Present: Scott Gilroy, Chairman

Karin Prucnal, Vice Chair – she was present at the meeting but recused herself from deliberation and voting based on a conflict of interest.
- Opening of meeting by the Chair: Scott Gilroy opened the meeting at 6:11 p.m.
- Review & Acceptance of Minutes: Elliott Nadeau motioned to accept the minutes of November 7, 2016. Scott Gilroy seconded. Vote was unanimous.
The Board of Health will be referred to as the “Board”.
New Business:
Public Hearing: 6:00 p.m. – 61 Pommogussett Road
Present: Karin & George Prucnal, 273 Pommogussett Road, owners
George Kiritsy, Counsel for owners

Scott Gilroy discussed that the Board of Health Agent, Randy Mizereck, conducted an inspection of the house on January 5, 2017 to review the condition of the property. Pictures from his inspection are attached. (A letter along with the inspection report has been sent certified to Ms. Leonard and a copy to all interested parties). (A copy of the letter and inspection report is attached). Several violations were noted in the report. An inspection was also conducted by the Fire Department.
Scott Gilroy asked Will Cassanelli to conduct an inspection and complete a report of any violations that were found as soon as possible. He conducted an inspection on January 17, 2017 and a report and letter was sent to Mr. & Mrs. Prucnal and a copy to Ms. Leonard and all interested parties.

Scott Gilroy asked Ms. Leonard if she would be willing to work with the owners in resolving these issues. At first she did not have any comment and then she seemed willing to try to work with the owners of the property. Attorney Kiritsy was willing to speak with Ms. Leonard to try to resolve some of the issues. He stated that if it’s a matter of fuel then that can be resolved by Ms. Leonard. Ms. Leonard stated that she wasn’t planning on moving out until this June.
Ms. Leonard stated she has no hot water and she needs a dumpster for the trash. She does not have any propane or oil. She can’t get fuel assistance. She has electric space heaters throughout the house. She felt 30 days was feasible to try to resolve some of the issues on the property.
George Prucnal stated he bought the property in 1985 and has put a lot of work into it. Karin Prucnal stated she has tried to reach out to Ms. Leonard but she would not contact her.
Ms. Leonard also has a Pitbull that demonstrated aggressive behavior when Seth Knipe, Deputy Fire Chief and Laura Pease, Animal Control Officer visited the property. She stated she does not have $100 to bring the dog to be euthanized in Boston. The Board will look into possibly finding assistance to help her with the cost. The Town will not pay for the cost of the euthanization though.
Elliott Nadeau stated that he would strongly like to see Ms. Leonard give access of the property to Mr. & Mrs. Prucnal.
Scott Gilroy would like to see what progress is made in about 30 days. Mr. & Mrs. Prucnal, Ms. Leonard and Attorney Kiritsy were going to discuss how to try to work together to clean up the violations after the hearing.
Scott Gilroy motioned to continue the Public Hearing to February 28, 2017 @ 6:00 p.m. Elliott Nadeau seconded. Motion made and seconded. All in favor. The Public Hearing is continued to February 28, 2017 @ 6:00 p.m.
Randy Mizereck left the meeting at 6:35 p.m. after the hearing was concluded.

J.M. Soucy Building Contracting – Residential Subdivision Spruce Hill Estates – Main Street
The Board reviewed the letter submitted by New England Environmental Design and Preliminary Subdivision Plan. A memo was sent to the Planning Board and JM Soucy Building Contracting that the Board of Health does not have any issues at this time if the subdivision is to be on Town Sewer and Water systems.
Mr. Liptak expressed concern with the proposed subdivision and asked if there was a Title 5 done on the property. Scott Gilroy said the Board will look into this further and get back to him as soon as possible.
Old Business:
The Board discussed the ongoing situation at this property. Paul Cranston is going back to court on January 18, 2017 regarding this matter. Discussion will continue at the next meeting.

Food Establishment/Tobacco Permits – follow up – will be continued to next meeting.

Adjournment: Elliott Nadeau made a motion to adjourn the meeting. Scott Gilroy seconded. All in favor. Meeting adjourned at 7:20 p.m.
