Present: Dick Williams, Norman Anderson, Stephanie Bacon, Tim Nahrwold, Addison Redfield

Meeting opened at 6:50pm with a 10 minute recess prior to the public hearing on Site Plan Review at 7:00pm.
Meeting reconvened at 8:03pm
A motion to accept the site plan completed application that was submitted to Board for approval was made. Dick moved, Tim 2nd, all in favor.
Boards’ thoughts: Applicant has fulfilled what we’ve asked them to do and what the bylaw has required for the exempt use. The board has gone over it and the main thing is safety. Everything has been constructed as it was supposed to be
Delaying this could pose a safety issue.
A structural engineer is looking at this as well.
During construction there should be a security fence around tower.
A question regarding decommissioning aspect of construction was brought up.
This will not necessary as this is a municipal structure. It would be up to the town to decommission or remove the tower.
Dave Capone of Capone Construction stated that theoretically the tower can be left there for 100 years.
Town Counsel: Advised that the appropriate inspections should be done according to good construction practices.
A regular inspection per FCC regulations have been submitted to the public safety dept. and Board of Selectmen.
The structure is warrantied for 20 years.
What the Board has now:
- a completed application including all documents requested by the board
- a presentation that has demonstrated the nature of the project and the need for it.
- held a public hearing and heard both concerns and positive reactions
- consulted town council for interpretations and legal advice
- thoroughly read and interpreted the applicable bylaw
- viewed the site of the proposed tower
Conditions of approval:
- tower will be constructed according to the submitted plans and construction inspections shall be conducted by the appropriate design or construction engineer at all appropriate stages of construction.
- at the conclusion of construction a written report detailing all construction inspection shall be given to the Planning Board and the Building Inspector.
- The sole use of the tower shall be for municipal public safety communication purposes.
- a security fence shall be erected around the tower immediately at completion of the construction.
- An appropriate vegetation shall be planted around the base of the trunk.
A straw “no” vote was taken: 4 to 1
Dick motioned to grant the site plan approval is unanimous. Tim amended the motion to include conditions as decided by the Board and what was read into the motion by Chairman Anderson. Addison 2nd, all in favor.
A letter was formulated, transcribed and given to the Building Inspector this evening.
(A formal certificate of approval) which read:
At our Planning Board meeting of 11/29/11 the Board voted unanimously to grant the Site Plan Approval to the Town of Rutland to construct the applied for public safety communications tower and a formal document of our special permit approval with conditions will follow.
Addison moved to accept the letter to be given to Mr. Travers, Tim 2nd, all in favor.
Addison moved to adjourn at 8:46pm, Dick 2nd, all in favor.
