Open hearing: 7:04pm

Chairman stated the purpose of the hearing and legal ad was read.

Attorney George Kiritsy, representing Mr. Soucy, stated that the applicant is applying for a special permit to construct housing units on Maple Ave.  The plan has undergone a review with Planning Board engineer, Quinn Engineering.  He described special permit processes. Town Center Zoning (TC2) allows for multi-family uses for special permit,   Historically Rutland Zoning Map has never had a place for this.  Businesses and Industrial were only placed where multi-family dwellings could have been built.  Later, the zoning was amended and since then the town revisited zoning and adopted Town Center (TC) and Village Center (VC) zones which now allows for this to be done. What is being proposed is a substantial reduction.  Jim reviewed his development options on the site and has reduced 3 buildings to 2 buildings and 20 units to 16 units.  This has created open space and buffer zoning to abutting properties.  Plans have been submitted to the Board and reviewed by Quinn Engineering.  Issues have been addressed.
There is no connection with this project and 40 B.
Quinn Engineering report received today was gone over in detail.  
Most items have been addressed.
Outstanding items are as follows:
#10 – Defers to Board – Information regarding proposed sign was not found in submitted information.
#11 – Re-review of drainage system has not been completed
#14 – Slope of the piping identified on plan does not match that used in the HydroCAD calculations.   Board to confirm
#20 – Wheelchair ramps are recommended at the proposed intersection with Highland Park Road and at the proposed main driveway.  This needs to be confirmed
#23 – Defers to Board – A fence and locking gate are recommended around the storm water basin for liability purposes and to prevent unwanted entry.  Board is not in favor of this.  Tim disagrees.
#24 – Defers to Board – Suggest extension of sidewalk proposed parallel to Maple Avenue (southerly property line in order to accommodate future sidewalk extension.   
Proposed sidewalk is only 30 feet and is private.  The Board is okay with this for the time being, can connect later.
Chairman will check to see if copy of report went to Fire Chief.


Board comments:

  • Deed restriction
Response: No deed restriction will be put on this property.

Abutter comments:
-Bill Senecal/Main Street:  applicant’s proposal meets requirements for Town Center (TC) District.  
-Steve Kazinski, Highland Park Road: Asked if the units would be apartments.
 Yes, single family units.
- Linda DeLaurie: What if regrading is done?  
  Existing buffer will stay.
- Kevin Briggs, Highland Park Road: Questioned what would happen if someone else buys the  
  property at a later date?
  A variance would need to be done. Any significant changes would need to come back to the   
  Board.
- Bill Senecal: The idea is to make it look like a village – can’t move back.  That was the intent.
- Jennifer Keevan, Highland Park Road: How deep is the open space to Highland Park Road?
 Over 60 feet, closer to 80 feet.

Addison moved to close the hearing, Dick 2nd, all in favor.

Chairman thanked everyone for coming.  The Board believes this looks like a pretty good project as authors of the Town Center Bylaw, looking for mixed use and residential.  Pretty good use.
