Demond Pond ROW public hearing continuation

Guests Mr. Mark Elbag
Hearing opened at 7:05pm.
Mr. Elbag referenced the email he sent to the Board from Attorney Adam Costa regarding the title search on the property. He stated that each deed references the right of way but Mr. Peterson, previous owner, apparently never recorded it.
Chairman Anderson informed Mr. Elbag that the attorney’s letter and record title document would have to be reviewed by Town Counsel before the Board could even consider accepting the ROW as legal frontage. Would this still be considered a ROW or private road? Discussions ensued.
Mr. Elbag stated that it is a private street owned by the abutters to the center line.
Chairman will compose a letter with the Board’s thoughts to be sent to Attorney Cranston, town counsel.
Dick moved to forward documents with letter to Town Counsel and to continue the public hearing to 1/28 at 7:00pm. Marilyn 2nd, all in favor.
