RUTLAND PLANNING BOARD
MEETING MINUTES MAY 28, 2013
Opened: 6:34 P.M.
Present: Norman Anderson, chairman; Marilyn Sidoti; Timothy Nahrwald; Richard Williams; Addison Redfield
Guests: Attorney George Kiritsy; Nelson Calkins; Jim Soucy; Tom Dufault
- Attorney Kiritsy presented a plan for an ANR on Wheeler Rd. (3 lots) Endorsed by Richard Williams; 2nd by Addison Redfield; unanimous. Check for $450.00 (#107) presented on behalf of Pleasantdale Estates.
- Attorney Kiritsy presented a plan on Naquag Street that would make one lot #49R. A sewer easement is present on the lot—access and frontage in conformity. Check for $350.00 (#108) presented on behalf of Pleasantdale Estates. Moved to endorse by Addison; 2nd by Marilyn—unanimous.
- Attorney Kiritsy requested a continuance of McCallister Estates public hearing to July 23, 2013 at 7:00 P.M. Moved by Addison; 2nd Marilyn—unanimous.
- Nelson Calkins presented a plan for a 14.3 Acre parcel off Walnut St., to be deeded to DCR (Department of Conservation/Recreation). Moved to endorse by Addison; 2nd Richard Williams;--unanimous. Tim Nahrwald moved to waive the filing fee due to the proposed use of the land for recreation and preservation purposes; 2nd Richard—unanimous. (fee would have been $400.00.)
- Jim Soucy (w/attorney Kiritsy) presented a conceptual plan for two eight-unit apartment buildings to be constructed on Maple Avenue on a lot opposite the entrance to Rutland Heights. Much discussion and questions about buildings, parking, frontage views, etc. Attorney Kiristy also submitted possible special permit application draft form that may be used by the Planning Board. Norman requested that George email the form. Jim Soucy will file for a special permit.
- Norman submitted a draft letter to be sent to Mark Elbag and Julian Votruba in re Moose Meadow development. The letter addresses possible issues regarding the affordable housing agreement that was entered into when special permit(s) were issued for the development (letter attached). There was some discussion regarding the letter and the issues involved.

- Norman submitted a draft of letter for review by the Board to Clealand Blair, Jr. regarding Bear Hill bridge. (Letter attached) There was much discussion and agreement to have Norman mail the letter.
- Marilyn asked if CMRPC (Trish Settles) could meet with the Planning Board on June 25, 2013. There was discussion about whether this is really about Planning Board issues. Marilyn will see that it gets on our agenda for 6/25 at 7:00 P.M.
- Addison brought up the Lussier storage facility being constructed on Rte 122 at Four Corners. Addison reported that he had received an email suggesting that the facility was not in keeping with the correspondent’s understanding of The Village Center by-law, and that it (the facility) was too close to the highway and rather ugly. Addison viewed the site and felt that even though it undoubtedly complied with our setback requirements, it really was very close to the road. Richard suggested that in the future we should always perform site walks and understand just how far the setbacks actually are.
- Tom Dufault asked about Brintnal Estates. He was told that wetland crossings may need to be discussed and addressed. Tom is requesting that the permit(s) for Brintnal Estates sub-division be rescinded immediately. Tom presented a letter citing his reasons for the request. (copy attached) Tim suggested that Susan send us a letter indicating our intention to begin rescission proceedings. It was agreed that this should be discussed at a future meeting before further proceeding.
