Open meeting: 6:30PM
Review Minutes of 6.24.14:
- Regular meeting minutes: Addison moved to approve with corrections, Dick 2nd, Norman and Marilyn in favor. Tim abstained.
- Public hearing minutes: Dick moved to approve with corrections, Addison 2nd, Norman and Marilyn in favor. Tim abstained.
ANRS
- Dennis Suchocki/23 Barre Paxton Road: Mr. Suchocki purchased parcel A (3 acres) which is part of a 9 acre piece of land (line is being put in). Plan was reviewed. Applicant will be making this 1 parcel. Discussion ensued.
Mr. Suchocki was advised to take the plan back to Julian Votruba to change notes on the plan to denote a dotted line on the plan and“non-buildable lot”.
- River Road/Clealand Blair, Jr./East County Road (part of Miliken Brook):
Chairman informed Mr. Blair that his ad for River Road published twice in the T &G was $428.00. He referenced a public hearing published in the Landmark for $138.00. Mr. Blair will get a check in the amount of $282.00 (the difference) to the Board.
Mr. Redfield referenced his memo to the Board dated 6/29/14 in which he had occasion to visit Mike Caruso’s home. He could not see any sign of mud running down the road or degradation. Refer to attached.
Discussion ensued regarding conditions:
- Is it large enough for a truck to turnaround?
- Homeowners Association for the driveway
- Snow Storage
- 4th driveway (Lot #2) share the entrance of the driveway (off to the side). Add rain gardens.
Mr. Blair stated that he could put an easement so everyone shares instead of only 1 owner at lot 1. Homeowners Association will get recorded and Clea assured the Board that owners purchasing homes will know this up front.
- 4th home will have a condition (is only using the entrance of the common driveway).
Two special permits will be required:
Dick moved to accept as drawn and 2 ANR’s on River Road, Tim 2nd, all in favor.
Dick moved to approve 2 common driveways on for 3 homes and the other for 4 homes, Addison 2nd, all in favor.
Addison moved to endorse the plan, Dick 2nd, all in favor.
7:24pm Meeting recessed for public hearing on Brice Lemon Subdivision:
Meeting reconvened at 8:00pm
Brief discussion after public hearing on Brice Lemon Subdivision:
- So little is definitive on this. The Board has a set of conditions but need to come up with a new set of conditions (should #26 on subdivision not special permit be included)?
- Does Army Corps of Engineers require a 404?
- If they don’t have a MOA (memorandum of agreement) the Board needs a letter.
- Where does the Board stand on opening a public hearing on the open space? New amendment should have a special permit. Is the old special permit still valid?
- Are revisions to the plan good causes? For example, delays from MEPA, Mass Historic, crash in economy, sewer moratorium.
- MEPA document regarding photo simulation. Was this done? What are the ramifications if not?
- If MEPA does not go historic 404 what then? MEPA did not do their job if they granted the certificate without study completion.
- What actions are appropriate for the Board to take?
- How much authority does the Mass Historic Commission have?
- Point of information: Website states that Mass Historic Commission works in consultation to Army Corps of Engineers. How much weight does this carry?
Chairman will call Attorney Cranston tomorrow morning and run the above questions by him. He will be invited to attend the 7/22/14 public hearing continuation.
