PLANNING BOARD PUBLIC HEARING
JULY  11, 2017

Public Hearing – Pleasantdale Estates, LLC. application to create an estate lot on Wheeler
Road

Hearing opened at 7:00pm
Norm read the legal ad.  He then explained that the applicant would present the plan, the board would have time for discussion and comments and then he would accept comments and questions from the public.

Clea stated that A, B, and C on the plan are built already.  He has 2 ANRs and 1 estate lot that he is applying for.  The 2 ANRS are on Main Street. The estate lot is on Wheeler Road.

There was discussion about Bonnie Brae Circle which was a definitive subdivision created in 1977 and amended in 1983. The 2 ANRs are taken from lots that were previously drawn as having frontage on Bonnie Brae which is a road that was never actually built. The lots have been reconfigured with frontage on Main Street. There is a house (parcel 59 B A 77) that has been there since 1920 that has frontage on Bonnie Brae that Dick is questioning since the road is not in existence.  The board questioned whether an approved subdivision would expire if it is not built within a certain number of years. Kiristy stated that unless this was listed in the conditions of approval then it would not expire. The board could vote to rescind the subdivision approval and would have to go through the rescission process.  Marilyn, Shawn and Clea all believe the ANRs being presented are a separate issue than the existing house on Bonnie Brae.    

The floor was opened to the residents in attendance.  David Fredette of 12 Wheeler Road spoke. He stated that he did not receive any official notice of this meeting. He heard about the meeting by word of mouth from abutter Tim O’Connor.  He stated residents at 8 and 14 Wheeler Road also did not receive notice. Laurie stated that abutter notices were mailed out. Norm referenced the abutters list given to the board by the applicant.  The abutter list should be 300 feet. The list provided was only 150 feet. An incorrect abutter list was given to the board. Norm was upset about the lack of notification to the appropriate people. Clea stated that he was fine with putting off the special permit application so that the abutters could be notified. He requested that they move forward with the ANRs since they do not require abutter notification.  Dick stated he is still uncomfortable with the ANRs. He doesn’t know if there were conditions on approval for Bonnie Brae without doing some research.  Jeff was concerned that the plans they were viewing were dated 6/21/17 when the original plans were dated 3/16/17. Clea said they were redone to show house placement on the estate lot. Jeff wanted to see the definitive subdivision plans to see if lot 2 was part of the subdivision and to see if changes are being made to the subdivision. Norm said that there are no issues with changing lots within an approved subdivision as long as no changes are being made to the approved road or drainage system.  

The abutters questioned if they could talk about the estate lot. The board felt it was best to save conversation on the estate lot for a time when the meeting could be advertised properly. Shawn made a motion to close the hearing on the estate lot due to it being invalid because of improper abutter notification.  Marilyn 2nd.  A new date was discussed. The new hearing will be held on August 8th at 7pm. A vote was taken, all in favor.
