Meeting opened at 6:30pm
- Review of minutes of 12/22/09
Minutes approved with corrections.
Dick moved to accept, Tim 2nd, all in favor.
- Certificate of Action for Mr. Roger Salonis (2 estate lots):
Dick moved to endorse, Tim 2nd, all in favor. Board signed. Steve will obtain
Lester’s signature and bring to Town Clerk.

Meeting recessed at 6:44pm for public hearing for Mr. Roger Salonis, 2 estate lots.
Meeting reconvened at 6:51pm. Chairman moved to approve 2 estate lots for Mr. Salonis, Dick
2nd, all in favor.
- Discussions on Conservation Restriction Cameron Drive (Hillcrest Estates):
Chairman referenced the above CR that was returned to the Board with corrections made by the state (too many components were missing). A discussion ensued.
Chairman and Board agreed that more verbiage needs to be put in our subdivision
regulations. Referenced: Moose Meadow, Hillcrest and Fieldstone were all the same.
The Board would like to find out if the Highlands of Brunelle, Brunelle East, Brintnal Estates, Brice Estates were filed and sent to Boston.
Steve suggested that a letter be sent to Attorney Cranston, Town Counsel first.
Chairman suggested looking into the possibility of reopening public hearings on some subdivisions especially Brintnal and Brice as both will have a bridge, plans are incomplete and the Board has not received any reports to date from Mr. Blair.
Neil Viner stated that only after planning board approval is he allowed
to go to other town boards.
After a discussion, the Board agreed that they do not want “after the fact surprises” anymore (i.e. headwalls, bridge, how water and sewer was done, etc.).
Tom Dufault stated that there must be a conservation restriction. Until the town accepts the road the developer owns it. He referenced the issues on Brintnal and Bear Hill.
Chairman stated that the Board needs to have specific plans for specific structures.
Modification can be considered later when developer returns to the planning board.
Tom Dufault added “the one safety valve is putting these into the
conditions of approval”. (i.e., 2nd egress)
Bill Richard of Cullinan Engineering stated that he met with Steve Parker, Wes Spaulding,
district structural engineer and Gary Kellaher of DPW. He also spoke with Mike Marone who
will be looking at the design. The Bridge Engineer gave Bill a similar designed bridge (Western Mass). He would like to see more detail on the sidewalk, using rivets vs. bolts, concrete deck per state requirements, weight limits, bridge needs to meet ASHTO requirements. Bill further stated that if the town accepts the road with a bridge,
Mass Highway will review and list deficiencies, if any, and could close the bridge if deficiencies are severe enough. If this were to occur, the town would have to pay for this. Department of Transportation (DOT) would inspect semi-annually.
Mr. Blair stated that he would like to submit this evening.
Bill Richard stated that because this is not a standard bridge, the state has to make sure it meets state requirements. Wes Spaulding has agreed to do a peer review on the bridge. His estimated fee is $5,350.00.
Chairman moved to endorse contract with Wes Spaulding, Dick 2nd, all in favor.
Bill Richard stated that as soon as Cullinan receives the package the review will start.
Of note: Chairman referenced the outstanding $3600 invoice on Bear Hill for second bond estimate.
Mr. Redfield asked why inspections were not done throughout the process. Chairman stated that this is the first bridge for Rutland. Cullinan was the review engineer and we found out after the fact.
Mr. Blair stated that he is very confident the bridge is built perfectly but without the second egress the Board informed him that he should not build another house until there is a second way out.
Neil Viner expressed his concern. As a former member of the Board he gave an abutter his word that a 2nd egress would be put in and now even if bridge is paved there is still not going to be a second egress. When asked how many placed Clea has filed for other two crossings on Brintnal Estates, he responded by saying that he will get this done.
The Board was told that there would be a second egress (Bear Hill) before any houses were built. After further discussion, Chairman reiterated that the Board does not want to receive information “after the fact”. We need the plans ahead of time.
Attorney Kiritsy referenced the road configurations. He stated the Board has written regulations pertaining to the construction of bridges. All the developer wants to do is “built the bridge”.
Chairman stated that the issue is with some of the language in the subdivision regulations.
Bear Hill Estates wetland crossing binder was given to Bill Richard to assist with review.
Carl Hultgren of Quinn Engineering asked for clarification on second access (bond estimate on Bear Hill). “Exactly to the foot where does Bear Hill stop and Brintnal Estates start? Reduced scale shows a marriage of Bear Hill to Brintnal Subdivision. He needs to quantify what goes in Bear Hill and what goes in Brintnal.
Plans ( Brintnal approved 2006 is the way it exists today, compared with old Brintnal plan brought in by Carl).
Tim’s concern is that there are two plans doing two different things.
