9/27/11 Public Hearing Sign Bylaw
Dick moved to approve, Tim 2nd, all in favor.

Plan was reviewed. Julian will return next meeting.
- GEO TMS Permitting System memo from Rick Travers, Building Commissioner (software networks can tie all Board’s together):
Information session: 10/26/11 at 7:00pm in the Community Hall Annex at 7:00pm
- Public Safety Communications Tower application from Town of Rutland Dispatch Center:
Chairman stated that Public Safety decided they wanted to put up a tower
as there is no radio contact in certain town buildings. ZBA started a public hearing and consulted with town counsel, Paul Cranston who confirmed that ZBA did not have jurisdiction as this would fall under town zoning which would require a site plan review, therefore they were referred to the Planning Board. Chairman and Mr. Kenney met do discuss. This falls under town center zoning and will require a public hearing (this is not listed in the Village Center Bylaw) although the bylaw does reference “Site Plan Review”. Discussion ensued to include the following:
- This grant was secured and is being done at no cost to the town (a chance of a lifetime)
- We are time sensitive to weather, etc. Cannot afford any more delays
- Would like to start construction as soon as possible, biggest thing is getting the foundation in as it takes 28 days to cure (if there is an appeal period they would be proceeding at their own risk)
- Federal Government forced narrow main mandate will be in effect 7/2013
- Tower will stand 120 feet high
- Site Plan approval with conditions
- Public safety issue (no radio contact at Glenwood Elementary School)
Addison moved to accept the application (approval with conditions) from the Town of Rutland Dispatch Center on the Public Safety Communications Tower, Dick 2nd, all in favor.
Certified list of abutters, with stamped envelopes will be left in the Planning Board mailbox for Susan. Public Hearing originally scheduled for 10/29 was changed by Chairman to 11/1 at 7:00pm to allow time for publication. Legal ad will appear in the Worcester Telegram for 2 consecutive weeks starting on Saturday, October 15. Legal ad will be billed to Dispatch Center.
- Sign Bylaw discussions with Mr. William Scanlan on 10/7/11 (refer to attached for amendments made) response from Attorney Paul Cranston, Town Counsel.
This was a work of the planning board bylaw subcommittee, letter of 10//7/11 (Atty. Cranston) was referenced. ZBA was taken out as there is no reference to ZBA in the Sign Bylaw.
- Under definitions, “Reviewing Agency” was added as the Planning Board is the reviewing agency.
- Public Event definition is any event that is open to the general public. “Town” was removed.
- 8.0 – Add after the 2nd sentence “Said response shall be in writing and made within 30 days of receipt of the complaint and shall be given to the complainant and permit holder/applicant/owner. Third bullet, last sentence should be separated from bullet language.
Mr. Scanlan to make corrections discussed.
Attorney Cranston letter of 10/5/11 was referenced. Refer to attached.
- P. 1 – one change
- P. 2 – F (1) – Article III, Section 10B of the Rutland Zoning Bylaw for “site plan approval to the Planning Board, which shall be the permit granting authority” was added. (Mr. Scanlan stated that Page 1 and 2 additions are correct).

Mr. Scanlan will make revisions. Document will be available for town
meeting with copy to Sally Hayden, Town Clerk.
- Site Plan Regulations for Proposed Solar Bylaw.
Mr. Scanlan distributed copies to all present. Regulations were reviewed.
Mr. Scanlan will make corrections and have ready for public hearing on
11/8 at 7:00am. Susan will send legal ad to Landmark and
Town Clerk’s office.
Bill referenced Charlton, Ma two-page narrative tracking form. He will email
Susan.
- Scott Lundgren “Old Man’s Oil” (two story plus dwelling, zoned residential, looks like an office building). If it’s going to be a business he needs to bring this to the Planning Board’s attention to consider applying for MHO (Major Home Occupation) Discussion ensued.
