Present: Norm Anderson (Chairman), Marilyn Sidoti, Shawn Moore, Dick Williams, Tim Nahrwold, Jeff Bagg (town planner)

Review minutes: The board reviewed the minutes from the 11/28/17 meeting. Dick moved to accept the minutes with corrections. Tim 2nd, all in favor. Dick requested that reviewing the reports from Gill on Brice Lemon and Bear Hill be put on the 1/9/18 agenda. The board reviewed the 11/28/17 Thurston Hill Common Driveway Public Hearing minutes. Dick moved to accept the minutes. Tim 2nd, all in favor. The board reviewed the 11/28/17 Lussier Mixed Use Property in Town Center District Public Hearing minutes. Tim moved to accept the minutes. Shawn 2nd, all in favor.
ANRS: Julian Vortruba presented plans for 2 changed lots and 3 new lots on Campbell/Pommogussett. There are 2 estate lots which will require special permits. The board received check #2256 in the amount of $600.00 from J&K Ventures, LLC. Jeff questioned the illusory frontage. The board spoke about their past conversations with Kwesell from KP Law and the Gifford vs. Nantucket case. Julian is trying to preserve 60 acres for his son. There were questions as to whether case law is binding and whether the board had sufficient cause to deny the ANR. Shawn made a motion to send to town counsel. Tim 2nd, all in favor. The check will not be cashed unless and until the ANR is endorsed. The ANR will be decided upon at a future meeting within the 21 day time limitation.
Public Hearing Continuation – Lussier Mixed Use Property in Town Center District

Bear Hill: Blair has almost enough signatures to warrant a town meeting.
Notice of Decision Thurston Hill: The board reviewed the draft of the notice of decision for the common driveway on Thurston Hill. Dick moved to sign the notice with corrections. Marilyn 2nd, all in favor. Laurie will get the notice to the town clerk on Thursday and send out the abutter notices.
Brice Lemon Release of Covenant: A phone conversation earlier on 12/12/17 between Kwesell and Norm and Jeff was referenced. She approves of the latest agreements. There are 3 covenants. They are releasing the covenants of 2005 and 2009. The covenant of 2014 is being partially released. The bank has already signed the documents. The release of covenant is contingent upon a fully executed triparty agreement. Dick motioned to sign the release of covenant. Tim 2nd, all in favor. Tim motioned to sign the partial release of covenant. Dick 2nd, all in favor. Shawn motioned to sign the subdivision control triparty agreement. Marilyn 2nd, all in favor. The board signed the three documents.
Jeff’s contract is finished for the year. Norm and Jeff will be meeting with Margaret Nartowicz in the upcoming week to discuss the plan going forward. There is a possibility of getting a part time town planner in the future.
Shawn moved to close the meeting. Marilyn 2nd, all in favor.
