RUTLAND PLANNING BOARD MINUTES
March 26, 2013

Addison moved to accept the minutes with corrections, Marilyn 2nd, all in favor. Dick abstained.
- Town Center Zoning Bylaw Review: P. 26 #1 Floor Area Ratio was referenced. There appears to be new construction verbiage in TC1 District but not in TC2 district which talks more about roof pitch (p. 27). Top of P. 23 in the Bylaw summed up philosophy of the TC1 and TC 2 districts.
- Mr. Bill Senecal and Jim Soucy regarding 87 Maple Avenue:
Mr. Senecal summarized what is being proposed.
- Site is 78, 000 sq. feet, 200 feet long and allows 19K sq. ft. building. Mr. Soucy prefers to build 2 smaller buildings (preferable 8 units each) on site as opposed to one large building. Discussion ensued.
P. 23 B # 1 was referenced (P.B. may authorize anyone to make a mix of residential or non residential uses within the same building).
Board questions included:
- Can the Board allow a multi unit residential structure because of the word “may” on P. 23? Would this be precedent setting?
- P. 25 Section 4 was referenced (special uses in the TC district).
After a lengthy discussion both were advised to return with a site plan and a list of things that explain how this would complement the town.
Susan will send a copy of the Zoning Bylaw to Mr. Senecal.
- Mr. George Lussier and Dave Lussier/Route 122-Pleasantdale Road/Village Center District: The Luster’s are here seeking advice.
- 4 3/4 acres roughly in Village Center district (keeping 50 ft frontage for 1 estate lot).
- Zoning Bylaw was referenced. Discussion ensued.
- Brice Lemon/Mr. Clealand Blair, Jr. and Attorney George Kiritsy:
Revised plan was reviewed. Attorney Kiritsy gave a summary of proposed revisions done since the inception of Brice Estates, now Brice Lemon Estates. The newest designed plan with proposed revisions done by James Kalloch was reviewed. A new road is now away from the wetlands which eliminates the need to fill. The plan grading has been designed. It is now all open space. Rail trail is denoted and waiver may be needed (grading in subdivision regulations is 20%). Mr. Blair has a sewer permit and will need a subdivision and special permit modification. The area containing lots 77 through 111 have been moved from their original position to the other areas within the subdivision and the attendant road and wetland crossing have been
eliminated.
Board comments:
This is a major modification which will require a public hearing.
The Board requested that Mr. Blair return back with detailed engineering plans showing bridges being proposed on all crossings as DOT will need to review and approve these.
Mr. Blair would like to have submission by mid May.
- Wind Turbine Bylaw Vote needed by Selectmen April 1st:
Addison moved that we submit the draft Wind Turbine Bylaw to the Select Board for inclusion on the annual town meeting May 18th, Marilyn 2nd, all in favor.
There being no further business, the meeting adjourned at 8:48pm.
