in favor. Check number 15254 from Sherman and Frydryk LLC in the amount of $400 was received.  

Jim Gusha submitted an ANR for Campbell Street.  Gasparoni is selling him land to make his lot 3 acres.  The original intent of a past sale was for him to have 3 acres, but his land was incorrectly measured. He actually has just under 3 acres.  It is important for him to have 3 acres because he wants to divide it and needs two 1.5 acre lots per current bylaws. There is an open space permit on the land belonging to Gasparoni. Tim wants KP to look at the plans.  Norm does not think this is necessary. The lot would still have the required frontage and acreage required by the open space bylaw.  Norm stated if it does go to KP Law he would want the applicant to pay for this.  Norm requested this ANR be put on the agenda for the 2/13/18.   There was concern if they will have a quorum at this meeting as Dick and Tim will both be away.  The ANR was submitted with the town clerk starting the 21 day clock.  Ron will check with Jeff to see if there is a way to continue an ANR decision if both parties agree.

Public Hearing Continuation – Lussier Mixed Use Property in Town Center District 211 Main Street
Opened: 7:53pm

On 1/23/18 the board received an email from David Lussier requesting a continuance of this hearing. They are waiting to hear from Mass DOT are not ready to submit revised plans at this time.  

Dick made a motion to continue the hearing on February 13th at 7:30pm. Shawn 2nd, all in favor.

Set Public Hearing Dates for Soucy and Votruba Estate Lots: Votruba submitted applications for special permits for 3 estate lots on Campbell Street.  Soucy submitted an application for an estate lot on 314 Main Street (part of Spruce Hill).  Tim is concerned whether there are any current estate lots being changed.  The board pulled out the old plans to see what changes Soucy is trying to make. Tim would like an email sent to Soucy before this hearing asking him to explain what he is trying to do.  Laurie will send Jim an email. Dick made a motion to set the public hearing date for Soucy’s estate lot for March 13th at 7pm. Shawn 2nd, all in favor. Tim made a motion to set the public hearing date for Votruba’s 3 estate lots for March 13th at 7:30pm. Marilyn 2nd, all in favor.  

RDIC: RDIC requested a letter of support for an 83 unit affordable living community for residents 62+ on the old Rutland Heights property.  Dick stated that the other departments in town have already written letters in favor of the project. Tim said that the town would need to come up with one million dollars to cover the construction costs of this building with a payback of $80,000 per year.  This is a 12 year payback.  Dick said they could be using grant money. Tim’s concern is that the grants are not guaranteed at this point.  Tim would be comfortable with a 3-5 year payback, but not with 12 years.  Dick feels showing support of the project is important to obtaining grant money. The board is in full support of the concept of this project provided the funding does not put a financial burden on the town.  Laurie and Norm will draft a letter to be sent out to RDIC.  

Bear Hill Bridge: There has not yet been a meeting between Norm, Gary, Gill and Mass DOT to discuss the bridge.  Norm said that the 2 major items on the Gill Report are the rubber spacer at the end of the bridge that is missing and some sort of guard protection along the sidewalk.  Tim was concerned that Gill did not have the recommendations from Mass DOT on this bridge from 5 years ago.  Dick has concerns about the fence that is currently there. He feels it is unsafe. Gill in an engineering firm approved by Mass DOT.  Norm wants to ask Gary to contact Mass DOT to see if they accept Gill’s report.  

Marijuana Moratorium updates: Jeff Bagg will up at the library to give some final details on Monday.  The board of Selectmen will meet this night as well to set the date for a special town meeting to vote on the Marijuana Moratorium.  

Tim made a motion to close the meeting.  Marilyn 2nd, all in favor.
