Hearing opened at 7:00m.

Legal ads were referenced:
  • Two common driveway proposals
  • Five estate lots
FIVE ESTATES LOTS:
Design plans were presented and reviewed for 2 common driveways to 5 estate lots by Mr. Julian Votruba.
  • Mr. Votruba stated that applicant is within the 200 ft. no touch zone (DCR) and received a variance for 2 driveways.  Three houses will be served by 1 common driveway; the other driveway will have 3 and possibly a 4th one if the Board approves this.
  • 500 ft. (common part) meets town rules and regulations.
Abutters:
Christine Smith/83 River Road:
Questioned: Why spray painting is being done at their property line and she was not notified?  She is concerned that River Road is taking a beating and is starting to fall apart.  She also asked if there was a timeline on the subdivision.

Tracy Briggs-Ammeets:
Stated that runoff of the hill is dumping onto her property and Ware River.  She is also concerned with traffic on that road.

Chairman Anderson asked what was going on with the two culverts up the street.
Hay bales will be placed for Thursday before the rain happens.

He informed abutters that the Planning Board jurisdiction is “Do the estate lots conform to our zoning bylaws”?



Regarding the common driveways being proposed, the applicant would have to submit a maintenance plan stating the town has not liability.

Gary Kellaher, DPW, stated that he has a concern with clearing in the wintertime with both common driveways being proposed.  Snow is going to be pushed across the street.
There has to be snow storage for this.

Jeff Lacy, DCR referenced the estate lots portion of the hearing.
He stated that special permit criteria must be met.  He referenced review and design criteria P. 62 – 64 of the Rutland Zoning Bylaw.
He cautioned the Board on the need to assess before granting the special permit.
He suggested setting conditions before the Board approves.

Chairman Anderson would like to see a written condition of requirement for storage for snow for both estate lots and common driveways.  Zoning bylaws were referenced.  

When asked, Chairman stated that the special permit document would not be ready this evening.  The Board could approve, however, the Town Clerk would not accept this until the Board signs it.
Mr. Blair stated that he would appreciate it being put together at the next meeting.


Discussion ensued after which Mr. Redfield moved to close the hearing at 7:25pm, Marilyn 2nd, all in favor.

TWO COMMON DRIVEWAYS:
Applicant is proposing two common driveways servicing three lots.
Plan meets all dimensional requirements.
Board was informed that every agency involved saw the plans.  Drainage analysis has been done.

Mr. Redfield had a conversation with the Fire Chief.  He is concerned with common driveway turnarounds (the condition is that one driveway joins with the other driveway).

Mr. Blair stated that a Homeowners Association has been drawn.

Jeff Lacy stated that this binds homeowners into maintenance (rain gardens are not part of this).

Addison moved to close the hearing, Marilyn 2nd, all in favor.
