Public Hearing - CB Blair Development Corp. application to create 6 estate lots on Glenwood Place
Hearing opened at 7:05pm
Norm read the legal notice. Norm explained how the meeting would proceed: presentation by the applicant, comments from the planning board, and ending with comment/questions from the public.
Norm discussed the citizen’s petition to vacate the previous decision to endorse the ANRs on Glenwood Place. He read the letter from Cranston (legal counsel). No changes will be made to the approved ANRs.
Kiritsy presented the plan for 6 estate lots on Glenwood Place – Lots 2, 3, 6, 7, 10 and 11 on behalf of CB Blair Development Corp. He reviewed the bylaws. They are in excess of 5 acres. The access strip is not included in this number. There is 50 feet of frontage. At the building line they are a minimum of 200 feet wide. There are not more than 3 contiguous estate lots. Lots 2&3, lots 6&7 and lots 10&11 are contiguous. There are no common driveways.
The board reviewed the plans. Discussion ensued. The private way is a gravel road. Norm stated conditions must be set to endorse this plan. Improvements to the road must be made. There needs to be a homeowner’s association in place to maintain the private part of the road. They will also plow the private part of the road. A turn around must be built big enough for the passage of fire trucks. Participation in the association must be mandatory for homeowners. A lien will be placed on the property for those not abiding by the association’s guidelines. Dick questioned the grade of the land. Julian did not know, but will find out. Blair (Builder) and Kelliher (DPW) must fix the public part of the road for approval to be granted.
The floor was opened to resident concerns. Discussion ensued.
A concerned resident stated that in 1986 3 perc tests were done that failed. He questioned the validity of the perc tests done recently. Norm advised him to bring his concerns to the Board of Health as this is out of planning board jurisdiction.
Blair stated that he would be willing to fix any damage that he may have done to the public way.
Norm does not want to take any action at this time. Norm plans to speak with Gary Kellaher concerning repairs to the road. Information from the fire department concerning the proper size of the turnaround will be sought. Grade of the road needs to be determined. A homeowner’s association needs to be drafted.
Jeff will work on drafting some conditions for June 13th.
Dick moved to recess the Public Hearing to June 13, 2017 at 7pm Ms. Sidoti 2nd, all in favor.
